<strong>District</strong> Attendance Policy<br />

According to N.Y.S. Law, children must attend school between the ages of six and<br />

16-years-old. Absence from school for the following reasons are considered excusable:<br />

illness, death or illness in the family, medical appointments, impassable roads, religious<br />

observances, quarantine, an approved college visit, take-your-child-to-work-day, military<br />

obligations, required presence in court, remedial health treatment, approved cooperative<br />

work programs or other reason approved by Board of Education. Absences,<br />

tardiness or early departure are considered unexcused if they do not fall<br />

in one of the above categories. Unexcused absences include: family vacation,<br />

hunting, babysitting, hair cut, obtaining learner's permit, road test, oversleeping. Please<br />

inform the school prior to 9 a.m. that morning if your child will be absent, and send<br />

a written excuse with your child when he or she returns to school stating the date<br />

and reason for the absence. After three days without an excuse, the student is<br />

declared illegally absent. If a student needs to be excused from school early, please<br />

write an excuse. In grades K-6, the student should present the excuse to the classroom<br />

teacher, and in grades 7-8, to the school nurse.<br />

High <strong>School</strong> Attendance Policy<br />

ABSENCE: Parents are responsible for calling the Attendance Office when their child<br />

is absent at 585-392-1000 ext. 2246. Voice mail is available 24 hours a day. Please<br />

follow up your phone call with a note. Excused absence is defined as: SICK, DOC-<br />

TOR OR DENTIST APPOINTMENT, COURT, FUNERAL, COLLEGE VISIT. Unverified<br />

absences are unexcused. Teachers do not have to let students make up work for<br />

unexcused absences. Please notify the Attendance Office of extended absences such<br />

as vacations or surgery.<br />

EARLY DISMISSAL FOR APPOINTMENTS: Contact must be made between<br />

parent/guardian and the Attendance Office before a student may be dismissed from<br />

school. Students should bring a note to the Attendance Office before school begins<br />

to get a pass to leave. They can then sign out at the appointed time and meet their<br />

ride at the front of the school. Parents can make arrangements to pick up their child<br />

by calling the Attendance Office. If a student feels ill and wants to go home early, they<br />

should go to the Nurse or Attendance Office to call home. They are not allowed to<br />

call from class or use cell phones.<br />

TARDIES [LATE]: Students who arrive after 7:25 a.m. are tardy to school and must<br />

sign in. Students with a note for being sick, at a doctor or dentist appointment, or<br />

other excused reason will not be penalized for tardiness.<br />

HCSD Food Service/Child Nutrition<br />

<strong>Hilton</strong>’s Food Service and Child Nutrition Program prepares and serves over 2,300<br />

lunches and 300 breakfasts per day and employs a prepayment system for students purchasing<br />

lunch. Subsidies are available for families who are eligible for the Free or Reduced<br />

Price Lunch Program. Lunch prices are: Grades K-12 Lunch: $2.00 [NEW]; Breakfast:<br />

$1.00 [all schools]. Pre-payment of weekly lunches is available at each school.<br />

<strong>Hilton</strong> Food Service Catering Policy precludes bringing home-baked or home-cooked<br />

food items into any school or classroom in order to comply with stricter sanitary and<br />

hygenic practices. “The <strong>Hilton</strong> Food Service Program is the only group authorized to<br />

cater functions in the <strong>Hilton</strong> <strong>School</strong> <strong>District</strong>,” Policy 3260R Community Relations reads.<br />

This policy also refers to food being sold at extra-curricular functions: “All food must<br />

be prepared by or obtained by a licensed establishment. [with State/County Health<br />

Dept. permits].” For information, please call the Food Service Office, Director Nancy<br />

Armocida at 585-392-1000 ext. 2152.<br />

Transportation Services<br />

All <strong>Hilton</strong> <strong>Central</strong> <strong>School</strong> <strong>District</strong> students are transported except those grades 7-12<br />

students living in the village of <strong>Hilton</strong> who have sidewalks available and live less than 0.9<br />

mi. from <strong>Hilton</strong> High <strong>School</strong> or 0.6 mi. from Merton Williams Middle <strong>School</strong>. Childcare<br />

Transportation Request forms are required for those children receiving childcare<br />

in a location other than the home; applications are available from the Trans. Dept.<br />

at 392-1000 ext. 7402 and need to be returned to the Transportation Dept.<br />

by August 1. Transportation of private and parochial students outside the district is<br />

provided up to a maximum of 15 miles. Transportation for handicapped students is<br />

provided a maximum of 50 miles from the district. Requests for transportation of nonhandicapped<br />

students attending private schools must be made by April 1.<br />

Emergency <strong>School</strong> Closing & Early Dismissal<br />

When bad weather or any other emergency situation forces the closing of district<br />

schools, the information will be communicated as soon as possible to both TV and<br />

radio media including WHAM 1180; WROC TV-8; WHEC TV-10; WOKR TV-13; RNEWS<br />

CH 9; FOX News; etc. A message is also placed on the <strong>District</strong>’s Main Telephone<br />

Number, 585-392-1000, as soon as possible. The decision to close school in winter<br />

weather-related situations will normally be made no later than 6:30 a.m. in most cases,<br />

prior to the school buses being sent on the road. Most TV and radio stations carry<br />

school closing information. When schools are closed for weather-related conditions,<br />

all other activities including YMCA Child Care; sports practice, athletic events; student<br />

activities; Community Education; and community-related classes and activities may be<br />

cancelled. EdAlert, a NEW, urgent message by email begins this school year. Go to<br />

Early Dismissal . . . Have a Plan in Place and<br />

Communicate this to your Children<br />

In the event of an early dismissal of students during the school day due to loss of power,<br />

loss of water, or other emergency situation, there are procedures in place to transport<br />

students home. This information will be communicated as soon as possible to both TV<br />

and radio media. A message is on the <strong>District</strong> Number, 392-1000. Parents indicate a<br />

course of action to be taken on the Emergency Closing Data Card which is completed<br />

for all K-6 students, and updated every year for grades 7-12. Please take this opportunity<br />

to talk to your child. Make sure your child knows where to go in your<br />

neighborhood if the parent or caregiver is not at home.<br />

HCSD Community Education offers Driver Education;<br />

Online Learner's Permit testing; Five-Hour Pre-Licensing;<br />

Defensive Driving; Insurance/Point Reduction<br />

<strong>Hilton</strong>’s Community Education program offers Driver Education; the NYS Dept. of Motor<br />

Vehicles [DMV] Online Learner's Permit held in the High <strong>School</strong> Library Computer<br />

Free <strong>School</strong> #4 at West Ave. and Henry St. The Henry<br />

Street <strong>School</strong> opened in 1930. The Union Free <strong>School</strong><br />

housed grades 1-12 and was built in 1892.<br />

Physicals, Immunizations & Medicines<br />

New York State Education Law requires physical examinations be completed in grades<br />

PRE-K, K, 2, 4, 7 and 10, as well as for new entrants to school. Examinations are<br />

best completed by your physician. After Oct. 1 the school district physician will perform<br />

a health appraisal. HEALTH APPRAISAL forms are now available ONLINE<br />

on the <strong>District</strong> Web Site www.hilton.k12.ny.us and at each school’s Nurse's Office.<br />

These must be completed by your physician. Vision, hearing and scoliosis [curvature<br />

of the back] screenings are also held in the schools.<br />

Immunization Requirements Pre-K-12 for school entrance:<br />

(1) DTaP (diptheria toxoid-containing vaccine);<br />

(2) Tdap Booster (tetanus, diptheria and pertussis) - born on or after January 1, 1994<br />

and enrolling in sixth grade;<br />

(3) Polio [IPV];<br />

(4) MMR (measles, mumps, rubella);<br />

(5) Varicella [Chicken Pox]: - born on or after Jan. 1, 1998 or born on or after Jan. 1,<br />

1994 and enrolling in sixth grade;<br />

(6) Hepatitis B (Hep B);<br />

(7) Haemophilus influenza type b (Hib) - Pre-Kindergarden entrants only.<br />

Other immunizations: Tetanus Td (tetanus-diptheria booster)<br />

College-Bound Students planning to attend colleges in N.Y.S. are required to show<br />

proof of MMR and menigitis immunization; for more www.cdc.gov/<br />

COMMUNICABLE DISEASE recommendations:<br />

(1) if there is a suspicion of a communicable disease, consult your physician for diagnosis<br />

and treatment;<br />

(2) call the Nurse’s Office to report the disease and re-admittance policy;<br />

(3) for readmission to school in some instances, the parent must accompany the<br />

child to school for examination.<br />

MEDICINE IN SCHOOL may be dispensed in school under strict guidelines established<br />

by New York State:<br />

(1) ALL medication taken in school including over-the-counter drugs (pain medication,<br />

cough syrups, lozenges, etc.) must be prescribed by a physician;<br />

(2) The school nurse MUST have on file a written request from the student’s physician<br />

and a written request from the parent to administer the medication;<br />

(3) NO medication of any kind is to be brought to school by a child. It must be<br />

delivered directly to the school nurse by a parent; not transported on the bus.<br />

NYS Graduation Requirements<br />

In order to obtain a high school Regents diploma, students are required to take and<br />

pass five Regents examinations. Graduation requirements are: English - 4 cr. including<br />

Gr. 11 Comprehensive English Language Arts Regents passing at 65%+; Math - 3 cr. and<br />

passing at 65%+ passing; Social Studies - 4 cr. including Global History & Geography<br />

and U.S. History & Government Regents and Participation in Government/Economics<br />

at 65%+ passing; Science - 3 cr. including one Regents Science exam at 65%+ passing<br />

[Earth Science, The Living Environment, Chemistry and/or Physics]; Art/Music 1 cr.;<br />

Health .5 cr.; P.E. 2 cr.; Parenting - .5 cr. [Parenting Education or Child Psychology &<br />

All new and transfer students register at the Census Office located at <strong>District</strong><br />

Offices, 225 West Ave., <strong>Hilton</strong>. You may call for an appointment at 585-392-1000 ext.<br />

6072/7031. Registration packets are sent prior to the appointment. Forms are online<br />

certificate; social security card; proof of residency [deed, rental/lease contract, utility<br />

Kindergarten Registration<br />

Children are eligible to enroll in kindergarten if their fifth birthday falls on or before<br />

December 1 following the start of school in September. <strong>Hilton</strong> <strong>School</strong> <strong>District</strong> offers<br />

full-day kindergarten. Original birth certificate, proof of residency, social security<br />

card and proof of immunization are required. Families living in the district at the time<br />

of the annual census will receive registration information in the mail. Kindergarten<br />

registration is held March 16-17, 2009 for Northwood and Village Elementary schools.<br />

Applications for Quest Elementary are due Feb. 29, 2008 including kindergarten. Quest<br />

Kindergarten registration will be held March 9-10, 2009. Families new to the <strong>District</strong><br />

Quest Elementary <strong>School</strong> Registration<br />

Quest Elementary <strong>School</strong>, an authorized International Baccalaureate Primary Years Programme,<br />

is a K-6 multi-age community of learners that parents and students can choose<br />

to attend no matter where you live in the <strong>District</strong>. Quest promotes a sense of community<br />

through multi-age groupings and parent involvement and develops critical thinkers<br />

through inquiry-based learning. Registration is open to any <strong>Hilton</strong> student, incoming<br />

kindergartner to grade six. Quest’s population is representative of other classrooms in<br />

the <strong>District</strong> and includes special education students. Once a family is enrolled in Quest<br />

Elementary, other siblings are given preference.<br />

<strong>School</strong> Safety, Security & Code of Conduct:<br />

The <strong>Hilton</strong> <strong>School</strong> <strong>District</strong> is staffed with personnel in all of our schools who are<br />

trained and equipped to respond to incidents involving security issues. The Youth Assistants<br />

have substantial expertise in school security, defusing conflict and working with<br />

youth. Director of Safety & Security is Steven Lemon: 585-392-1000 ext. 2337.<br />

ID Badges: <strong>District</strong> policy requires that all HCSD staff members visibly wear a photo<br />

identification badge while working. Students in grades 7-12 are issued ID cards which<br />

they are required to carry while in school. Building Access: Visitors to each <strong>Hilton</strong><br />

<strong>School</strong> are required to enter via the main door during the school day. Visitors are<br />

required to check in at the main security station and sign in. Visitors may be required<br />

to present identification if they are not known by staff. False Bomb Threats: Threatening<br />

messages are taken very seriously. Anyone issuing a false bomb threat directed<br />

toward a school is subject to a Class D felony punishable by up to seven years in prison.<br />

Safety and evacuation plans are in place in every building. <strong>District</strong> Policy on Guns<br />

in <strong>School</strong>s: Approved by the Board of Education in 1995 in accordance with federal<br />

and state laws including SAVE, the Gun-Free <strong>School</strong>s Legislation, Policy # 7361 and 7361R<br />

require a mandatory, one-year suspension for any student found guilty of bringing a firearm<br />

to school. A <strong>District</strong> Safety Committee meets regularly to review safety concerns<br />

Code of Conduct:<br />

The Safe <strong>School</strong> Against Violence in Education [SAVE] and Section 100.2[1] of the<br />

Regulations of the Commissioner of Education require that each school district adopt a<br />

written policy on school conduct and discipline "designed to promote responsible student<br />

behavior." Each year a public hearing is held in June after which the <strong>Hilton</strong> Board<br />

of Education reauthorizes a K-12 Code of Conduct. A copy of the complete Code of<br />

Conduct document is available on the <strong>Hilton</strong> <strong>District</strong> Web Site www.hilton.k12.ny.us/<br />

codeofconduct.htm and at every school’s main office. The Code of Conduct applies<br />

to all students, school personnel, parents and other visitors when on school property<br />

or attending any school function. The <strong>District</strong>'s annually-approved Code of Conduct for<br />

Special Education Learning Support Services<br />

<strong>Hilton</strong> Learning Support Services [LSS] is located in <strong>District</strong> Offices, 225 West Ave.,<br />

<strong>Hilton</strong>. Director of Student Services and 504/ADA Coordinator is Maureen Thayer.<br />

Director of Special Education is Laura Whitcomb. Chairperson for the Committee<br />

on Special Education [CSE] is Julie Tempio. Chairperson for the Committee on<br />

Prechool Special Education [CPSE] TBA.<br />

Individualized Education Plan [IEP] is developed for students identified for special<br />

education services. The process is governed by State and Federal law and regulations<br />

including Sect. 504 of the ADA (Americans with Disabilities Act) which protects the rights<br />

of individuals with disabilities in programs and activities which receive federal funds<br />

from the U.S. Dept. of Education. The Office is responsible for the evaluation, placement<br />

and service provision of and for students with disabilities as defined by Part<br />

200 of the Commissioner’s Regulations and IDEA (Individuals with Disabilities Education<br />

Improvement Act of 2004) which mandates a free and appropriate education in the least<br />

restrictive environment.<br />

Pre-school evaluations, English as a Second Language services, home and hospital<br />

tutoring services, health-related services, social worker services, psychological<br />

services, speech and language services, occupational therapy, physical therapy, extended<br />

school year programs are governed and coordinated through this office.<br />

The <strong>Hilton</strong> <strong>Central</strong> <strong>School</strong> <strong>District</strong> provides access to the Internet. Students are encouraged to utilize these resources to promote the exchange of information to further education<br />

and research. The <strong>District</strong> provides Internet filtering as part of the <strong>District</strong> Computer Services; however, no filtering technology can guarantee that staff and students will be<br />

prevented from accessing all inappropriate locations. The users shall understand that communications on the <strong>District</strong> Computer Services are often public in nature. These services<br />

are monitored routinely by the <strong>School</strong> <strong>District</strong>, Internet providers, and/or law enforcement agencies. The <strong>District</strong>'s Acceptable Use Policy and accompanying Regulations will be disseminated<br />

to parents and students in order to provide notice of the school's requirements, expectations, and student's obligations when accessing the Internet. "Passive Consent"<br />

HCSD Code of Conduct Plain Language Summary<br />

The Safe <strong>School</strong> Against Violence in Education [SAVE]<br />

and Section 100.2[1] of the Regulations of the Commissioner<br />

of Education require that each school<br />

district adopt a written policy on school conduct and<br />

discipline "designed to promote responsible student<br />

behavior." Each year a public hearing is held in June after<br />

which the <strong>Hilton</strong> Board of Education reauthorizes<br />

a K-12 Code of Conduct. A copy of the complete<br />

Code of Conduct document is available on the <strong>Hilton</strong><br />

<strong>District</strong> Web Site www.hilton.k12.ny.us/codeofconduct.htm<br />

and at every school’s main office.<br />

The Code of Conduct applies to all students, school<br />

personnel, parents and other visitors when on school<br />

property or attending any school function. Roman<br />

numeral designations found in this summary correspond to<br />

the specific areas of information within the complete Code.<br />

I INTRODUCTION<br />

The <strong>District</strong> has a long-standing set of expectations for<br />

conduct on school property and at school functions.<br />

These expectations are based upon mutual respect,<br />

citizenship, character, civility, tolerance, honesty, and<br />

integrity.<br />

II HILTON BOARD OF EDUCATION POLICY<br />

The Board of Education [BOE] is committed to providing<br />

a safe and orderly school environment where<br />

students may receive and <strong>District</strong> personnel may<br />

deliver quality educational services without disruption<br />

or interference. Responsible behavior by students,<br />

teachers, other <strong>District</strong> personnel, parents, and other<br />

visitors is essential to achieving this goal. The Board of<br />

Education recognizes the need to clearly define these<br />

expectations for acceptable conduct on school property,<br />

outline possible consequences of unacceptable<br />

conduct, and to ensure that discipline when necessary<br />

is administered promptly and fairly.<br />

III DEFINITIONS - For the purposes of this Code<br />

of Conduct, the following definitions apply:<br />

Disruptive Student<br />

"Disruptive Student" means an elementary or secondary<br />

student under the age of 21 who is substantially<br />

disruptive of the educational process or substantially<br />

interferes with the teacher's authority over the classroom.<br />

This behavior may include students who:<br />

• Continuously interfere with the educational process.<br />

• Continuously interfere with the teacher's authority<br />

over the classroom.<br />

• Demonstrates a persistent unwillingness to comply<br />

with the teacher's instructions.<br />

Violent Student<br />

Any student under the age of 21 who:<br />

• Commits an act of violence upon a school employee.<br />

• Commits, while on school property or at a<br />

school function, an act of violence upon another student<br />

or any other person lawfully on school property<br />

or at a school function.<br />

• Possesses, while on school property or at a school<br />

function, a weapon [below].<br />

• Displays, while on school property or at a school<br />

event, what appears to be a weapon.<br />

• Threatens, while on school property or at a school<br />

event, to use a weapon, inflict bodily harm, or communicates<br />

acts of violence with phrases that contain<br />

words such as kill, shoot, stab, murder, etc.<br />

• Knowingly and intentionally damages or destroys<br />

personal or school property of any school employee<br />

or any person lawfully on school property or at a<br />

school function.<br />

Weapon<br />

A firearm as defined in 18USC s/s921 for purposes of<br />

the Gun Free <strong>School</strong> Act. It also means any other gun,<br />

pistol, revolver, shotgun, rifle, machine gun, disguised<br />

gun, dagger, dirk, razor, stiletto, switchblade knife,<br />

gravity knife, brass knuckles, sling shot, metal knuckle<br />

knife, electronic dart gun, kung fu star, electronic stun<br />

gun, pepper spray or other noxious spray, explosive<br />

or incendiary bomb, or other device, instrument or<br />

substance that can cause physical injury or death<br />

when used as a weapon.<br />

IV ESSENTIAL PARTNERS<br />

Essential partners are stakeholders who have a collaborative<br />

responsibility for school safety and compliance<br />

with the Code of Conduct. They include students,<br />

parents, teachers, guidance counselors, building administrators,<br />

superintendent and the Board of Education.<br />

V STUDENT RIGHTS & RESPONSIBILITIES<br />

The Board is committed to safeguarding rights given<br />

to all students under state and federal law. In addition<br />

to those rights, all students have the right to:<br />

1. A safe, healthy, orderly, and civil school atmosphere;<br />

2. Take part in all <strong>District</strong> activities on an equal basis<br />

regardless of age, race, religion, color, national origin,<br />

sex, sexual orientation or disability;<br />

3. Present their version of the relevant events to<br />

school personnel authorized to impose a disciplinary<br />

penalty as in connection with the imposition of the<br />

penalty;<br />

4. Access school rules and, when necessary, receive an<br />

explanation of those rules from school personnel.<br />

All <strong>District</strong> students have the responsibility to:<br />

1. Contribute to maintaining a safe and orderly school<br />

environment that is conducive to learning and to<br />

show respect to other persons and to property.<br />

2. Be familiar with and abide by all <strong>District</strong> rules, policies,<br />

and regulations dealing with student conduct.<br />

3. Attend school every day unless they are legally<br />

excused, and be in class, on time, prepared to learn.<br />

4. Work to the best of their ability in all academic<br />

and extra-curricular activities and strive toward their<br />

highest level of achievement possible.<br />

5. Comply with directions given by school personnel<br />

in a respectful and positive manner.<br />

6. Where appropriate, work to develop mechanisms<br />

to control anger and aggression.<br />

7. Seek help in solving problems that might lead to<br />

discipline.<br />

8. Report information regarding issues of safety.<br />

9. Dress appropriately for school and at school functions.<br />

10. Conduct themselves as representatives of the<br />

<strong>District</strong> when participating in or attending school<br />

sponsored events, and to hold themselves to the<br />

highest standards of conduct, demeanor, and sportsmanship.<br />

VI STUDENT DRESS CODE<br />

All students are expected to give proper attention<br />

to personal cleanliness and to dress appropriately<br />

for school and school functions. Students and their<br />

parents have the primary responsibility for acceptable<br />

student dress and appearance as outlined in the<br />

Code of Conduct. Each building principal or his or<br />

her designee shall be responsible for informing all<br />

students and their parents of the student dress/<br />

grooming code at the beginning of the school year<br />

and any revisions to the dress code made during the<br />

school year. Student grooming includes hair/style/<br />

color, makeup, nails.<br />

VII PROHIBITED STUDENT CONDUCT<br />

Discipline is most effective when it deals directly<br />

with the problem at the time and place it occurs, and<br />

in a way that is viewed as fair and impartial by the<br />

student. Therefore, before seeking outside assistance,<br />

teachers will first use all their resources to create<br />

a change of behavior in the classroom. When the<br />

teacher has made every effort to bring about positive<br />

behavioral change, and has been unsuccessful, the<br />

student will be referred to the administration. At<br />

that point, the administration will decide what further<br />

action will be taken. Students who break the law, use<br />

or possess illegal drugs, use vulgar language, exhibit<br />

inappropriate behavior or engage in bullying including<br />

cyberbullying will be held accountable not only to the<br />

<strong>District</strong> disciplinary Code but may also be referred<br />

to the appropriate law enforcement agencies.<br />

VIII REPORTING VIOLATIONS OF THE CODE<br />

Any student observing a student possessing a<br />

weapon, alcohol, or illegal substance on school<br />

property or at a school function shall report this information<br />

immediately to a teacher or administrator<br />

who initiates the process to notify parents and begin<br />

disciplinary proceedings. Violations that constitute a<br />

crime initiate<br />

contact with appropriate law enforcement.<br />

IX DISCIPLINARY PROCEDURES,<br />

PENALTIES, AND REFERRALS<br />

Discipline is most effective when it deals directly with<br />

the problem at the time and place it occurs, and in a<br />

way that students view as fair and impartial. <strong>School</strong><br />

personnel who interact with students are expected<br />

to use disciplinary action only when necessary and<br />

to place emphasis on the students' ability to grow in<br />

self-discipline.<br />

Procedures<br />

• Disciplinary action, when necessary, will be firm,<br />

fair, and consistent so as to be the most effective in<br />

changing student behavior. In determining the appropriate<br />

disciplinary action, school personnel authorized<br />

to impose disciplinary penalties will consider the<br />

following:<br />

• The student's age.<br />

• The nature of the offense and the circumstances<br />

that led to the offense.<br />

• The student's prior disciplinary record.<br />

• The effectiveness of other forms of discipline.<br />

• Information from parents, teachers and/or others, as<br />

appropriate.<br />

• Other extenuating circumstances.<br />

• As a general rule, discipline will be progressive.<br />

This means that a student's first violation will usually<br />

merit a lighter penalty than subsequent violations.<br />

Individual behavior management plans may preclude a<br />

gradual process.<br />

Penalties<br />

• Depending upon the nature of the violation, it is the<br />

Board's desire that student discipline be progressive:<br />

i.e.; a student's first violation may merit a lighter penalty<br />

than subsequent violations. It is also the Board's<br />

desire that an employee or agent take into account all<br />

other relevant factors in determining an appropriate<br />

penalty. The penalties may be imposed either alone<br />

or in combination.<br />

• The amount of due process a student is entitled to<br />

receive before a penalty is imposed depends on the<br />

penalty being imposed. In all cases, regardless of the<br />

penalty imposed, the school personnel authorized<br />

to impose the penalty must inform the student of<br />

the alleged misconduct and must investigate, to the<br />

extent necessary, the facts surrounding the alleged<br />

misconduct. All students will have an opportunity to<br />

present their version of the facts to the school personnel<br />

imposing the disciplinary penalty in connection<br />

with the imposition of the penalty.<br />

• Disciplinary options that may be imposed for violations<br />

of the student disciplinary code range from,<br />

but are not limited to, school community service,<br />

detention, teacher removal of disruptive pupils and<br />

short/long term suspension as outlined in the Code<br />

of Conduct. It is understood that the <strong>District</strong> has

the authority to assign consequences based on age<br />

and grade-level appropriateness and/or individual<br />

circumstances.<br />

X ALTERNATIVE INSTRUCTION<br />

When a student of any age is removed from class by<br />

a teacher or a student of compulsory attendance age<br />

is suspended from school pursuant to Education Law<br />

3214, the <strong>District</strong> will take immediate steps to provide<br />

alternative means of instruction for the student.<br />

XI DISCIPLINE OF STUDENTS WITH<br />

DISABILITIES<br />

The Board recognizes that it may be necessary to<br />

suspend, remove or otherwise discipline students<br />

with disabilities [including those identified or presumed<br />

to have a disability by written notice prior<br />

to process by parent and /or teacher] to address<br />

disruptive or problem behavior. The Board also<br />

recognizes that students with disabilities enjoy certain<br />

procedural protections whenever school authorities<br />

intend to impose discipline upon them. The Board is<br />

committed to ensuring that the procedures followed<br />

for suspending, removing or otherwise disciplining<br />

students with disabilities are consistent with the<br />

procedural safeguards required by applicable laws and<br />

regulations.<br />

XII STUDENTS WITH DISABILITIES<br />

REFERRAL TO LAW ENFORCEMENT AND<br />

JUDICIAL AUTHORITIES<br />

In accordance with the provisions of IDEA and implementing<br />

regulations:<br />

1. The <strong>District</strong> may report a crime committed by<br />

a child with a disability to appropriate authorities,<br />

and such action will NOT constitute a change of the<br />

student’s placement.<br />

2. The Superintendent shall ensure that copies of<br />

the special education and disciplinary records of a<br />

student with disabilities are transmitted for consideration<br />

to the appropriate authorities to whom a crime<br />

is committed.<br />

XIII CORPORAL PUNISHMENT<br />

Corporal punishment is any act of physical force upon<br />

a student for the purpose of punishing that student.<br />

Corporal punishment of any student by any <strong>District</strong><br />

employee is strictly forbidden. The district will file<br />

all complaints about the use of corporal punishment<br />

with the Commissioner of Education in accordance<br />

with Commissioner's Regulations.<br />

XIV STUDENT SEARCHES &<br />

INTERROGATIONS<br />

The Board of Education is committed to ensuring<br />

an atmosphere on school property and at school<br />

functions that is safe and orderly. To achieve this<br />

kind of environment, any school official authorized<br />

to impose a disciplinary penalty on a student may<br />

question a student about an alleged violation of law<br />

or the <strong>District</strong> Code of Conduct. Students are not<br />

entitled to any sort of "Miranda"-type warning before<br />

being questioned by school officials, nor are school<br />

officials required to contact a student's parent before<br />

questioning the student. However, school officials<br />

will tell all students why they are being questioned.<br />

In addition, the Board authorizes the superintendent,<br />

building principals/administrators, the school nurse<br />

and <strong>District</strong> security officials to conduct searches<br />

of students and their belongings if the authorized<br />

school official has reasonable suspicion to believe that<br />

the search will result in evidence that the student<br />

violated the law or the <strong>District</strong> Code of Conduct.<br />

XV VISITORS TO SCHOOLS<br />

The Board encourages parents and other <strong>District</strong><br />

citizens to visit the <strong>District</strong>'s schools and classrooms<br />

to observe the work of students, teachers and<br />

other staff. Since schools are a place of work and<br />

learning, however, certain limits must be set for such<br />

visits. The building principal or his or her designee is<br />

responsible for all persons in the building and on the<br />

grounds.<br />

XVI PUBLIC CONDUCT ON SCHOOL<br />

PROPERTY<br />

The <strong>District</strong> is committed to providing an orderly,<br />

respectful environment that is conducive to learning.<br />

To create and maintain this kind of an environment,<br />

it is necessary to regulate public conduct on school<br />

property and at school functions. For purposes of<br />

this section of the Code of Conduct, "public" shall<br />

mean all persons when on school property or attending<br />

a school function including students, teachers and<br />

<strong>District</strong> personnel. All persons on school property<br />

or attending a school function shall conduct themselves<br />

in a respectful and orderly manner as outlined<br />

in the Code of Conduct. Use of tobacco anywhere on<br />

school property prohibited including inside vehicles.<br />

XVII PUBLICATION, DISSEMINATION,<br />

AND REVIEW OF CODE OF CONDUCT<br />

The Board will work to ensure that all members of<br />

the school community - students, administrators,<br />

teacher and parents - are aware of this Code of<br />

Conduct by providing copies of a summary of the<br />

Code of Conduct at the beginning of each school<br />

year. The complete Code of Conduct document is<br />

available on the <strong>Hilton</strong> <strong>District</strong> Web Site www.hilton.<br />

k12.ny.us and at every school’s main office.<br />

Code of Conduct reviewed yearly by the Board of Education.<br />

Annual Notifications<br />

Emergency Preparedness Planning Written<br />

information about basic emergency response actions<br />

are communicated through schools in accordance<br />

with the N.Y.S. Commissioner of Education Regulation<br />

155.13 Emergency Planning. Each school annually<br />

conducts sheltering or evacuation drills with notices<br />

in advance to parents and students.<br />

Fire Safety: Copies of the annual New York State<br />

Education Dept. Fire Safety Inspections of each<br />

building by the <strong>Hilton</strong> and No. Greece Fire Marshalls<br />

are shared with the fire district officials with all<br />

deficiencies cited in the inspection reports corrected.<br />

State-issued Certificates of Occupancy are on display<br />

in the main offices of each building.<br />

<strong>School</strong> Pesticide Neighbor Notification: In accordance<br />

with New York State Education Dept. Law,<br />

public schools must provide written notification 48<br />

hrs. in advance of application if required. The <strong>District</strong><br />

has implemented integrated pest management<br />

several years ago and pesticides are only applied upon<br />

express authorization of the <strong>District</strong>. For further<br />

information: 392-1000 ext. 7065.<br />

Asbestos Compliance Report Available: The<br />

<strong>District</strong> maintains a current Management Plan for<br />

each school building as well as the 2002 AHERA<br />

Reinspection of the <strong>District</strong> completed by BOCES<br />

Health/Safety personnel which are available for<br />

inspection upon request to the Buildings & Grounds<br />

Office at 392-1000 ext. 7065.<br />

Access to Student Records & Directory<br />

Information governed by FERPA [Family<br />

Educational Rights & Privacy Act] A parent,<br />

guardian, or student over the age of 18 has access<br />

to the school records according to federal law, Family<br />

Educational Rights and Privacy Act of 1974 [FERPA].<br />

Any records maintained by a school district as part<br />

of the official record are available for review by the<br />

parent or the student after age 18. The law also<br />

controls sharing of pupil records with third party<br />

individuals or agencies. The <strong>District</strong> may release directory<br />

information [student name/address/phone;<br />

date/place of birth; grade level; participation in<br />

officially-recognized sports; height and weight of athletic<br />

team members; dates of attendance; major field<br />

of study, degree, honors and awards received; school<br />

related photographs; agency/school previously<br />

attended] about a student without student or pa-<br />

rental consent in certain circumstances. Directory<br />

information is information about the student which<br />

would generally not be considered harmful or an<br />

invasion of privacy if disclosed. At the discretion of<br />

the <strong>District</strong>, directory information may be disclosed<br />

in the case of sports or performing arts programs,<br />

news releases or in connection with educational<br />

or extra-curricular activities or events. Release<br />

of directory information is not permitted if such<br />

information is to be used for solicitation, fundraising,<br />

political or commercial purposes. The district<br />

publishes this annual notice in the <strong>District</strong> <strong>Calendar</strong><br />

which is mailed to all residents of the district. If a<br />

parent, guardian or eligible student does not wish<br />

to have some or all of the directory information<br />

described above released without prior consent, he<br />

or she must in writing, contact the <strong>Hilton</strong> <strong>Central</strong><br />

<strong>School</strong> <strong>District</strong>, Census Office, 225 West Ave.,<br />

<strong>Hilton</strong>, NY 14468 or the school’s principal within<br />

30 days after publication of this notice.<br />

Parental Rights regarding Military Recruiters'<br />

Access to Information on HS Students: In<br />

compliance with Federal No Child Left Behind Act<br />

of 2001 and the National Defense Authorization<br />

The purpose of Board of Education<br />

meetings is for board members to<br />

consider and approve recommendations<br />

by the Superintendent regarding<br />

policy; curriculum; approval of<br />

textbooks; personnel actions [governed<br />

by state rulings protecting<br />

the confidentiality of appointments,<br />

promotions, demotions, dismissal or<br />

removal]; budget and financial issues;<br />

and other matters. Subscribing to<br />

the Open Meetings Law, the Board<br />

allows public comment at meetings. To<br />

speak at a Board Meeting, contact the<br />

<strong>District</strong> Clerk prior to the meeting.<br />

Regarding any personnel matters, the<br />

speaker's comments may not include<br />

mentioning any district employee by<br />

name. The Board reserves the right<br />

to restrict access for a speaker who<br />

does not comply with district policies<br />

and guidelines. Official minutes are<br />

reviewed and approved prior to posting<br />

The Board of Education meetings are held generally the second and fourth Tuesdays of the month<br />

respectively at 7 p.m. in the Board Room of the <strong>District</strong> Offices, 225 West Avenue, <strong>Hilton</strong>, unless<br />

otherwise announced. Board members are elected to three-year terms and serve without pay.<br />

Elections are held annually at the Budget Vote in the spring of the year. To become a board candidate,<br />

nominating petitions may be filed with the Board Clerk 30 days before the election. Qualifications<br />

to become a candidate for the board: a district resident for at least one year prior to the<br />
