Chapter III: <strong>Contend<strong>in</strong>g</strong> <strong>Issues</strong> <strong>in</strong> Governance and Democracy at <strong>the</strong> Local<br />

Government Level <strong>in</strong> <strong>Niger</strong>ia: Some Reflections on <strong>the</strong> <strong>Niger</strong> <strong>Delta</strong> Question<br />

susta<strong>in</strong> grassroot transformation. A situation that is still persist<strong>in</strong>g<br />

today <strong>in</strong> <strong>the</strong> <strong>Niger</strong> <strong>Delta</strong> region.<br />

It was <strong>the</strong> 1976 reforms and <strong>the</strong> 1979 constitution that gave<br />

expression to local government as <strong>the</strong> third tier <strong>of</strong> government with<br />

specific functions, source <strong>of</strong> fund<strong>in</strong>g and def<strong>in</strong>ed boundaries. The<br />

constitution however created some loopholes by subsum<strong>in</strong>g local<br />

government under <strong>the</strong> control <strong>of</strong> <strong>the</strong> state government. Politicians <strong>of</strong><br />

<strong>the</strong> second republic (1979 – 1983), effectively subverted this<br />

autonomy given local government thus result<strong>in</strong>g <strong>in</strong>to myriad <strong>of</strong><br />

leadership problems. First, it was <strong>the</strong> dissolution <strong>of</strong> councils and <strong>the</strong>ir<br />

replacement with management committees based on political<br />

patronage, <strong>in</strong>stead <strong>of</strong> conduct<strong>in</strong>g fresh elections <strong>in</strong>to <strong>the</strong> <strong>of</strong>fices<br />

(Akesode, 1988:100). Next <strong>in</strong> l<strong>in</strong>e was <strong>the</strong> proliferation <strong>of</strong> local<br />

governments without regard to guidel<strong>in</strong>es and regulations for <strong>the</strong>ir<br />

creation. Also, <strong>the</strong> issue <strong>of</strong> usurpation <strong>of</strong> functions and illegal transfer<br />

<strong>of</strong> funds by state governments from local government councils was<br />

rampant. There were situations that most <strong>of</strong> <strong>the</strong> states hardly paid <strong>the</strong><br />

10% <strong>in</strong>ternal revenue due to local government to <strong>the</strong>m. To sum up <strong>the</strong><br />

activities <strong>of</strong> local government for this period, Adejumobi (1995:285)<br />

said that;<br />

… between 1979 and 1983, <strong>the</strong> local authorities<br />

were lack<strong>in</strong>g <strong>in</strong> power, responsibilities and<br />

resources. They also lacked a democratic character<br />
