$106,245 to $124,342 plus superannuation<br />

(ongoing/non-ongoing vacancy in Melbourne)<br />

<strong>Fair</strong> <strong>Work</strong> Australia (FWA) is established under section (s.) 575 of the <strong>Fair</strong> <strong>Work</strong> Act 2009 (FW<br />

Act). FWA has a number of functions conferred by s.576 of the FW Act and included in these are<br />

matters in relation to unfair dismissal.<br />

A vacancy has arisen for a conciliator based in our Melbourne office. Conciliators are ongoing<br />

positions appointed under the Public Service Act 1999. The successful applicant will be offered<br />

either ongoing employment or non-ongoing employment for a period of 12 months.<br />

Within a framework consistent with the FW Act and its delegated legislation, conciliators conduct<br />

conciliations to assist parties to unfair dismissal applications explore whether agreement can be<br />

reached to resolve applications at an early stage. Conciliations are conducted mostly over the<br />

telephone.<br />

Qualifications and/or practical experience in conciliation/mediation, workplace relations, law and/or<br />

human resource management are required. Analytical, organisational, communication and<br />

conciliation and negotiation skills are essential for the successful performance of the requirements<br />

of the position. Successful applicants will also have a high level of initiative, an ability to work to<br />

deadlines and as part of a team, a capacity to adapt quickly to new or changed circumstances and<br />

an ability to communicate effectively with persons from a wide variety of backgrounds.<br />

A high level of professional ethics is necessary to meet the standard of confidentiality and<br />

discretion required. Importantly, many applications for unfair dismissal involve persons who are<br />

unrepresented and unfamiliar with the workings of FWA and the legislation.<br />

Selection will be on the basis of assessment against specified criteria. Applicants should obtain a<br />

copy of the selection documentation and, specifically and directly address their experiences,<br />

competencies and skills against the criteria. Applications that do not include a statement<br />

DUTIES<br />

As part of a small team and within a framework consistent with the <strong>Fair</strong> <strong>Work</strong> Act 2009 (FW Act)<br />

and its delegated legislation:<br />

1. Examine applications for unfair dismissal made under Part 3-2, Chapter 3 of the FW Act.<br />

2. Administrative and case management tasks and processes related to applications.<br />

3. Conduct conciliations of such applications both over the telephone and in face-to-face<br />

meetings with the parties to an application.<br />

4. Liaise as required with parties to applications, FWA Members and staff.<br />

5. Other duties as directed.<br />

SELECTION CRITERIA<br />

1. Demonstrated high level conciliation competencies and skills.<br />

2. <strong>Work</strong>ing knowledge of the FW Act and its delegated legislation, and the capacity to quickly<br />

further that knowledge particularly regarding FWA procedures.<br />

3. High level analytical and organisational skills.<br />

4. High level written and oral communication skills and an ability to relate and communicate<br />

effectively with diverse range of FWA clients.<br />

5. Demonstrated initiative, ability to work independently and as part of a team with a proven ability<br />

to develop positive working relationships.<br />

6. High level of professional ethics to meet the confidentiality and discretion required.
