<strong>CEDAW</strong> and the Law:<br />

person intends to reside and to whose jurisdiction she will submit. Domicile is originally<br />

acquired by a child through its parents but, in adulthood, denotes the country in which<br />

a person normally resides and in which she intends to reside permanently. As in the<br />

case of nationality, the examination of States parties’ reports demonstrates that a<br />

woman will not always be permitted at law to choose her own domicile. Domicile, like<br />

nationality, should be capable of change at will by an adult woman regardless of her<br />

marital status. Any restrictions on a woman’s right to choose a domicile on the same<br />

basis as a man may limit her access to the courts in the country in which she lives or<br />

prevent her from entering and leaving a country freely and in her own right.<br />

Article 15(1) guarantees women equality with men before the law. The right to own,<br />

manage, enjoy and dispose of property is central to a woman’s right to enjoy financial<br />

independence, and in many countries will be critical to her ability to earn a livelihood and<br />

to provide adequate housing and nutrition for herself and for her family.<br />

V.12.2 SELECTED INDICATORS<br />

Bearing in mind the obligations under <strong>CEDAW</strong>, the selected indicators for equality before the<br />

law are:<br />

Indicator 101 Does the Constitution guarantee equality before the law<br />

Indicator 102 Do women have equal capacity in civil matters<br />

Indicator 103 Do women (regardless of marital status) have an equal right to conclude<br />

contracts (Are there any restrictions to women entering and concluding<br />

contracts)<br />

Indicator 104 Do women have an equal right to be executors or administrators of<br />

estates<br />

Indicator 105 Do women have the same right with respect to ownership, acquisition,<br />

management, administration, enjoyment and disposition of property,<br />

including land<br />

Indicator 106 Do women have equal right to freedom of movement and to choose<br />

residence and domicile<br />

Article 52 of the Constitution provides that all citizens are equal before the law. Other laws also<br />
