4. The powers, duties and functions of the Minister extend to and<br />

include all matters over which Parliament has jurisdiction, not by law<br />

assigned to any other department, board or agency of the<br />

Government of Canada, relating to<br />

(a) Indian affairs;<br />

(b) the Yukon Territory and the Northwest Territories<br />

and their resources and affairs; and<br />

(c) Inuit affairs.<br />

5. The Minister shall be responsible for<br />

(a) coordinating the activities in the Yukon Territory<br />

and the Northwest Territories of the several<br />

departments, boards and agencies of the Government<br />

of Canada;<br />

(b) undertaking, promoting and recommending<br />

policies and programs for the further economic and<br />

political development of the Yukon Territory and the<br />

Northwest Territories; and<br />

(c) fostering, through scientific investigation and<br />

technology, knowledge of the Canadian north and of<br />

the means of dealing with conditions related to its<br />

further development.<br />

[200] The Regional Offices of the Department were located in Whitehorse. The most senior<br />

representative of the Department located in Whitehorse was the RDG. In the time frame that is<br />

relevant for the purposes of this action, that position was occupied by Mr. Ivanski from July 1993 to<br />

July or August 1997 and by Mr. Terrence Sewell from December 1997 until September 2001.<br />

[201] The Yukon forest industry has historically been focused in the region surrounding Watson<br />

Lake. Watson Lake is a community 454 kilometres southeast of Whitehorse, with a population in
