Government Level <strong>in</strong> <strong>Niger</strong>ia: Some Reflections on <strong>the</strong> <strong>Niger</strong> <strong>Delta</strong> Question<br />

constitutions concern<strong>in</strong>g local government, we may have to ask <strong>the</strong>se<br />

questions;<br />

(1) Who does <strong>the</strong> guarantee<strong>in</strong>g that section 7(1) speaks about<br />

(2) What does it mean to talk <strong>of</strong> democratically elected local<br />

government councils<br />

(3) How democratic are <strong>the</strong> exist<strong>in</strong>g local governments<br />

If local government is believed to be an <strong>in</strong>stitution provided for <strong>in</strong> <strong>the</strong><br />

nation’s constitution, <strong>the</strong>n both <strong>the</strong> fundamental objectives and<br />

directive pr<strong>in</strong>ciples <strong>of</strong> <strong>the</strong> constitution should be supported by<br />

<strong>in</strong>stitutional structures that works (Dudley 1981:131). The two<br />

constitutions (1979 and 1999) were fashioned by <strong>the</strong> military. The<br />

military even had written <strong>in</strong>to <strong>the</strong> constitution, decrees which it had<br />

passed, <strong>the</strong>reby conferr<strong>in</strong>g on <strong>the</strong> decrees <strong>the</strong> status <strong>of</strong> a<br />

constitutional enactment, which could not be altered except by <strong>the</strong><br />

process <strong>of</strong> a formal constitutional amendment (Bennett, 1984:5 – 15).<br />

In <strong>the</strong> cases <strong>of</strong> Sierra Leon under Siaka Stevens <strong>in</strong> 1967 and Ghana<br />

under K<strong>of</strong>i Busia <strong>in</strong> 1979 who <strong>in</strong>herited power from <strong>the</strong> military<br />

respectively, <strong>the</strong>y had <strong>the</strong>ir constitutions changed immediately <strong>the</strong>y<br />

(elected civilian’s) got <strong>in</strong>to power. The <strong>Niger</strong>ian constitution which is a<br />

product <strong>of</strong> <strong>the</strong> military has become too immutably. It pa<strong>in</strong>ts a picture<br />

that speaks <strong>of</strong> <strong>the</strong> fact that, though <strong>the</strong> nation is ruled by civilians, it<br />

is not practic<strong>in</strong>g democracy. This is because, <strong>the</strong> created <strong>in</strong>stitutions,<br />

which should become <strong>the</strong> medium <strong>of</strong> expression <strong>of</strong> its tenability, are<br />
