Sub:Prevention and prohibition <strong>of</strong> Ragg<strong>in</strong>g <strong>in</strong> technical Institutions,<br />
Universities <strong>in</strong>clud<strong>in</strong>g Deemed to be Universities impart<strong>in</strong>g technical<br />
education.<br />
F.No.37-3/Legal/AICTE/2009 – In exercise <strong>of</strong> <strong>the</strong> powers conferred under Section<br />
23 read with Section 10 (b), (g), (p) and (q) <strong>of</strong> AICTE Act, 1987, <strong>the</strong> All India<br />
Council for Technical Education, hereby makes <strong>the</strong> follow<strong>in</strong>g Regulations:-<br />
1. Short title and <strong>com</strong>mencement:-<br />

These Regulations may be called <strong>the</strong> All India Council for Technical<br />
Education (Prevention and Prohibition <strong>of</strong> Ragg<strong>in</strong>g <strong>in</strong> Technical<br />
Institutions, Universities <strong>in</strong>clud<strong>in</strong>g Deemed to be Universities<br />
impart<strong>in</strong>g technical education) Regulations 2009.<br />
They shall <strong>com</strong>e <strong>in</strong>to force on <strong>the</strong> date <strong>of</strong> <strong>the</strong> notification.<br />
2. Objectives:-<br />
In view <strong>of</strong> <strong>the</strong> directions <strong>of</strong> <strong>the</strong> Hon’ble Supreme Court <strong>in</strong> SLP No. 24295 <strong>of</strong> 2006<br />
dated 16-05-2007 and <strong>in</strong> Civil Appeal number 887 <strong>of</strong> 2009, dated 08-05-2009 to<br />
prohibit, prevent and elim<strong>in</strong>ate <strong>the</strong> scourge <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> <strong>in</strong>clud<strong>in</strong>g any conduct by any<br />
student or students whe<strong>the</strong>r by words spoken or written or by an act which has <strong>the</strong><br />
effect <strong>of</strong> teas<strong>in</strong>g, treat<strong>in</strong>g or handl<strong>in</strong>g with rudeness a fresher or any o<strong>the</strong>r student,<br />
or <strong>in</strong>dulg<strong>in</strong>g <strong>in</strong> rowdy or undiscipl<strong>in</strong>ed activities by any student or students which<br />
causes or is likely to cause annoyance, hardship or psychological harm or to raise<br />
fear or apprehension <strong>the</strong>re<strong>of</strong> <strong>in</strong> any fresher or any o<strong>the</strong>r student or ask<strong>in</strong>g any<br />
student to do any act which such student will not <strong>in</strong> <strong>the</strong> ord<strong>in</strong>ary course do and<br />
which has <strong>the</strong> effect <strong>of</strong> caus<strong>in</strong>g or generat<strong>in</strong>g a sense <strong>of</strong> shame, or torment or<br />
embarrassment so as to adversely affect <strong>the</strong> physique or psyche <strong>of</strong> such fresher or<br />
any o<strong>the</strong>r student, with or without an <strong>in</strong>tent to derive a sadistic pleasure or show<strong>in</strong>g<br />
<strong>of</strong>f power, authority or superiority by a student over any fresher or any o<strong>the</strong>r<br />
student, <strong>in</strong> all <strong>higher</strong> education <strong>in</strong>stitutions <strong>in</strong> <strong>the</strong> country, and <strong>the</strong>reby, to provide<br />
for <strong>the</strong> healthy development, physically and psychologically, <strong>of</strong> all students, <strong>the</strong> All<br />
India Council for Technical Education,(AICTE) br<strong>in</strong>gs forth <strong>the</strong>se Regulations.<br />

3. Def<strong>in</strong>itions:-<br />

“Act” means <strong>the</strong> All India Council for Technical Education Act 1987 (52 <strong>of</strong><br />
1987);<br />
“Technical Institution” means an <strong>in</strong>stitution <strong>of</strong> Government, Government<br />
Aided and Private (self f<strong>in</strong>anc<strong>in</strong>g) conduct<strong>in</strong>g <strong>the</strong> courses/programmes <strong>in</strong> <strong>the</strong><br />
field <strong>of</strong> technical education, tra<strong>in</strong><strong>in</strong>g and research <strong>in</strong> Eng<strong>in</strong>eer<strong>in</strong>g,<br />
Technology <strong>in</strong>clud<strong>in</strong>g MCA, Architecture, Town Plann<strong>in</strong>g, Management,<br />
Pharmacy, Hotel Management & Cater<strong>in</strong>g Technology, Applied Arts &<br />
Crafts and such o<strong>the</strong>r programmes and areas as notified by <strong>the</strong> Council from<br />
time to time;<br />
‘University” means a University def<strong>in</strong>ed under clause (f) <strong>of</strong> section 2 <strong>of</strong> <strong>the</strong><br />
University Grants Commission Act, 1956 and <strong>in</strong>cludes an <strong>in</strong>stitution deemed<br />
to be a University under section 3 <strong>of</strong> that Act.<br />
“Academic year” means <strong>the</strong> period from <strong>the</strong> <strong>com</strong>mencement <strong>of</strong> admission<br />
<strong>of</strong> students <strong>in</strong> any course <strong>of</strong> study <strong>in</strong> <strong>the</strong> <strong>in</strong>stitution up to <strong>the</strong> <strong>com</strong>pletion <strong>of</strong><br />
academic requirements for that particular year.<br />
“Head <strong>of</strong> <strong>the</strong> <strong>in</strong>stitution” means <strong>the</strong> Vice-Chancellor <strong>in</strong> case <strong>of</strong> a university<br />
or a deemed to be university, <strong>the</strong> Pr<strong>in</strong>cipal or <strong>the</strong> Director or such o<strong>the</strong>r<br />
designation as <strong>the</strong> executive head <strong>of</strong> <strong>the</strong> <strong>in</strong>stitution or <strong>the</strong> college is referred.<br />
“Fresher” means a student who has been admitted to an <strong>in</strong>stitution and who<br />
is undergo<strong>in</strong>g his/her first year <strong>of</strong> study <strong>in</strong> such <strong>in</strong>stitution.<br />
Words and expressions used and not def<strong>in</strong>ed here<strong>in</strong> but def<strong>in</strong>ed <strong>in</strong> <strong>the</strong> Act or<br />
<strong>in</strong> <strong>the</strong> General Clauses Act, 1887, shall have <strong>the</strong> mean<strong>in</strong>gs respectively<br />
assigned to <strong>the</strong>m <strong>in</strong> <strong>the</strong> Act or <strong>in</strong> <strong>the</strong> General Clauses Act, 1887, as <strong>the</strong> case<br />
may be. And<br />
All o<strong>the</strong>r words and expressions used here<strong>in</strong> and not def<strong>in</strong>ed but def<strong>in</strong>ed <strong>in</strong><br />
<strong>the</strong> All India Council for Technical Education Act, 1987 (52 <strong>of</strong> 1987), shall<br />
have <strong>the</strong> mean<strong>in</strong>gs respectively assigned to <strong>the</strong>m <strong>in</strong> <strong>the</strong> said Act;<br />
4 What constitutes Ragg<strong>in</strong>g: - Ragg<strong>in</strong>g constitutes one or more <strong>of</strong> any <strong>of</strong> <strong>the</strong><br />
follow<strong>in</strong>g acts:<br />

a. any conduct by any student or students whe<strong>the</strong>r by words spoken or written<br />
or by an act which has <strong>the</strong> effect <strong>of</strong> teas<strong>in</strong>g, treat<strong>in</strong>g or handl<strong>in</strong>g with<br />
rudeness a fresher or any o<strong>the</strong>r student;<br />
b. <strong>in</strong>dulg<strong>in</strong>g <strong>in</strong> rowdy or undiscipl<strong>in</strong>ed activities by any student or students<br />
which causes or is likely to cause annoyance, hardship, physical or<br />
psychological harm or to raise fear or apprehension <strong>the</strong>re<strong>of</strong> <strong>in</strong> any fresher or<br />
any o<strong>the</strong>r student;<br />
c. ask<strong>in</strong>g any student to do any act which such student will not <strong>in</strong> <strong>the</strong> ord<strong>in</strong>ary<br />
course do and which has <strong>the</strong> effect <strong>of</strong> caus<strong>in</strong>g or generat<strong>in</strong>g a sense <strong>of</strong><br />
shame, or torment or embarrassment so as to adversely affect <strong>the</strong> physique or<br />
psyche <strong>of</strong> such fresher or any o<strong>the</strong>r student;<br />
d. any act by a senior student that prevents, disrupts or disturbs <strong>the</strong> regular<br />
academic activity <strong>of</strong> any o<strong>the</strong>r student or a fresher;<br />
e. exploit<strong>in</strong>g <strong>the</strong> services <strong>of</strong> a fresher or any o<strong>the</strong>r student for <strong>com</strong>plet<strong>in</strong>g <strong>the</strong><br />
academic tasks assigned to an <strong>in</strong>dividual or a group <strong>of</strong> students.<br />
f. any act <strong>of</strong> f<strong>in</strong>ancial extortion or forceful expenditure burden put on a fresher<br />
or any o<strong>the</strong>r student by students;<br />
g. any act <strong>of</strong> physical abuse <strong>in</strong>clud<strong>in</strong>g all variants <strong>of</strong> it: sexual abuse,<br />
homosexual assaults, stripp<strong>in</strong>g, forc<strong>in</strong>g obscene and lewd acts, gestures,<br />
caus<strong>in</strong>g bodily harm or any o<strong>the</strong>r danger to health or person;<br />
h. any act or abuse by spoken words, emails, posts, public <strong>in</strong>sults which would<br />
also <strong>in</strong>clude deriv<strong>in</strong>g perverted pleasure, vicarious or sadistic thrill from<br />
actively or passively participat<strong>in</strong>g <strong>in</strong> <strong>the</strong> dis<strong>com</strong>fiture to fresher or any o<strong>the</strong>r<br />
student;<br />
i. any act that affects <strong>the</strong> mental health and self-confidence <strong>of</strong> a fresher or any<br />
o<strong>the</strong>r student with or without an <strong>in</strong>tent to derive a sadistic pleasure or<br />
show<strong>in</strong>g <strong>of</strong>f power, authority or superiority by a student over any fresher or<br />
any o<strong>the</strong>r student.<br />
5. Measures for prevention <strong>of</strong> <strong>ragg<strong>in</strong>g</strong>:-<br />
It shall be mandatory for every technical Institution, University, deemed to<br />
be University impart<strong>in</strong>g technical education to take follow<strong>in</strong>g measures for<br />
prevention <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> at such <strong>in</strong>stitutions.<br />

1. The advertisement issued for admission by a technical <strong>in</strong>stitution, University<br />
<strong>in</strong>clud<strong>in</strong>g Deemed to be University concerned and/or <strong>the</strong> admission<br />
authority/ affiliat<strong>in</strong>g University/State Govt./UT/Central Govt. as <strong>the</strong> case<br />
may be, shall clearly mention that <strong>ragg<strong>in</strong>g</strong> is totally banned and anyone<br />
found guilty <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> and/or abett<strong>in</strong>g <strong>ragg<strong>in</strong>g</strong> is liable to be punished.<br />
2. The ‘Prospectus’ and o<strong>the</strong>r admission related documents shall conta<strong>in</strong><br />
directions <strong>of</strong> <strong>the</strong> Supreme Court Affiliat<strong>in</strong>g University/admission<br />
Authority/State Govt/Central Govt. shall make it mandatory for <strong>the</strong><br />
<strong>in</strong>stitutions under <strong>the</strong>ir jurisdiction to <strong>com</strong>pulsorily <strong>in</strong>corporate such<br />
<strong>in</strong>formation <strong>in</strong> <strong>the</strong>ir ‘Prospectus’. These Regulations shall be pr<strong>in</strong>ted <strong>in</strong> <strong>the</strong><br />
brochure <strong>of</strong> admission/<strong>in</strong>struction booklet for candidates.<br />
3. The application form for admission/enrolment shall have a pr<strong>in</strong>ted affidavit,<br />
preferably both <strong>in</strong> English and H<strong>in</strong>di and/or <strong>in</strong> one <strong>of</strong> <strong>the</strong> regional languages.<br />
The affidavit should be filled up and signed by <strong>the</strong> candidate to <strong>the</strong> effect<br />
that he/she is aware <strong>of</strong> <strong>the</strong> law regard<strong>in</strong>g prohibition <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> as well as <strong>the</strong><br />
punishments, and that he/she, if found guilty <strong>of</strong> <strong>the</strong> <strong>of</strong>fence <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> and/or<br />
abett<strong>in</strong>g <strong>ragg<strong>in</strong>g</strong>, is liable to be punished appropriately.<br />
4. The application form shall also conta<strong>in</strong> a pr<strong>in</strong>ted affidavit, preferably both <strong>in</strong><br />
English and H<strong>in</strong>di and/or <strong>in</strong> one <strong>of</strong> <strong>the</strong> regional languages and <strong>the</strong> affidavit<br />
should be signed by <strong>the</strong> parent/guardian <strong>of</strong> <strong>the</strong> applicant to <strong>the</strong> effect that<br />
he/she is also aware <strong>of</strong> <strong>the</strong> law <strong>in</strong> this regard and agrees to abide by <strong>the</strong><br />
punishment meted out to his/her ward <strong>in</strong> case <strong>the</strong> latter is found guilty <strong>of</strong><br />
<strong>ragg<strong>in</strong>g</strong> and/or abett<strong>in</strong>g <strong>ragg<strong>in</strong>g</strong>.<br />
5. The application for admission shall be ac<strong>com</strong>panied by a document along<br />
with <strong>the</strong> School Leav<strong>in</strong>g Certificate/Character Certificate which shall <strong>in</strong>clude<br />
a report on <strong>the</strong> behavioral patter <strong>of</strong> <strong>the</strong> applicant, so that <strong>the</strong> <strong>in</strong>stitution can<br />
<strong>the</strong>reafter keep <strong>in</strong>tense watch upon <strong>the</strong> student who has a negative entry <strong>in</strong><br />
this regard.<br />
6. A student seek<strong>in</strong>g admission to <strong>the</strong> hostel shall have to submit ano<strong>the</strong>r<br />
affidavit along with his/her application for hostel ac<strong>com</strong>modation that he/she<br />
is also aware <strong>of</strong> <strong>the</strong> law <strong>in</strong> this regard and agrees to abide by <strong>the</strong> punishments<br />
meted out if he/she is found guilty <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> and/or abett<strong>in</strong>g <strong>ragg<strong>in</strong>g</strong>.<br />
7. Every technical <strong>in</strong>stitution, University <strong>in</strong>clud<strong>in</strong>g Deemed to be University<br />
impart<strong>in</strong>g technical education shall ma<strong>in</strong>ta<strong>in</strong> a proper record <strong>of</strong> <strong>the</strong> affidavits<br />
obta<strong>in</strong>ed to ensure its safe up keep <strong>the</strong>re<strong>of</strong>,<strong>in</strong>clud<strong>in</strong>g digital copies <strong>of</strong> <strong>the</strong><br />
affidavits and such digital copy should be made available to <strong>the</strong> AICTE or to<br />
an Agency identified/nom<strong>in</strong>ated by AICTE.<br />

8. The AICTE or an Agency identified/nom<strong>in</strong>ated for <strong>the</strong> purpose and<br />
affiliat<strong>in</strong>g Universities and Directorate <strong>of</strong> Technical Education <strong>of</strong> <strong>the</strong><br />
concerned State Govt./UT shall ma<strong>in</strong>ta<strong>in</strong> an appropriate data base <strong>of</strong> <strong>the</strong><br />
affidavits <strong>in</strong> <strong>the</strong> digital form obta<strong>in</strong>ed from every student at <strong>the</strong> time <strong>of</strong><br />
admission to <strong>the</strong> technical <strong>in</strong>stitutions, Universities <strong>in</strong>clud<strong>in</strong>g Deemed to be<br />
Universities impart<strong>in</strong>g technical education.<br />
9. Each batch <strong>of</strong> freshers should be divided <strong>in</strong>to small groups and each such<br />
group shall be assigned to a member <strong>of</strong> staff. Such staff member should<br />
<strong>in</strong>teract <strong>in</strong>dividually with each member <strong>of</strong> <strong>the</strong> group on daily basis to<br />
ascerta<strong>in</strong> <strong>the</strong> problems/difficulties, if any faced by <strong>the</strong> freshers <strong>in</strong> <strong>the</strong><br />
Institution and extend necessary help.<br />
10. Incase <strong>of</strong> freshers admitted to a Hostel it shall be <strong>the</strong> responsibility <strong>of</strong> <strong>the</strong><br />
teacher <strong>in</strong>charge <strong>of</strong> <strong>the</strong> group to co-ord<strong>in</strong>ate with <strong>the</strong> warden <strong>of</strong> <strong>the</strong> Hostel<br />
and to make surprise visits to <strong>the</strong> rooms <strong>in</strong> <strong>the</strong> hostel where <strong>the</strong> members <strong>of</strong><br />
<strong>the</strong> group are lodged. Freshers should be lodged <strong>in</strong> a separate hostel block<br />
wherever possible and where such facilities are not available, <strong>the</strong><br />
college/<strong>in</strong>stitution shall ensure that seniors’ access to freshers’<br />
ac<strong>com</strong>modation is strictly monitored by wardens, Security Guards and Staff.<br />
11. Every <strong>in</strong>stitution should engage or seek <strong>the</strong> assistance <strong>of</strong> pr<strong>of</strong>essional<br />
counselors at <strong>the</strong> time <strong>of</strong> admissions to counsel ‘freshers’ <strong>in</strong> order to prepare<br />
<strong>the</strong>m for <strong>the</strong> life ahead, particularly for adjust<strong>in</strong>g to <strong>the</strong> life <strong>in</strong> hostels. At <strong>the</strong><br />
<strong>com</strong>mencement <strong>of</strong> <strong>the</strong> academic session <strong>the</strong> Head <strong>of</strong> <strong>the</strong> technical Institution,<br />
University <strong>in</strong>clud<strong>in</strong>g Deemed to be University impart<strong>in</strong>g technical education<br />
shall convene and address a meet<strong>in</strong>g <strong>of</strong> various functionaries/agencies, like<br />
Wardens, representatives <strong>of</strong> students, parents/guardians, faculty, district<br />
adm<strong>in</strong>istration <strong>in</strong>clud<strong>in</strong>g police, to discuss <strong>the</strong> measures to be taken to<br />
prevent <strong>ragg<strong>in</strong>g</strong> and steps to be taken to identify <strong>the</strong> <strong>of</strong>fenders and punish<br />
<strong>the</strong>m suitably.<br />
12. Every fresher admitted to <strong>the</strong> technical Institution, University <strong>in</strong>clud<strong>in</strong>g<br />
Deemed to be University impart<strong>in</strong>g technical education shall be given a<br />
pr<strong>in</strong>ted <strong>in</strong>formation booklet detail<strong>in</strong>g when and whom he/she has to turn to<br />
for help and guidance for various purposes (<strong>in</strong>clud<strong>in</strong>g Wardens, Head <strong>of</strong> <strong>the</strong><br />
<strong>in</strong>stitution, members <strong>of</strong> <strong>the</strong> <strong>anti</strong>–<strong>ragg<strong>in</strong>g</strong> <strong>com</strong>mittee, relevant district and<br />
police authorities), addresses and telephone numbers <strong>of</strong> such<br />
persons/authorities, etc.<br />
13. The technical <strong>in</strong>stitutions, University <strong>in</strong>clud<strong>in</strong>g Deemed to be University<br />
impart<strong>in</strong>g technical education through <strong>the</strong> <strong>in</strong>formation booklet mentioned<br />

above shall expla<strong>in</strong> to <strong>the</strong> new entrants <strong>the</strong> arrangements for <strong>the</strong>ir <strong>in</strong>duction<br />
and orientation which promote efficient and effective means <strong>of</strong> <strong>in</strong>tegrat<strong>in</strong>g<br />
<strong>the</strong>m fully as students.<br />
14. The <strong>in</strong>formation booklet mentioned above shall also tell <strong>the</strong> freshers about<br />
<strong>the</strong>ir rights as bona fide students and clearly <strong>in</strong>struct<strong>in</strong>g <strong>the</strong>m that <strong>the</strong>y<br />
should desist from do<strong>in</strong>g anyth<strong>in</strong>g aga<strong>in</strong>st <strong>the</strong>ir will even if ordered by <strong>the</strong><br />
seniors, and that <strong>the</strong>y have noth<strong>in</strong>g to fear as <strong>the</strong> <strong>in</strong>stitution cares for <strong>the</strong>m<br />
and shall not tolerate any atrocities aga<strong>in</strong>st <strong>the</strong>m.<br />
15. The <strong>in</strong>formation booklet mentioned above shall conta<strong>in</strong> a calendar <strong>of</strong> events<br />
and activities laid down by <strong>the</strong> <strong>in</strong>stitution to facilitate and <strong>com</strong>plement<br />
familiarization <strong>of</strong> juniors with <strong>the</strong> academic environment <strong>of</strong> <strong>the</strong> <strong>in</strong>stitution.<br />
16. To make <strong>the</strong> <strong>com</strong>munity at large and <strong>the</strong> students <strong>in</strong> particular aware <strong>of</strong> <strong>the</strong><br />
dehumaniz<strong>in</strong>g effect <strong>of</strong> <strong>ragg<strong>in</strong>g</strong>, and <strong>the</strong> approach <strong>of</strong> <strong>the</strong> <strong>in</strong>stitution towards<br />
those <strong>in</strong>dulg<strong>in</strong>g <strong>in</strong> <strong>ragg<strong>in</strong>g</strong>, big posters (preferably with different colors for<br />
<strong>the</strong> provisions <strong>of</strong> law, punishments, etc.) shall be prom<strong>in</strong>ently displayed on<br />
all Notice Boards <strong>of</strong> all departments, hostels and o<strong>the</strong>r build<strong>in</strong>gs as well as at<br />
vulnerable places Some <strong>of</strong> such posters shall be <strong>of</strong> permanent nature <strong>in</strong><br />
certa<strong>in</strong> vulnerable places.<br />
17. The technical Institution, University <strong>in</strong>clud<strong>in</strong>g Deemed to be University<br />
impart<strong>in</strong>g technical education shall request <strong>the</strong> media to give adequate<br />
publicity to <strong>the</strong> law prohibit<strong>in</strong>g <strong>ragg<strong>in</strong>g</strong> and <strong>the</strong> negative aspects <strong>of</strong> <strong>ragg<strong>in</strong>g</strong><br />
and <strong>the</strong> <strong>in</strong>stitutions ‘s resolve to ban <strong>ragg<strong>in</strong>g</strong> and punish those found guilty<br />
without fear or favor.<br />
18. The technical Institution, University <strong>in</strong>clud<strong>in</strong>g Deemed to be University<br />
impart<strong>in</strong>g technical education shall identify, properly illum<strong>in</strong>ate and man all<br />
vulnerable locations.<br />
19. The technical Institution, University <strong>in</strong>clud<strong>in</strong>g Deemed to be University<br />
impart<strong>in</strong>g technical education shall tighten security <strong>in</strong> its premises, especially<br />
at <strong>the</strong> vulnerable places. If necessary, <strong>in</strong>tense polic<strong>in</strong>g shall be resorted to at<br />
such po<strong>in</strong>ts at odd hours dur<strong>in</strong>g <strong>the</strong> early months <strong>of</strong> <strong>the</strong> academic session.<br />
20. The technical Institution, University <strong>in</strong>clud<strong>in</strong>g Deemed to be University<br />
impart<strong>in</strong>g technical education shall utilize <strong>the</strong> vacation period before <strong>the</strong> start<br />
<strong>of</strong> <strong>the</strong> new academic year to launch wide publicity campaign aga<strong>in</strong>st <strong>ragg<strong>in</strong>g</strong><br />
through posters, <strong>in</strong>formation booklets, sem<strong>in</strong>ars, street plays, etc.<br />

21. The faculties/departments/units <strong>of</strong> <strong>the</strong> technical Institution, University<br />
<strong>in</strong>clud<strong>in</strong>g Deemed to be University impart<strong>in</strong>g technical education shall have<br />
<strong>in</strong>duction arrangements (<strong>in</strong>clud<strong>in</strong>g those which <strong>anti</strong>cipate, identify and plan<br />
to meet any special needs <strong>of</strong> any specific section <strong>of</strong> students) <strong>in</strong> place well<br />
<strong>in</strong> advance <strong>of</strong> <strong>the</strong> beg<strong>in</strong>n<strong>in</strong>g <strong>of</strong> <strong>the</strong> academic year with a clear sense <strong>of</strong> <strong>the</strong><br />
ma<strong>in</strong> aims and objectives <strong>of</strong> <strong>the</strong> <strong>in</strong>duction process.<br />
22. Mobile Phones and o<strong>the</strong>r <strong>com</strong>munication devices may be permitted <strong>in</strong><br />
residential areas <strong>in</strong>clud<strong>in</strong>g hostels to provide access to <strong>the</strong> students<br />
particularly freshers, to reach out for help from teachers, parents and<br />
Institution authorities.<br />
6. Monitor<strong>in</strong>g mechanism <strong>in</strong> technical <strong>in</strong>stitution, University <strong>in</strong>clud<strong>in</strong>g<br />
Deemed to be University impart<strong>in</strong>g technical education:-<br />
a) Anti-<strong>ragg<strong>in</strong>g</strong> Committee: Every <strong>in</strong>stitution University <strong>in</strong>clud<strong>in</strong>g Deemed to be<br />
University impart<strong>in</strong>g technical education shall constitute a Committee to be<br />
known as <strong>the</strong> Anti-<strong>ragg<strong>in</strong>g</strong> Committee to be nom<strong>in</strong>ated and headed by <strong>the</strong><br />
Head <strong>of</strong> <strong>the</strong> Institution, and consist<strong>in</strong>g <strong>of</strong> representatives <strong>of</strong> civil and police<br />
adm<strong>in</strong>istration, local media, Non Government Organizations <strong>in</strong>volved <strong>in</strong><br />
youth activities, representatives <strong>of</strong> faculty members, representatives <strong>of</strong><br />
parents, representatives <strong>of</strong> students belong<strong>in</strong>g to <strong>the</strong> freshers’ category as<br />
well as senior students, non-teach<strong>in</strong>g staff; and shall have a diverse mix <strong>of</strong><br />
membership <strong>in</strong> terms <strong>of</strong> level as well as gender.<br />
b) It shall be <strong>the</strong> duty <strong>of</strong> <strong>the</strong> Anti-Ragg<strong>in</strong>g Committee to ensure <strong>com</strong>pliance with<br />
<strong>the</strong> provisions <strong>of</strong> <strong>the</strong>se Regulations as well as <strong>the</strong> provisions <strong>of</strong> any law for<br />
<strong>the</strong> time be<strong>in</strong>g <strong>in</strong> force concern<strong>in</strong>g <strong>ragg<strong>in</strong>g</strong>; and also to monitor and oversee<br />
<strong>the</strong> performance <strong>of</strong> <strong>the</strong> Anti-Ragg<strong>in</strong>g Squad <strong>in</strong> prevention <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> <strong>in</strong> <strong>the</strong><br />
<strong>in</strong>stitution.<br />
c) Anti-Ragg<strong>in</strong>g Squad: Every <strong>in</strong>stitution University <strong>in</strong>clud<strong>in</strong>g Deemed to be<br />
University impart<strong>in</strong>g technical education shall also constitute a smaller body<br />
to be known as <strong>the</strong> Anti-Ragg<strong>in</strong>g Squad to be nom<strong>in</strong>ated by <strong>the</strong> Head <strong>of</strong> <strong>the</strong><br />
Institution with such representation as may be considered necessary for<br />
ma<strong>in</strong>ta<strong>in</strong><strong>in</strong>g vigil, oversight and patroll<strong>in</strong>g functions and shall rema<strong>in</strong><br />
mobile, alert and active at all times. Provided that <strong>the</strong> Anti-Ragg<strong>in</strong>g Squad<br />
shall have representation <strong>of</strong> various members <strong>of</strong> <strong>the</strong> campus <strong>com</strong>munity and<br />
shall have no outside representation.<br />
d) It shall be <strong>the</strong> duty <strong>of</strong> <strong>the</strong> Anti-Ragg<strong>in</strong>g Squad to be called upon to make<br />
surprise raids on hostels, and o<strong>the</strong>r places vulnerable to <strong>in</strong>cidents and hav<strong>in</strong>g<br />
<strong>the</strong> potential for <strong>ragg<strong>in</strong>g</strong> and shall be empowered to <strong>in</strong>spect such places.<br />

e) It shall also be <strong>the</strong> duty <strong>of</strong> <strong>the</strong> Anti-Ragg<strong>in</strong>g Squad to conduct an on-<strong>the</strong>-spot<br />
enquiry <strong>in</strong>to any <strong>in</strong>cidents <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> referred to it by <strong>the</strong> Head <strong>of</strong> <strong>the</strong><br />
<strong>in</strong>stitution or any member <strong>of</strong> <strong>the</strong> faculty or any member <strong>of</strong> <strong>the</strong> staff or any<br />
student or any parent or guardian or any employee <strong>of</strong> a service provider or by<br />
any o<strong>the</strong>r person, as <strong>the</strong> case may be; and <strong>the</strong> enquiry report along with<br />
re<strong>com</strong>mendations shall be submitted to <strong>the</strong> Anti-Ragg<strong>in</strong>g Committee for<br />
action. Provided that <strong>the</strong> Anti-Ragg<strong>in</strong>g Squad shall conduct such enquiry<br />
observ<strong>in</strong>g a fair and transparent procedure and <strong>the</strong> pr<strong>in</strong>ciples <strong>of</strong> natural<br />
justice and after giv<strong>in</strong>g adequate opportunity to <strong>the</strong> student or students<br />
accused <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> and o<strong>the</strong>r witnesses to place before it <strong>the</strong> facts,<br />
documents and views concern<strong>in</strong>g <strong>the</strong> <strong>in</strong>cidents <strong>of</strong> <strong>ragg<strong>in</strong>g</strong>, and considerations<br />
such o<strong>the</strong>r relevant <strong>in</strong>formation as may be required.<br />
f) Mentor<strong>in</strong>g Cell: Every <strong>in</strong>stitution shall, at <strong>the</strong> end <strong>of</strong> each academic year, <strong>in</strong><br />
order to promote <strong>the</strong> objectives <strong>of</strong> <strong>the</strong>se Regulations, constitute a Mentor<strong>in</strong>g<br />
Cell consist<strong>in</strong>g <strong>of</strong> students volunteer<strong>in</strong>g to be Mentors for freshers, <strong>in</strong> <strong>the</strong><br />
succeed<strong>in</strong>g academic year; and <strong>the</strong>re shall be as many levels or tiers <strong>of</strong><br />
Mentors as <strong>the</strong> number <strong>of</strong> batches <strong>in</strong> <strong>the</strong> <strong>in</strong>stitution, at <strong>the</strong> rate <strong>of</strong> one Mentor<br />
for six freshers and one Mentor <strong>of</strong> a <strong>higher</strong> level for six Mentors <strong>of</strong> <strong>the</strong> lower<br />
level.<br />
g) Monitor<strong>in</strong>g Cell on Ragg<strong>in</strong>g:- The State Govt./UT and <strong>the</strong> affiliat<strong>in</strong>g<br />
University shall set up a Monitor<strong>in</strong>g Cell on Ragg<strong>in</strong>g to coord<strong>in</strong>ate with <strong>the</strong><br />
<strong>in</strong>stitutions to monitor <strong>the</strong> activities <strong>of</strong> <strong>the</strong> Anti-Ragg<strong>in</strong>g Committees, Squads<br />
, and Mentor<strong>in</strong>g Cells, regard<strong>in</strong>g <strong>com</strong>pliance with <strong>the</strong> <strong>in</strong>structions on<br />
conduct<strong>in</strong>g orientation programmes, counsel<strong>in</strong>g sessions, etc., and regard<strong>in</strong>g<br />
<strong>the</strong> <strong>in</strong>cidents <strong>of</strong> <strong>ragg<strong>in</strong>g</strong>, <strong>the</strong> problem faced by wardens and o<strong>the</strong>r <strong>of</strong>ficials,<br />
etc. This Cell shall also review <strong>the</strong> efforts made by such <strong>in</strong>stitutions to<br />
publicize <strong>anti</strong>-<strong>ragg<strong>in</strong>g</strong> measures, cross-verify <strong>the</strong> receipt <strong>of</strong> affidavits from<br />
candidates/students and <strong>the</strong>ir parents/guardians every year, and shall be <strong>the</strong><br />
prime mover for <strong>in</strong>itiat<strong>in</strong>g action by <strong>the</strong> University authorities to suitably<br />
amend <strong>the</strong> Statutes or Ord<strong>in</strong>ances or Bye-laws to facilitate <strong>the</strong><br />
implementation <strong>of</strong> <strong>anti</strong> <strong>ragg<strong>in</strong>g</strong> measures at <strong>the</strong> level <strong>of</strong> <strong>the</strong> <strong>in</strong>stitution.<br />
h) The Monitor<strong>in</strong>g Cell shall coord<strong>in</strong>ate with <strong>the</strong> <strong>the</strong> <strong>in</strong>stitutions, universities<br />
<strong>in</strong>clud<strong>in</strong>g deemed to be universities impart<strong>in</strong>g technical education to achieve<br />
<strong>the</strong> objectives <strong>of</strong> <strong>the</strong>se Regulations; and <strong>the</strong> Monitor<strong>in</strong>g Cell shall call for<br />
reports from <strong>the</strong> Heads <strong>of</strong> <strong>in</strong>stitutions <strong>in</strong> regard to <strong>the</strong> activities <strong>of</strong> <strong>the</strong> Anti-<br />
Ragg<strong>in</strong>g Committees, Anti-Ragg<strong>in</strong>g Squads, and <strong>the</strong> Mentor<strong>in</strong>g Cells at <strong>the</strong><br />
<strong>in</strong>stitutions, and it shall also keep itself abreast <strong>of</strong> <strong>the</strong> decisions <strong>of</strong> <strong>the</strong> Anti-<br />
Ragg<strong>in</strong>g Committees etc.<br />

i) The Monitor<strong>in</strong>g Cell shall also review <strong>the</strong> efforts made by <strong>in</strong>stitutions to<br />
publicize <strong>anti</strong>-<strong>ragg<strong>in</strong>g</strong> measures, solicit<strong>in</strong>g <strong>of</strong> affidavits from<br />
parents/guardians and from students, each academic year, to absta<strong>in</strong> from<br />
<strong>ragg<strong>in</strong>g</strong> activities or will<strong>in</strong>gness to be penalized for violation; and shall<br />
function as <strong>the</strong> prime mover for <strong>in</strong>itiat<strong>in</strong>g action for amend<strong>in</strong>g <strong>the</strong> Statues or<br />
Ord<strong>in</strong>ances or Bye-laws to facilitate <strong>the</strong> implementation <strong>of</strong> <strong>anti</strong>-<strong>ragg<strong>in</strong>g</strong><br />
measures at <strong>the</strong> level <strong>of</strong> <strong>the</strong> <strong>in</strong>stitution.<br />
7. Action to be taken aga<strong>in</strong>st <strong>the</strong> Pr<strong>in</strong>cipal or <strong>the</strong> Head <strong>of</strong> <strong>the</strong><br />
Institution/Faculty Members/Non-Teach<strong>in</strong>g staff <strong>of</strong> technical <strong>in</strong>stitution,<br />
Universities <strong>in</strong>clud<strong>in</strong>g Deemed to be Universities impart<strong>in</strong>g technical<br />
education.<br />
1. The Head <strong>of</strong> <strong>the</strong> Institution along with o<strong>the</strong>r adm<strong>in</strong>istrative authorities should<br />
take adequate measures for prevention <strong>of</strong> <strong>ragg<strong>in</strong>g</strong>. Any lapse on <strong>the</strong> part <strong>of</strong><br />
<strong>the</strong>se authorities shall make <strong>the</strong>m liable for crim<strong>in</strong>al action for negligence <strong>of</strong><br />
duty. The technical Institution, University <strong>in</strong>clud<strong>in</strong>g Deemed to be<br />
University impart<strong>in</strong>g technical education should <strong>in</strong>corporate a clause <strong>in</strong> <strong>the</strong>ir<br />
letter <strong>of</strong> appo<strong>in</strong>tment that <strong>the</strong> Director, Faculty and o<strong>the</strong>r adm<strong>in</strong>istrative<br />
Heads should ensure all possible steps for prevention <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> <strong>in</strong> <strong>the</strong><br />
premises <strong>of</strong> <strong>the</strong> educational <strong>in</strong>stitutions, and that <strong>the</strong>y are liable for action, <strong>in</strong><br />
case <strong>of</strong> non-<strong>com</strong>pliance.<br />
2. The Pr<strong>in</strong>cipal or Head <strong>of</strong> <strong>the</strong> Institution/Department shall obta<strong>in</strong> an affidavit<br />
from every employee <strong>of</strong> <strong>the</strong> Institution <strong>in</strong>clud<strong>in</strong>g teach<strong>in</strong>g/non-teach<strong>in</strong>g staff,<br />
contract labor employed <strong>in</strong> <strong>the</strong> premises ei<strong>the</strong>r for runn<strong>in</strong>g canteen or as<br />
watch and ward staff or for clean<strong>in</strong>g or ma<strong>in</strong>tenance <strong>of</strong> <strong>the</strong> build<strong>in</strong>g, lawns<br />
etc. that he/she would report promptly any case <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> which <strong>com</strong>es to<br />
his/her notice. A provision shall be made <strong>in</strong> <strong>the</strong> service rules for issu<strong>in</strong>g<br />
certificates <strong>of</strong> appreciation to such members <strong>of</strong> <strong>the</strong> staff who report <strong>ragg<strong>in</strong>g</strong><br />
which will form part <strong>of</strong> <strong>the</strong>ir service records.<br />
3. Departmental enquiries shall be <strong>in</strong>itiated, <strong>in</strong> addition to penal consequences<br />
aga<strong>in</strong>st such heads <strong>of</strong> <strong>the</strong> Institution/Faculty members/non-teach<strong>in</strong>g staff<br />
who display an apa<strong>the</strong>tic or <strong>in</strong>sensitive attitude towards <strong>com</strong>pla<strong>in</strong>ts <strong>of</strong><br />
<strong>ragg<strong>in</strong>g</strong> and would not take timely steps <strong>in</strong> <strong>the</strong> prevention <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> and<br />
punish<strong>in</strong>g those who rag.<br />
4. The Pr<strong>in</strong>cipal or <strong>the</strong> Head <strong>of</strong> <strong>the</strong> Institution/Faculty Members/Non-Teach<strong>in</strong>g<br />
staff, if found negligent <strong>in</strong> tak<strong>in</strong>g necessary measures for ensur<strong>in</strong>g safety <strong>of</strong><br />
students and prevent<strong>in</strong>g <strong>the</strong> <strong>ragg<strong>in</strong>g</strong> would be declared unfit for hold<strong>in</strong>g any<br />
post <strong>in</strong> any technical <strong>in</strong>stitution, University <strong>in</strong>clud<strong>in</strong>g Deemed to be<br />
University impart<strong>in</strong>g technical education.<br />

8. Actions to be taken aga<strong>in</strong>st students for <strong>in</strong>dulg<strong>in</strong>g and abett<strong>in</strong>g <strong>ragg<strong>in</strong>g</strong><br />
<strong>in</strong> technical <strong>in</strong>stitutions Universities <strong>in</strong>clud<strong>in</strong>g Deemed to be University<br />
impart<strong>in</strong>g technical education:-<br />
1. The punishment to be meted out to <strong>the</strong> persons <strong>in</strong>dulged <strong>in</strong> <strong>ragg<strong>in</strong>g</strong> has to be<br />
exemplary and justifiably harsh to act as a deterrent aga<strong>in</strong>st recurrence <strong>of</strong><br />
such <strong>in</strong>cidents.<br />
2. Every s<strong>in</strong>gle <strong>in</strong>cident <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> a First Information Report (FIR) must be<br />
filed without exception by <strong>the</strong> <strong>in</strong>stitutional authorities with <strong>the</strong> local police<br />
authorities.<br />
3. The Anti-Ragg<strong>in</strong>g Committee <strong>of</strong> <strong>the</strong> <strong>in</strong>stitution shall take an appropriate<br />
decision, with regard to punishment or o<strong>the</strong>rwise, depend<strong>in</strong>g on <strong>the</strong> facts <strong>of</strong><br />
each <strong>in</strong>cident <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> and nature and gravity <strong>of</strong> <strong>the</strong> <strong>in</strong>cident <strong>of</strong> <strong>ragg<strong>in</strong>g</strong>.<br />
4. a) Depend<strong>in</strong>g upon <strong>the</strong> nature and gravity <strong>of</strong> <strong>the</strong> <strong>of</strong>fence as established <strong>the</strong><br />
possible punishments for those found guilty <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> at <strong>the</strong><br />
<strong>in</strong>stitution level shall be any one or any <strong>com</strong>b<strong>in</strong>ation <strong>of</strong> <strong>the</strong><br />
follow<strong>in</strong>g:-<br />

Debarr<strong>in</strong>g from represent<strong>in</strong>g <strong>the</strong> <strong>in</strong>stitution <strong>in</strong> any regional,<br />
national or <strong>in</strong>ternational meet, tournament, youth festival, etc.<br />
(vii) Suspension/expulsion from <strong>the</strong> hostel<br />
(viii) Rustication from <strong>the</strong> <strong>in</strong>stitution for period rang<strong>in</strong>g from 1 to 4<br />
semesters<br />

Expulsion from <strong>the</strong> <strong>in</strong>stitution and consequent debarr<strong>in</strong>g from<br />
admission to any o<strong>the</strong>r <strong>in</strong>stitution.<br />
Collective punishment: when <strong>the</strong> persons <strong>com</strong>mitt<strong>in</strong>g or<br />
abett<strong>in</strong>g <strong>the</strong> crime <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> are not identified, <strong>the</strong> <strong>in</strong>stitution<br />
shall resort to collective punishment as a deterrent to ensure<br />
<strong>com</strong>munity pressure on <strong>the</strong> potential raggers.<br />
b) An appeal aga<strong>in</strong>st <strong>the</strong> order <strong>of</strong> punishment by <strong>the</strong> Anti-Ragg<strong>in</strong>g<br />
Committee shall lie,<br />

i. In case <strong>of</strong> an order <strong>of</strong> an <strong>in</strong>stitution, affiliated to or constituent<br />
part, <strong>of</strong> <strong>the</strong> University, to <strong>the</strong> Vice-Chancellor <strong>of</strong> <strong>the</strong><br />
University;<br />

In case <strong>of</strong> an order <strong>of</strong> a University, to its Chancellor.<br />
In case <strong>of</strong> an <strong>in</strong>stitution <strong>of</strong> national importance created by an<br />
Act <strong>of</strong> Parliament, to <strong>the</strong> Chairman or Chancellor <strong>of</strong> <strong>the</strong><br />
<strong>in</strong>stitution, as <strong>the</strong> case may be.<br />
5. The <strong>in</strong>stitutional authorities shall <strong>in</strong>timate <strong>the</strong> <strong>in</strong>cidents <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> occurred<br />
<strong>in</strong> <strong>the</strong>ir premises along with actions taken to <strong>the</strong> Council form time to time.<br />
9 Action to be taken aga<strong>in</strong>st <strong>the</strong> technical Institution, University <strong>in</strong>clud<strong>in</strong>g<br />
Deemed to be University impart<strong>in</strong>g technical education which fail to<br />
take measures for prevention <strong>of</strong> <strong>ragg<strong>in</strong>g</strong>:-<br />
1. Role <strong>of</strong> <strong>the</strong> concerned technical <strong>in</strong>stitutions, Universities <strong>in</strong>clud<strong>in</strong>g Deemed<br />
to be Universities impart<strong>in</strong>g technical education shall be open to scrut<strong>in</strong>y for<br />
<strong>the</strong> purpose <strong>of</strong> f<strong>in</strong>d<strong>in</strong>g out whe<strong>the</strong>r <strong>the</strong>y have taken effective steps for<br />
prevent<strong>in</strong>g <strong>ragg<strong>in</strong>g</strong> and action taken aga<strong>in</strong>st provision <strong>in</strong>dulged and/or<br />
abett<strong>in</strong>g <strong>ragg<strong>in</strong>g</strong>. The Council shall constitute Committees to <strong>in</strong>spect<br />
technical <strong>in</strong>stitutions, Universities <strong>in</strong>clud<strong>in</strong>g Deemed to be Universities<br />
impart<strong>in</strong>g technical education to verify <strong>the</strong> status <strong>of</strong> <strong>anti</strong> <strong>ragg<strong>in</strong>g</strong> measures<br />
and to <strong>in</strong>vestigate specific <strong>in</strong>stances <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> and take appropriate action.<br />
2. The technical Institution, University <strong>in</strong>clud<strong>in</strong>g Deemed to be University<br />
impart<strong>in</strong>g technical education should submit an affidavit along with its<br />
<strong>com</strong>pliance report submitted to AICTE annually with details <strong>of</strong> measures<br />
taken for prevention <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> <strong>in</strong> technical <strong>in</strong>stitutions. The Compliance<br />
Report should also conta<strong>in</strong> <strong>the</strong> details <strong>of</strong> <strong>the</strong> <strong>in</strong>stances <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> and action<br />
taken aga<strong>in</strong>st students, and o<strong>the</strong>rs for <strong>in</strong>dulg<strong>in</strong>g and abett<strong>in</strong>g <strong>ragg<strong>in</strong>g</strong>.<br />
3. All Letters <strong>of</strong> Approval issued by AICTE such as extension <strong>of</strong> approval<br />
letters, letters issued for additional courses/<strong>in</strong>crease <strong>in</strong> <strong>in</strong>take and letters<br />
issued for new technical <strong>in</strong>stitutions, release <strong>of</strong> grants, letters <strong>of</strong> approval<br />
issued to <strong>in</strong>tegrated campus, second shift etc. shall conta<strong>in</strong> a specific clause<br />
<strong>of</strong> prevention <strong>of</strong> <strong>ragg<strong>in</strong>g</strong>.<br />
4. The AICTE shall, <strong>in</strong> respect <strong>of</strong> any <strong>in</strong>stitution that fails to take adequate<br />
steps to prevent <strong>ragg<strong>in</strong>g</strong> or fails to act <strong>in</strong> accordance with <strong>the</strong>se Regulations<br />
or fails to punish perpetrators or <strong>in</strong>cidents <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> suitably, take one <strong>of</strong><br />
more <strong>of</strong> <strong>the</strong> follow<strong>in</strong>g measures, namely;<br />

i. No admission/Withdrawal <strong>of</strong> approval granted under section 10(k) <strong>of</strong><br />
AICTE Act.<br />
ii. Withhold<strong>in</strong>g any grant allocated.<br />
iii. Declar<strong>in</strong>g <strong>the</strong> <strong>in</strong>stitution <strong>in</strong>eligible for consideration for any assistance<br />
under any <strong>of</strong> <strong>the</strong> general or special assistance programmes <strong>of</strong> <strong>the</strong><br />
AICTE.<br />
iv. Inform<strong>in</strong>g <strong>the</strong> general public, <strong>in</strong>clud<strong>in</strong>g potential candidates for<br />
admission, through a notice displayed prom<strong>in</strong>ently <strong>in</strong> <strong>the</strong> newspapers<br />
or o<strong>the</strong>r suitable media and posted on <strong>the</strong> website <strong>of</strong> <strong>the</strong> AICTE,<br />
declar<strong>in</strong>g that <strong>the</strong> <strong>in</strong>stitution does not possess <strong>the</strong> m<strong>in</strong>imum academic<br />
standards.<br />
v. Tak<strong>in</strong>g such o<strong>the</strong>r action with<strong>in</strong> its powers as it may deem fit and<br />
impose such o<strong>the</strong>r penalties as may be provided <strong>in</strong> <strong>the</strong> Act for such<br />
duration <strong>of</strong> time as <strong>the</strong> <strong>in</strong>stitution <strong>com</strong>plies with <strong>the</strong> provisions <strong>of</strong><br />
<strong>the</strong>se Regulations.<br />
5. As regards <strong>the</strong> Universities <strong>in</strong>clud<strong>in</strong>g Deemed to be Universities impart<strong>in</strong>g<br />
technical education <strong>the</strong> actions proposed to be taken such as stopp<strong>in</strong>g release<br />
<strong>of</strong> grants, withdrawal <strong>of</strong> approval/recognition will be sent to University<br />
Grants Commission (UGC), M<strong>in</strong>istry <strong>of</strong> Human Resource Development<br />
(MHRD), Govt. <strong>of</strong> India and <strong>the</strong> concerned State Govt./UT. The UGC,<br />
MHRD Govt. <strong>of</strong> India, and <strong>the</strong> State Govt./UT concerned shall <strong>in</strong>itiate<br />
immediate action on <strong>the</strong> re<strong>com</strong>mendations <strong>of</strong> <strong>the</strong> Council.<br />
10. Duties and Responsibilities <strong>of</strong> <strong>the</strong> All India Council for technical<br />
Education:-<br />
a) All India Council for technical Education, or <strong>the</strong> Central Government or <strong>the</strong><br />
agency authorized for <strong>the</strong> purpose shall establish, fund and operate, a tollfree<br />
Anti-Ragg<strong>in</strong>g Helpl<strong>in</strong>e, operational round <strong>the</strong> clock, which could be<br />
accessed by students <strong>in</strong> distress ow<strong>in</strong>g to <strong>ragg<strong>in</strong>g</strong> related <strong>in</strong>cidents.<br />
b) Any distress message received at <strong>the</strong> Anti-Ragg<strong>in</strong>g Helpl<strong>in</strong>e shall be<br />
simultaneously relayed to <strong>the</strong> Head <strong>of</strong> <strong>the</strong> Institution, <strong>the</strong> Warden <strong>of</strong> <strong>the</strong><br />
Hostels, <strong>the</strong> Nodal Officer <strong>of</strong> <strong>the</strong> affiliat<strong>in</strong>g University, if <strong>the</strong> <strong>in</strong>cident<br />
reported has taken place <strong>in</strong> an <strong>in</strong>stitution affiliated to a University, <strong>the</strong><br />
concerned District authorities and if so required, <strong>the</strong> District Magistrate, and<br />
<strong>the</strong> Super<strong>in</strong>tendent <strong>of</strong> Police, and shall also be web enabled so as to be <strong>in</strong> <strong>the</strong><br />
public doma<strong>in</strong> simultaneously for <strong>the</strong> media and citizens to access it.<br />
c) The Head <strong>of</strong> <strong>the</strong> <strong>in</strong>stitution shall be obliged to act immediately <strong>in</strong> response to<br />
<strong>the</strong> <strong>in</strong>formation received from <strong>the</strong> Anti-Ragg<strong>in</strong>g Helpl<strong>in</strong>e as at sub-clause (b)<br />
<strong>of</strong> this clause.<br />

d) The telephone numbers <strong>of</strong> <strong>the</strong> Anti-Ragg<strong>in</strong>g Helpl<strong>in</strong>e and all <strong>the</strong> important<br />
functionaries <strong>in</strong> every <strong>in</strong>stitution, Heads <strong>of</strong> <strong>in</strong>stitutions, faculty members,<br />
members <strong>of</strong> <strong>the</strong> <strong>anti</strong>-<strong>ragg<strong>in</strong>g</strong> <strong>com</strong>mittees and <strong>anti</strong>- <strong>ragg<strong>in</strong>g</strong> squads, district<br />
and sub-divisional authorities and state authorities, Wardens <strong>of</strong> hostels, and<br />
o<strong>the</strong>r functionaries or authorities where relevant, shall be widely<br />
dissem<strong>in</strong>ated for access or to seek help <strong>in</strong> emergencies.<br />
f) The All India Council for technical Education, <strong>the</strong> Central Government or <strong>the</strong><br />
agency authorized for <strong>the</strong> purpose shall ma<strong>in</strong>ta<strong>in</strong> an appropriate data base to<br />
be created out <strong>of</strong> affidavits, affirmed by each student and his/her<br />
parents/guardians and stored electronically by <strong>the</strong> <strong>in</strong>stitution; and such<br />
database shall also function as a record <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> <strong>com</strong>pla<strong>in</strong>ts received, and<br />
<strong>the</strong> status <strong>of</strong> <strong>the</strong> action taken <strong>the</strong>reon.<br />
g) The All India Council for technical Education, <strong>the</strong> Central Government or <strong>the</strong><br />
agency authorized for <strong>the</strong> purpose shall make available <strong>the</strong> database to a<br />
non-governmental agency to be nom<strong>in</strong>ated by <strong>the</strong> Central Government, to<br />
build confidence <strong>in</strong> <strong>the</strong> public and also to provide <strong>in</strong>formation <strong>of</strong> non<br />
<strong>com</strong>pliance with <strong>the</strong>se Regulations to <strong>the</strong> Councils and to such bodies as may<br />
be authorized by <strong>the</strong> All India Council for technical Education/Central<br />
Government.<br />
11. The All India Council for technical Education shall take <strong>the</strong> follow<strong>in</strong>g<br />
regulatory steps, namely;<br />
a) The All India Council for technical Education shall make it mandatory for <strong>the</strong><br />
<strong>in</strong>stitutions to <strong>in</strong>corporate <strong>in</strong> <strong>the</strong>ir prospectus, <strong>the</strong> directions <strong>of</strong> <strong>the</strong> Central<br />
Government or <strong>the</strong> State Level Monitor<strong>in</strong>g Committee with regard to<br />
prohibition and consequences <strong>of</strong> <strong>ragg<strong>in</strong>g</strong>, and that non-<strong>com</strong>pliance with <strong>the</strong>se<br />
Regulations and directions so provided, shall be considered as lower<strong>in</strong>g <strong>of</strong><br />
academic standards by <strong>the</strong> <strong>in</strong>stitution, <strong>the</strong>refore mak<strong>in</strong>g it liable for<br />
appropriate action.<br />
b) The All India Council for technical Education shall verify that <strong>the</strong> <strong>in</strong>stitutions<br />
strictly <strong>com</strong>ply with <strong>the</strong> requirement <strong>of</strong> gett<strong>in</strong>g <strong>the</strong> affidavits from <strong>the</strong><br />
students and <strong>the</strong>ir parents/guardians as envisaged under <strong>the</strong>se Regulations.<br />
c) The All India Council for technical Education shall <strong>in</strong>clude a specific<br />
condition <strong>in</strong> <strong>the</strong> Utilization Certificate, <strong>in</strong> respect <strong>of</strong> any f<strong>in</strong>ancial assistance<br />
or grants-<strong>in</strong>-aid to any <strong>in</strong>stitution under any <strong>of</strong> <strong>the</strong> general or special schemes<br />
<strong>of</strong> <strong>the</strong> All India Council for technical Education, that <strong>the</strong> <strong>in</strong>stitution has<br />
<strong>com</strong>plied with <strong>the</strong> <strong>anti</strong>-<strong>ragg<strong>in</strong>g</strong> measures.<br />

d) Any <strong>in</strong>cident <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> <strong>in</strong> an <strong>in</strong>stitution shall adversely affect its<br />
accreditation, rank<strong>in</strong>g or grad<strong>in</strong>g by National Board <strong>of</strong> Accreditation or by<br />
any o<strong>the</strong>r authorised accreditation agencies while assess<strong>in</strong>g <strong>the</strong> <strong>in</strong>stitution for<br />
accreditation, rank<strong>in</strong>g or grad<strong>in</strong>g purposes.<br />
e) The All India Council for technical Education shall constitute an Inter-<br />
Council Committee, consist<strong>in</strong>g <strong>of</strong> representatives <strong>of</strong> <strong>the</strong> various Councils,<br />
<strong>the</strong> Non-Governmental agency responsible for monitor<strong>in</strong>g <strong>the</strong> database<br />
ma<strong>in</strong>ta<strong>in</strong>ed by <strong>the</strong> All India Council for technical Education/Central<br />
Government and such o<strong>the</strong>r bodies <strong>in</strong> <strong>higher</strong> education, to coord<strong>in</strong>ate and<br />
monitor <strong>the</strong> <strong>anti</strong>-<strong>ragg<strong>in</strong>g</strong> measures <strong>in</strong> <strong>in</strong>stitutions across <strong>the</strong> country and to<br />
make re<strong>com</strong>mendations from time to time; and shall meet at least once <strong>in</strong> six<br />
months each year.<br />
f) The All India Council for technical Education shall <strong>in</strong>stitute an Anti-Ragg<strong>in</strong>g<br />
Cell with<strong>in</strong> <strong>the</strong> AICTE as an <strong>in</strong>stitutional mechanism to provide secretarial<br />
support for collection <strong>of</strong> <strong>in</strong>formation and monitor<strong>in</strong>g, and to coord<strong>in</strong>ate with<br />
<strong>the</strong> State Level Monitor<strong>in</strong>g Cells and University Level Committees for<br />
effective implementation <strong>of</strong> <strong>anti</strong>-<strong>ragg<strong>in</strong>g</strong> measures, and <strong>the</strong> Cell shall also<br />
coord<strong>in</strong>ate with <strong>the</strong> Non-Governmental agency responsible for monitor<strong>in</strong>g<br />
<strong>the</strong> database ma<strong>in</strong>ta<strong>in</strong>ed by <strong>the</strong> All India Council for technical<br />
Education/central Government.<br />

The follow<strong>in</strong>g Notification will be published <strong>in</strong> <strong>the</strong> Tamil Nadu Government<br />
Gazette Extraord<strong>in</strong>ary, dated <strong>the</strong> 26th day <strong>of</strong> July 1999.<br />
NOTIFICATION<br />
In exercise <strong>of</strong> <strong>the</strong> powers conferred by sub-section (1) <strong>of</strong> section 8 <strong>of</strong> <strong>the</strong> Tamil<br />
Nadu Prohibition <strong>of</strong> Ragg<strong>in</strong>g Act, 1997 (Tamil Nadu Act 7 <strong>of</strong> 1997), <strong>the</strong> Governor <strong>of</strong><br />
Tamil Nadu hereby makes <strong>the</strong> follow<strong>in</strong>g Rules, namely :-<br />
1. Short title and Commencement (1) These Rules may be called <strong>the</strong> Tamil Nadu<br />
Prohibition <strong>of</strong> Ragg<strong>in</strong>g Rules, 99.<br />
(2) They shall <strong>com</strong>e <strong>in</strong>to force on <strong>the</strong> 26th day <strong>of</strong> July 1999.<br />
2. Def<strong>in</strong>ition:- In <strong>the</strong>se rules, unless <strong>the</strong> context o<strong>the</strong>rwise requires-<br />
(a) ‘Act’ means <strong>the</strong> Tamil Nadu Prohibition <strong>of</strong> Ragg<strong>in</strong>g Act, 1997<br />
(Tamil Nadu Act 7 <strong>of</strong> 1997)<br />
(b)<br />
‘Government’ means <strong>the</strong> State Government.<br />
(c)<br />
‘Management’ means <strong>the</strong> head <strong>of</strong> <strong>the</strong> educational <strong>in</strong>stitution or a person<br />
responsible for <strong>the</strong> management <strong>of</strong> <strong>the</strong> educational <strong>in</strong>stitution.<br />
3. Mode <strong>of</strong> giv<strong>in</strong>g <strong>com</strong>pla<strong>in</strong>t:-<br />
The student shall give <strong>the</strong> <strong>com</strong>pla<strong>in</strong>t referred to <strong>in</strong> sub-section (1) <strong>of</strong> section 6 <strong>of</strong><br />
<strong>the</strong> Act <strong>in</strong> writ<strong>in</strong>g to <strong>the</strong> Management with<strong>in</strong> three days from <strong>the</strong> date <strong>of</strong> occurrence <strong>of</strong><br />
<strong>ragg<strong>in</strong>g</strong>.<br />
4. Procedure after receipt <strong>of</strong> <strong>com</strong>pla<strong>in</strong>t:-<br />
On receipt <strong>of</strong> <strong>the</strong> <strong>com</strong>pla<strong>in</strong>t under rule 3 <strong>the</strong> management shall <strong>in</strong>quire <strong>in</strong>to <strong>the</strong><br />
<strong>com</strong>pla<strong>in</strong>t immediately with<strong>in</strong> seventy two hours, ei<strong>the</strong>r by himself or through a senior<br />
teach<strong>in</strong>g staff work<strong>in</strong>g <strong>in</strong> <strong>the</strong> educational <strong>in</strong>stitution. On f<strong>in</strong>alisation <strong>the</strong> <strong>in</strong>quiry, if it is<br />
found that a student or any o<strong>the</strong>r person is guilty <strong>of</strong> <strong>ragg<strong>in</strong>g</strong>, <strong>the</strong> Management shall<br />
make a written <strong>com</strong>pla<strong>in</strong>t with<strong>in</strong> twenty four hours <strong>of</strong> such f<strong>in</strong>alisation, narrat<strong>in</strong>g <strong>the</strong><br />
fur<strong>the</strong>r history <strong>of</strong> <strong>the</strong> case to <strong>the</strong> Police Station hav<strong>in</strong>g jurisdiction over <strong>the</strong> educational
<strong>in</strong>stitution. The <strong>of</strong>ficer <strong>in</strong> charge <strong>of</strong> <strong>the</strong> Police Station shall on receipt <strong>of</strong> <strong>the</strong> said written<br />
<strong>com</strong>pla<strong>in</strong>t, register <strong>the</strong> case and proceed fur<strong>the</strong>r <strong>in</strong> accordance with Law.<br />
5. Report to University, Government Department and Government:-<br />
The Management shall report to <strong>the</strong> University if <strong>the</strong> educational <strong>in</strong>stitution is a college<br />
to which it is affiliated to, and to <strong>the</strong> head <strong>of</strong> <strong>the</strong> Government Department concerned and<br />
also to <strong>the</strong> Government with<strong>in</strong> twenty four hours <strong>of</strong> <strong>the</strong> f<strong>in</strong>alisation <strong>of</strong> <strong>the</strong> <strong>in</strong>quiry under rule<br />
4 about <strong>the</strong> occurence <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> and whe<strong>the</strong>r any <strong>com</strong>pla<strong>in</strong>t has been made to <strong>the</strong> Police<br />
Station.<br />
6. Duty <strong>of</strong> <strong>the</strong> Police Officer:-<br />
All <strong>the</strong> cases <strong>of</strong> conviction made under section 4 <strong>of</strong> <strong>the</strong> Act shall be reported by <strong>the</strong><br />
<strong>of</strong>ficer <strong>in</strong> charge <strong>of</strong> <strong>the</strong> Police Station, where <strong>the</strong> <strong>com</strong>pla<strong>in</strong>t was registered, to <strong>the</strong><br />
Management, <strong>the</strong> University if <strong>the</strong> educational <strong>in</strong>stitution is a college to which it is affiliated<br />
to, and to <strong>the</strong> head <strong>of</strong> <strong>the</strong> Government Department concerned and also to <strong>the</strong> Government.<br />
7. Revocation and treatment <strong>of</strong> period <strong>of</strong> suspension:-<br />
Where <strong>the</strong> student who was placed under suspension based on <strong>the</strong> <strong>com</strong>pla<strong>in</strong>t <strong>of</strong><br />
<strong>ragg<strong>in</strong>g</strong> is ultimately not convicted, <strong>the</strong> Management shall revoke <strong>the</strong> suspension on and <strong>the</strong><br />
period <strong>of</strong> suspension <strong>of</strong> such student shall be treated as if <strong>the</strong> student had attended <strong>the</strong><br />
Classes.<br />

if <strong>the</strong> educational <strong>in</strong>stitution is a college to which it is affiliated to, and to <strong>the</strong> head <strong>of</strong> <strong>the</strong> Government<br />
Department concerned and also to <strong>the</strong> Government.<br />
7. Revocation and treatment <strong>of</strong> period <strong>of</strong> suspension:- Where <strong>the</strong> student who was placed under suspension<br />
based on <strong>the</strong> <strong>com</strong>pla<strong>in</strong>t <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> is ultimately not convicted, <strong>the</strong> Management shall revoke <strong>the</strong> suspension on<br />
and <strong>the</strong> period <strong>of</strong> suspension <strong>of</strong> such student shall be treated as if <strong>the</strong> student had attended <strong>the</strong> Classes.<br />

The follow<strong>in</strong>g Act <strong>of</strong> <strong>the</strong> Tamil Nadu Legislative Assembly received <strong>the</strong> assent <strong>of</strong><br />
<strong>the</strong> Governor on <strong>the</strong> 14 th February 1997 and is hereby published for general<br />
<strong>in</strong>formation:-<br />

An Act to prohibit <strong>ragg<strong>in</strong>g</strong> <strong>in</strong> educational <strong>in</strong>stitutions <strong>in</strong> <strong>the</strong> state <strong>of</strong> Tamil Nadu.<br />
BE it enacted by <strong>the</strong> Legislative Assembly <strong>of</strong> <strong>the</strong> State <strong>of</strong> Tamil Nadu <strong>in</strong> <strong>the</strong><br />
Forty eighth year <strong>of</strong> <strong>the</strong> Republic <strong>of</strong> India as follows: -<br />
1. (1) This Act may be called <strong>the</strong> Tamil Nadu Prohibition <strong>of</strong> Ragg<strong>in</strong>g Act,<br />
1997.<br />
(2) It extends to <strong>the</strong> whole <strong>of</strong> <strong>the</strong> State <strong>of</strong> Tamil Nadu.<br />
(3) It shall be deemed to have <strong>com</strong>e <strong>in</strong>to force on <strong>the</strong> 19 th day <strong>of</strong><br />
December 1996.<br />
2. In this Act unless <strong>the</strong> context o<strong>the</strong>rwise requires, “<strong>ragg<strong>in</strong>g</strong>” means display<br />
<strong>of</strong> noisy, disorderly conduct do<strong>in</strong>g any act which causes or is likely to cause<br />
physical or psychological harm or raise apprehension or fear or shame or<br />
embarrassment to a student <strong>in</strong> any educational <strong>in</strong>stitution and <strong>in</strong>cludes:-<br />
(a) teas<strong>in</strong>g, abus<strong>in</strong>g <strong>of</strong>, play<strong>in</strong>g practical jokes on, or caus<strong>in</strong>g hurt to such<br />
student; or<br />
(b) ask<strong>in</strong>g <strong>the</strong> student to do any act or perform someth<strong>in</strong>g which such student<br />
will not <strong>in</strong> <strong>the</strong> ord<strong>in</strong>ary course will<strong>in</strong>gly do.<br />
3. Ragg<strong>in</strong>g with<strong>in</strong> or without any educational <strong>in</strong>stitution is prohibited<br />
4. Whoever directly or <strong>in</strong>directly <strong>com</strong>mits, participates <strong>in</strong> abets or propagates<br />
“<strong>ragg<strong>in</strong>g</strong>” with<strong>in</strong> or without any educational <strong>in</strong>stitution, shall be punished<br />
with imprisonment for a term which may extend to two years and shall<br />
also be liable to a f<strong>in</strong>e which may extend to ten thousand rupees..<br />
5. Any student convicted <strong>of</strong> an <strong>of</strong>fence under section 4 shall also be<br />
dismissed from <strong>the</strong> educational <strong>in</strong>stitution and such student shall not be<br />
admitted <strong>in</strong> any o<strong>the</strong>r educational <strong>in</strong>stitution.<br />
6. (1) Without prejudice to <strong>the</strong> forego<strong>in</strong>g provisions, whenever any student<br />
<strong>com</strong>pla<strong>in</strong>ts <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> to <strong>the</strong> head <strong>of</strong> an educational <strong>in</strong>stitution, or to any<br />
o<strong>the</strong>r person responsible for <strong>the</strong> management <strong>of</strong> <strong>the</strong> educational <strong>in</strong>stitution,<br />
such head <strong>of</strong> <strong>the</strong> educational <strong>in</strong>stitution or person responsible for <strong>the</strong><br />
management <strong>of</strong> <strong>the</strong> educational <strong>in</strong>stitution shall <strong>in</strong>quire <strong>in</strong>to <strong>the</strong> same<br />
immediately and if found true shall suspend <strong>the</strong> student, who has<br />
<strong>com</strong>mitted <strong>the</strong> <strong>of</strong>fence, from <strong>the</strong> educational <strong>in</strong>stitution.<br />

(2) The decision <strong>of</strong> <strong>the</strong> head <strong>of</strong> <strong>the</strong> educational <strong>in</strong>stitution or <strong>the</strong> person<br />
responsible for <strong>the</strong> management <strong>of</strong> <strong>the</strong> educational <strong>in</strong>stitution that any<br />
student has <strong>in</strong>dulged <strong>in</strong> <strong>ragg<strong>in</strong>g</strong> under sub-section (1) shall be f<strong>in</strong>al.
7. If <strong>the</strong> head <strong>of</strong> <strong>the</strong> educational <strong>in</strong>stitution or <strong>the</strong> person responsible for<br />
<strong>the</strong> management <strong>of</strong> <strong>the</strong> educational <strong>in</strong>stitution fails or neglects to take<br />
action <strong>in</strong> <strong>the</strong> manner specified <strong>in</strong> sub-section (1) <strong>of</strong> section 6 when<br />
<strong>com</strong>pla<strong>in</strong>t <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> is made, such person shall be deemed to have<br />
abetted <strong>the</strong> <strong>of</strong>fence or <strong>ragg<strong>in</strong>g</strong> and shall be punished as provided for <strong>in</strong><br />
section 4.<br />
8. (1) The State Government may make rules for carry<strong>in</strong>g out all or any<br />
<strong>of</strong> <strong>the</strong> purpose <strong>of</strong> this Act.<br />

(2) All rules made under this Act shall be published <strong>in</strong> <strong>the</strong> Tamil<br />
Nadu Government Gazette and unless <strong>the</strong>y are expressed to <strong>com</strong>e <strong>in</strong>to<br />
force on a particular day, shall <strong>com</strong>e <strong>in</strong>to force on <strong>the</strong> day on which <strong>the</strong>y<br />
are so published<br />

(3) Every rule made under <strong>the</strong> Act shall, as soon as possible after it<br />
is made be placed on <strong>the</strong> table <strong>of</strong> <strong>the</strong> Legislative Assembly and if, before<br />
<strong>the</strong> expiry <strong>of</strong> <strong>the</strong> session <strong>in</strong> which it is so placed or <strong>the</strong> next session, <strong>the</strong><br />
Assembly makes any modification <strong>in</strong> any such rule, or <strong>the</strong> Assembly<br />
decides that <strong>the</strong> rule should not be made <strong>the</strong> rule shall <strong>the</strong>reafter have<br />
effect only <strong>in</strong> such modified form or be <strong>of</strong> no effect, as <strong>the</strong> case may be,<br />
so, however, that any such modification or annulment shall be without<br />
prejudice to <strong>the</strong> validity <strong>of</strong> anyth<strong>in</strong>g previously done under <strong>the</strong> rule.<br />
9. (1) The Tamil Nadu Prohibition <strong>of</strong> Ragg<strong>in</strong>g Ord<strong>in</strong>ance, 1996 is<br />
hereby repealed.<br />
(2) Not withstand<strong>in</strong>g such repeal, anyth<strong>in</strong>g done or any action<br />
taken under <strong>the</strong> ord<strong>in</strong>ance shall be deemed to have been<br />
done or taken under this Act.<br />

PREAMBLE.<br />
In view <strong>of</strong> <strong>the</strong> directions <strong>of</strong> <strong>the</strong> Hon’ble Supreme Court <strong>in</strong> <strong>the</strong> matter <strong>of</strong> “University <strong>of</strong> Kerala<br />
v/s. Council, Pr<strong>in</strong>cipals, Colleges and o<strong>the</strong>rs” <strong>in</strong> SLP no. 24295 <strong>of</strong> 2006 dated 16.05.2007 and that<br />
dated 8.05.2009 <strong>in</strong> Civil Appeal number 887 <strong>of</strong> 2009, and <strong>in</strong> consideration <strong>of</strong> <strong>the</strong> determ<strong>in</strong>ation <strong>of</strong> <strong>the</strong><br />
Central Government and <strong>the</strong> University Grants Commission to prohibit, prevent and elim<strong>in</strong>ate <strong>the</strong><br />
scourge <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> <strong>in</strong>clud<strong>in</strong>g any conduct by any student or students whe<strong>the</strong>r by words spoken or<br />
written or by an act which has <strong>the</strong> effect <strong>of</strong> teas<strong>in</strong>g, treat<strong>in</strong>g or handl<strong>in</strong>g with rudeness a fresher or<br />
any o<strong>the</strong>r student, or <strong>in</strong>dulg<strong>in</strong>g <strong>in</strong> rowdy or <strong>in</strong>discipl<strong>in</strong>ed activities by any student or students which<br />
causes or is likely to cause annoyance, hardship or psychological harm or to raise fear or<br />
apprehension <strong>the</strong>re<strong>of</strong> <strong>in</strong> any fresher or any o<strong>the</strong>r student or ask<strong>in</strong>g any student to do any act which<br />
such student will not <strong>in</strong> <strong>the</strong> ord<strong>in</strong>ary course do and which has <strong>the</strong> effect <strong>of</strong> caus<strong>in</strong>g or generat<strong>in</strong>g a<br />
sense <strong>of</strong> shame, or torment or embarrassment so as to adversely affect <strong>the</strong> physique or psyche <strong>of</strong><br />
such fresher or any o<strong>the</strong>r student, with or without an <strong>in</strong>tent to derive a sadistic pleasure or show<strong>in</strong>g<br />
<strong>of</strong>f power, authority or superiority by a student over any fresher or any o<strong>the</strong>r student, <strong>in</strong> all <strong>higher</strong><br />
education <strong>in</strong>stitutions <strong>in</strong> <strong>the</strong> country, and <strong>the</strong>reby, to provide for <strong>the</strong> healthy development, physically<br />
and psychologically, <strong>of</strong> all students, <strong>the</strong> University Grants Commission, <strong>in</strong> consultation with <strong>the</strong><br />
Councils, br<strong>in</strong>gs forth this Regulation.<br />
In exercise <strong>of</strong> <strong>the</strong> powers conferred by Clause (g) <strong>of</strong> sub-section (1) <strong>of</strong> Section 26 <strong>of</strong> <strong>the</strong><br />
University Grants Commission Act, 1956, <strong>the</strong> University Grants Commission hereby makes <strong>the</strong><br />
follow<strong>in</strong>g Regulations, namely;<br />
1. Title, <strong>com</strong>mencement and applicability.-<br />
1.1 These regulations shall be called <strong>the</strong> “UGC Regulations on Curb<strong>in</strong>g <strong>the</strong> Menace <strong>of</strong> Ragg<strong>in</strong>g <strong>in</strong><br />
Higher Educational Institutions, 2009”.
1.2 They shall <strong>com</strong>e <strong>in</strong>to force from <strong>the</strong> date <strong>of</strong> <strong>the</strong>ir publication <strong>in</strong> <strong>the</strong> Official Gazette.<br />
1 They shall apply to all <strong>the</strong> <strong>in</strong>stitutions <strong>com</strong><strong>in</strong>g with<strong>in</strong> <strong>the</strong> def<strong>in</strong>ition <strong>of</strong> an University under<br />
sub-section (f) <strong>of</strong> section (2) <strong>of</strong> <strong>the</strong> University Grants Commission Act, 1956, and to all <strong>in</strong>stitutions<br />
deemed to be a university under Section 3 <strong>of</strong> <strong>the</strong> University Grants Commission Act, 1956, to all o<strong>the</strong>r<br />
<strong>higher</strong> educational <strong>in</strong>stitutions, or elements <strong>of</strong> such universities or <strong>in</strong>stitutions, <strong>in</strong>clud<strong>in</strong>g its<br />
departments, constituent units and all <strong>the</strong> premises, whe<strong>the</strong>r be<strong>in</strong>g academic, residential,<br />
playgrounds, canteen, or o<strong>the</strong>r such premises <strong>of</strong> such universities, deemed universities and <strong>higher</strong><br />
educational <strong>in</strong>stitutions, whe<strong>the</strong>r located with<strong>in</strong> <strong>the</strong> campus or outside, and to all means <strong>of</strong><br />
transportation <strong>of</strong> students, whe<strong>the</strong>r public or private, accessed by students for <strong>the</strong> pursuit <strong>of</strong> studies<br />
<strong>in</strong> such universities, deemed universities and <strong>higher</strong> educational <strong>in</strong>stitutions.<br />
2 Objectives.-<br />
To prohibit any conduct by any student or students whe<strong>the</strong>r by words spoken or written or by<br />
an act which has <strong>the</strong> effect <strong>of</strong> teas<strong>in</strong>g, treat<strong>in</strong>g or handl<strong>in</strong>g with rudeness a fresher or any o<strong>the</strong>r<br />
student, or <strong>in</strong>dulg<strong>in</strong>g <strong>in</strong> rowdy or <strong>in</strong>discipl<strong>in</strong>ed activities by any student or students which causes or is<br />

all its forms from universities, deemed universities and o<strong>the</strong>r <strong>higher</strong> educational <strong>in</strong>stitutions <strong>in</strong> <strong>the</strong><br />
country by prohibit<strong>in</strong>g it under <strong>the</strong>se Regulations, prevent<strong>in</strong>g its occurrence and punish<strong>in</strong>g those who<br />
<strong>in</strong>dulge <strong>in</strong> <strong>ragg<strong>in</strong>g</strong> as provided for <strong>in</strong> <strong>the</strong>se Regulations and <strong>the</strong> appropriate law <strong>in</strong> force.<br />
3. What constitutes Ragg<strong>in</strong>g.- Ragg<strong>in</strong>g constitutes one or more <strong>of</strong> any <strong>of</strong> <strong>the</strong> follow<strong>in</strong>g acts:<br />
a. any conduct by any student or students whe<strong>the</strong>r by words spoken or written or by an<br />
act which has <strong>the</strong> effect <strong>of</strong> teas<strong>in</strong>g, treat<strong>in</strong>g or handl<strong>in</strong>g with rudeness a fresher or any o<strong>the</strong>r student;<br />
b. <strong>in</strong>dulg<strong>in</strong>g <strong>in</strong> rowdy or <strong>in</strong>discipl<strong>in</strong>ed activities by any student or students which causes<br />
or is likely to cause annoyance, hardship, physical or psychological harm or to raise fear or<br />
apprehension <strong>the</strong>re<strong>of</strong> <strong>in</strong> any fresher or any o<strong>the</strong>r student;<br />
c. ask<strong>in</strong>g any student to do any act which such student will not <strong>in</strong> <strong>the</strong> ord<strong>in</strong>ary course do<br />
and which has <strong>the</strong> effect <strong>of</strong> caus<strong>in</strong>g or generat<strong>in</strong>g a sense <strong>of</strong> shame, or torment or embarrassment<br />
so as to adversely affect <strong>the</strong> physique or psyche <strong>of</strong> such fresher or any o<strong>the</strong>r student;<br />
d. any act by a senior student that prevents, disrupts or disturbs <strong>the</strong> regular academic<br />
activity <strong>of</strong> any o<strong>the</strong>r student or a fresher;<br />
e. exploit<strong>in</strong>g <strong>the</strong> services <strong>of</strong> a fresher or any o<strong>the</strong>r student for <strong>com</strong>plet<strong>in</strong>g <strong>the</strong> academic<br />
tasks assigned to an <strong>in</strong>dividual or a group <strong>of</strong> students.<br />
f. any act <strong>of</strong> f<strong>in</strong>ancial extortion or forceful expenditure burden put on a fresher or any<br />
o<strong>the</strong>r student by students;<br />
g. any act <strong>of</strong> physical abuse <strong>in</strong>clud<strong>in</strong>g all variants <strong>of</strong> it: sexual abuse, homosexual<br />
assaults, stripp<strong>in</strong>g, forc<strong>in</strong>g obscene and lewd acts, gestures, caus<strong>in</strong>g bodily harm or any o<strong>the</strong>r danger<br />
to health or person;<br />
h. any act or abuse by spoken words, emails, post, public <strong>in</strong>sults which would also <strong>in</strong>clude<br />
deriv<strong>in</strong>g perverted pleasure, vicarious or sadistic thrill from actively or passively participat<strong>in</strong>g <strong>in</strong> <strong>the</strong>
dis<strong>com</strong>fiture to fresher or any o<strong>the</strong>r student ;<br />
i. any act that affects <strong>the</strong> mental health and self-confidence <strong>of</strong> a fresher or any<br />
o<strong>the</strong>r student with or without an <strong>in</strong>tent to derive a sadistic pleasure or show<strong>in</strong>g <strong>of</strong>f power,<br />
authority or superiority by a student over any fresher or any o<strong>the</strong>r student.<br />
4. Def<strong>in</strong>itions.-<br />
1) In <strong>the</strong>se regulations unless <strong>the</strong> context o<strong>the</strong>rwise requires,-a) “Act” means, <strong>the</strong> University Grants<br />
Commission Act, 1956 (3 <strong>of</strong> 1956); b) “Academic year” means <strong>the</strong> period from <strong>the</strong><br />
<strong>com</strong>mencement <strong>of</strong> admission <strong>of</strong> students <strong>in</strong> any course <strong>of</strong> study <strong>in</strong> <strong>the</strong> <strong>in</strong>stitution up to <strong>the</strong><br />
<strong>com</strong>pletion <strong>of</strong> academic requirements for that particular year. c) “Anti-Ragg<strong>in</strong>g Helpl<strong>in</strong>e”<br />
means <strong>the</strong> Helpl<strong>in</strong>e established under clause (a) <strong>of</strong> Regulation 8.1 <strong>of</strong> <strong>the</strong>se Regulations. d)<br />
“Commission” means <strong>the</strong> University Grants Commission; e) “Council” means a body so<br />
constituted by an Act <strong>of</strong> Parliament or an Act <strong>of</strong> any State Legislature for sett<strong>in</strong>g, or<br />
co-ord<strong>in</strong>at<strong>in</strong>g or ma<strong>in</strong>ta<strong>in</strong><strong>in</strong>g standards <strong>in</strong> <strong>the</strong> relevant areas <strong>of</strong> <strong>higher</strong> education, such as <strong>the</strong><br />
All India Council for Technical Education (AICTE), <strong>the</strong> Bar Council <strong>of</strong> India (BCI), <strong>the</strong> Dental<br />
Council <strong>of</strong> India (DCI), <strong>the</strong> Distance Education Council (DEC), <strong>the</strong> Indian Council <strong>of</strong><br />
Agricultural Research (ICAR), <strong>the</strong> Indian Nurs<strong>in</strong>g Council (INC), <strong>the</strong> Medical Council <strong>of</strong> India<br />
(MCI), <strong>the</strong> National Council for Teacher Education (NCTE), <strong>the</strong> Pharmacy Council <strong>of</strong> India<br />
(PCI), etc. and <strong>the</strong> State Higher Education Councils. f) “District Level Anti-Ragg<strong>in</strong>g Committee”<br />
means <strong>the</strong> Committee, headed by <strong>the</strong> District Magistrate, constituted by <strong>the</strong> State<br />
Government, for <strong>the</strong> control and elim<strong>in</strong>ation <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> <strong>in</strong> <strong>in</strong>stitutions with<strong>in</strong> <strong>the</strong> jurisdiction <strong>of</strong><br />
<strong>the</strong> district. g) “Head <strong>of</strong> <strong>the</strong> <strong>in</strong>stitution” means <strong>the</strong> Vice-Chancellor <strong>in</strong> case <strong>of</strong> a university or a<br />
deemed to be university, <strong>the</strong> Pr<strong>in</strong>cipal or <strong>the</strong> Director or such o<strong>the</strong>r designation as <strong>the</strong><br />
executive head <strong>of</strong> <strong>the</strong> <strong>in</strong>stitution or <strong>the</strong> college is referred. h) “Fresher” means a student who<br />
has been admitted to an <strong>in</strong>stitution and who is undergo<strong>in</strong>g his/her first year <strong>of</strong> study <strong>in</strong> such<br />
<strong>in</strong>stitution. i) “Institution” means a <strong>higher</strong> educational <strong>in</strong>stitution <strong>in</strong>clud<strong>in</strong>g, but not limited to<br />
an university, a deemed to be university, a college, an <strong>in</strong>stitute, an <strong>in</strong>stitution <strong>of</strong> national<br />
importance set up by an Act <strong>of</strong> Parliament or a constituent unit <strong>of</strong> such <strong>in</strong>stitution, impart<strong>in</strong>g<br />
<strong>higher</strong> education beyond 12 years <strong>of</strong> school<strong>in</strong>g lead<strong>in</strong>g to, but not necessarily culm<strong>in</strong>at<strong>in</strong>g <strong>in</strong>, a<br />
degree (graduate, postgraduate and/or <strong>higher</strong> level) and/or to a university diploma.<br />
j) “NAAC” means <strong>the</strong> National Academic and Accreditation Council established by <strong>the</strong><br />
Commission under section 12(ccc) <strong>of</strong> <strong>the</strong> Act; k) “State Level Monitor<strong>in</strong>g Cell” means <strong>the</strong> body<br />
constituted by <strong>the</strong> State Government for <strong>the</strong> control and elim<strong>in</strong>ation <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> <strong>in</strong> <strong>in</strong>stitutions<br />
with<strong>in</strong> <strong>the</strong> jurisdiction <strong>of</strong> <strong>the</strong> State, established under a State Law or on <strong>the</strong> advice <strong>of</strong> <strong>the</strong><br />
Central Government, as <strong>the</strong> case may be.<br />
(2) Words and expressions used and not def<strong>in</strong>ed here<strong>in</strong> but def<strong>in</strong>ed <strong>in</strong> <strong>the</strong> Act or <strong>in</strong> <strong>the</strong> General
Clauses Act, 1897, shall have <strong>the</strong> mean<strong>in</strong>gs respectively assigned to <strong>the</strong>m <strong>in</strong> <strong>the</strong> Act or <strong>in</strong> <strong>the</strong> General<br />
Clauses Act, 1897, as <strong>the</strong> case may be.<br />
5. Measures for prohibition <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> at <strong>the</strong> <strong>in</strong>stitution level:-<br />
a) No <strong>in</strong>stitution or any part <strong>of</strong> it <strong>the</strong>re<strong>of</strong>, <strong>in</strong>clud<strong>in</strong>g its elements, <strong>in</strong>clud<strong>in</strong>g, but not limited<br />
to, <strong>the</strong> departments, constituent units, colleges, centres <strong>of</strong> studies and all its premises,<br />
whe<strong>the</strong>r academic, residential, playgrounds, or canteen, whe<strong>the</strong>r located with<strong>in</strong> <strong>the</strong><br />
campus or outside, and <strong>in</strong> all means <strong>of</strong> transportation <strong>of</strong> students, whe<strong>the</strong>r public or<br />
private, accessed by students for <strong>the</strong> pursuit <strong>of</strong> studies <strong>in</strong> such <strong>in</strong>stitutions, shall<br />
permit or condone any reported <strong>in</strong>cident <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> <strong>in</strong> any form; and all <strong>in</strong>stitutions<br />
shall take all necessary and required measures, <strong>in</strong>clud<strong>in</strong>g but not limited to <strong>the</strong><br />
provisions <strong>of</strong> <strong>the</strong>se Regulations, to achieve <strong>the</strong> objective <strong>of</strong> elim<strong>in</strong>at<strong>in</strong>g <strong>ragg<strong>in</strong>g</strong>, with<strong>in</strong><br />
<strong>the</strong> <strong>in</strong>stitution or outside,<br />
b) All <strong>in</strong>stitutions shall take action <strong>in</strong> accordance with <strong>the</strong>se Regulations aga<strong>in</strong>st those<br />
found guilty <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> and/or abett<strong>in</strong>g <strong>ragg<strong>in</strong>g</strong>, actively or passively, or be<strong>in</strong>g part <strong>of</strong><br />
a conspiracy to promote <strong>ragg<strong>in</strong>g</strong>.<br />
6 Measures for prevention <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> at <strong>the</strong> <strong>in</strong>stitution level.-<br />
6.1 An <strong>in</strong>stitution shall take <strong>the</strong> follow<strong>in</strong>g steps <strong>in</strong> regard to admission or registration <strong>of</strong> students;<br />
namely, a) Every public declaration <strong>of</strong> <strong>in</strong>tent by any <strong>in</strong>stitution, <strong>in</strong> any electronic, audiovisual<br />
or pr<strong>in</strong>t or any o<strong>the</strong>r media, for admission <strong>of</strong> students to any course <strong>of</strong> study shall<br />
expressly provide that <strong>ragg<strong>in</strong>g</strong> is totally prohibited <strong>in</strong> <strong>the</strong> <strong>in</strong>stitution, and anyone found guilty<br />
<strong>of</strong> <strong>ragg<strong>in</strong>g</strong> and/or abett<strong>in</strong>g <strong>ragg<strong>in</strong>g</strong>, whe<strong>the</strong>r actively or passively, or be<strong>in</strong>g a part <strong>of</strong> a<br />
conspiracy to promote <strong>ragg<strong>in</strong>g</strong>, is liable to be punished <strong>in</strong> accordance with <strong>the</strong>se Regulations<br />
as well as under <strong>the</strong> provisions <strong>of</strong> any penal law for <strong>the</strong> time be<strong>in</strong>g <strong>in</strong> force.<br />
b) The brochure <strong>of</strong> admission/<strong>in</strong>struction booklet or <strong>the</strong> prospectus, whe<strong>the</strong>r <strong>in</strong> pr<strong>in</strong>t or<br />
electronic format, shall prom<strong>in</strong>ently pr<strong>in</strong>t <strong>the</strong>se Regulations <strong>in</strong> full. Provided that <strong>the</strong><br />
<strong>in</strong>stitution shall also draw attention to any law concern<strong>in</strong>g <strong>ragg<strong>in</strong>g</strong> and its consequences, as<br />
may be applicable to <strong>the</strong> <strong>in</strong>stitution publish<strong>in</strong>g such brochure <strong>of</strong> admission/<strong>in</strong>struction<br />
booklet or <strong>the</strong> prospectus. Provided fur<strong>the</strong>r that <strong>the</strong> telephone numbers <strong>of</strong> <strong>the</strong> Anti-Ragg<strong>in</strong>g<br />
Helpl<strong>in</strong>e and all <strong>the</strong> important functionaries <strong>in</strong> <strong>the</strong> <strong>in</strong>stitution, <strong>in</strong>clud<strong>in</strong>g but not limited to <strong>the</strong><br />
Head <strong>of</strong> <strong>the</strong> <strong>in</strong>stitution, faculty members, members <strong>of</strong> <strong>the</strong> Anti-Ragg<strong>in</strong>g Committees and<br />
Anti-Ragg<strong>in</strong>g Squads, District and Sub-Divisional authorities, Wardens <strong>of</strong> hostels, and o<strong>the</strong>r
functionaries or authorities where relevant, shall be published <strong>in</strong> <strong>the</strong> brochure <strong>of</strong><br />
admission/<strong>in</strong>struction booklet or <strong>the</strong> prospectus.<br />
c) Where an <strong>in</strong>stitution is affiliated to a University and publishes a brochure <strong>of</strong><br />
admission/<strong>in</strong>struction booklet or a prospectus, <strong>the</strong> affiliat<strong>in</strong>g university shall ensure that<br />
<strong>the</strong> affiliated <strong>in</strong>stitution shall <strong>com</strong>ply with <strong>the</strong> provisions <strong>of</strong> clause (a) and clause (b) <strong>of</strong><br />
Regulation 6.1 <strong>of</strong> <strong>the</strong>se Regulations.<br />
d) The application form for admission, enrolment or registration shall conta<strong>in</strong> an affidavit,<br />
mandatorily <strong>in</strong> English and <strong>in</strong> H<strong>in</strong>di and/or <strong>in</strong> one <strong>of</strong> <strong>the</strong> regional languages known to <strong>the</strong><br />
applicant, as provided <strong>in</strong> <strong>the</strong> English language <strong>in</strong> Annexure I to <strong>the</strong>se Regulations, to be filled<br />
up and signed by <strong>the</strong> applicant to <strong>the</strong> effect that he/she has read and understood <strong>the</strong> provisions<br />
<strong>of</strong> <strong>the</strong>se Regulations as well as <strong>the</strong> provisions <strong>of</strong> any o<strong>the</strong>r law for <strong>the</strong> time be<strong>in</strong>g <strong>in</strong> force, and is<br />
aware <strong>of</strong> <strong>the</strong> prohibition <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> and <strong>the</strong> punishments prescribed, both under penal laws as<br />
well as under <strong>the</strong>se Regulations and also affirm to <strong>the</strong> effect that he/she has not been expelled<br />
and/or debarred by any <strong>in</strong>stitution and fur<strong>the</strong>r aver that he/she would not <strong>in</strong>dulge, actively or<br />
passively, <strong>in</strong> <strong>the</strong> act or abet <strong>the</strong> act <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> and if found guilty <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> and/or abett<strong>in</strong>g<br />
<strong>ragg<strong>in</strong>g</strong>, is liable to be proceeded aga<strong>in</strong>st under <strong>the</strong>se Regulations or under any penal law or any<br />
o<strong>the</strong>r law for <strong>the</strong> time be<strong>in</strong>g <strong>in</strong> force and such action would <strong>in</strong>clude but is not limited to<br />
debarment or expulsion <strong>of</strong> such student.<br />
e) The application form for admission, enrolment or registration shall conta<strong>in</strong> an affidavit,<br />
mandatorily <strong>in</strong> English and <strong>in</strong> H<strong>in</strong>di and/or <strong>in</strong> one <strong>of</strong> <strong>the</strong> regional languages known to <strong>the</strong><br />
parents/guardians <strong>of</strong> <strong>the</strong> applicant, as provided <strong>in</strong> <strong>the</strong> English language <strong>in</strong> Annexure I to<br />
<strong>the</strong>se Regulations, to be filled up and signed by <strong>the</strong> parents/guardians <strong>of</strong> <strong>the</strong> applicant to <strong>the</strong><br />
effect that he/she has read and understood <strong>the</strong> provisions <strong>of</strong> <strong>the</strong>se Regulations as well as <strong>the</strong><br />
provisions <strong>of</strong> any o<strong>the</strong>r law for <strong>the</strong> time be<strong>in</strong>g <strong>in</strong> force, and is aware <strong>of</strong> <strong>the</strong> prohibition <strong>of</strong> <strong>ragg<strong>in</strong>g</strong><br />
and <strong>the</strong> punishments prescribed, both under penal laws as well as under <strong>the</strong>se Regulations and<br />
also affirm to <strong>the</strong> effect that his/her ward has not been expelled and/or debarred by any<br />
<strong>in</strong>stitution and fur<strong>the</strong>r aver that his/her ward would not <strong>in</strong>dulge, actively or passively, <strong>in</strong> <strong>the</strong> act or<br />
abet <strong>the</strong> act <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> and if found guilty <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> and/or abett<strong>in</strong>g <strong>ragg<strong>in</strong>g</strong>, his/her ward is<br />
liable to be proceeded aga<strong>in</strong>st under <strong>the</strong>se Regulations or under any penal law or any o<strong>the</strong>r law<br />
for <strong>the</strong> time be<strong>in</strong>g <strong>in</strong> force and such action would <strong>in</strong>clude but is not limited to debarment or<br />
expulsion <strong>of</strong> his/her ward.<br />
f) The application for admission shall be ac<strong>com</strong>panied by a document <strong>in</strong> <strong>the</strong> form <strong>of</strong>, or<br />
annexed to, <strong>the</strong> School Leav<strong>in</strong>g Certificate/Transfer Certificate/Migration<br />
Certificate/Character Certificate report<strong>in</strong>g on <strong>the</strong> <strong>in</strong>ter-personal/social behavioural pattern<br />
<strong>of</strong> <strong>the</strong> applicant, to be issued by <strong>the</strong> school or <strong>in</strong>stitution last attended by <strong>the</strong> applicant,
so that <strong>the</strong> <strong>in</strong>stitution can <strong>the</strong>reafter keep watch on <strong>the</strong> applicant, if admitted, whose<br />
behaviour has been <strong>com</strong>mented <strong>in</strong> such document.<br />
g) A student seek<strong>in</strong>g admission to a hostel form<strong>in</strong>g part <strong>of</strong> <strong>the</strong> <strong>in</strong>stitution, or seek<strong>in</strong>g to<br />
reside <strong>in</strong> any temporary premises not form<strong>in</strong>g part <strong>of</strong> <strong>the</strong> <strong>in</strong>stitution, <strong>in</strong>clud<strong>in</strong>g a private<br />
<strong>com</strong>mercially managed lodge or hostel, shall have to submit additional affidavits<br />
countersigned by his/her parents/guardians <strong>in</strong> <strong>the</strong> form prescribed <strong>in</strong> Annexure I and<br />
Annexure II to <strong>the</strong>se Regulations respectively along with his/her application.<br />
h) Before <strong>the</strong> <strong>com</strong>mencement <strong>of</strong> <strong>the</strong> academic session <strong>in</strong> any <strong>in</strong>stitution, <strong>the</strong> Head <strong>of</strong> <strong>the</strong><br />
Institution shall convene and address a meet<strong>in</strong>g <strong>of</strong> various functionaries/agencies, such as<br />
Hostel Wardens, representatives <strong>of</strong> students, parents/ guardians, faculty, district<br />
adm<strong>in</strong>istration <strong>in</strong>clud<strong>in</strong>g <strong>the</strong> police, to discuss <strong>the</strong> measures to be taken to prevent <strong>ragg<strong>in</strong>g</strong> <strong>in</strong> <strong>the</strong><br />
<strong>in</strong>stitution and steps to be taken to identify those <strong>in</strong>dulg<strong>in</strong>g <strong>in</strong> or abett<strong>in</strong>g <strong>ragg<strong>in</strong>g</strong> and punish<br />
<strong>the</strong>m.<br />
i) The <strong>in</strong>stitution shall, to make <strong>the</strong> <strong>com</strong>munity at large and <strong>the</strong> students <strong>in</strong> particular aware<br />
<strong>of</strong> <strong>the</strong> dehumaniz<strong>in</strong>g effect <strong>of</strong> <strong>ragg<strong>in</strong>g</strong>, and <strong>the</strong> approach <strong>of</strong> <strong>the</strong> <strong>in</strong>stitution towards those<br />
<strong>in</strong>dulg<strong>in</strong>g <strong>in</strong> <strong>ragg<strong>in</strong>g</strong>, prom<strong>in</strong>ently display posters depict<strong>in</strong>g <strong>the</strong> provisions <strong>of</strong> penal law<br />
applicable to <strong>in</strong>cidents <strong>of</strong> <strong>ragg<strong>in</strong>g</strong>, and <strong>the</strong> provisions <strong>of</strong> <strong>the</strong>se Regulations and also any<br />
o<strong>the</strong>r law for <strong>the</strong> time be<strong>in</strong>g <strong>in</strong> force, and <strong>the</strong> punishments <strong>the</strong>re<strong>of</strong>, shall be prom<strong>in</strong>ently<br />
displayed on Notice Boards <strong>of</strong> all departments, hostels and o<strong>the</strong>r build<strong>in</strong>gs as well as at<br />
places, where students normally ga<strong>the</strong>r and at places, known to be vulnerable to<br />
occurrences <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> <strong>in</strong>cidents.<br />
j) The <strong>in</strong>stitution shall request <strong>the</strong> media to give adequate publicity to <strong>the</strong> law prohibit<strong>in</strong>g<br />
<strong>ragg<strong>in</strong>g</strong> and <strong>the</strong> negative aspects <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> and <strong>the</strong> <strong>in</strong>stitution’s resolve to ban <strong>ragg<strong>in</strong>g</strong><br />
and punish those found guilty without fear or favour.<br />
k) The <strong>in</strong>stitution shall identify, properly illum<strong>in</strong>ate and keep a close watch on all locations<br />
known to be vulnerable to occurrences <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> <strong>in</strong>cidents.<br />
l) The <strong>in</strong>stitution shall tighten security <strong>in</strong> its premises, especially at vulnerable places and<br />
<strong>in</strong>tense polic<strong>in</strong>g by Anti-Ragg<strong>in</strong>g Squad, referred to <strong>in</strong> <strong>the</strong>se Regulations and volunteers, if<br />
any, shall be resorted to at such po<strong>in</strong>ts at odd hours dur<strong>in</strong>g <strong>the</strong> first few months <strong>of</strong> <strong>the</strong><br />
academic session.<br />
m) The <strong>in</strong>stitution shall utilize <strong>the</strong> vacation period before <strong>the</strong> start <strong>of</strong> <strong>the</strong> new academic year to<br />
launch a publicity campaign aga<strong>in</strong>st <strong>ragg<strong>in</strong>g</strong> through posters, leaflets and such o<strong>the</strong>r means, as<br />
may be desirable or required, to promote <strong>the</strong> objectives <strong>of</strong> <strong>the</strong>se Regulations.<br />
n) The faculties/departments/units <strong>of</strong> <strong>the</strong> <strong>in</strong>stitution shall have <strong>in</strong>duction arrangements,<br />
<strong>in</strong>clud<strong>in</strong>g those which <strong>anti</strong>cipate, identify and plan to meet any special needs <strong>of</strong> any
specific section <strong>of</strong> students, <strong>in</strong> place well <strong>in</strong> advance <strong>of</strong> <strong>the</strong> beg<strong>in</strong>n<strong>in</strong>g <strong>of</strong> <strong>the</strong> academic<br />
year with an aim to promote <strong>the</strong> objectives <strong>of</strong> this Regulation.<br />
o) Every <strong>in</strong>stitution shall engage or seek <strong>the</strong> assistance <strong>of</strong> pr<strong>of</strong>essional counsellors before <strong>the</strong><br />
<strong>com</strong>mencement <strong>of</strong> <strong>the</strong> academic session, to be available when required by <strong>the</strong> <strong>in</strong>stitution, for<br />
<strong>the</strong> purposes <strong>of</strong> <strong>of</strong>fer<strong>in</strong>g counsell<strong>in</strong>g to freshers and to o<strong>the</strong>r students after <strong>the</strong> <strong>com</strong>mencement <strong>of</strong><br />
<strong>the</strong> academic year.<br />
p) The head <strong>of</strong> <strong>the</strong> <strong>in</strong>stitution shall provide <strong>in</strong>formation to <strong>the</strong> local police and local<br />
authorities, <strong>the</strong> details <strong>of</strong> every privately <strong>com</strong>mercially managed hostels or lodges<br />
used for residential purposes by students enrolled <strong>in</strong> <strong>the</strong> <strong>in</strong>stitution and <strong>the</strong> head <strong>of</strong><br />
<strong>the</strong> <strong>in</strong>stitution shall also ensure that <strong>the</strong> Anti-Ragg<strong>in</strong>g Squad shall ensure vigil <strong>in</strong> such<br />
locations to prevent <strong>the</strong> occurrence <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> <strong>the</strong>re<strong>in</strong>.<br />
6.2 An <strong>in</strong>stitution shall, on admission or enrolment or registration <strong>of</strong> students, take<br />
<strong>the</strong> follow<strong>in</strong>g steps, namely; a) Every fresh student admitted to <strong>the</strong> <strong>in</strong>stitution<br />
shall be given a pr<strong>in</strong>ted leaflet detail<strong>in</strong>g to whom he/she has to turn to for help<br />
and guidance for various purposes <strong>in</strong>clud<strong>in</strong>g addresses and telephone numbers,<br />
so as to enable <strong>the</strong> student to contact <strong>the</strong> concerned person at any time, if and<br />
when required, <strong>of</strong> <strong>the</strong> Anti-Ragg<strong>in</strong>g Helpl<strong>in</strong>e referred to <strong>in</strong> <strong>the</strong>se Regulations,<br />
Wardens, Head <strong>of</strong> <strong>the</strong> <strong>in</strong>stitution, all members <strong>of</strong> <strong>the</strong> <strong>anti</strong>-<strong>ragg<strong>in</strong>g</strong> squads and<br />
<strong>com</strong>mittees, relevant district and police authorities. b) The <strong>in</strong>stitution, through <strong>the</strong><br />
leaflet specified <strong>in</strong> clause (a) <strong>of</strong> Regulation 6.2 <strong>of</strong> <strong>the</strong>se Regulations shall expla<strong>in</strong><br />
to <strong>the</strong> freshers, <strong>the</strong> arrangements made for <strong>the</strong>ir <strong>in</strong>duction and orientation which<br />
promote efficient and effective means <strong>of</strong> <strong>in</strong>tegrat<strong>in</strong>g <strong>the</strong>m fully as students with<br />
those already admitted o <strong>the</strong> <strong>in</strong>stitution <strong>in</strong> earlier years. c) The leaflet specified <strong>in</strong><br />
clause (a) <strong>of</strong> Regulation 6.2 <strong>of</strong> <strong>the</strong>se Regulations shall <strong>in</strong>form <strong>the</strong> freshers about<br />
<strong>the</strong>ir rights as bona fide students <strong>of</strong> <strong>the</strong> <strong>in</strong>stitution and clearly <strong>in</strong>struct<strong>in</strong>g <strong>the</strong>m<br />
that <strong>the</strong>y should desist from do<strong>in</strong>g anyth<strong>in</strong>g, with or aga<strong>in</strong>st <strong>the</strong>ir will, even if<br />
ordered to by <strong>the</strong> seniors students, and that any attempt <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> shall be<br />
promptly reported to <strong>the</strong> Anti-<strong>ragg<strong>in</strong>g</strong> Squad or to <strong>the</strong> Warden or to <strong>the</strong> Head <strong>of</strong><br />
<strong>the</strong> <strong>in</strong>stitution, as <strong>the</strong> case may be.<br />
d) The leaflet specified <strong>in</strong> clause (a) <strong>of</strong> Regulation 6.2 <strong>of</strong> <strong>the</strong>se Regulations shall conta<strong>in</strong><br />
a calendar <strong>of</strong> events and activities laid down by <strong>the</strong> <strong>in</strong>stitution to facilitate and<br />
<strong>com</strong>plement familiarization <strong>of</strong> freshers with <strong>the</strong> academic environment <strong>of</strong> <strong>the</strong><br />
<strong>in</strong>stitution.<br />
e) The <strong>in</strong>stitution shall, on <strong>the</strong> arrival <strong>of</strong> senior students after <strong>the</strong> first week or after <strong>the</strong>
second week, as <strong>the</strong> case may be, schedule orientation programmes as follows, namely;<br />
(i) jo<strong>in</strong>t sensitization programme and counsell<strong>in</strong>g <strong>of</strong> both freshers and senior students by<br />
a pr<strong>of</strong>essional counsellor, referred to <strong>in</strong> clause<br />
(o) <strong>of</strong> Regulation 6.1 <strong>of</strong> <strong>the</strong>se Regulations; (ii) jo<strong>in</strong>t orientation programme <strong>of</strong> freshers and<br />
seniors to be addressed by <strong>the</strong> Head <strong>of</strong> <strong>the</strong> <strong>in</strong>stitution and <strong>the</strong> <strong>anti</strong> -<strong>ragg<strong>in</strong>g</strong> <strong>com</strong>mittee;(iii)<br />
organization on a large scale <strong>of</strong> cultural, sports and o<strong>the</strong>r activities to provide a platform for <strong>the</strong><br />
freshers and seniors to <strong>in</strong>teract <strong>in</strong> <strong>the</strong> presence <strong>of</strong> faculty members ; (iv) <strong>in</strong> <strong>the</strong> hostel, <strong>the</strong> warden<br />
should address all students; and may request two junior colleagues from <strong>the</strong> college faculty to<br />
assist <strong>the</strong> warden by be<strong>com</strong><strong>in</strong>g resident tutors for a temporary duration.(v) as far as possible<br />
faculty members should d<strong>in</strong>e with <strong>the</strong> hostel residents <strong>in</strong> <strong>the</strong>ir respective hostels to <strong>in</strong>stil a feel<strong>in</strong>g<br />
<strong>of</strong> confidence among <strong>the</strong> freshers.<br />
f) The <strong>in</strong>stitution shall set up appropriate <strong>com</strong>mittees, <strong>in</strong>clud<strong>in</strong>g <strong>the</strong> course-<strong>in</strong>-charge, student<br />
advisor, Wardens and some senior students as its members, to actively monitor, promote and<br />
regulate healthy <strong>in</strong>teraction between <strong>the</strong> freshers, junior students and senior students.<br />
g) Freshers or any o<strong>the</strong>r student(s), whe<strong>the</strong>r be<strong>in</strong>g victims, or witnesses, <strong>in</strong> any <strong>in</strong>cident <strong>of</strong><br />
<strong>ragg<strong>in</strong>g</strong>, shall be encouraged to report such occurrence, and <strong>the</strong> identity <strong>of</strong> such<br />
<strong>in</strong>formants shall be protected and shall not be subject to any adverse consequence only<br />
for <strong>the</strong> reason for hav<strong>in</strong>g reported such <strong>in</strong>cidents.<br />
h) Each batch <strong>of</strong> freshers, on arrival at <strong>the</strong> <strong>in</strong>stitution, shall be divided <strong>in</strong>to small groups and<br />
each such group shall be assigned to a member <strong>of</strong> <strong>the</strong> faculty, who shall <strong>in</strong>teract<br />
<strong>in</strong>dividually with each member <strong>of</strong> <strong>the</strong> group every day for ascerta<strong>in</strong><strong>in</strong>g <strong>the</strong> problems or<br />
difficulties, if any, faced by <strong>the</strong> fresher <strong>in</strong> <strong>the</strong> <strong>in</strong>stitution and shall extend necessary help<br />
to <strong>the</strong> fresher <strong>in</strong> over<strong>com</strong><strong>in</strong>g <strong>the</strong> same.<br />
i) It shall be <strong>the</strong> responsibility <strong>of</strong> <strong>the</strong> member <strong>of</strong> <strong>the</strong> faculty assigned to <strong>the</strong> group <strong>of</strong><br />
freshers, to coord<strong>in</strong>ate with <strong>the</strong> Wardens <strong>of</strong> <strong>the</strong> hostels and to make surprise visits to <strong>the</strong><br />
rooms <strong>in</strong> such hostels, where a member or members <strong>of</strong> <strong>the</strong> group are lodged; and such<br />
member <strong>of</strong> faculty shall ma<strong>in</strong>ta<strong>in</strong> a diary <strong>of</strong> his/her <strong>in</strong>teraction with <strong>the</strong> freshers under<br />
his/her charge.<br />
j) Freshers shall be lodged, as far as may be, <strong>in</strong> a separate hostel block, and where such<br />
facilities are not available, <strong>the</strong> <strong>in</strong>stitution shall ensure that access <strong>of</strong> seniors to<br />
ac<strong>com</strong>modation allotted to freshers is strictly monitored by wardens, security guards and<br />
o<strong>the</strong>r staff <strong>of</strong> <strong>the</strong> <strong>in</strong>stitution.<br />
k) A round <strong>the</strong> clock vigil aga<strong>in</strong>st <strong>ragg<strong>in</strong>g</strong> <strong>in</strong> <strong>the</strong> hostel premises, <strong>in</strong> order to prevent <strong>ragg<strong>in</strong>g</strong><br />
<strong>in</strong> <strong>the</strong> hostels after <strong>the</strong> classes are over, shall be ensured by <strong>the</strong> <strong>in</strong>stitution.<br />
l) It shall be <strong>the</strong> responsibility <strong>of</strong> <strong>the</strong> parents/guardians <strong>of</strong> freshers to promptly br<strong>in</strong>g any
<strong>in</strong>stance <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> to <strong>the</strong> notice <strong>of</strong> <strong>the</strong> Head <strong>of</strong> <strong>the</strong> Institution.<br />
m) Every student study<strong>in</strong>g <strong>in</strong> <strong>the</strong> <strong>in</strong>stitution and his/her parents/guardians shall provide <strong>the</strong> specific<br />
affidavits required under clauses (d), (e) and (g) <strong>of</strong> Regulation 6.1 <strong>of</strong> <strong>the</strong>se Regulations at <strong>the</strong><br />
time <strong>of</strong> admission or registration, as <strong>the</strong> case may be, dur<strong>in</strong>g each academic year.<br />
n) Every <strong>in</strong>stitution shall obta<strong>in</strong> <strong>the</strong> affidavit from every student as referred to above <strong>in</strong><br />
clause (m) <strong>of</strong> Regulation 6.2 and ma<strong>in</strong>ta<strong>in</strong> a proper record <strong>of</strong> <strong>the</strong> same and to ensure its<br />
safe upkeep <strong>the</strong>re<strong>of</strong>, <strong>in</strong>clud<strong>in</strong>g ma<strong>in</strong>ta<strong>in</strong><strong>in</strong>g <strong>the</strong> copies <strong>of</strong> <strong>the</strong> affidavit <strong>in</strong> an electronic<br />
form, to be accessed easily when required ei<strong>the</strong>r by <strong>the</strong> Commission or any <strong>of</strong> <strong>the</strong><br />
Councils or by <strong>the</strong> <strong>in</strong>stitution or by <strong>the</strong> affiliat<strong>in</strong>g University or by any o<strong>the</strong>r person or<br />
organisation authorised to do so.<br />
o) Every student at <strong>the</strong> time <strong>of</strong> his/her registration shall <strong>in</strong>form <strong>the</strong> <strong>in</strong>stitution about his/her<br />
place <strong>of</strong> residence while pursu<strong>in</strong>g <strong>the</strong> course <strong>of</strong> study, and <strong>in</strong> case <strong>the</strong> student has not<br />
decided his/her place <strong>of</strong> residence or <strong>in</strong>tends to change <strong>the</strong> same, <strong>the</strong> details <strong>of</strong> his place<br />
<strong>of</strong> residence shall be provided immediately on decid<strong>in</strong>g <strong>the</strong> same; and specifically <strong>in</strong><br />
regard to a private <strong>com</strong>mercially managed lodge or hostel where he/she has taken up<br />
residence.<br />
p) The Head <strong>of</strong> <strong>the</strong> <strong>in</strong>stitution shall, on <strong>the</strong> basis <strong>of</strong> <strong>the</strong> <strong>in</strong>formation provided by <strong>the</strong> student<br />
under clause (o) <strong>of</strong> Regulation 6.2, apportion sectors to be assigned to members <strong>of</strong> <strong>the</strong><br />
faculty, so that such member <strong>of</strong> faculty can ma<strong>in</strong>ta<strong>in</strong> vigil and report any <strong>in</strong>cident <strong>of</strong><br />
<strong>ragg<strong>in</strong>g</strong> outside <strong>the</strong> campus or en route while <strong>com</strong>mut<strong>in</strong>g to <strong>the</strong> <strong>in</strong>stitution us<strong>in</strong>g any<br />
means <strong>of</strong> transportation <strong>of</strong> students, whe<strong>the</strong>r public or private.<br />
q) The Head <strong>of</strong> <strong>the</strong> <strong>in</strong>stitution shall, at <strong>the</strong> end <strong>of</strong> each academic year, send a letter to<br />
<strong>the</strong> parents/guardians <strong>of</strong> <strong>the</strong> students who are <strong>com</strong>plet<strong>in</strong>g <strong>the</strong>ir first year <strong>in</strong> <strong>the</strong><br />
<strong>in</strong>stitution, <strong>in</strong>form<strong>in</strong>g <strong>the</strong>m about <strong>the</strong>se Regulations and any law for <strong>the</strong> time be<strong>in</strong>g <strong>in</strong><br />
force prohibit<strong>in</strong>g <strong>ragg<strong>in</strong>g</strong> and <strong>the</strong> punishments <strong>the</strong>re<strong>of</strong> as well as punishments<br />
prescribed under <strong>the</strong> penal laws, and appeal<strong>in</strong>g to <strong>the</strong>m to impress upon <strong>the</strong>ir wards<br />
to desist from <strong>in</strong>dulg<strong>in</strong>g <strong>in</strong> <strong>ragg<strong>in</strong>g</strong> on <strong>the</strong>ir return to <strong>the</strong> <strong>in</strong>stitution at <strong>the</strong> beg<strong>in</strong>n<strong>in</strong>g <strong>of</strong><br />
<strong>the</strong> academic session next.<br />
6.3 Every <strong>in</strong>stitution shall constitute <strong>the</strong> follow<strong>in</strong>g bodies; namely,<br />
a) Every <strong>in</strong>stitution shall constitute a Committee to be known as <strong>the</strong> Anti-Ragg<strong>in</strong>g<br />
Committee to be nom<strong>in</strong>ated and headed by <strong>the</strong> Head <strong>of</strong> <strong>the</strong> <strong>in</strong>stitution, and consist<strong>in</strong>g<br />
<strong>of</strong> representatives <strong>of</strong> civil and police adm<strong>in</strong>istration, local media, Non Government<br />
Organizations <strong>in</strong>volved <strong>in</strong> youth activities, representatives <strong>of</strong> faculty members,<br />
representatives <strong>of</strong> parents, representatives <strong>of</strong> students belong<strong>in</strong>g to <strong>the</strong> freshers'
category as well as senior students, non-teach<strong>in</strong>g staff; and shall have a diverse mix<br />
<strong>of</strong> membership <strong>in</strong> terms <strong>of</strong> levels as well as gender.<br />
b) It shall be <strong>the</strong> duty <strong>of</strong> <strong>the</strong> Anti-Ragg<strong>in</strong>g Committee to ensure <strong>com</strong>pliance with <strong>the</strong><br />
provisions <strong>of</strong> <strong>the</strong>se Regulations as well as <strong>the</strong> provisions <strong>of</strong> any law for <strong>the</strong> time be<strong>in</strong>g<br />
<strong>in</strong> force concern<strong>in</strong>g <strong>ragg<strong>in</strong>g</strong>; and also to monitor and oversee <strong>the</strong> performance <strong>of</strong> <strong>the</strong><br />
Anti-Ragg<strong>in</strong>g Squad <strong>in</strong> prevention <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> <strong>in</strong> <strong>the</strong> <strong>in</strong>stitution.<br />
c) Every <strong>in</strong>stitution shall also constitute a smaller body to be known as <strong>the</strong> Anti-Ragg<strong>in</strong>g<br />
Squad to be nom<strong>in</strong>ated by <strong>the</strong> Head <strong>of</strong> <strong>the</strong> Institution with such representation as may<br />
be considered necessary for ma<strong>in</strong>ta<strong>in</strong><strong>in</strong>g vigil, oversight and patroll<strong>in</strong>g functions and<br />
shall rema<strong>in</strong> mobile, alert and active at all times.<br />
Provided that <strong>the</strong> Anti-Ragg<strong>in</strong>g Squad shall have representation <strong>of</strong> various members <strong>of</strong><br />
<strong>the</strong> campus <strong>com</strong>munity and shall have no outside representation.<br />
d) It shall be <strong>the</strong> duty <strong>of</strong> <strong>the</strong> Anti-Ragg<strong>in</strong>g Squad to be called upon to make surprise raids<br />
on hostels, and o<strong>the</strong>r places vulnerable to <strong>in</strong>cidents <strong>of</strong>, and hav<strong>in</strong>g <strong>the</strong> potential <strong>of</strong>,<br />
<strong>ragg<strong>in</strong>g</strong> and shall be empowered to <strong>in</strong>spect such places.<br />
e) It shall also be <strong>the</strong> duty <strong>of</strong> <strong>the</strong> Anti-Ragg<strong>in</strong>g Squad to conduct an on-<strong>the</strong>-spot enquiry<br />
<strong>in</strong>to any <strong>in</strong>cident <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> referred to it by <strong>the</strong> Head <strong>of</strong> <strong>the</strong> <strong>in</strong>stitution or any member<br />
<strong>of</strong> <strong>the</strong> faculty or any member <strong>of</strong> <strong>the</strong> staff or any student or any parent or guardian or any<br />
employee <strong>of</strong> a service provider or by any o<strong>the</strong>r person, as <strong>the</strong> case may be; and <strong>the</strong> enquiry<br />
report along with re<strong>com</strong>mendations shall be submitted to <strong>the</strong> Anti-Ragg<strong>in</strong>g Committee for<br />
action under clause (a) <strong>of</strong> Regulation 9.1.<br />
Provided that <strong>the</strong> Anti-Ragg<strong>in</strong>g Squad shall conduct such enquiry observ<strong>in</strong>g a fair and<br />
transparent procedure and <strong>the</strong> pr<strong>in</strong>ciples <strong>of</strong> natural justice and after giv<strong>in</strong>g adequate opportunity<br />
to <strong>the</strong> student or students accused <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> and o<strong>the</strong>r witnesses to place before it <strong>the</strong> facts,<br />
documents and views concern<strong>in</strong>g <strong>the</strong> <strong>in</strong>cident <strong>of</strong> <strong>ragg<strong>in</strong>g</strong>, and consider<strong>in</strong>g such o<strong>the</strong>r relevant<br />
<strong>in</strong>formation as may be required.<br />
f) Every <strong>in</strong>stitution shall, at <strong>the</strong> end <strong>of</strong> each academic year, <strong>in</strong> order to promote <strong>the</strong><br />
objectives <strong>of</strong> <strong>the</strong>se Regulations, constitute a Mentor<strong>in</strong>g Cell consist<strong>in</strong>g <strong>of</strong> students<br />
volunteer<strong>in</strong>g to be Mentors for freshers, <strong>in</strong> <strong>the</strong> succeed<strong>in</strong>g academic year; and <strong>the</strong>re shall<br />
be as many levels or tiers <strong>of</strong> Mentors as <strong>the</strong> number <strong>of</strong> batches <strong>in</strong> <strong>the</strong> <strong>in</strong>stitution, at <strong>the</strong><br />
rate <strong>of</strong> one Mentor for six freshers and one Mentor <strong>of</strong> a <strong>higher</strong> level for six Mentors <strong>of</strong> <strong>the</strong><br />
lower level.<br />
g)Every University shall constitute a body to be known as Monitor<strong>in</strong>g Cell on Ragg<strong>in</strong>g, which shall<br />
coord<strong>in</strong>ate with <strong>the</strong> affiliated colleges and <strong>in</strong>stitutions under <strong>the</strong> doma<strong>in</strong> <strong>of</strong> <strong>the</strong> University to<br />
achieve <strong>the</strong> objectives <strong>of</strong> <strong>the</strong>se Regulations; and <strong>the</strong> Monitor<strong>in</strong>g Cell shall call for reports from <strong>the</strong>
Heads <strong>of</strong> <strong>in</strong>stitutions <strong>in</strong> regard to <strong>the</strong> activities <strong>of</strong> <strong>the</strong> Anti-Ragg<strong>in</strong>g Committees, Anti - Ragg<strong>in</strong>g<br />
Squads, and <strong>the</strong> Mentor<strong>in</strong>g Cells at <strong>the</strong> <strong>in</strong>stitutions, and it shall also keep itself abreast <strong>of</strong> <strong>the</strong><br />
decisions <strong>of</strong> <strong>the</strong> District level Anti-Ragg<strong>in</strong>g Committee headed by <strong>the</strong> District Magistrate.<br />
h) The Monitor<strong>in</strong>g Cell shall also review <strong>the</strong> efforts made by <strong>in</strong>stitutions to publicize<br />
<strong>anti</strong>-<strong>ragg<strong>in</strong>g</strong> measures, solicit<strong>in</strong>g <strong>of</strong> affidavits from parents/guardians and from students,<br />
each academic year, to absta<strong>in</strong> from <strong>ragg<strong>in</strong>g</strong> activities or will<strong>in</strong>gness to be penalized for<br />
violations; and shall function as <strong>the</strong> prime mover for <strong>in</strong>itiat<strong>in</strong>g action on <strong>the</strong> part <strong>of</strong> <strong>the</strong><br />
appropriate authorities <strong>of</strong> <strong>the</strong> university for amend<strong>in</strong>g <strong>the</strong> Statutes or Ord<strong>in</strong>ances or<br />
Bye-laws to facilitate <strong>the</strong> implementation <strong>of</strong> <strong>anti</strong>-<strong>ragg<strong>in</strong>g</strong> measures at <strong>the</strong> level <strong>of</strong> <strong>the</strong><br />
<strong>in</strong>stitution.<br />
6.4 Every <strong>in</strong>stitution shall take <strong>the</strong> follow<strong>in</strong>g o<strong>the</strong>r measures, namely; a) Each hostel or a place<br />
where groups <strong>of</strong> students reside, form<strong>in</strong>g part <strong>of</strong> <strong>the</strong> <strong>in</strong>stitution, shall have a full-time Warden,<br />
to be appo<strong>in</strong>ted by <strong>the</strong> <strong>in</strong>stitution as per <strong>the</strong> eligibility criteria laid down for <strong>the</strong> post reflect<strong>in</strong>g<br />
both <strong>the</strong> <strong>com</strong>mand and control aspects <strong>of</strong> ma<strong>in</strong>ta<strong>in</strong><strong>in</strong>g discipl<strong>in</strong>e and prevent<strong>in</strong>g <strong>in</strong>cidents <strong>of</strong><br />
<strong>ragg<strong>in</strong>g</strong> with<strong>in</strong> <strong>the</strong> hostel, as well as <strong>the</strong> s<strong>of</strong>ter skills <strong>of</strong> counsell<strong>in</strong>g and <strong>com</strong>municat<strong>in</strong>g with<br />
<strong>the</strong> youth outside <strong>the</strong> class-room situation; and who shall reside with<strong>in</strong> <strong>the</strong> hostel, or at <strong>the</strong><br />
very least, <strong>in</strong> <strong>the</strong> close vic<strong>in</strong>ity <strong>the</strong>re<strong>of</strong>. b) The Warden shall be accessible at all hours and be<br />
available on telephone and o<strong>the</strong>r modes <strong>of</strong> <strong>com</strong>munication, and for <strong>the</strong> purpose <strong>the</strong> Warden<br />
shall be provided with a mobile phone by <strong>the</strong> <strong>in</strong>stitution, <strong>the</strong> number <strong>of</strong> which shall be<br />
publicised among all students resid<strong>in</strong>g <strong>in</strong> <strong>the</strong> hostel. c) The <strong>in</strong>stitution shall review and suitably<br />
enhance <strong>the</strong> powers <strong>of</strong> Wardens; and <strong>the</strong> security personnel posted <strong>in</strong> hostels shall be under<br />
<strong>the</strong> direct control <strong>of</strong> <strong>the</strong> Warden and <strong>the</strong>ir performance shall be assessed by <strong>the</strong>m. d) The<br />
pr<strong>of</strong>essional counsellors referred to under clause (o) <strong>of</strong> Regulation<br />
6.1 <strong>of</strong> <strong>the</strong>se Regulations shall, at <strong>the</strong> time <strong>of</strong> admission, counsel freshers and/or any o<strong>the</strong>r<br />
student(s) desir<strong>in</strong>g counsell<strong>in</strong>g, <strong>in</strong> order to prepare <strong>the</strong>m for <strong>the</strong> life ahead, particularly <strong>in</strong><br />
regard to <strong>the</strong> life <strong>in</strong> hostels and to <strong>the</strong> extent possible, also <strong>in</strong>volve parents and teachers <strong>in</strong><br />
<strong>the</strong> counsell<strong>in</strong>g sessions. e) The <strong>in</strong>stitution shall undertake measures for extensive publicity<br />
aga<strong>in</strong>st <strong>ragg<strong>in</strong>g</strong> by means <strong>of</strong> audio-visual aids, counsell<strong>in</strong>g sessions, workshops, pa<strong>in</strong>t<strong>in</strong>g and<br />
design <strong>com</strong>petitions among students and such o<strong>the</strong>r measures, as it may deem fit. f) In order<br />
to enable a student or any person to <strong>com</strong>municate with <strong>the</strong> Anti-Ragg<strong>in</strong>g Helpl<strong>in</strong>e, every<br />
<strong>in</strong>stitution shall permit unrestricted access to mobile phones and public phones <strong>in</strong> hostels and<br />
campuses, o<strong>the</strong>r than <strong>in</strong> class-rooms, sem<strong>in</strong>ar halls, library, and <strong>in</strong> such o<strong>the</strong>r places that <strong>the</strong><br />
<strong>in</strong>stitution may deem it necessary to restrict <strong>the</strong> use <strong>of</strong> phones. g) The faculty <strong>of</strong> <strong>the</strong><br />
<strong>in</strong>stitution and its non-teach<strong>in</strong>g staff, which <strong>in</strong>cludes but is not limited to <strong>the</strong> adm<strong>in</strong>istrative<br />
staff, contract employees, security guards and employees <strong>of</strong> service providers provid<strong>in</strong>g
services with<strong>in</strong> <strong>the</strong> <strong>in</strong>stitution, shall be sensitized towards <strong>the</strong> ills <strong>of</strong> <strong>ragg<strong>in</strong>g</strong>, its prevention and<br />
<strong>the</strong> consequences <strong>the</strong>re<strong>of</strong>. h) The <strong>in</strong>stitution shall obta<strong>in</strong> an undertak<strong>in</strong>g from every<br />
employee <strong>of</strong> <strong>the</strong> <strong>in</strong>stitution <strong>in</strong>clud<strong>in</strong>g all teach<strong>in</strong>g and non-teach<strong>in</strong>g members <strong>of</strong> staff, contract<br />
labour employed <strong>in</strong> <strong>the</strong> premises ei<strong>the</strong>r for runn<strong>in</strong>g canteen or as watch and ward staff or for<br />
clean<strong>in</strong>g or ma<strong>in</strong>tenance <strong>of</strong> <strong>the</strong> build<strong>in</strong>gs/lawns and employees <strong>of</strong> service providers provid<strong>in</strong>g<br />
services with<strong>in</strong> <strong>the</strong> <strong>in</strong>stitution, that he/she would report promptly any case <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> which<br />
<strong>com</strong>es to his/her notice. i) The <strong>in</strong>stitution shall make a provision <strong>in</strong> <strong>the</strong> service rules <strong>of</strong> its<br />
employees for issu<strong>in</strong>g certificates <strong>of</strong> appreciation to such members <strong>of</strong> <strong>the</strong> staff who report<br />
<strong>in</strong>cidents <strong>of</strong> <strong>ragg<strong>in</strong>g</strong>, which will form part <strong>of</strong> <strong>the</strong>ir service record. j) The <strong>in</strong>stitution shall give<br />
necessary <strong>in</strong>structions to <strong>the</strong> employees <strong>of</strong> <strong>the</strong> canteens and mess<strong>in</strong>g, whe<strong>the</strong>r that <strong>of</strong> <strong>the</strong><br />
<strong>in</strong>stitution or that <strong>of</strong> a service provider provid<strong>in</strong>g this service, or <strong>the</strong>ir employers, as <strong>the</strong> case<br />
may be, to keep a strict vigil <strong>in</strong> <strong>the</strong> area <strong>of</strong> <strong>the</strong>ir work and to report <strong>the</strong> <strong>in</strong>cidents <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> to<br />
<strong>the</strong> Head <strong>of</strong> <strong>the</strong> <strong>in</strong>stitution or members <strong>of</strong> <strong>the</strong> Anti-Ragg<strong>in</strong>g Squad or members <strong>of</strong> <strong>the</strong><br />
Anti-Ragg<strong>in</strong>g Committee or <strong>the</strong> Wardens, as may be required. k) All Universities award<strong>in</strong>g a<br />
degree <strong>in</strong> education at any level, shall be required to ensure that <strong>in</strong>stitutions impart<strong>in</strong>g<br />
<strong>in</strong>struction <strong>in</strong> such courses or conduct<strong>in</strong>g tra<strong>in</strong><strong>in</strong>g programme for teachers <strong>in</strong>clude <strong>in</strong>puts<br />
relat<strong>in</strong>g to <strong>anti</strong>-<strong>ragg<strong>in</strong>g</strong> and <strong>the</strong> appreciation <strong>of</strong> <strong>the</strong> relevant human rights, as well as <strong>in</strong>puts on<br />
topics regard<strong>in</strong>g sensitization aga<strong>in</strong>st corporal punishments and check<strong>in</strong>g <strong>of</strong> bully<strong>in</strong>g amongst<br />
students, so that every teacher is equipped to handle at least <strong>the</strong> rudiments <strong>of</strong> <strong>the</strong> counsell<strong>in</strong>g<br />
approach. l) Discreet random surveys shall be conducted amongst <strong>the</strong> freshers every<br />
fortnight dur<strong>in</strong>g <strong>the</strong> first three months <strong>of</strong> <strong>the</strong> academic year to verify and cross-check whe<strong>the</strong>r<br />
<strong>the</strong> <strong>in</strong>stitution is <strong>in</strong>deed free <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> or not and for <strong>the</strong> purpose <strong>the</strong> <strong>in</strong>stitution may design<br />
its own methodology <strong>of</strong> conduct<strong>in</strong>g such surveys. m) The <strong>in</strong>stitution shall cause to have an<br />
entry, apart from those relat<strong>in</strong>g to general conduct and behaviour, made <strong>in</strong> <strong>the</strong><br />
Migration/Transfer Certificate issued to <strong>the</strong> student while leav<strong>in</strong>g <strong>the</strong> <strong>in</strong>stitution, as to whe<strong>the</strong>r<br />
<strong>the</strong> student has been punished for <strong>com</strong>mitt<strong>in</strong>g or abett<strong>in</strong>g an act <strong>of</strong> <strong>ragg<strong>in</strong>g</strong>, as also whe<strong>the</strong>r<br />
<strong>the</strong> student has displayed persistent violent or aggressive behaviour or any <strong>in</strong>cl<strong>in</strong>ation to harm<br />
o<strong>the</strong>rs, dur<strong>in</strong>g his course <strong>of</strong> study <strong>in</strong> <strong>the</strong> <strong>in</strong>stitution. n) Notwithstand<strong>in</strong>g anyth<strong>in</strong>g conta<strong>in</strong>ed <strong>in</strong><br />
<strong>the</strong>se Regulations with regard to obligations and responsibilities perta<strong>in</strong><strong>in</strong>g to <strong>the</strong> authorities<br />
or members <strong>of</strong> bodies prescribed above, it shall be <strong>the</strong> general collective responsibility <strong>of</strong> all<br />
levels and sections <strong>of</strong> authorities or functionaries <strong>in</strong>clud<strong>in</strong>g members <strong>of</strong> <strong>the</strong> faculty and<br />
employees <strong>of</strong> <strong>the</strong> <strong>in</strong>stitution, whe<strong>the</strong>r regular or temporary, and employees <strong>of</strong> service<br />
providers provid<strong>in</strong>g service with<strong>in</strong> <strong>the</strong> <strong>in</strong>stitution, to prevent or to act promptly aga<strong>in</strong>st <strong>the</strong><br />
occurrence <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> or any <strong>in</strong>cident <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> which <strong>com</strong>es to <strong>the</strong>ir notice. o) The Heads <strong>of</strong><br />
<strong>in</strong>stitutions affiliated to a University or a constituent <strong>of</strong> <strong>the</strong> University, as <strong>the</strong> case may be,
shall, dur<strong>in</strong>g <strong>the</strong> first three months <strong>of</strong> an academic year, submit a weekly report on <strong>the</strong> status<br />
<strong>of</strong> <strong>com</strong>pliance with Anti-Ragg<strong>in</strong>g measures under <strong>the</strong>se Regulations, and a monthly report on<br />
such status <strong>the</strong>reafter, to <strong>the</strong> Vice-Chancellor <strong>of</strong> <strong>the</strong> University to which <strong>the</strong> <strong>in</strong>stitution is<br />
affiliated to or recognized by.<br />
p) The Vice Chancellor <strong>of</strong> each University, shall submit<br />
fortnightly reports <strong>of</strong> <strong>the</strong> University, <strong>in</strong>clud<strong>in</strong>g those <strong>of</strong> <strong>the</strong> Monitor<strong>in</strong>g Cell on Ragg<strong>in</strong>g <strong>in</strong> case<br />
<strong>of</strong> an affiliat<strong>in</strong>g university, to <strong>the</strong> State Level Monitor<strong>in</strong>g Cell.<br />
7. Action to be taken by <strong>the</strong> Head <strong>of</strong> <strong>the</strong> <strong>in</strong>stitution.- On receipt <strong>of</strong> <strong>the</strong> re<strong>com</strong>mendation <strong>of</strong> <strong>the</strong><br />
Anti Ragg<strong>in</strong>g Squad or on receipt <strong>of</strong> any <strong>in</strong>formation concern<strong>in</strong>g any reported <strong>in</strong>cident <strong>of</strong> <strong>ragg<strong>in</strong>g</strong>, <strong>the</strong><br />
Head <strong>of</strong> <strong>in</strong>stitution shall immediately determ<strong>in</strong>e if a case under <strong>the</strong> penal laws is made out and if so,<br />
ei<strong>the</strong>r on his own or through a member <strong>of</strong> <strong>the</strong> Anti-Ragg<strong>in</strong>g Committee authorised by him <strong>in</strong> this<br />
behalf, proceed to file a First Information Report (FIR), with<strong>in</strong> twenty four hours <strong>of</strong> receipt <strong>of</strong> such<br />
<strong>in</strong>formation or re<strong>com</strong>mendation, with <strong>the</strong> police and local authorities, under <strong>the</strong> appropriate penal<br />
provisions relat<strong>in</strong>g to one or more <strong>of</strong> <strong>the</strong> follow<strong>in</strong>g, namely;<br />
i. Abetment to <strong>ragg<strong>in</strong>g</strong>;<br />
ii.<br />
iii.<br />
Crim<strong>in</strong>al conspiracy to rag;<br />
Unlawful assembly and riot<strong>in</strong>g while <strong>ragg<strong>in</strong>g</strong>;<br />
iv.<br />
Public nuisance created dur<strong>in</strong>g <strong>ragg<strong>in</strong>g</strong>;<br />
v. Violation <strong>of</strong> decency and morals through <strong>ragg<strong>in</strong>g</strong>;<br />
vi.<br />
vii.<br />
viii.<br />
Injury to body, caus<strong>in</strong>g hurt or grievous hurt;<br />
Wrongful restra<strong>in</strong>t;<br />
Wrongful conf<strong>in</strong>ement;<br />
ix.<br />
Use <strong>of</strong> crim<strong>in</strong>al force;<br />
x.<br />
Assault as well as sexual<br />
<strong>of</strong>fences<br />
or<br />
unnatural <strong>of</strong>fences;<br />
xi.<br />
Extortion;<br />
xii.<br />
Crim<strong>in</strong>al trespass;<br />

Offences aga<strong>in</strong>st property;<br />
xiv.<br />
Crim<strong>in</strong>al <strong>in</strong>timidation;<br />
xv.<br />
Attempts to <strong>com</strong>mit any or all <strong>of</strong> <strong>the</strong> above mentioned <strong>of</strong>fences aga<strong>in</strong>st<br />
<strong>the</strong> victim(s);<br />
xvi.<br />
Threat to <strong>com</strong>mit any or all <strong>of</strong> <strong>the</strong> above mentioned <strong>of</strong>fences aga<strong>in</strong>st <strong>the</strong><br />
victim(s);<br />
xvii.<br />
xviii.<br />
Physical or psychological humiliation;<br />
All o<strong>the</strong>r <strong>of</strong>fences follow<strong>in</strong>g from <strong>the</strong> def<strong>in</strong>ition <strong>of</strong> “Ragg<strong>in</strong>g”.
Provided that <strong>the</strong> Head <strong>of</strong> <strong>the</strong> <strong>in</strong>stitution shall forthwith report <strong>the</strong> occurrence <strong>of</strong> <strong>the</strong><br />
<strong>in</strong>cident <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> to <strong>the</strong> District Level Anti-Ragg<strong>in</strong>g Committee and <strong>the</strong> Nodal <strong>of</strong>ficer <strong>of</strong> <strong>the</strong><br />
affiliat<strong>in</strong>g University, if <strong>the</strong> <strong>in</strong>stitution is an affiliated <strong>in</strong>stitution.<br />
Provided fur<strong>the</strong>r that <strong>the</strong> <strong>in</strong>stitution shall also cont<strong>in</strong>ue with its own enquiry <strong>in</strong>itiated<br />
under clause 9 <strong>of</strong> <strong>the</strong>se Regulations and o<strong>the</strong>r measures without wait<strong>in</strong>g for action on <strong>the</strong><br />
part <strong>of</strong> <strong>the</strong> police/local authorities and such remedial action shall be <strong>in</strong>itiated and <strong>com</strong>pleted<br />
immediately and <strong>in</strong> no case later than a period <strong>of</strong> seven days <strong>of</strong> <strong>the</strong> reported occurrence <strong>of</strong><br />
<strong>the</strong> <strong>in</strong>cident <strong>of</strong> <strong>ragg<strong>in</strong>g</strong>.<br />
8. Duties and Responsibilities <strong>of</strong> <strong>the</strong> Commission and <strong>the</strong> Councils.<br />
8.1 The Commission shall, with regard to provid<strong>in</strong>g facilitat<strong>in</strong>g <strong>com</strong>munication <strong>of</strong> <strong>in</strong>formation<br />
regard<strong>in</strong>g <strong>in</strong>cidents <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> <strong>in</strong> any <strong>in</strong>stitution, take <strong>the</strong> follow<strong>in</strong>g steps, namely;<br />
a) The Commission shall establish, fund and operate, a toll-free Anti-Ragg<strong>in</strong>g Helpl<strong>in</strong>e,<br />
operational round <strong>the</strong> clock, which could be accessed by students <strong>in</strong> distress ow<strong>in</strong>g to<br />
<strong>ragg<strong>in</strong>g</strong> related <strong>in</strong>cidents.<br />
b) Any distress message received at <strong>the</strong> Anti-Ragg<strong>in</strong>g Helpl<strong>in</strong>e shall be simultaneously<br />
relayed to <strong>the</strong> Head <strong>of</strong> <strong>the</strong> Institution, <strong>the</strong> Warden <strong>of</strong> <strong>the</strong> Hostels, <strong>the</strong> Nodal Officer <strong>of</strong><br />
<strong>the</strong> affiliat<strong>in</strong>g University, if <strong>the</strong> <strong>in</strong>cident reported has taken place <strong>in</strong> an <strong>in</strong>stitution<br />
affiliated to a University, <strong>the</strong> concerned District authorities and if so required, <strong>the</strong><br />
District Magistrate, and <strong>the</strong> Super<strong>in</strong>tendent <strong>of</strong> Police, and shall also be web enabled so<br />
as to be <strong>in</strong> <strong>the</strong> public doma<strong>in</strong> simultaneously for <strong>the</strong> media and citizens to access it.<br />
c) The Head <strong>of</strong> <strong>the</strong> <strong>in</strong>stitution shall be obliged to act immediately <strong>in</strong> response to <strong>the</strong><br />
<strong>in</strong>formation received from <strong>the</strong> Anti-Ragg<strong>in</strong>g Helpl<strong>in</strong>e as at sub-clause (b) <strong>of</strong> this<br />
clause.<br />
d) The telephone numbers <strong>of</strong> <strong>the</strong> Anti-Ragg<strong>in</strong>g Helpl<strong>in</strong>e and all <strong>the</strong> important<br />
functionaries <strong>in</strong> every <strong>in</strong>stitution, Heads <strong>of</strong> <strong>in</strong>stitutions, faculty members, members <strong>of</strong><br />
<strong>the</strong> <strong>anti</strong>-<strong>ragg<strong>in</strong>g</strong> <strong>com</strong>mittees and <strong>anti</strong> <strong>ragg<strong>in</strong>g</strong> squads, district and sub-divisional<br />
authorities and state authorities, Wardens <strong>of</strong> hostels, and o<strong>the</strong>r functionaries or<br />
authorities where relevant, shall be widely dissem<strong>in</strong>ated for access or to seek help <strong>in</strong><br />
emergencies.<br />
e) The Commission shall ma<strong>in</strong>ta<strong>in</strong> an appropriate data base to be created out <strong>of</strong><br />
affidavits, affirmed by each student and his/her parents/guardians and stored<br />
electronically by <strong>the</strong> <strong>in</strong>stitution, ei<strong>the</strong>r on its or through an agency to be designated by<br />
it; and such database shall also function as a record <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> <strong>com</strong>pla<strong>in</strong>ts received,
and <strong>the</strong> status <strong>of</strong> <strong>the</strong> action taken <strong>the</strong>reon.<br />
f) The Commission shall make available <strong>the</strong> database to a non-governmental agency to<br />
be nom<strong>in</strong>ated by <strong>the</strong> Central Government, to build confidence <strong>in</strong> <strong>the</strong> public and also to<br />
provide <strong>in</strong>formation <strong>of</strong> non <strong>com</strong>pliance with <strong>the</strong>se Regulations to <strong>the</strong> Councils and to<br />
such bodies as may be authorised by <strong>the</strong> Commission or by <strong>the</strong> Central Government.<br />
8.2 The Commission shall take <strong>the</strong> follow<strong>in</strong>g regulatory steps, namely;<br />
a) The Commission shall make it mandatory for <strong>the</strong> <strong>in</strong>stitutions to <strong>in</strong>corporate <strong>in</strong> <strong>the</strong>ir<br />
prospectus, <strong>the</strong> directions <strong>of</strong> <strong>the</strong> Central Government or <strong>the</strong> State Level Monitor<strong>in</strong>g<br />
Committee with regard to prohibition and consequences <strong>of</strong> <strong>ragg<strong>in</strong>g</strong>, and that<br />
non-<strong>com</strong>pliance with <strong>the</strong>se Regulations and directions so provided, shall be considered as<br />
lower<strong>in</strong>g <strong>of</strong> academic standards by <strong>the</strong> <strong>in</strong>stitution, <strong>the</strong>refore mak<strong>in</strong>g it liable for<br />
appropriate action.<br />
b) The Commission shall verify that <strong>the</strong> <strong>in</strong>stitutions strictly <strong>com</strong>ply with <strong>the</strong> requirement <strong>of</strong><br />
gett<strong>in</strong>g <strong>the</strong> affidavits from <strong>the</strong> students and <strong>the</strong>ir parents/guardians as envisaged under<br />
<strong>the</strong>se Regulations.<br />
c) The Commission shall <strong>in</strong>clude a specific condition <strong>in</strong> <strong>the</strong> Utilization Certificate, <strong>in</strong> respect<br />
<strong>of</strong> any f<strong>in</strong>ancial assistance or grants-<strong>in</strong>-aid to any <strong>in</strong>stitution under any <strong>of</strong> <strong>the</strong> general or<br />
special schemes <strong>of</strong> <strong>the</strong> Commission, that <strong>the</strong> <strong>in</strong>stitution has <strong>com</strong>plied with <strong>the</strong><br />
<strong>anti</strong>-<strong>ragg<strong>in</strong>g</strong> measures.<br />
d) Any <strong>in</strong>cident <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> <strong>in</strong> an <strong>in</strong>stitution shall adversely affect its accreditation, rank<strong>in</strong>g or<br />
grad<strong>in</strong>g by NAAC or by any o<strong>the</strong>r authorised accreditation agencies while assess<strong>in</strong>g <strong>the</strong><br />
<strong>in</strong>stitution for accreditation, rank<strong>in</strong>g or grad<strong>in</strong>g purposes.<br />
e) The Commission may accord priority <strong>in</strong> f<strong>in</strong>ancial grants-<strong>in</strong>-aid to those <strong>in</strong>stitutions,<br />
o<strong>the</strong>rwise eligible to receive grants under section 12B <strong>of</strong> <strong>the</strong> Act, which report a<br />
blemishless record <strong>in</strong> terms <strong>of</strong> <strong>the</strong>re be<strong>in</strong>g no reported <strong>in</strong>cident <strong>of</strong> <strong>ragg<strong>in</strong>g</strong>.<br />
f) The Commission shall constitute an Inter-Council Committee, consist<strong>in</strong>g <strong>of</strong> representatives<br />
<strong>of</strong> <strong>the</strong> various Councils, <strong>the</strong> Non-Governmental agency responsible for monitor<strong>in</strong>g <strong>the</strong><br />
database ma<strong>in</strong>ta<strong>in</strong>ed by <strong>the</strong> Commission under clause (g) <strong>of</strong> Regulation 8.1 and such<br />
o<strong>the</strong>r bodies <strong>in</strong> <strong>higher</strong> education, to coord<strong>in</strong>ate and monitor <strong>the</strong> <strong>anti</strong>-<strong>ragg<strong>in</strong>g</strong> measures<br />
<strong>in</strong> <strong>in</strong>stitutions across <strong>the</strong> country and to make re<strong>com</strong>mendations from time to time; and<br />
shall meet at least once <strong>in</strong> six months each year.<br />
g) The Commission shall <strong>in</strong>stitute an Anti-Ragg<strong>in</strong>g Cell with<strong>in</strong> <strong>the</strong> Commission as an<br />
<strong>in</strong>stitutional mechanism to provide secretarial support for collection <strong>of</strong> <strong>in</strong>formation and<br />
monitor<strong>in</strong>g, and to coord<strong>in</strong>ate with <strong>the</strong> State Level Monitor<strong>in</strong>g Cell and University level
Committees for effective implementation <strong>of</strong> <strong>anti</strong>-<strong>ragg<strong>in</strong>g</strong> measures, and <strong>the</strong> Cell shall also<br />
coord<strong>in</strong>ate with <strong>the</strong> Non-Governmental agency responsible for monitor<strong>in</strong>g <strong>the</strong> database<br />
ma<strong>in</strong>ta<strong>in</strong>ed by <strong>the</strong> Commission appo<strong>in</strong>ted under clause (g) <strong>of</strong> Regulation 8.1.<br />
9. Adm<strong>in</strong>istrative action <strong>in</strong> <strong>the</strong> event <strong>of</strong> <strong>ragg<strong>in</strong>g</strong>.-<br />
9.1 The <strong>in</strong>stitution shall punish a student found guilty <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> after follow<strong>in</strong>g <strong>the</strong><br />
procedure and <strong>in</strong> <strong>the</strong> manner prescribed here<strong>in</strong>under:<br />
a) The Anti-Ragg<strong>in</strong>g Committee <strong>of</strong> <strong>the</strong> <strong>in</strong>stitution shall take an appropriate decision, <strong>in</strong><br />
regard to punishment or o<strong>the</strong>rwise, depend<strong>in</strong>g on <strong>the</strong> facts <strong>of</strong> each <strong>in</strong>cident <strong>of</strong> <strong>ragg<strong>in</strong>g</strong><br />
and nature and gravity <strong>of</strong> <strong>the</strong> <strong>in</strong>cident <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> established <strong>in</strong> <strong>the</strong> re<strong>com</strong>mendations<br />
<strong>of</strong> <strong>the</strong> Anti-Ragg<strong>in</strong>g Squad.<br />
b) The Anti-Ragg<strong>in</strong>g Committee may, depend<strong>in</strong>g on <strong>the</strong> nature and gravity <strong>of</strong> <strong>the</strong> guilt<br />
established by <strong>the</strong> Anti-Ragg<strong>in</strong>g Squad, award, to those found guilty, one or more <strong>of</strong><br />
<strong>the</strong> follow<strong>in</strong>g punishments, namely;<br />
i. Suspension from attend<strong>in</strong>g classes and academic privileges.<br />
ii. Withhold<strong>in</strong>g/ withdraw<strong>in</strong>g scholarship/ fellowship and o<strong>the</strong>r benefits.<br />
iii. Debarr<strong>in</strong>g from appear<strong>in</strong>g <strong>in</strong> any test/ exam<strong>in</strong>ation or o<strong>the</strong>r evaluation process.<br />
iv. Withhold<strong>in</strong>g results.<br />
v. Debarr<strong>in</strong>g from represent<strong>in</strong>g <strong>the</strong> <strong>in</strong>stitution <strong>in</strong> any regional, national or<br />
<strong>in</strong>ternational meet, tournament, youth festival, etc.<br />
ii.<br />
iii.<br />
vi. Suspension/ expulsion from <strong>the</strong> hostel.<br />
vii. Cancellation <strong>of</strong> admission.<br />
viii. Rustication from <strong>the</strong> <strong>in</strong>stitution for period rang<strong>in</strong>g from one to four semesters.<br />
ix. Expulsion from <strong>the</strong> <strong>in</strong>stitution and consequent debarr<strong>in</strong>g from<br />
admission to any o<strong>the</strong>r <strong>in</strong>stitution for a specified period. Provided<br />
that where <strong>the</strong> persons <strong>com</strong>mitt<strong>in</strong>g or abett<strong>in</strong>g <strong>the</strong> act <strong>of</strong> <strong>ragg<strong>in</strong>g</strong><br />
are not identified, <strong>the</strong> <strong>in</strong>stitution shall resort to collective<br />
punishment.<br />
c) An appeal aga<strong>in</strong>st <strong>the</strong> order <strong>of</strong> punishment by <strong>the</strong> Anti-Ragg<strong>in</strong>g Committee shall lie,<br />
i. <strong>in</strong> case <strong>of</strong> an order <strong>of</strong> an <strong>in</strong>stitution, affiliated to or constituent part, <strong>of</strong> a<br />
University, to <strong>the</strong> Vice-Chancellor <strong>of</strong> <strong>the</strong> University;<br />
<strong>in</strong> case <strong>of</strong> an order <strong>of</strong> a University, to its Chancellor.<br />
<strong>in</strong> case <strong>of</strong> an <strong>in</strong>stitution <strong>of</strong> national importance created by an Act <strong>of</strong><br />
Parliament, to <strong>the</strong> Chairman or Chancellor <strong>of</strong> <strong>the</strong> <strong>in</strong>stitution, as <strong>the</strong> case<br />
may be.
9.2 Where an <strong>in</strong>stitution, be<strong>in</strong>g constituent <strong>of</strong>, affiliated to or recognized by a University, fails<br />
to <strong>com</strong>ply with any <strong>of</strong> <strong>the</strong> provisions <strong>of</strong> <strong>the</strong>se Regulations or fails to curb <strong>ragg<strong>in</strong>g</strong> effectively,<br />
such University may take any one or more <strong>of</strong> <strong>the</strong> follow<strong>in</strong>g actions, namely;<br />
i. Withdrawal <strong>of</strong> affiliation/recognition or o<strong>the</strong>r privileges conferred.<br />
ii. Prohibit<strong>in</strong>g such <strong>in</strong>stitution from present<strong>in</strong>g any student or students <strong>the</strong>n undergo<strong>in</strong>g<br />
any programme <strong>of</strong> study <strong>the</strong>re<strong>in</strong> for <strong>the</strong> award <strong>of</strong> any degree/diploma <strong>of</strong> <strong>the</strong> University.<br />
Provided that where an <strong>in</strong>stitution is prohibited from present<strong>in</strong>g its student or students,<br />
<strong>the</strong> Commission shall make suitable arrangements for <strong>the</strong> o<strong>the</strong>r students so as to ensure that<br />
such students are able to pursue <strong>the</strong>ir academic studies.<br />
iii. Withhold<strong>in</strong>g grants allocated to it by <strong>the</strong> university, if any<br />
iv. Withhold<strong>in</strong>g any grants chanellised through <strong>the</strong> university to <strong>the</strong> <strong>in</strong>stitution.<br />
v. Any o<strong>the</strong>r appropriate penalty with<strong>in</strong> <strong>the</strong> powers <strong>of</strong> <strong>the</strong> university.<br />
9.3 Where <strong>in</strong> <strong>the</strong> op<strong>in</strong>ion <strong>of</strong> <strong>the</strong> appo<strong>in</strong>t<strong>in</strong>g authority, a lapse is attributable to any member <strong>of</strong><br />
<strong>the</strong> faulty or staff <strong>of</strong> <strong>the</strong> <strong>in</strong>stitution, <strong>in</strong> <strong>the</strong> matter <strong>of</strong> report<strong>in</strong>g or tak<strong>in</strong>g prompt action to<br />
prevent an <strong>in</strong>cident <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> or who display an apa<strong>the</strong>tic or <strong>in</strong>sensitive attitude towards<br />
<strong>com</strong>pla<strong>in</strong>ts <strong>of</strong> <strong>ragg<strong>in</strong>g</strong>, or who fail to take timely steps, whe<strong>the</strong>r required under <strong>the</strong>se<br />
Regulations or o<strong>the</strong>rwise, to prevent an <strong>in</strong>cident or <strong>in</strong>cidents <strong>of</strong> <strong>ragg<strong>in</strong>g</strong>, <strong>the</strong>n such authority<br />
shall <strong>in</strong>itiate departmental discipl<strong>in</strong>ary action, <strong>in</strong> accordance with <strong>the</strong> prescribed procedure <strong>of</strong><br />
<strong>the</strong> <strong>in</strong>stitution, aga<strong>in</strong>st such member <strong>of</strong> <strong>the</strong> faulty or staff.<br />
Provided that where such lapse is attributable to <strong>the</strong> Head <strong>of</strong> <strong>the</strong> <strong>in</strong>stitution, <strong>the</strong><br />
authority designated to appo<strong>in</strong>t such Head shall take such departmental discipl<strong>in</strong>ary action;<br />
and such action shall be without prejudice to any action that may be taken under <strong>the</strong> penal<br />
laws for abetment <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> for failure to take timely steps <strong>in</strong> <strong>the</strong> prevention <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> or<br />
punish<strong>in</strong>g any student found guilty <strong>of</strong> <strong>ragg<strong>in</strong>g</strong>.<br />
9.4 The Commission shall, <strong>in</strong> respect <strong>of</strong> any <strong>in</strong>stitution that fails to take adequate steps to<br />
prevent <strong>ragg<strong>in</strong>g</strong> or fails to act <strong>in</strong> accordance with <strong>the</strong>se Regulations or fails to punish<br />
perpetrators or <strong>in</strong>cidents <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> suitably, take one <strong>of</strong> more <strong>of</strong> <strong>the</strong> follow<strong>in</strong>g measures,<br />
namely;<br />
i. Withdrawal <strong>of</strong> declaration <strong>of</strong> fitness to receive grants under section 12B <strong>of</strong><br />
<strong>the</strong> Act.<br />
ii. Withhold<strong>in</strong>g any grant allocated.<br />
iii. Declar<strong>in</strong>g <strong>the</strong> <strong>in</strong>stitution <strong>in</strong>eligible for consideration for any assistance<br />
under any <strong>of</strong> <strong>the</strong> general or special assistance programmes <strong>of</strong> <strong>the</strong>
Commission.<br />
iv. Inform<strong>in</strong>g <strong>the</strong> general public, <strong>in</strong>clud<strong>in</strong>g potential candidates for admission,<br />
through a notice displayed prom<strong>in</strong>ently <strong>in</strong> <strong>the</strong> newspapers or o<strong>the</strong>r<br />
suitable media and posted on <strong>the</strong> website <strong>of</strong> <strong>the</strong> Commission, declar<strong>in</strong>g<br />
that <strong>the</strong> <strong>in</strong>stitution does not possess <strong>the</strong> m<strong>in</strong>imum academic standards.<br />
v. Tak<strong>in</strong>g such o<strong>the</strong>r action with<strong>in</strong> its powers as it may deem fit and impose<br />
such o<strong>the</strong>r penalties as may be provided <strong>in</strong> <strong>the</strong> Act for such duration <strong>of</strong><br />
time as <strong>the</strong> <strong>in</strong>stitution <strong>com</strong>plies with <strong>the</strong> provisions <strong>of</strong> <strong>the</strong>se Regulations.<br />
Provided that <strong>the</strong> action taken under this clause by <strong>the</strong> Commission aga<strong>in</strong>st any <strong>in</strong>stitution<br />
shall be shared with all Councils.<br />

CURBING THE MENACE OF RAGGING IN HIGHER EDUCATIONAL<br />
INSTITUTIONS<br />
It is brought to <strong>the</strong> notice <strong>of</strong> <strong>the</strong> Institutions, students and o<strong>the</strong>r various<br />
stakeholders that <strong>ragg<strong>in</strong>g</strong> is a crim<strong>in</strong>al <strong>of</strong>fence and UGC has framed regulations, on<br />
<strong>curb<strong>in</strong>g</strong> <strong>the</strong> <strong>menace</strong> <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> <strong>in</strong> <strong>higher</strong> educational <strong>in</strong>stitution, <strong>in</strong> order to prohibit,<br />
prevent and elim<strong>in</strong>ate <strong>the</strong> scourge <strong>of</strong> <strong>ragg<strong>in</strong>g</strong>. The regulations have been notified vide<br />
No. F. 1-16/2009 (CPP-II) dated 21.10.2009 and are available on UGC website<br />
www.ugc.ac.<strong>in</strong>.<br />
The above mentioned regulations are mandatory and shall apply to all<br />
Universities established or <strong>in</strong>corporated by or under a Central Act, a Prov<strong>in</strong>cial Act or a<br />
State/Union Territory Act and all Institutions recognized by or affiliated to such<br />
Universities and all Institutions deemed to be Universities under Section (3) <strong>of</strong> <strong>the</strong> UGC<br />
Act, 1956 with effect from 4 th July, 2009 i.e. <strong>the</strong> date <strong>of</strong> its Publication <strong>in</strong> <strong>the</strong> <strong>of</strong>ficial<br />
Gazette. All <strong>in</strong>stitutions are required to take necessary steps for its implementation<br />
<strong>in</strong> toto <strong>in</strong>clud<strong>in</strong>g <strong>the</strong> monitor<strong>in</strong>g mechanism as per provisions provided <strong>in</strong> <strong>the</strong> above<br />
regulation and ensure its strict <strong>com</strong>pliance. The follow<strong>in</strong>g preventive measures for<br />
Anti-Ragg<strong>in</strong>g should also be strictly followed:-<br />
1) The Institutions may erect suitable hoard<strong>in</strong>gs/bill boards/banners <strong>in</strong> prom<strong>in</strong>ent<br />
places with<strong>in</strong> <strong>the</strong> campus to exhort <strong>the</strong> students to prevent or not to <strong>in</strong>dulge <strong>in</strong><br />
<strong>ragg<strong>in</strong>g</strong> and also <strong>in</strong>dicat<strong>in</strong>g <strong>the</strong>re<strong>in</strong> <strong>the</strong> names <strong>of</strong> <strong>the</strong> <strong>of</strong>ficials and <strong>the</strong>ir telephone<br />
numbers to be contacted <strong>in</strong> case <strong>of</strong> <strong>ragg<strong>in</strong>g</strong>.<br />
2) All Educational Institutions should form an Anti-Ragg<strong>in</strong>g-Committee and squads<br />
and dedicated cadre <strong>of</strong> wardens and pr<strong>of</strong>essional counselors to ensure that <strong>the</strong><br />
directions <strong>of</strong> Hon’ble Supreme Court <strong>of</strong> India and Justice Raghavan Committee<br />
re<strong>com</strong>mendations are followed without exception.
3) An affidavit must be obta<strong>in</strong>ed from every Student, Parent/Guardian separately as<br />
per clause (m & n) <strong>of</strong> Regulation 6.2.<br />
4) The Institution may also undertake o<strong>the</strong>r forms <strong>of</strong> campaign as it may consider<br />
appropriate for prevention <strong>of</strong> <strong>ragg<strong>in</strong>g</strong>.<br />
5) UGC has uploaded a film on <strong>anti</strong>-<strong>ragg<strong>in</strong>g</strong> on its website. All universities and<br />
colleges are requested to download <strong>the</strong> same and give wide publicity amongst <strong>the</strong><br />
students, before <strong>the</strong> start <strong>of</strong> <strong>the</strong> academic session. Besides, this may be constantly<br />
monitored dur<strong>in</strong>g <strong>the</strong> entire period <strong>of</strong> <strong>the</strong> academic session.<br />
Any violation <strong>of</strong> UGC regulations as cited above or if any Institution fails to take<br />
adequate steps to prevent <strong>ragg<strong>in</strong>g</strong> or act <strong>in</strong> accordance with <strong>the</strong>se regulations or fails to<br />
punish perpetrators <strong>of</strong> <strong>in</strong>cidents <strong>of</strong> <strong>ragg<strong>in</strong>g</strong> suitably, UGC shall call for punitive action<br />
aga<strong>in</strong>st err<strong>in</strong>g <strong>in</strong>stitutions.<br />
