IMPORTANT INFORMATION<br />

1. PAYMENT OPTION 1<br />

Ratepayers who pay their rates in full by the due date are automatically included<br />

in the prize draw (Refer enclosed flyer for details).<br />

2. PAYMENT OPTION 2 - FOUR INSTALMENTS<br />

Current rates and charges may be paid by four instalments. The amounts<br />

payable and the dates by when they must be paid are shown on the front <strong>of</strong> this<br />

Rate Notice. Payment in this manner will avoid recovery action as described in<br />

(3) Late Payments/Arrears below.<br />

(a) Payment by instalments may not be made unless all arrears <strong>of</strong> rates and<br />

charges and any associated costs are paid in full, together with the first<br />

instalment by the due date.<br />

(b) Payment <strong>of</strong> the first instalment must be made with this notice. Instalment<br />

notices will be issued 28 days prior to each respective due date. Please<br />

advise the <strong>Shire</strong> <strong>of</strong> non-receipt <strong>of</strong> an instalment notice.<br />

Ratepayers experiencing financial hardship in paying rates and charges must<br />

contact the <strong>Shire</strong>'s Rate Department before the due date, to discuss alternative<br />

arrangements.<br />

3. LATE PAYMENTS/ARREARS<br />

If the amount shown as payable in respect <strong>of</strong> rates and rubbish charges is not<br />

paid in full by the due date, or the first instalment amount is not paid in full by<br />

the due date, the full amount falls into arrears and may be recovered by action<br />

in the court.<br />

COST OF LEGAL ACTION WILL BE ADDED TO YOUR ACCOUNT.<br />

Penalty interest, in accordance with section 6.51 <strong>of</strong> the Local Government Act<br />

1995, will be charged at a rate <strong>of</strong> 0.0274% on a daily basis on overdue amounts<br />

and will be applied in the following manner:<br />

(a) NO INSTALMENT OPTION TAKEN - Interest shall begin to accrue on<br />

Rates and/or Charges that remain unpaid after the due date.<br />

(b) INSTALMENT OPTION TAKEN - Interest shall begin to accrue<br />

daily on any Instalment payment that remains unpaid after the<br />

due date <strong>of</strong> the instalment and continue to accrue until such time<br />

that the instalment is paid.<br />

(c) ARREARS - Interest shall begin to accrue at 1 July on all Rates and/or<br />

Charges, including previous interest charges that remain in arrears.<br />

If payment falls into arrears for a period <strong>of</strong> 3 years or more, the <strong>Shire</strong> may;<br />

i) take the land and let it on lease,<br />

ii) sell the land,<br />

iii) have the land vested in the Local Government,<br />

iv) have the land vested in the Crown.<br />

4. PENSIONERS/SENIORS<br />

Pensioners and/or Seniors may be eligible to claim rebates up to a maximum <strong>of</strong><br />

50% <strong>of</strong>f current Rates and ESL charges, or defer payment and forgo the rebate,<br />

in accordance with the Rates and Charges (Rebates and Deferment) Act 1992.<br />

To qualify for rebates, applicants must:<br />

(a) own and occupy their residence as at 1 July, and<br />

(b) hold a current Pensioner Concession Card, or<br />

(c) hold a current Seniors Card, or<br />

(d) hold a current Seniors & Commonwealth Seniors Health Card, or<br />

(e) hold a current State Concession Card.<br />

If you are already registered and claiming a rebate, the amount <strong>of</strong> your rebate is<br />

shown on the front <strong>of</strong> this Rate Notice.<br />

Entitled Pensioners/Seniors are not charged for instalments or interest on arrears<br />

and have until 30 June to pay.<br />

5. OBJECTIONS AND APPEAL PROVISIONS<br />

Objections not to affect Payment <strong>of</strong> Rates - Lodgement <strong>of</strong> an objection or an<br />

appeal does not alleviate a ratepayer’s responsibility or liability to pay all rates<br />

owed by the due date pending determination <strong>of</strong> that objection or the appeal.<br />

(a) The Valuation <strong>of</strong> Land Act 1978 (as amended) Part IV, sets out the manner<br />

in which objections and appeals may be instituted regarding valuations.<br />

• An objection against the valuation must be made in writing and received<br />

by the Valuer General, 18 Mount Street, Perth 6000 within 60 days <strong>of</strong> the<br />

date <strong>of</strong> issue <strong>of</strong> the rate notice.<br />

• A person who is dissatisfied with the decision <strong>of</strong> the Valuer General must<br />

lodge a Notice <strong>of</strong> Intention to proceed to a formal appeal within 60 days<br />

after service <strong>of</strong> the Valuer General's decision <strong>of</strong> an objection.<br />

(b) Section 6.76 and 6.77 <strong>of</strong> the Local Government Act 1995, provide the<br />

grounds on which individual objections and appeals to the Rate Book may<br />

be instituted. An objection to the Rate Book shall be made in writing to<br />

the <strong>Shire</strong> within 60 days <strong>of</strong> the date <strong>of</strong> issue <strong>of</strong> this rate notice. Section<br />

6.82 relates to general appeals.<br />

6. CHANGE OF OWNERSHIP<br />

Under the provisions <strong>of</strong> the Local Government Act 1995 notice must be given in<br />

writing to the <strong>Shire</strong> within 21 days <strong>of</strong> a rateable property being sold, disposed<br />

<strong>of</strong>, or having its ownership changed. Details <strong>of</strong> the land description and name<br />

and address <strong>of</strong> the new owner must be provided. Pro<strong>of</strong> <strong>of</strong> any change in<br />

ownership is required prior to its records being altered (eg Certificate <strong>of</strong> Title).<br />

7. CHANGE OF ADDRESS<br />

Any change <strong>of</strong> address must be provided in writing to the <strong>Shire</strong> and should<br />

quote the relevant property and rate assessment details.<br />

8. SWIMMING POOL LEVY<br />

State Government legislation requires the <strong>Shire</strong> to physically inspect all private<br />

swimming pools every four years to ensure compliance with safety standards.<br />

9. BUILDING BY-LAWS<br />

Building by-laws require all ratepayers to submit proper plans and specifications<br />

<strong>of</strong> any alteration or additions to existing buildings or the erection <strong>of</strong> any new<br />

buildings including out buildings on properties within the boundaries <strong>of</strong> this<br />

district.<br />

10. INTERIM RATES<br />

The <strong>Shire</strong> may be required to issue interim rates during the course <strong>of</strong> a financial<br />

year for various reasons. Some <strong>of</strong> the main reasons are:<br />

• Completion <strong>of</strong> a new building or structure.<br />

• Alteration, addition or demolition <strong>of</strong> an existing building or structure.<br />

• Variation to land due to amalgamation, subdivision or strata title.<br />

• An error in valuation or rating <strong>of</strong> a property.<br />

• Subsequent revaluation <strong>of</strong> a property.<br />

In accordance with section 6.39 <strong>of</strong> the Local Government Act 1995, the <strong>Shire</strong><br />

may amend the rate record for the current year and/or for the 5 years preceding<br />

the current year.<br />

11. EMERGENCY SERVICES LEVY<br />

The Emergency Services Levy is forwarded to FESA to fund the Career Fire and<br />

Rescue Service, Volunteer Fire and Rescue Service, Bush Fire Brigades, SES units<br />

and FESA units throughout Western Australia.<br />

Pay by Mail - No receipt will be issued.Cheques and money orders accepted.<br />

Cheques should be made payable to <strong>Shire</strong> <strong>of</strong> <strong>Mundaring</strong> and crossed "Not Negotiable".<br />

Retain the top portion <strong>of</strong> this notice as your record.<br />

Beware the drop face for waste at Coppin Road is in excess <strong>of</strong> 1.8 metres,<br />

use extreme caution to avoid falling. Children must stay inside vehicles at all times<br />

The <strong>Shire</strong> <strong>of</strong> <strong>Mundaring</strong> actively supports recycling. Presorting your<br />

refuse recyclables and green waste prior to disposal will assist with<br />

this environmental measure.<br />

Tyres will be accepted. However a maximum <strong>of</strong> 5 per ratepayer will<br />

be enforced and a charge <strong>of</strong> $6.00 per car tyre, $10.00 per car tyre<br />

on rim and $10.00 for light truck tyres will be levied.<br />

You will need to present this pass each time you wish to use the<br />

facilities otherwise access will be denied. You may be requested to<br />

prove you reside at the address on the pass by presentation <strong>of</strong> a<br />

driver’s license. Unauthorised use <strong>of</strong> this pass may result in<br />

confiscation. Only waste or recyclables from the property notated<br />

on the front <strong>of</strong> the pass will be accepted. Details may be recorded<br />

to collect data to assist future planning on waste services.<br />

No large truck or grader tyres will be accepted.<br />

Do not lose this pass as a replacement may not be issued, and if<br />

reissued a fee <strong>of</strong> $30.00 will be charged.<br />
