384. The MacDonell report was issued in January 2003 by the DIAND/YTG Technical Timber<br />

Supply Committee, as headed by Mr. MacDonell.<br />

[173] In his preliminary TSA, Mr. Henry proposed that the harvest ceiling for FMUs Y02 and<br />

Y03 be set at 128,000 m 3 . This harvest ceiling recommendation was accepted and implemented.<br />

This was a significant decrease from the previous annual allowable cut (“AAC”). This change in the<br />

AAC was done without public consultation.<br />

[174] There was a period of consultation after the completion of the preliminary TSA. Comments<br />

were received from the public and these comments were summarized. A copy of the summary was<br />

entered as Exhibit D-53.<br />

[175] Mr. Henry’s report was reviewed by Mr. Doug Williams who was engaged by the YTG to<br />

conduct a review. Mr. Williams was an independent consultant who does TSA work, according to<br />

Mr. Henry. His work was also reviewed by Mr. Herb Hammond under contract with the Yukon<br />

Conservation Society (“YCS”).<br />

[176] Mr. Henry had limited contact with the Plaintiffs but he learned of the mill project and<br />

toured the facility before it opened. He participated in some meetings and was aware of<br />

communications within the Whitehorse office about the mill. He was aware of the constraints
