3. Shelley Mewett
Summary of Submission
Partial Objection to the Amendment
1. Objects to the removal of “Liquor Store” as
a “Permitted” use (Shop – ‘P’) as there is no
distinction between goods sold from shops
on planning grounds and this is prejudicial.
Supports Amendment
2. Strongly supports the proposed amendment
as the existing ‘Tavern’ use is inappropriate
given the access on to Slade Street.
3. The ‘Local Shopping’ term is also
inappropriate given it is ambiguous and has
led to the current high-traffic, high use Fast
Food Outlets approved for the site (such as
Red Rooster and Muzz Buzz).
Neither Support nor Object to Amendment
1. As the site is an entry statement to the City
of Bayswater and is situated on the corner
of a residential street, Council should
ensure:
a. The site has quality development that
does not detract from the ‘Garden
City’ ethos;
b. The development should not create
extra noise, traffic, pollution and ruin
the quiet enjoyment of adjoining
residents;
c. Any development should have
extensive landscaping to protect
residents from noise, glare and visual
pollution;
d. Slade Street traffic must be reduced so
as to not exacerbate the existing
issues.
Comments
1. Noted. This amendment seeks
to make a distinction between
‘Shop’ and ‘Liquor Store’ for
this particular site for the
reasons noted in the report. It
is noted that there are no
objections to the other
proposed changes.
2. Agreed.
3. Agreed, however the
proposed scheme amendment
would not change or limit any
existing valid approval(s)
granted for the sites or the
continuation of existing
lawful land uses.
1. These comments are
acknowledged, however these
issues all relate to
development on the site
rather than the underlying
zoning of the land. This
amendment is proposed to
resolve the future use of the
land rather than development
issues. Notwithstanding this,
it is agreed that any
development on the site
should be of a high quality.

Partial Support for the Amendment
1. Given the subject site’s significance as the
eastern entry to the City of Bayswater,
access to the Swan River and proximity to
Bayswater train station and Circle Bus
route, the City should:
a. Zone the site Medium and High
Density Residential R40 subject to
specific guidelines including:
• A minimum building height of 3
storeys on the Guildford Road /
Slade Street corner with a
maximum height of 4 storeys.
1. The points raised are noted
and there is general agreement
with the principles raised.
However, this amendment
principally deals with the
future use of the land, rather
than development on the land.
Appendix 3 of Town Planning
Scheme No. 24 ‘Special
Purpose Zones’ only deals
with ‘Permitted’ and
‘Discretionary’ uses of land
and does not provide for other
details such as the height or
form of development.
5. Patrick and
Kellie Moran
20 Slade Street
Bayswater
• Buildings should have a
maximum height of 2 storeys
facing Slade Street and Guildford
Road;
• The development should
incorporate passive solar design
and cross ventilation; and
• The development should
incorporate landscaping and water
sensitive urban design.
2. If Lot 101 is zoned other than
“Residential”, vehicles should not be
permitted access via Slade Street as this
would be inconsistent with Town Planning
Scheme No. 24 “Preservation of Amenity”
requirements.
Object to ‘Fast Food Outlet’ being a
‘Discretionary’ use as part of the
Amendment
Support removal of ‘Tavern’ use
1. Object to ‘Fast Food Outlet’ being a
‘Discretionary’ use as part of the
Amendment. Unable to understand
why the City approved the ‘Fast Food
Outlets’ on the site.
Development controls such as
height, setback, landscaping and
car parking requirements are
contained in Part 8 of Town
Planning Scheme No. 24.
2. The intent behind this
suggestion is acknowledged,
however Main Roads WA
require that all vehicular
access in the future from the
subject sites is via Slade
Street in accordance with its
policies on limiting direct
vehicular access to Regional
Roads.
It is therefore unlikely that the
City could limit or stop
vehicular access to the sites
from Slade Street.
1. Noted. The report to
Council’s Ordinary Meeting
of 24 February 2009 details
the approval of the ‘Fast Food
Outlets’.
Planning and Development Services
Attachment 2 - Submissions Table
Amendment No. 43 to Town Planning
Scheme No. 24
August 2010
2. The land use of ‘Fast Food Outlet’ was
not appropriate in February 2009 and is
not appropriate for the site now. It
would appear that the City is seeking
this amendment as they are
acknowledging an error of judgement
was made in February 2009.
2. ‘Fast Food Outlets’ is
proposed as a ‘Discretionary’
use as part of the amendment
for the following reasons:
a. The sites are located on an
identified ‘Activity
Corridor’ in Western
Australian Planning
Commission documents.
‘Activity Corridors’
conceptually provide for a
greater mix of land uses and
potentially more intensive
development.
b. The sites have a high
exposure to passing traffic,
making commercial
development more viable.
c. Council granted approval
for ‘Fast Food Outlets’ on
Lot 101 at its Ordinary
Meeting of 24 February
2009. ‘Fast Food Outlets’
have also been operating on
Lot 26 for a number of
years. The uses can
therefore lawfully operate
from the site.
d. Changes of zoning or
‘Permitted’ or
‘Discretionary’ land uses on
a site do not supersede
previous approvals. ‘Fast
Food Outlets’ could
therefore continue to
operate from the sites
indefinitely as ‘nonconforming
uses’ even if
‘Fast Food Outlets’ was not
a ‘Permitted’ or
‘Discretionary’ land use as
they have received the
necessary approvals.
e. It is proposed to make one
minor change to the
amendment initiated by
Council to further clarify
the limits on ‘Fast Food
Outlet’ uses. It is
considered that the limit of
500m² across both lots
Planning and Development Services
Attachment 2 - Submissions Table
Amendment No. 43 to Town Planning
Scheme No. 24
August 2010
should be more specifically
applied to both lots – a
250m² limit on ‘Fast Food
Outlets’ for Lot 26 and
225m² limit on ‘Fast Food
Outlets’ for Lot 101.
3. Remain concerned about the impact of the
development on the local amenity and
specifically the issues of traffic volume
down Slade Street. There has been a lack
of support and urgency displayed by the
City in facilitating a traffic management
plan for Slade Street.
4. Support removing ‘Tavern’ as a
‘Permitted’ use on the site.
3. Council has formed a
Working Group to assess
traffic issues on Slade
Street.
4. Noted.
6. Telstra No objection to the amendment. Noted.
7. Water
No objection to the amendment.
Corporation
8. Main Roads WA Supports Amendment
1. Supports the proposed amendment.
2. A reciprocal right of carriageway for Lots
26 and 101 should be adopted to direct all
vehicle access on to Slade Street.
Noted.
1. Noted.
2. An existing crossover has
been in place with access
to Lot 26. Generally
speaking, use of the
crossover can continue,
but Main Roads may not
allow it be to expended or
moved.
A reciprocal rights of
carriageway agreement
already exists over Lot 26
and Lot 101, with access
from Slade Street and
Guildford Road.

There were 84 infringements notices issued and 71 warnings given. The details of infringement notices
issued are set out below. The four year average for infringement notices is 68 for the July period. The
Rangers issued a total of 75 parking infringements and 43 parking warnings throughout July 2010 and
received 130 parking action requests. The warnings issued are higher than normal due to an increase in
monitoring of private parking agreements and Maylands Golf Course. Rangers are currently upgrading the
ABANDONED VEHICLES
Abandoned Vehicle Reports 48
Vehicles were impounded this month with Pickles Auctions at
26 Casino Street, Welshpool
14
This month the process for impounding vehicles has been changed to include this issuing of an infringement
notice for vehicles abandoned. This is to ensure that the ownership details can be obtained from the
Department of Transport. It was found that some owners of vehicles were abandoning vehicles as a way to
easily dispose of vehicles rather than organising removal themselves.
LITTER
Please note –
Litter requests also include aspects such as garden waste and building site waste.
Dumping of materials on verges has been increasing in the City. This creates a high demand on the
resources necessary to remove the material. Rangers are focusing their attention on identifying the alleged
offenders and issuing infringement notices to the offenders rather than warnings. The increase in local law
warning notices is a direct result of this approach to litter and dumping of disused materials.
