to shut down operations if it was not feasible, I find that the meeting of April 7, 1999 induced the<br />

Plaintiffs to continue in business with the Watson Lake mill.<br />

[424] Also, in April 1999, the Department produced a THA Development Process document. This<br />

was entered as Exhibit D-65. Notes on this exhibit were written by Mr. Sewell. This document<br />

identifies the goals and objective of a THA, specifically: sustainability, economic and social<br />

objectives including jobs and development of the resources, and the provision of access to a land<br />

base that can provide a harvest volume of 50,000 to 140,000 m 3 to a proponent who meets all of its<br />

commitments.<br />

[425] The mill remained closed at this time. The Plaintiffs were reviewing their options, that is<br />

final closure or reopening of the mill.<br />

[426] Following the April 7 th meeting, SYFC sent a letter to DIAND to ensure that it properly<br />

understood the commitments of the ADM and the Department. In a letter entered as Exhibit P-79,<br />

Tab 147, Ms. Clark, on behalf of SYFC, stated:<br />

We would appreciate you confirming that we have accurately<br />

interpreted the commitments made during our meeting. If there are<br />

other commitments you and your staff require of the company,<br />

please let me know.<br />

[427] Days after the April 7 th meeting, a further joint venture agreement was signed. This joint<br />

venture agreement, found in Exhibit D-81, Tab 421, formalized the introduction of KFR as a<br />

participant in the Watson Lake mill. This joint venture agreement was effective as of April 14 th .
