2. Bid documents may be purchased from the Office <strong>of</strong> the undersigned against a non-refundable fee towards cost<br />

<strong>of</strong> the documents indic<strong>at</strong>ed in Column 6 in shape <strong>of</strong> Cash or Demand Draft drawn in favour <strong>of</strong> the Block<br />

Development Officer, Sonepur, Dist- <strong>Subarnapur</strong> from any N<strong>at</strong>ionalised Bank and payable <strong>at</strong> St<strong>at</strong>e Bank <strong>of</strong> India,<br />

Sonepur.<br />

3. The Sale and receipt <strong>of</strong> Bid documents shall start from Dt. 22.06.2012 during <strong>of</strong>fice hours and will close on<br />

Dt. 29.06.2012 <strong>at</strong> 1.00 PM in the Office <strong>of</strong> the Panchay<strong>at</strong> Samiti Sonepur.<br />

4. Bid documents requested by mail will be disp<strong>at</strong>ched by registered/Speed post on payment <strong>of</strong> an extra amount<br />

<strong>of</strong> Rs.500/- (Rupees five hundred) only over the cost <strong>of</strong> the documents. The BDO Sonepur will not be held<br />

responsible for the postal delay, if any, in the delivery <strong>of</strong> the documents or non-receipt <strong>of</strong> the same.<br />

5. Bids must be accompanied by bid security (E.M.D.) <strong>of</strong> the amount specified for the work indic<strong>at</strong>ed in the table<br />

above in shape <strong>of</strong> N.S.C./K.V.P./ Post Office Savings Bank Account/ Post Office Time Deposit Account/Deposit<br />

receipt <strong>of</strong> any Scheduled Bank duly pledged in favour <strong>of</strong> the Block Development Officer, Sonepur.<br />

6. The bid is to be submitted with E.M.D., signed DTCN, <strong>at</strong>tested copies <strong>of</strong> registr<strong>at</strong>ion certific<strong>at</strong>e, PAN Card, Valid<br />

VAT Clearance Certific<strong>at</strong>e and documents required as per the relevant clauses <strong>of</strong> the DTCN.<br />

7. The Plan, specific<strong>at</strong>ion for the work and terms and conditions <strong>of</strong> the contract and other necessary documents<br />

can be seen <strong>at</strong> the Office <strong>of</strong> the. Block Development Officer, Sonepur during working hours and days till the last<br />

d<strong>at</strong>e <strong>of</strong> sale <strong>of</strong> the bid documents.<br />

8. Bids can be delivered in the tender box <strong>at</strong> Block Office Sonepur. The Tenderers delivered the tender documents<br />

along with the relevant documents <strong>of</strong> one work in the sealed cover with caption the name <strong>of</strong> the work over the<br />

envelop. Also he/she should put a tick mark over the work If the envelop contained more than one work’s<br />

tender documents will likely to be rejected both.<br />

9. The bids will be opened by the Sonepur Block Tender Committee <strong>of</strong> Sonepur Panchay<strong>at</strong> Samiti Office,<br />

Sonepur i.e. <strong>at</strong> 03.00 PM on d<strong>at</strong>ed 29.06.2012 in presence <strong>of</strong> the bidders or their authorized represent<strong>at</strong>ives<br />

who wish to <strong>at</strong>tend. If the Office happens to be closed on the d<strong>at</strong>e <strong>of</strong> opening, the bid will be opened on the<br />

next working day <strong>at</strong> the same time and venue.<br />

10. The bidders who download bid documents from INTERNET SITE www.subarnapur.nic.in will have to pay the cost<br />

<strong>of</strong> bid document <strong>of</strong> appropri<strong>at</strong>e amount in shape <strong>of</strong> Demand draft in favour <strong>of</strong> the BDO Sonepur payable <strong>at</strong><br />

S.B.I., Sonepur. In a separ<strong>at</strong>e envelop marked “COST OF BID DOCUMENT, DOWNLOADED FROM INTERNET”<br />

along with the bid.<br />

11. (a) In case <strong>of</strong> Engineer Contractors who are willing to avail exemption <strong>of</strong> EMD should enclose an Affidavit for<br />

the purpose. In the affidavit it should be cleared th<strong>at</strong> how many times he/she has availed such facility prior to<br />

this during the current financial year. Also the Engineer Contractor will produce his / her original license <strong>at</strong> the<br />

time <strong>of</strong> opening, so th<strong>at</strong> the authority will enter the exemption <strong>of</strong> E.M.D. in the license which is mand<strong>at</strong>ory and<br />

failing which bid shall be liable for rejection.<br />

(b) Adjustment <strong>of</strong> E.M.D. given with other bids submitted previously is not to be entertained.<br />

(c) Fixed deposit holders as per Works Department Order No.288838, dt.18.12.95 are exempted from<br />

furnishing E.M.D. but should enclose the copy <strong>of</strong> the exemption order along with the bid.<br />

12. The work will be executed through the block. The work is to be completed in all respect within four calendar<br />

months (including monsoon) from the d<strong>at</strong>e <strong>of</strong> issue <strong>of</strong> Work Order by the B.D.O. Bidders whose bid is accepted<br />

must submit a work programme <strong>at</strong> the time <strong>of</strong> execution <strong>of</strong> the Agreement.<br />

13. All bids received will remain valid for a period <strong>of</strong> 90 (Ninety) days from the last d<strong>at</strong>e <strong>of</strong> receipt <strong>of</strong> bids and<br />

validity <strong>of</strong> the bids can also be extended if agreed to by the bidders and the Department.<br />

14. For signing the Agreement by the successful bidders will be intim<strong>at</strong>ed by the Block Development Officer<br />

Sonepur. The d<strong>at</strong>e <strong>of</strong> commencement <strong>of</strong> the work will be counted from the d<strong>at</strong>e <strong>of</strong> work order given to them in<br />

writing.<br />

15. The bidders shall carefully study the tent<strong>at</strong>ive drawings and specific<strong>at</strong>ions applicable to the contract and all<br />

documents which will form a part <strong>of</strong> the agreement to be entered into by the accepted bidder and detailed<br />

specific<strong>at</strong>ion for Orissa and other relevant specific<strong>at</strong>ions and drawings which are available for sale. Complaint<br />

<strong>at</strong> a future d<strong>at</strong>e th<strong>at</strong> plans and specific<strong>at</strong>ions have not been seen by the bidders cannot be entertained.<br />

16. The drawings furnished with the bid are tent<strong>at</strong>ive and subject to revision or modific<strong>at</strong>ion during the execution<br />

as per actual necessity. But the tendered r<strong>at</strong>es quoted by the bidder will hold good in case <strong>of</strong> such modific<strong>at</strong>ion<br />

and shall in no way invalid<strong>at</strong>e the contract and no extra monetary compens<strong>at</strong>ion will be entertained. The work<br />

shall however be executed as per final approved drawing to be issued by the Engineer-in-charge as and when<br />

required.<br />

17. All r<strong>at</strong>es should be for finished item <strong>of</strong> works mentioned in the tender schedules.<br />

18. The bidder should quote the % ge r<strong>at</strong>es over the amount put to tender both in figure and words for the work.<br />

19. Every bidder is expected before quoting his/her r<strong>at</strong>es to inspect the proposed work site and should also inspect<br />

the quarries and approach roads to quarries and s<strong>at</strong>isfy himself/herself about the quality and availability <strong>of</strong><br />

m<strong>at</strong>erials. Complaints <strong>at</strong> future d<strong>at</strong>e th<strong>at</strong> the availability <strong>of</strong> m<strong>at</strong>erials <strong>at</strong> quarries has been misjudged cannot be<br />

entertained.<br />

20. The bidder may <strong>at</strong> his option quote reasonable % ge r<strong>at</strong>e for the work carefully during filled up so th<strong>at</strong> it should<br />

not be unworkable during execution.<br />

21. The bid containing the extraneous conditions not covered by the DTCN are liable for rejection and quot<strong>at</strong>ions<br />

should be strictly in accordance with the tender call notice. Any change in the wording will not be accepted.<br />

22. The authority reserves the right to reject any or all the bids received without assigning any reasons there<strong>of</strong><br />

wh<strong>at</strong> so ever.<br />

22. Bids not accompanied by required amount <strong>of</strong> E.M.D. or exemption order as per Works Department<br />

Memorandum NMo.288838, dt.18.12.95 will be summarily rejected. No E.M.D. will be accepted after closing<br />

hour <strong>of</strong> the tender.<br />

24. The earnest money will be retained in the case <strong>of</strong> successful bidder and will be dealt with as per the terms<br />

and conditions <strong>of</strong> the O.P.W.D. Code and will not carry any interest. The earnest money <strong>of</strong> the un-successful<br />

idders will be refunded on applic<strong>at</strong>ion after the bid is finally accepted.<br />

25. The bid documents received after due d<strong>at</strong>e and time will not be entertained.<br />

26. NO RELATION CERTIFICATE: - The bidder shall furnish a certific<strong>at</strong>e along with the tender to the effect th<strong>at</strong><br />

he/she is not rel<strong>at</strong>ed to any Officer in the rank <strong>of</strong> Asst. Engineer, B.D.O., Under Secretary and above in<br />

Panchay<strong>at</strong>i Raj Department. If the fact subsequently proved to be false, the contract is liable to be rescinded.<br />

The earnest money and total security will be forfeited.<br />

27. ADDITIONAL PERFORMANCE SECURITY<br />

If the bidder quoting his/her r<strong>at</strong>es less than 10 % <strong>of</strong> the scheduled amount , he/she should deposit the<br />

additional performance security to the extent <strong>of</strong> the differential cost <strong>of</strong> the bid amount and 90% <strong>of</strong> the<br />

estim<strong>at</strong>ed cost in shape <strong>of</strong> P.OS.B.A/C, P.O.T.D/ N.S.C/ K.V.P/ Deposit receipt <strong>of</strong> any Schedule Bank duly<br />

pledged in favour <strong>of</strong> the Block Development Officer Sonepur. along with the tender paper otherwise the<br />

tender will not be accepted.<br />

28. WORK EXPERIENECE<br />

Each bidder is to submit along with the bid a note regarding his/her experience on successfully completion <strong>of</strong><br />

civil work, during last 3 years. The above inform<strong>at</strong>ion should be certified by the concerned authority not<br />

below the rank <strong>of</strong> B.D.O / Executive Engineer. The same is exempted for the Engineer Contractor.<br />

29. No bidder will be permitted to furnish their bid in their own manuscript paper.<br />

30. The bidder whose bid is selected for acceptance and who has no fixed deposit with the Govt. <strong>of</strong> Orissa, shall<br />

within a period <strong>of</strong> seven days upon written intim<strong>at</strong>ion being given to him/her bid make an initial security<br />

deposit (ISD) @ 1% <strong>of</strong> the tendered amount in the form <strong>of</strong> NSC/KVP/ P.O.S.B A/C / P.O.T.D/ deposit receipt <strong>of</strong><br />

any schedule bank and in no other form so th<strong>at</strong> the EMD and ISD will be 2% (two percent) <strong>of</strong> the tendered<br />

amount and sign the agreement in the P.W.D from F2 (Schedule XLV No.61) for the fulfillment <strong>of</strong> the contract<br />

in the “Office <strong>of</strong> the BDO Sonepur” The security deposit together with the earnest money and the amount<br />

withheld according to the provision <strong>of</strong> F2 agreement shall be retained as security for the due fulfillment <strong>of</strong><br />

this contract. Failure to enter into the required agreement and to make the security deposits as above shall<br />

entail forfeiture <strong>of</strong> the E.M.D. No bid shall be finally accepted until the required amount <strong>of</strong> security money is<br />

deposited. The written agreement to be entered into between the contractor and the Govt. shall be the<br />

found<strong>at</strong>ion <strong>of</strong> the rights <strong>of</strong> both the parties and the contract shall be deemed to be incomplete until the<br />

agreement has first been signed by the Contractor and then by the proper Officer authorized to enter into<br />

the contract on behalf <strong>of</strong> the Govt. As concurred by Law Department and Finance Department in their U.O.R.<br />

No.848, Dt. 21.05.97, J.O.R. No.202, W.F.D., d<strong>at</strong>ed.6.03.98 respectively the E.M.D. will be forfeited in the<br />

case, where the bidders back out from the <strong>of</strong>fer before acceptance <strong>of</strong> the bid by the competent authority.<br />

The security will be refunded six months after completion <strong>of</strong> the work and payment <strong>of</strong> the final bill and will<br />

not carry any interest.<br />

31. U/S.12 <strong>of</strong> Contract Labour (Regul<strong>at</strong>ion and Abolition Act, 1970) the Contractor, who undertakes execution <strong>of</strong><br />

work through labour, should produce valid license from Licensing Authority <strong>of</strong> Labour Department.<br />

32. The Contractor shall be liable to fully indemnify the department <strong>of</strong> any compens<strong>at</strong>ion under Workmen<br />

Compens<strong>at</strong>ion Act VIII <strong>of</strong> 1993 on account <strong>of</strong> the Workmen employed by the Contractor and full amount <strong>of</strong><br />

compens<strong>at</strong>ion paid will be recovered from the Contractor.<br />

33. The bidders are required to abide by the fair wages clause as introduced by the Govt. <strong>of</strong> Orissa and will not<br />

pay less than the fair wages fixed by the Govt. to the labourer engaged by him/her for the work.<br />

34. The contractor are quote there % ge both in words and figures and put their sign<strong>at</strong>ure on every over writings.<br />

35. The length and sizes <strong>of</strong> the M.S. or Tor steel are to be procured by the contractor and should be TATA TISCON<br />

/ SAIL or any rod approved by the DRDA <strong>Subarnapur</strong>.<br />

36. No part <strong>of</strong> the contract shall sublet without writing permission <strong>of</strong> the BDO and P.D.DRDA. or transfer be made<br />

by power <strong>of</strong> <strong>at</strong>torney authorizing other to receive payment on the contractor’s behalf.<br />

37. Only ACC/Konark/ Ultr<strong>at</strong>ech cement (OPC &PPC) are to be used and weight <strong>of</strong> each cement bag being taken<br />

as 50 Kg.<br />

38. In case <strong>of</strong> any complaint by the labourer working about the non-payment <strong>of</strong> his/her wages as per l<strong>at</strong>est<br />

minimum wages Act, the B.D.O., will have the right to investig<strong>at</strong>e and if the contractor is found to be in<br />

default, he/she may recover such amount due from the Contractor and pay such amount to the labourer<br />

directly under intim<strong>at</strong>ion to the local labour Officer <strong>of</strong> the Govt. The contractor shall not employ child labour.<br />

The decision <strong>of</strong> the B.D.O. is final and binding on the contractor.<br />

39. No compens<strong>at</strong>ion will be paid by the Department for any damage done by rain, flood, cyclone, and tide or by<br />

any other n<strong>at</strong>ural calamities during the execution <strong>of</strong> the work.<br />

40. It should be understood clearly th<strong>at</strong> no claim wh<strong>at</strong>soever will be entertained in regard to extra items <strong>of</strong> work<br />

or extra quantity <strong>of</strong> any item besides estim<strong>at</strong>ed amount, unless written order is obtained from the<br />

BDO/Addl P.D. (Tech) DRDA and r<strong>at</strong>es settled before the extra items <strong>of</strong> work or extra quantity <strong>of</strong> any item <strong>of</strong><br />

work is taken up.<br />

41. The bidder shall have to abide by the C.P.W.D. safety Code Rules introduced by the Govt. <strong>of</strong> India, Ministry <strong>of</strong><br />

Works Housing and Supply in their standing order No.44150 dt. 25.11.1957.<br />

42. The Contractor shall bear various incidentals, sundries and contingencies necessit<strong>at</strong>ed by the work in full<br />

within the following or similar c<strong>at</strong>egory.<br />

(a) Rent, Royalties and other charges <strong>of</strong> m<strong>at</strong>erials, Octroi duty, all other taxes including sales tax, ferry tolls,<br />

conveyance charges and other cost on account <strong>of</strong> land and building including temporary building and<br />

construction <strong>of</strong> service road and diversion road and its’ maintenance till completion <strong>of</strong> the work as<br />

required by the Contractor for collection <strong>of</strong> m<strong>at</strong>erials, storage, housing <strong>of</strong> staff or other purpose <strong>of</strong> the<br />

work. No bidder will however be liable to pay Govt. for temporary occup<strong>at</strong>ion <strong>of</strong> land owned by Govt. <strong>at</strong><br />

the site <strong>of</strong> work.<br />

(b) Labour Camps or huts necessary to a suitable scale including conservancy and sanitary arrangements<br />

there in to the s<strong>at</strong>isfaction <strong>of</strong> the local health authorities.<br />

(c) Suitable w<strong>at</strong>er supply including pipe w<strong>at</strong>er supply wherever available for the staff and labour as well as<br />

for the work.<br />

(d) Fees and duties levied by the Municipal Canal or w<strong>at</strong>er supply authorities.<br />

(e) Suitable equipment and w<strong>at</strong>ering appar<strong>at</strong>us for the labour engaged in risky oper<strong>at</strong>ion and medical aid to<br />

the labourer engaged for the work.<br />

(f) Suitable fencing, barriers, signals including electric signals where necessary <strong>at</strong> work and approaches in<br />

order to protect public and employees from accident.<br />

(g) Compens<strong>at</strong>ion including cost <strong>of</strong> any suit for injury to persons or property due to neglect <strong>of</strong> any major<br />

precautions also becomes payable due to oper<strong>at</strong>ion <strong>of</strong> the workmen compens<strong>at</strong>ion Act.<br />

(h) The Contractor has to arrange adequ<strong>at</strong>e lighting arrangement for the work wherever necessary <strong>at</strong> his own<br />

cost.<br />

43. All preliminary works such as V<strong>at</strong>s, mixing pl<strong>at</strong>form etc. are to be done by the Contractor <strong>at</strong> his own cost.<br />

44. The Contractor should arrange the m<strong>at</strong>erials like steel, cement, paint, shutters, bitumen etc. <strong>of</strong> approved<br />

quality and specific<strong>at</strong>ion <strong>at</strong> his own cost for completion <strong>of</strong> the work with the time schedule. No extension <strong>of</strong><br />

time will be granted to the Contractor due to delay in procurement <strong>of</strong> m<strong>at</strong>erials. The m<strong>at</strong>erials can be supplied<br />

by the BDO on recommend<strong>at</strong>ion <strong>of</strong> the J.E. and A.E. to the contractor on Payment basis.<br />

45. The department will have the right to supply <strong>at</strong> any time in the interest <strong>of</strong> the work any departmental<br />

m<strong>at</strong>erials to be used in the work and the contractor shall use such m<strong>at</strong>erials without any controversy or<br />

dispute on th<strong>at</strong> account. The r<strong>at</strong>e <strong>of</strong> issue <strong>of</strong> such m<strong>at</strong>erials will be <strong>at</strong> the stock issue r<strong>at</strong>e inclusive <strong>of</strong> storage<br />

charges or r<strong>at</strong>es fixed by the Department or current market r<strong>at</strong>e whichever is higher.<br />

46. The Contractor will be responsible for the loss or damage <strong>of</strong> any departmental m<strong>at</strong>erials during transit and in<br />

the execution <strong>of</strong> the work due to reason wh<strong>at</strong>-so-ever and the cost <strong>of</strong> such m<strong>at</strong>erials will be recovered from<br />

the bills <strong>at</strong> stock issue r<strong>at</strong>es or market r<strong>at</strong>es whichever is higher.<br />

47. If the Contractor removes Govt. m<strong>at</strong>erials supplied to him/her from the work site with a view to dispose <strong>of</strong> the<br />

same dishonestly, he shall be in addition to any other liability Civil or criminal arising out <strong>of</strong> his contract be<br />

liable to pay a penalty equivalent to five times <strong>of</strong> the price <strong>of</strong> the m<strong>at</strong>erials according to the stock issue r<strong>at</strong>e or<br />

market r<strong>at</strong>e whichever is higher. The penalty so imposed shall be recovered <strong>at</strong> any time from any sum th<strong>at</strong><br />

may then or <strong>at</strong> any time thereafter become due to the Contractor or from his/her security deposit or from the<br />

proceeds <strong>of</strong> sale there<strong>of</strong>.<br />

48. The selected Contractor may take delivery <strong>of</strong> departmental supply according to his need for the work issued<br />

by the Department subject to the availability <strong>of</strong> the m<strong>at</strong>erials. The Contractor shall make all arrangement for<br />

proper storage <strong>of</strong> m<strong>at</strong>erials but no cost for raising shed for storage, pay <strong>of</strong> w<strong>at</strong>chman etc. will be borne by the<br />

Department. The department is not responsible for considering the theft <strong>of</strong> m<strong>at</strong>erials <strong>at</strong> site. It is contractor’s<br />

risk. Under any such plea if the Contractor stops the work, he/she shall have to pay the full penalty as per<br />

Clause <strong>of</strong> F2 agreement.<br />

49. After the work is finished all surplus m<strong>at</strong>erials and debris’s should be removed 100 meters clear ways from<br />

work site. Preliminary works such as V<strong>at</strong>s, mixing pl<strong>at</strong>form etc. should be dismantled and all m<strong>at</strong>erials<br />

removed from the work site and premises left ne<strong>at</strong> and clean and this should be inclusive <strong>of</strong> the r<strong>at</strong>es.<br />

50. The contractor should <strong>at</strong> his/her own cost arrange necessary tools and plants required for the efficient<br />

execution <strong>of</strong> work and the r<strong>at</strong>es quoted should be inclusive <strong>of</strong> the running charges <strong>of</strong> each plant and cost <strong>of</strong><br />

conveyance. The machineries, if available, with the department may be supplied on hire as per charges fixed<br />

by the Department.<br />

51. The depth <strong>of</strong> found<strong>at</strong>ion indic<strong>at</strong>ed on the drawing are provisional but these may be altered if necessary in the<br />

light <strong>of</strong> the n<strong>at</strong>ure <strong>of</strong> str<strong>at</strong>a indic<strong>at</strong>ed by boring which must be taken in advance <strong>of</strong> actual execution <strong>of</strong> the<br />

found<strong>at</strong>ion.<br />

52. The stack <strong>of</strong> road metal and muroom will be measured in box heaps <strong>of</strong> 1.50 X 1.50 X 0.44 M which will be<br />

taken as One Cum. The soling stone will be measured in the suitable stacks with deduction for voids @ 1/6 th <strong>of</strong><br />

volume or more depending upon the looseness <strong>of</strong> stacking which would be determined on actual observ<strong>at</strong>ion<br />

and deduction.. No claim for carriage <strong>of</strong> w<strong>at</strong>er wh<strong>at</strong> so ever will be entertained.<br />

53. It is the responsibility <strong>of</strong> the Contractor to procure and store explosive required for blasting oper<strong>at</strong>ion, if any.<br />

The Department may render necessary possible help for procuring license.<br />

54. Items <strong>of</strong> works not covered by the tender notice shall be paid <strong>at</strong> the current schedule <strong>of</strong> r<strong>at</strong>es <strong>of</strong> the St<strong>at</strong>e and<br />

those not covered by the said schedule <strong>of</strong> r<strong>at</strong>es will be paid on actual analysis approved by the Competent<br />

Authority.<br />

55. On no account, the contract work should be sublet to any body without the prior approval <strong>of</strong> the Department.<br />

In such an event the Contract may be rescinded.<br />

56. Dew<strong>at</strong>ering from the found<strong>at</strong>ion <strong>of</strong> bridges, culverts, buildings worksites etc. and w<strong>at</strong>ering for consolid<strong>at</strong>ion in<br />

roads embankments when and where necessary during execution will have to be done by the contractor and<br />

no extra payment will be made on th<strong>at</strong> account.<br />

57. Number <strong>of</strong> tests as specified in I.R.C./MORT & H/I.S.I. specific<strong>at</strong>ion required for the construction <strong>of</strong><br />

road/bridges/buildings or any other structural works will be conducted in any Govt. labor<strong>at</strong>ories or reputed<br />

m<strong>at</strong>erial testing labor<strong>at</strong>ory as to be decided by the Engineer in-charge. Testing charges including expenditure<br />

for collection/transport<strong>at</strong>ion <strong>of</strong> samples/specimens etc. will be borne by the Contractor. The collection <strong>of</strong><br />

samples and testing are to be conducted for both prior to execution as may be directed by the Engineer incharge<br />

and on both the accounts the cost shall be borne by the Contractor.<br />

58. Any damages caused by n<strong>at</strong>ural calamities should be repaired by the Contractor <strong>at</strong> his own cost. The<br />

Department will not be any way responsible for the same and will not pay any cost towards the repair done by<br />

the Contractor.<br />

59. Over and above these conditions, the terms and conditions and rules and regul<strong>at</strong>ions and specific<strong>at</strong>ions as laid<br />

down in Orissa Detailed Standard Specific<strong>at</strong>ion, Orissa P.W.D. Code, Bridge Code and MORT &H specific<strong>at</strong>ions<br />

with l<strong>at</strong>est revision/ amendment are also binding on the part <strong>of</strong> the Contractor.<br />

60. The contractor shall supply sample <strong>of</strong> all m<strong>at</strong>erials before procurement for the work for testing and<br />

acceptance as may be required by the Engineer in-charge.<br />

61. The contractor has to arrange the land required for borrowing earth if necessary for the road work <strong>at</strong> his/her<br />

cost. No extra payment by the Department will be made on this account and no claim wh<strong>at</strong> so ever will be<br />

entertained on this ground. The r<strong>at</strong>es quoted by the Contractor should be inclusive <strong>of</strong> all such charges.<br />

62. The inform<strong>at</strong>ion furnished must be sufficient to show th<strong>at</strong> the applicant is capable in all respects to<br />

successfully complete the envisaged work.<br />

63. Even qualified criteria are met; the bidders can be disqualified for the following reasons, if enquired by the<br />

Department.<br />

(a) Making a false st<strong>at</strong>ement or declar<strong>at</strong>ion<br />

(b) Past record <strong>of</strong> poor performance<br />

(c) Past record <strong>of</strong> abandoning the work half way/ rescinment <strong>of</strong> contract.<br />

(d) Past record <strong>of</strong> in-ordin<strong>at</strong>e delay in completion <strong>of</strong> the work.<br />

(e) Past history <strong>of</strong> litig<strong>at</strong>ion.<br />

In case <strong>of</strong> the 1 st lowest tendered or even the next lowest tendered withdraw in series one by one, thereby<br />

facilit<strong>at</strong>ing a particular tender for award, and then they shall be penalized with adequ<strong>at</strong>e disincentives with<br />

forfeiture <strong>of</strong> E.M.D. unless adequ<strong>at</strong>e justific<strong>at</strong>ion for such back out is furnished. Appropri<strong>at</strong>e action for black<br />

listing the tenderers shall also be taken apart from disincentivising the tender.<br />

64. PROVIDING FACILITIES TO THE ENGINEER CONTRACTOR :<br />

(a) As per works Department No.FR 11/2001/10003/00 BBSR, dt.24.05.01, 5% price preference allowed to the<br />

Engineer Contractor in the tender r<strong>at</strong>es has been withdrawn.<br />

(b) Exemption <strong>of</strong> E.M.D. to the Engineer Contractor will be allowed for a maximum <strong>of</strong> three works in a financial<br />

year for particip<strong>at</strong>ing in the tender and the fact <strong>of</strong> particip<strong>at</strong>ing with exemption <strong>of</strong> E.M.D. should be entered<br />

in the original Registr<strong>at</strong>ion Certific<strong>at</strong>e <strong>of</strong> the Engineer Contractor.<br />

65. Income Tax will be deducted from the Contractor’s bill @ prevailing percentage fixed by I.T. Department.<br />

66. Prevailing r<strong>at</strong>e <strong>of</strong> VAT on the gross amount <strong>of</strong> the bill will be deducted from Contractor’s bill.<br />

67. Under no circumstances interest is chargeable for the dues or additional dues if any payable for the work.<br />

68. The Contractors are required to pay royalty to Govt. as fixed from time to time and produced such<br />

authentic<strong>at</strong>ed documents in support <strong>of</strong> their payment as royalty, along with their bills. Failing which, the<br />

amount <strong>of</strong> royalties <strong>of</strong> different m<strong>at</strong>erials as utilized by them in the work will be recovered from their bills.<br />

69. The contractor shall be responsible for the defect liability period for one year from the d<strong>at</strong>e <strong>of</strong> completion <strong>of</strong><br />

the Project.<br />

75. S.C/S.T contractors should pay Earnest Money 50 % along with the <strong>at</strong>tested copies <strong>of</strong> the caste certific<strong>at</strong>e and<br />

an undertaking in shape <strong>of</strong> affidavit th<strong>at</strong> he has not avail the concessions for more than three times in the<br />

current financial year 2011 - 12. If the tender <strong>of</strong> the S.C./S.T. contractor is within 10% <strong>of</strong> the r<strong>at</strong>e quoted by the<br />

lowest tenderer for the work, the same will be considered for awarded to him/her <strong>at</strong> the lowest tender r<strong>at</strong>e.<br />

Any amendment order noticed by the Government may be enclosed by the contractor to get the facilities in<br />

the tender.<br />
