without the promised timber. This letter, as part of Exhibit D-11, was entered for the truth and<br />

accuracy of its contents.<br />

[552] On November 9 th , this action was commenced with the filing of a Statement of Claim by<br />

SYFC.<br />

[553] On November 11 th , Minister Nault wrote to Mr. Dennis Fentie, MLA for Watson Lake, in<br />

reply to Mr. Fentie’s letter of October 24 th . This letter is found in Exhibit P-80, Tab 86.<br />

[554] Here, Minister Nault said that a THA in the amount of 30,000 m 3 met the “principles of<br />

sustainability, economic viability and social acceptability”. The letter that was entered as the exhibit<br />

is not signed. Accordingly, I give it little weight.<br />

[555] Shortly after this letter, a meeting was held in Watson Lake on November 14 th between<br />

members of the YFIA and Minister Nault. The transcript of this meeting is found in Exhibit P-79,<br />

Tab 357. At this meeting, numerous mistakes and problems with the DIAND Regional Office’s<br />

handling of issuing CTPs were discussed.<br />

[556] A few days after this meeting, by email dated November 19 th , Mr. MacDonell wrote to Mr.<br />

Wortley, concerning an industry TSA run for the Minister. In this email, found at Exhibit P-80, Tab<br />

87, Mr. MacDonell recommended that the Minister wait and get the report and then consider all<br />

options presented to determine the AAC.
