<strong>The</strong> complexity <strong>of</strong> <strong>resource</strong> <strong>governance</strong> <strong>in</strong> a context <strong>of</strong> state fragility: An analysis <strong>of</strong> the m<strong>in</strong><strong>in</strong>g sector <strong>in</strong> the Kivu h<strong>in</strong>terlands<br />

m<strong>in</strong><strong>in</strong>g areas and frequently visit others. In recent years, these units have all been <strong>in</strong>volved <strong>in</strong><br />

serious security <strong>in</strong>cidents and there have been violent clashes between them. 56<br />

<strong>The</strong> behaviour <strong>of</strong> FARDC units <strong>in</strong> Nyunzu and Kalemie is similar to that <strong>in</strong> other parts <strong>of</strong> Eastern<br />

DRC. <strong>The</strong>ir <strong>in</strong>terference <strong>in</strong> m<strong>in</strong><strong>in</strong>g takes a number <strong>of</strong> forms. Sometimes they have people work<strong>in</strong>g<br />

for them (whether voluntarily or by force). At some sites, they are paid as guards; at others they<br />

impose illegal taxes, or simply steal. Army units also prey on the m<strong>in</strong><strong>in</strong>g sector away from the<br />

m<strong>in</strong>es, primarily through illegal taxation and other forms <strong>of</strong> extortion at checkpo<strong>in</strong>ts. <strong>The</strong> two<br />

paragraphs below describe recent cases <strong>of</strong> armed groups pr<strong>of</strong>it<strong>in</strong>g from m<strong>in</strong><strong>in</strong>g activities.<br />

Case 1: Lunga<br />

A recent case illustrates the control armed men exert over some m<strong>in</strong><strong>in</strong>g areas. At the end <strong>of</strong> March<br />

2010 an artisanal m<strong>in</strong>er discovered a large lump <strong>of</strong> gold at Lunga and was promptly “escorted” to<br />

an unknown dest<strong>in</strong>ation by men loyal to the poorly <strong>in</strong>tegrated ex-Mayi-Mayi leader, “Tango Four”<br />

(real name, Stanis Kahezya). 57 Tango Four and an <strong>in</strong>telligence <strong>of</strong>ficer from the Agence Nationale de<br />

Renseignement then threatened a civil servant <strong>in</strong>vestigat<strong>in</strong>g and report<strong>in</strong>g on the <strong>in</strong>cident. <strong>The</strong> victim, a<br />

m<strong>in</strong><strong>in</strong>g-division <strong>of</strong>ficial, fear<strong>in</strong>g for his security, wrote to the adm<strong>in</strong>istrator <strong>of</strong> Nyunzu territory plead<strong>in</strong>g<br />

with him to “watch over” him, copy<strong>in</strong>g the letter to n<strong>in</strong>e other authorities 58 . Harassment by uniformed<br />

men is a widespread phenomenon <strong>in</strong> Nyunzu and Kalemie. M<strong>in</strong><strong>in</strong>g <strong>of</strong>ficials consistently denounce the<br />

problems caused by these poorly controlled groups <strong>in</strong> reports to their hierarchy. 59<br />

Case 2: Bendera<br />

<strong>The</strong> only area <strong>in</strong> Katanga where rebel groups cont<strong>in</strong>ue to operate is to the north <strong>of</strong> Kalemie territory.<br />

Both the FDLR and a branch <strong>of</strong> the Mayi Mayi Yakutumba control positions <strong>in</strong> the area, and are believed<br />

to cooperate. 60 <strong>The</strong> FDLR force, about the size <strong>of</strong> a company, operates from the Mitumba range, with<br />

Kabobo as its ma<strong>in</strong> base <strong>of</strong> operations. Kabobo is situated at 25 km from Bendera. <strong>The</strong> area under<br />

FDLR control borders the Tanganyika lake.<br />

In the first half <strong>of</strong> 2010, FDLR elements (possibly supported by the Bavon branch <strong>of</strong> the Mayi-Mayi<br />

Yakutumba) reportedly raided several gold-m<strong>in</strong><strong>in</strong>g sites <strong>in</strong> the area. 61<br />

1.5 Conclusion<br />

Two recent measures taken at the prov<strong>in</strong>cial level, the US$5 tax and the comptoir unique contract<br />

with MMR, have had a major impact on the m<strong>in</strong>eral trade <strong>in</strong> Northern Katanga.<br />

<strong>The</strong> trade <strong>in</strong> Katangese cassiterite and coltan is now almost monopolised by a s<strong>in</strong>gle trader.<br />

Whereas before September 2009 the trad<strong>in</strong>g system was similar and <strong>in</strong>extricably l<strong>in</strong>ked to m<strong>in</strong>eral<br />

bus<strong>in</strong>ess <strong>in</strong> the Kivu prov<strong>in</strong>ces, s<strong>in</strong>ce March 2010 it has been transformed by the prov<strong>in</strong>cial<br />

authorities <strong>in</strong>to a system <strong>of</strong> their own mak<strong>in</strong>g. <strong>The</strong> prov<strong>in</strong>ce has acted on its own <strong>in</strong> this matter,<br />

which is exceptional and raises questions <strong>of</strong> legality.<br />
