5.110. Dealing with complaint <strong>of</strong> minor breach<br />
(6) The breach is to be dealt with by —<br />
(b) ordering that —<br />
(i) the person against whom the complaint was made be publicly censured as specified in the order; (ii) the person against<br />
whom the complaint was made apologise publicly as specified in the order; or<br />
(iii) the person against whom the complaint was made undertake training as specified in the order;<br />
or<br />
(c) ordering 2 or more <strong>of</strong> the sanctions described in paragraph (b).<br />
5.121. <strong>Register</strong> <strong>of</strong> certain complaints <strong>of</strong> minor breaches<br />
(1) The complaints <strong>of</strong>ficer for each local government is required to maintain a register <strong>of</strong> complaints which records all<br />
complaints that result in action under section 5.110(6)(b) or (c).<br />
(2) The register <strong>of</strong> complaints is to include, for each recorded complaint —<br />
(a) the name <strong>of</strong> the council member about whom the complaint is made;<br />
(b) the name <strong>of</strong> the person who makes the complaint;<br />
(c) a description <strong>of</strong> the minor breach that the standards panel finds has occurred; and<br />
(d) details <strong>of</strong> the action taken under section 5.110(6)(b) or (c).

Censure to be published in the<br />
‘Public Notices” or Local<br />
Government Notices” section <strong>of</strong> a<br />
Saturday edition <strong>of</strong> ‘The West<br />
Australian” newspaper, in no less<br />
than 10 point print.<br />
• Kevin Black apologise publicly at the<br />
next Ordinary Council Meeting<br />
immediately following the date <strong>of</strong><br />
service <strong>of</strong> Order on Kevin Black.<br />
• If Kevin Black fails to comply with<br />
requirement then within 14 days after<br />
the next <strong>Shire</strong> Ordinary Council<br />
Meeting immediately following the<br />
date <strong>of</strong> service <strong>of</strong> this order on him,<br />
Kevin Black cause Public Apology to<br />
be published in the “Public Notices”<br />
or “Local Government Notices”<br />
