Case III<br />

Deposit Retention<br />

In <strong>the</strong> matter of L. H. (Applicant<br />

Tenant) and E. N. (Respondent<br />

Landlord) <strong>the</strong> Private <strong>Residential</strong><br />

<strong>Tenanc<strong>ie</strong>s</strong> Board, in accordance with<br />

section 121 of <strong>the</strong> <strong>Residential</strong><br />

<strong>Tenanc<strong>ie</strong>s</strong> <strong>Act</strong> <strong>2004</strong>, determines as<br />

follows:<br />

The Respondent shall, within 7 days of<br />

<strong>the</strong> date of issuing this Order, pay <strong>to</strong><br />

<strong>the</strong> Applicant <strong>the</strong> sum of €1,050 being<br />

<strong>the</strong> deposit of €1,300 less €250 <strong>to</strong><br />

cover <strong>the</strong> cleaning and damages<br />

caused <strong>to</strong> <strong>the</strong> dwelling at<br />

_________________.<br />

This Order was made by <strong>the</strong> Private<br />

<strong>Residential</strong> <strong>Tenanc<strong>ie</strong>s</strong> Board on 8th<br />

July 2005.<br />

Case IV<br />

Breach of Landlord Obligations<br />

In <strong>the</strong> matter of S. O. (Applicant Third<br />

Party) and P.L. (Respondent Landlord)<br />

<strong>the</strong> Private <strong>Residential</strong> <strong>Tenanc<strong>ie</strong>s</strong><br />

Board, in accordance with section 121<br />

of <strong>the</strong> <strong>Residential</strong> <strong>Tenanc<strong>ie</strong>s</strong> <strong>Act</strong> <strong>2004</strong>,<br />

determines as follows:<br />

1. The Respondent was not in breach<br />

of her dut<strong>ie</strong>s under section 15 of <strong>the</strong><br />

<strong>Residential</strong> <strong>Tenanc<strong>ie</strong>s</strong> <strong>Act</strong> <strong>2004</strong> in<br />

relation <strong>to</strong> <strong>the</strong> dwelling at__________.<br />

2. In <strong>the</strong> event of any future complaints<br />

regarding <strong>the</strong> Tenant's behaviour at<br />

<strong>the</strong> dwelling at______________and if<br />

such behaviour is found <strong>to</strong> be in<br />

breach of <strong>the</strong> Tenant's obligations<br />

under section 16 of <strong>the</strong> <strong>Residential</strong><br />

<strong>Tenanc<strong>ie</strong>s</strong> <strong>Act</strong> <strong>2004</strong>, <strong>the</strong> Respondent<br />

must take all necessary steps open <strong>to</strong><br />

her under <strong>the</strong> <strong>Act</strong> <strong>to</strong> remedy <strong>the</strong><br />

matter.<br />

This Order was made by <strong>the</strong> Private<br />

<strong>Residential</strong> <strong>Tenanc<strong>ie</strong>s</strong> Board on 19th<br />

August 2005.<br />

Case V<br />

Rent Arrears, Breach of Landlord<br />

Obligations and Non-Vacating of<br />

Dwelling<br />

In <strong>the</strong> matter of M.D. (Applicant<br />

Tenant) and J. G. (Respondent<br />

Landlord) <strong>the</strong> Private <strong>Residential</strong><br />

<strong>Tenanc<strong>ie</strong>s</strong> Board, in accordance with<br />

section 121 of <strong>the</strong> <strong>Residential</strong><br />

<strong>Tenanc<strong>ie</strong>s</strong> <strong>Act</strong> <strong>2004</strong>, determines as<br />

follows:<br />

1. A valid Notice of Termination was<br />

served by <strong>the</strong> Respondent on <strong>the</strong><br />

Applicant on <strong>the</strong> 30th June 2005 in<br />

respect of <strong>the</strong> dwelling____________.<br />

2. The Applicant must give up<br />

possession of <strong>the</strong> dwelling before 5pm<br />

on Friday 30th September 2005.<br />

3. The Applicant must pay <strong>to</strong> <strong>the</strong><br />

Respondent, <strong>the</strong> sum of €1,980.78<br />

being arrears of rent owing in respect<br />

of <strong>the</strong> dwelling.<br />

4. The Applicant must pay <strong>to</strong> <strong>the</strong><br />

Respondent, rent at <strong>the</strong> rate of<br />

€330.15 per month or part <strong>the</strong>reof from<br />

<strong>the</strong> 31st July 2005 <strong>to</strong> <strong>the</strong> date of giving<br />

up possession of <strong>the</strong> dwelling.<br />

5. The security deposit will be returned<br />

<strong>to</strong> <strong>the</strong> Applicant after final inspection of<br />

<strong>the</strong> dwelling by <strong>the</strong> Respondent and<br />

<strong>the</strong> handing up of vacant possession<br />

of <strong>the</strong> dwelling less any appropriate<br />

deduction in respect of outstanding<br />

rent and on account of <strong>the</strong> condition of<br />

<strong>the</strong> dwelling at that date.<br />

This Order was made by <strong>the</strong> Private<br />

<strong>Residential</strong> <strong>Tenanc<strong>ie</strong>s</strong> Board on 19th<br />

August 2005.<br />
