<strong>CEDAW</strong> and the Law:<br />

It is suggested that guidelines for EMSBs be issued, in addition to those<br />

suggested above to: (a) ensure that scholarships, grants and allowances are provided<br />

to EMSB students to cover not only tuition fees and school fees but also cost of living<br />

expenses, partially or fully; (b) ensure that 30 percent and gradually moving up to 50<br />

percent of scholarships and grants are provided to ethnic minority women and girls;<br />

and (c) provide guidelines on student accommodation; for example, to regulate those<br />

renting out premises for students lodging an accreditation system can be developed,<br />

and to require on-site health services, social workers and counselors, if possible of<br />

both sexes, so they can adequately address concerns of both ethnic minority girls and<br />

boys as well.<br />

People with disabilities<br />

The Ordinance on Disabled Persons strictly forbids any act of discrimination or maltreatment<br />

against ‘disabled persons’. 436 In relation to education, the Ordinance on Disabled Persons<br />

provides:<br />

Article 15<br />

Students who are disabled shall be considered by the schools for reduction or<br />

exemption of school fees and other contributions to the school shall receive social<br />

allowances and shall be considered for the granting of scholarships according to State<br />

regulations.<br />

Article 16<br />

(1) Education for disabled children shall be organized and carried out in the forms of<br />

integration schooling at general schools or specialized schools for the disabled,<br />

nursing homes for the disabled and at the family.<br />

(2) Disabled children with special gifts are given priority in the admission to the<br />

corresponding schools for such gifts.<br />

(3) Teachers teaching at special schools and classes for disabled persons shall enjoy<br />

the regime of preferential allowances as provided for by the Government.<br />

Article 17<br />

(1) Students who are disabled boarders at educational and nursing establishments shall<br />

enjoy the regimes and policies prescribed by the Government.<br />

(2) The State shall create favorable conditions for organizations and individuals to open<br />

schools and classes specifically reserved for disabled persons.<br />

(3) The State encourages foreign organizations and individuals and Vietnamese settlers<br />

abroad to adopt programs and projects to provide financial, professional and<br />

technical assistance to the education combined with functional rehabilitation of<br />

disabled persons in Vietnam.<br />

The Law on Education also provides particular measures for people with disabilities.<br />

Article 63 states that the State must establish and encourage organizations and individuals to<br />
