5. Planning Considerations
5.1 This application seeks the felling of two Norway Maple trees to the front of
the property subject to Tree Preservation Order No.294. The main
consideration for this application is the health of the trees and the effect
their removal would have on the amenities of the area.
5.2 The Council’s Parks and Amenities Officer has visited the site. The Officer
recommends that both Norway Maple Trees should be felled as they fall
under the class ‘dead, dying or dangerous’. The applicant could be required
to replace these trees with two semi mature trees. The species of the two
trees and exact location need to be agreed with the Council’s Parks and
Amenities Officer. The comments of the objector will be considered when
deciding the species of the replacement trees.
5.3 Consideration has been given to the requirements of Article 8 and Article 1
of the First Protocol of the European Convention on Human Rights. It is not
considered that the granting of permission would result in a violation of any
objectors’ rights under the Convention.
Officers’ Recommendation
GRANT subject to the following condition:
1. By 18th July 2003 details of the replacement trees to be planted to
include species, size and location of the trees shall be submitted to
and approved in writing by the Local Planning Authority. The
replacement trees shall be planted in accordance with the agreed
details by the end of the next planting season or sooner.

1. In carrying out the works hereby approved the applicant is advised to
conform with the requirements of BS4043, the genus/species and
exact location to be agreed with the Council's Parks and Amenities
Officer.
