Motor Vehicle Repair License Inspection

PURPOSE: This work instruction establishes uniform guidelines for enforcing violations
related to Motor Vehicle Repair License Inspections.
SCOPE: This work instruction shall apply to all Department of Code Compliance
personnel that enforce violations related to Motor Vehicle Repair License Inspections.
RESPONSIBILITY & AUTHORITY: All managers and supervisors are responsible for
ensuring that employees follow this work instruction.
SAFETY: Follow all applicable City of Dallas safety guidelines associated with this
work instruction.
ENVIRONMENT: Follow all applicable City of Dallas Environmental procedures
associated with this work instruction.
GUIDELINES: The Dallas City Code, Chapter 50 Consumer Affairs, Section 50-114
states that no person shall own, maintain, conduect, operate, or engage in the business
of Motor Vehicle Repair for compensation within the City, or hold himslefout as being
able to do so, or act as the agent for another who is engaged in the motor vehcile repair
business, or take custody of the motor vehicle within the city for the purpose of repair
without first obtaining a Motor Vehicle Repair Establishment from the director. Should a
person maintain a Motor Vehicle Repair Establishment at more than one location, a
seperate license is required for each additional location. The license issued to a Motor
Vehicle Repair establishment authorizes the licensee and al lits bona fide employees to
engage in the business of Motor Vehciel Repair.
DEFINITIONS:
Customer Request Management System (CRMS): the City's CRMS software facilitates
the intake process and handling of citizen concerns and requests for City services.
Service Request: an electronic document created in CRMS.
Estimated Response Time (ERT): the estimated response time for the initial inspection
assessment activity to be completed.
Major Component: the engine (excluding accessories), transmission, or differential gear
of a motor vehicle.

Motor Vehicle: any self-propelled device in, upon, or by which persons or property are
or may be transported upon a highway, except devices moved by human power or used
exclusively upon stationary rails.
Motor Vehicle Repair: mechanical repair, alteration, or addition of equipment or parts
which includes but is not limited to, tune-up, brake work, transmission work, engine
repair, body work, painting, and upholstering.
Licensee: a person licensed to engage in the motor vehicle repair business under
provisions of this article.
Person: an individual, assumed name entity, partnership, joint-venture, association,
corporation, or other legal entity.
WORK INSTRUCTION:
1. Locater address of Motor Vehicle Repair Business by canvassing area, word of
mouth, or registration list.
2. Officer queries the CRMS system for open request:
2.1. The Officer contacts complainant to verify service request information, if
requested.
2.2. The Officer schedules and inspection within seven to ten business days.
3. The Officer conducting an inspection of the Motor Vehicle Repair Business or facility
and will request to view ther facilities Certificate of Occupancy and Motor Vehicle
Repair License.
4. If the requested documents are produced, the Officer shall record the following on
the Motor Vehicle Repair Notice of Violation (CCS-FRM-261):
4.1. License number;
4.2. Expiration date; and
4.3. Close the case with appropriate comments in the CRMS system.
5. If the Officer should find any violations under Section 50 thru 50-114, then issue a
Motor Vehicle Repair Notice of Violation (CCS-FRM-261) to the business owner or
person in control.
6. If a business or facility is unable to produce a valid Certificate of Occupancy at the
time of inspection, refer to work instruction (CCS-WKI-227 for Illegal Land Use).

7. A business without a current Motor Vehicle Repair License is in violation;
7.1. The Officer shall provide an Application for the City of Dallas Motor Vehicle
Repair License (CCS-FRM-257) to the business owner or person in control of
the property.
7.2. The owner has seven to ten business days to submit the Application for City of
Dallas Repair License (CCS-FRM-257) to Dallas Water Utlities, Special
Collections Division, located at 1500 Marilla Street 2DS.
7.3. Update the case with appropriate comments and;
7.4. Schedule a re-inspection for seven to ten business days.
8. Upon re-inspection of the Motor Vehicle Repair License is obtained, the Officer shall
record the following on the Motor Vehicle Repair Notice of Violation (CCS-FRM-
261):
8.1. License number
8.2. Expiration date and,
8.3. Close the case with appropriate comments in CRMS system.
9. Upon re-inspection if the Motor Vehicle Repair License has not been obtained, the
Officer should;
9.1. Issue a Criminal Citation;
9.2. A Criminal Citation is issued every 10 days until compliance is obtained.
9.3. After the third citation is issued, the Officer shall close the case and refer to work
instruction (CCS-WKI-227 Illegal Land Use).
EXCEPTIONS: Chapter 50-128 (a) A person engaged in the business of adding fluids
only to Motor Vehicles is exempted from the provisions of this article and (b) a licensee
who enters into a contract with a commercial, industrial, or governmental entity to repair
motor vehicles belonging to the entity subject to terms established in the contract, is
exempted from the provisions of Section 50-122 and 50-123 while in the performance of
repairs pursuant to the contract.
