9.0 Dispute Resolution<br />

Any disputes arising with regards <strong>to</strong> a<br />

tenancy covered by <strong>the</strong> <strong>Residential</strong><br />

Tenancy <strong>Act</strong> can be referred <strong>to</strong> <strong>the</strong><br />

Private <strong>Residential</strong> <strong>Tenanc<strong>ie</strong>s</strong><br />

Board (PRTB). Disputes around <strong>the</strong><br />

termination or ending of a tenancy<br />

must be referred <strong>to</strong> <strong>the</strong> Board within<br />

28 days of <strong>the</strong> termination.<br />

9.1 Who can refer a dispute <strong>to</strong><br />

<strong>the</strong> PRTB<br />

Disputes can be referred by a wide<br />

range of part<strong>ie</strong>s including:<br />

• Tenants<br />

• Sub-tenants<br />

• Landlords (but only where a tenancy<br />

is registered)<br />

• Licensees i.e. additional occupants<br />

brought in by a tenant who are not<br />

tenants <strong>the</strong>mselves (in certain<br />

circumstances)<br />

• Certain third part<strong>ie</strong>s who may be<br />

affected by a landlord’s failure <strong>to</strong><br />

enforce tenants’ obligations (e.g.<br />

neighbours)<br />

The person referring <strong>the</strong> dispute will<br />

have <strong>to</strong> pay a fee – <strong>to</strong> be decided by<br />

<strong>the</strong> PRTB – which will not be<br />

expensive. Legal representation<br />

should not be necessary as <strong>the</strong><br />

dispute resolution process will operate<br />

informally and is intended <strong>to</strong> minimise<br />

expense and stress for all part<strong>ie</strong>s<br />

involved. O<strong>the</strong>r than in exceptional<br />

cases as decided by <strong>the</strong> board, costs<br />

of legal or o<strong>the</strong>r professional<br />

representation at PRTB proceedings<br />

will not be awarded.<br />

A landlord must be registered in order<br />

<strong>to</strong> refer a dispute <strong>to</strong> <strong>the</strong> Board. It is <strong>the</strong><br />

landlord’s responsibility <strong>to</strong> register <strong>the</strong><br />

tenancy with <strong>the</strong> Board under <strong>Act</strong>. If<br />

<strong>the</strong> tenancy is not registered at <strong>the</strong><br />

time <strong>the</strong> dispute is referred, but if <strong>the</strong><br />

landlord registers it within a<br />

reasonable time, <strong>the</strong> Board can deal<br />

with <strong>the</strong> dispute. A tenant is free <strong>to</strong><br />

refer a dispute about an unregistered<br />

tenancy, and indeed <strong>the</strong>y should bring<br />

<strong>the</strong> landlord’s failure <strong>to</strong> register, <strong>to</strong> <strong>the</strong><br />

attention of <strong>the</strong> Board.<br />

9.2 How <strong>to</strong> refer a dispute<br />

Anyone wishing <strong>to</strong> refer a dispute <strong>to</strong><br />

<strong>the</strong> Private <strong>Residential</strong> Tenancy<br />

Board (PRTB) should contact it<br />

The PRTB will provide an application<br />

form, which should be completed and<br />

returned <strong>to</strong> <strong>the</strong> Board along with <strong>the</strong><br />

appropriate application fee. The PRTB<br />

staff will help anyone who may have<br />

difficult<strong>ie</strong>s completing <strong>the</strong> application<br />

form. Information provided <strong>to</strong> <strong>the</strong><br />

PRTB relating <strong>to</strong> <strong>the</strong> dispute will be<br />

cop<strong>ie</strong>d <strong>to</strong> part<strong>ie</strong>s involved.<br />

9.3 What disputes will <strong>the</strong><br />

PRTB deal with<br />

The types of problems that can be<br />

referred <strong>to</strong> <strong>the</strong> Board include:<br />

• Disagreements regarding landlords’<br />

or tenants’ obligations<br />
