[396] These documents were created for the benefit of DIAND Headquarters in Ottawa. This<br />

document is part of a course of conduct taken by DIAND staff at the Regional Office, to cast the<br />

joint venture in a bad light to the Departmental Headquarters.<br />

[397] An exchange of letters occurred at this time concerning the failure of DIAND to meet the<br />

timelines to which it had committed. These letters were entered as Exhibit D-61; Exhibit D-62;<br />

2010 FC 495 (CanLII)<br />

Exhibit D-63; and Exhibit D-64.<br />

[398] In a letter dated February 16 th from EnerVest to LPL, EnerVest expressed concern about the<br />

security of tenure. If the mill could get its own secure long-term THA, EnerVest was confident that<br />

$14,000,000 for Phase 2 could be raised.<br />

[399] More meetings occurred throughout this period between the Regional Office and SYFC.<br />

[400] On February 25 th , Ms. Clark corresponded with Alan Chisholm of HRDC, advising of some<br />

changes to the original plan of the continuing intention of SYFC to operate the mill at Watson Lake.<br />

At this time, SYFC was looking for further funding from the TJF. This letter was entered as Exhibit<br />

D-81, Tab 480. She advised that the mill was shutdown in December as a result of fibre shortage<br />

and that the shortage was due to delays by DIAND in approving permits for the suppliers of SYFC.<br />

[401] Additional funding from the TJF was provided in excess of $100,000 to assist with the reopening<br />

of the mill.
