justice should be <strong>the</strong> bases <strong>of</strong> build<strong>in</strong>g and underp<strong>in</strong>n<strong>in</strong>g foundations<br />

<strong>in</strong> <strong>the</strong> transformation <strong>of</strong> <strong>the</strong> <strong>Niger</strong>ian society <strong>in</strong> <strong>the</strong> 21 st century.<br />

However, <strong>the</strong> federal character pr<strong>in</strong>ciple has been distorted <strong>in</strong> its<br />

application <strong>in</strong> <strong>Niger</strong>ia. Its fundamental objective was to achieve a<br />

balanced and ordered society s<strong>in</strong>ce formal <strong>in</strong>dependence was ga<strong>in</strong>ed<br />

<strong>in</strong> 1960. Instead, it led to unbalance power where some groups had<br />

manipulated and used it to buttress and enhance <strong>the</strong>ir sectional or<br />

regional <strong>in</strong>terests at <strong>the</strong> detriment <strong>of</strong> o<strong>the</strong>rs. As Pr<strong>of</strong>essor John<br />

The operation <strong>of</strong> <strong>the</strong> federal character <strong>in</strong> <strong>Niger</strong>ia has given more<br />

powers to <strong>the</strong> politically superior groups thus creat<strong>in</strong>g a wider power<br />

disparity between <strong>the</strong> strong and <strong>the</strong> weak. The politically weak are<br />

subjected to double jeopardy, a situation that is patently anti<strong>the</strong>tical<br />

to national <strong>in</strong>tegration. 1[12]<br />

In <strong>the</strong> meantime, <strong>the</strong> Ijawland produces <strong>the</strong> bulk <strong>of</strong> <strong>the</strong><br />

petroleum and thus 70 % <strong>of</strong> <strong>the</strong> country’s foreign exchange earn<strong>in</strong>gs.<br />

Despite <strong>the</strong> enormous contributions from <strong>the</strong> Ijawland <strong>the</strong>re is not a<br />

major <strong>in</strong>frastructure or development project <strong>in</strong> <strong>the</strong> area. One can<br />

argue that oil revenues have not been fairly distributed to cover costs<br />

<strong>of</strong> pollution, health problems, social <strong>in</strong>frastructure, liv<strong>in</strong>g conditions,<br />

damage to biodiversity, etc., all be<strong>in</strong>g severely suffered from by <strong>the</strong><br />

Ijaw people. However, revenue allocation pr<strong>in</strong>ciple has and is still a<br />
