5.110. Dealing with complaint of minor breach
(6) The breach is to be dealt with by —
(b) ordering that —
(i) the person against whom the complaint was made be publicly censured as specified in the order; (ii) the person against
whom the complaint was made apologise publicly as specified in the order; or
(iii) the person against whom the complaint was made undertake training as specified in the order;
or
(c) ordering 2 or more of the sanctions described in paragraph (b).
5.121. Register of certain complaints of minor breaches
(1) The complaints officer for each local government is required to maintain a register of complaints which records all
complaints that result in action under section 5.110(6)(b) or (c).
(2) The register of complaints is to include, for each recorded complaint —
(a) the name of the council member about whom the complaint is made;
(b) the name of the person who makes the complaint;
(c) a description of the minor breach that the standards panel finds has occurred; and
(d) details of the action taken under section 5.110(6)(b) or (c).

standing order 2.1.10(1) of the Shire’s
standing orders, and has thus committed a
minor breach by virtue of regulation 4(2)

• Kevin Black be publicly censured,
within the period of 29 days to 43
days from the day following the date
of service of this Order on him.
• The CEO to arrange Notice of Public
Censure to be published in the
‘Public Notices” or Local
Government Notices” section of a
Saturday edition of ‘The West
Australian” newspaper, in no less
than 10 point print.
• Kevin Black apologise publicly at the
next Ordinary Council Meeting
immediately following the date of
service of Order on Kevin Black.
• If Kevin Black fails to comply with
requirement then within 14 days after
the next Shire Ordinary Council
Meeting immediately following the
date of service of this order on him,
Kevin Black cause Public Apology to
be published in the “Public Notices”
or “Local Government Notices”
section of a Saturday edition of “The
West Australian” newspaper.
