• What do I do if I speak and understand English, but not perfectly<br />
You have the right to understand all the questions you are asked during your hearing, and it is extremely<br />
important that you understand everything and not just part. It is also extremely important that you be able to<br />
speak to the judge and that the judge understand you well. For this reason, if you don't speak and understand<br />
English perfectly, you should tell the judge. <strong>The</strong> Court will get an interpreter who speaks your language.<br />
• How do I use this booklet<br />
If you don’t speak and understand English perfectly,<br />
tell the judge.<br />
Read the whole booklet in order to find out if you may qualify for asylum or withholding and what you need to<br />
do to complete the forms and prepare for your hearing. It is very important to understand that it is up to YOU to<br />
prepare your case and get evidence (proof), if there is any, to give to the judge. If you don't prepare for your<br />
hearing, you are more likely to lose than if you do prepare.<br />
• What are the requirements for receiving asylum or withholding of removal under INA section<br />
241(b)(3)<br />
In order to receive asylum or withholding of removal under INA section 241(b)(3), you have to show three<br />
things:<br />
1that you have good reasons to be afraid<br />
2of being persecuted or losing your life or freedom<br />
3because of your race, religion, nationality, political opinion, or membership in a particular social group.<br />
We will now explain each of these requirements.<br />
• What do I have to show about why I am afraid<br />
To receive asylum, you generally have to show that you are afraid of returning to your country and that you<br />
have good reasons for feeling this way. To receive withholding of removal under INA section 241(b)(3), you<br />
have to show not only that there is reason to think you may be persecuted if you go back, but that it is more<br />
likely than not that you will be persecuted. If you only show that maybe you will be persecuted, the judge<br />
cannot give you withholding.<br />
If you were persecuted before, it is easier to show that you are likely to be persecuted again if you go back,<br />
but you must show the persecution was for one of the reasons we just mentioned. It is very important that<br />
you explain this in your application and that you tell the judge all about it, in a lot of detail, at your hearing.<br />
• What is “persecution”<br />
