PURPOSE: This work instruction establishes uniform guidelines for enforcing violations<br />
related to <strong>Motor</strong> <strong>Vehicle</strong> <strong>Repair</strong> <strong>License</strong> <strong>Inspection</strong>s.<br />
SCOPE: This work instruction shall apply to all Department of Code Compliance<br />
personnel that enforce violations related to <strong>Motor</strong> <strong>Vehicle</strong> <strong>Repair</strong> <strong>License</strong> <strong>Inspection</strong>s.<br />
RESPONSIBILITY & AUTHORITY: All managers and supervisors are responsible for<br />
ensuring that employees follow this work instruction.<br />
SAFETY: Follow all applicable City of Dallas safety guidelines associated with this<br />
work instruction.<br />
ENVIRONMENT: Follow all applicable City of Dallas Environmental procedures<br />
associated with this work instruction.<br />
GUIDELINES: The Dallas City Code, Chapter 50 Consumer Affairs, Section 50-114<br />
states that no person shall own, maintain, conduect, operate, or engage in the business<br />
of <strong>Motor</strong> <strong>Vehicle</strong> <strong>Repair</strong> for compensation within the City, or hold himslefout as being<br />
able to do so, or act as the agent for another who is engaged in the motor vehcile repair<br />
business, or take custody of the motor vehicle within the city for the purpose of repair<br />
without first obtaining a <strong>Motor</strong> <strong>Vehicle</strong> <strong>Repair</strong> Establishment from the director. Should a<br />
person maintain a <strong>Motor</strong> <strong>Vehicle</strong> <strong>Repair</strong> Establishment at more than one location, a<br />
seperate license is required for each additional location. The license issued to a <strong>Motor</strong><br />
<strong>Vehicle</strong> <strong>Repair</strong> establishment authorizes the licensee and al lits bona fide employees to<br />
engage in the business of <strong>Motor</strong> Vehciel <strong>Repair</strong>.<br />
DEFINITIONS:<br />
Customer Request Management System (CRMS): the City's CRMS software facilitates<br />
the intake process and handling of citizen concerns and requests for City services.<br />
Service Request: an electronic document created in CRMS.<br />
Estimated Response Time (ERT): the estimated response time for the initial inspection<br />
assessment activity to be completed.<br />
Major Component: the engine (excluding accessories), transmission, or differential gear<br />
of a motor vehicle.<br />

<strong>Motor</strong> <strong>Vehicle</strong>: any self-propelled device in, upon, or by which persons or property are<br />
or may be transported upon a highway, except devices moved by human power or used<br />
exclusively upon stationary rails.<br />
<strong>Motor</strong> <strong>Vehicle</strong> <strong>Repair</strong>: mechanical repair, alteration, or addition of equipment or parts<br />
which includes but is not limited to, tune-up, brake work, transmission work, engine<br />
repair, body work, painting, and upholstering.<br />
<strong>License</strong>e: a person licensed to engage in the motor vehicle repair business under<br />
provisions of this article.<br />
Person: an individual, assumed name entity, partnership, joint-venture, association,<br />
corporation, or other legal entity.<br />
WORK INSTRUCTION:<br />
1. Locater address of <strong>Motor</strong> <strong>Vehicle</strong> <strong>Repair</strong> Business by canvassing area, word of<br />
mouth, or registration list.<br />
2. Officer queries the CRMS system for open request:<br />
2.1. The Officer contacts complainant to verify service request information, if<br />
requested.<br />
2.2. The Officer schedules and inspection within seven to ten business days.<br />
3. The Officer conducting an inspection of the <strong>Motor</strong> <strong>Vehicle</strong> <strong>Repair</strong> Business or facility<br />
and will request to view ther facilities Certificate of Occupancy and <strong>Motor</strong> <strong>Vehicle</strong><br />
<strong>Repair</strong> <strong>License</strong>.<br />
4. If the requested documents are produced, the Officer shall record the following on<br />
the <strong>Motor</strong> <strong>Vehicle</strong> <strong>Repair</strong> Notice of Violation (CCS-FRM-261):<br />
4.1. <strong>License</strong> number;<br />
4.2. Expiration date; and<br />
4.3. Close the case with appropriate comments in the CRMS system.<br />
5. If the Officer should find any violations under Section 50 thru 50-114, then issue a<br />
<strong>Motor</strong> <strong>Vehicle</strong> <strong>Repair</strong> Notice of Violation (CCS-FRM-261) to the business owner or<br />
person in control.<br />
6. If a business or facility is unable to produce a valid Certificate of Occupancy at the<br />
time of inspection, refer to work instruction (CCS-WKI-227 for Illegal Land Use).<br />

7. A business without a current <strong>Motor</strong> <strong>Vehicle</strong> <strong>Repair</strong> <strong>License</strong> is in violation;<br />
7.1. The Officer shall provide an Application for the City of Dallas <strong>Motor</strong> <strong>Vehicle</strong><br />
<strong>Repair</strong> <strong>License</strong> (CCS-FRM-257) to the business owner or person in control of<br />
the property.<br />
7.2. The owner has seven to ten business days to submit the Application for City of<br />
Dallas <strong>Repair</strong> <strong>License</strong> (CCS-FRM-257) to Dallas Water Utlities, Special<br />
Collections Division, located at 1500 Marilla Street 2DS.<br />
7.3. Update the case with appropriate comments and;<br />
7.4. Schedule a re-inspection for seven to ten business days.<br />
8. Upon re-inspection of the <strong>Motor</strong> <strong>Vehicle</strong> <strong>Repair</strong> <strong>License</strong> is obtained, the Officer shall<br />
record the following on the <strong>Motor</strong> <strong>Vehicle</strong> <strong>Repair</strong> Notice of Violation (CCS-FRM-<br />
261):<br />
8.1. <strong>License</strong> number<br />
8.2. Expiration date and,<br />
8.3. Close the case with appropriate comments in CRMS system.<br />
9. Upon re-inspection if the <strong>Motor</strong> <strong>Vehicle</strong> <strong>Repair</strong> <strong>License</strong> has not been obtained, the<br />
Officer should;<br />
9.1. Issue a Criminal Citation;<br />
9.2. A Criminal Citation is issued every 10 days until compliance is obtained.<br />
9.3. After the third citation is issued, the Officer shall close the case and refer to work<br />
instruction (CCS-WKI-227 Illegal Land Use).<br />
EXCEPTIONS: Chapter 50-128 (a) A person engaged in the business of adding fluids<br />
only to <strong>Motor</strong> <strong>Vehicle</strong>s is exempted from the provisions of this article and (b) a licensee<br />
who enters into a contract with a commercial, industrial, or governmental entity to repair<br />
motor vehicles belonging to the entity subject to terms established in the contract, is<br />
exempted from the provisions of Section 50-122 and 50-123 while in the performance of<br />
repairs pursuant to the contract.<br />
