<strong>The</strong> complexity <strong>of</strong> <strong>resource</strong> <strong>governance</strong> <strong>in</strong> a context <strong>of</strong> state fragility: An analysis <strong>of</strong> the m<strong>in</strong><strong>in</strong>g sector <strong>in</strong> the Kivu h<strong>in</strong>terlands<br />

Recently, however, Kivu traders have faced another challenge from Lubumbashi. In March 2010,<br />

the Katangan M<strong>in</strong>istry <strong>of</strong> M<strong>in</strong>es signed a contract with MMR, a subsidiary <strong>of</strong> the Lubumbashibased<br />

m<strong>in</strong><strong>in</strong>g company Somika, to explore and commercialise deposits <strong>in</strong> Northern Katanga<br />

(BOX 2). In exchange for a list <strong>of</strong> social and technical improvements, the contract grants MMR<br />

exclusive rights over m<strong>in</strong>erals from four major artisanal m<strong>in</strong><strong>in</strong>g sites <strong>in</strong> Tanganyika district:<br />

Kisengo (coltan, Nyunzu), Lunga (gold, Nyunzu), Mayi Baridi/100 Kilos (coltan, Kalemie) and<br />

Katonge (coltan, Manono).<br />

Some background on MMR/SOMIKA<br />

Accord<strong>in</strong>g to the notarial act, M<strong>in</strong><strong>in</strong>g M<strong>in</strong>eral Resources sprl was created on 22nd January 2009. <strong>The</strong><br />

company’s objectives, as def<strong>in</strong>ed <strong>in</strong> its statutes, are: the prospect<strong>in</strong>g, exploration and research <strong>of</strong><br />

m<strong>in</strong><strong>in</strong>g areas; the exploitation, conversion and development <strong>of</strong> m<strong>in</strong>es; the sale <strong>of</strong> m<strong>in</strong>erals and m<strong>in</strong>es;<br />

m<strong>in</strong><strong>in</strong>g; and import and export.<br />

MMR holds 24 m<strong>in</strong><strong>in</strong>g titles, all permis de recherche, <strong>of</strong> which 10 are located <strong>in</strong> Katanga. 30 It also holds<br />

several other titles through jo<strong>in</strong>t ventures. MMR claims to be aim<strong>in</strong>g at mechanisation <strong>of</strong> m<strong>in</strong><strong>in</strong>g<br />

operations and, as a first step, seeks to equip and support artisanal m<strong>in</strong>ers. By the end <strong>of</strong> 2011, MMR<br />

<strong>in</strong>tends to <strong>in</strong>stall gravimetric concentrators at its production centres, and smelt<strong>in</strong>g <strong>in</strong>stallations at<br />

Lubumbashi and Kalemie. 31<br />

MMR is a subsidiary <strong>of</strong> Somika, an established player <strong>in</strong> the copper belt. Before the 2006 elections, the<br />

company bought artisanal production through partnerships with Gécam<strong>in</strong>es. Chetan Chug is the CEO<br />

<strong>of</strong> Somika. <strong>The</strong> Chug family is Canadian and <strong>in</strong>cludes several brothers, notably Hitesh Chug and Rushi<br />

Chug. <strong>The</strong>y have l<strong>in</strong>ks with another Canadian family, the Jobanputras, who conduct bus<strong>in</strong>ess <strong>in</strong> the<br />

DRC and beyond (their best-known representative is Kirti Jobanputra, owner <strong>of</strong> R<strong>of</strong>fe Congo, a general<br />

trad<strong>in</strong>g bus<strong>in</strong>ess).<br />

<strong>The</strong>se two families have l<strong>in</strong>ks with a number <strong>of</strong> other firms 32 . <strong>The</strong> two most important are:<br />

• V<strong>in</strong>mart. Accord<strong>in</strong>g to its website, V<strong>in</strong>mart is a lead<strong>in</strong>g player <strong>in</strong> the export <strong>of</strong> commodities and trad<strong>in</strong>g<br />

<strong>in</strong> general merchandise. <strong>The</strong> company has <strong>of</strong>fices <strong>in</strong> Ch<strong>in</strong>a, Dubai and Tanzania (Dar-Es-Salaam),<br />

among other places. V<strong>in</strong>mart owns m<strong>in</strong><strong>in</strong>g concessions <strong>in</strong> the DRC. 33<br />

•Sogimpex. A m<strong>in</strong>eral trader with <strong>of</strong>fices <strong>in</strong> the Kivus, Sogimpex and MMR are both mentioned <strong>in</strong><br />

2009 statistics from the Centre d’Evaluation, d’Expertise et de Certification des substances m<strong>in</strong>érales<br />

précieuses et sémi précieuses (CEEC) <strong>in</strong> K<strong>in</strong>du (Maniema) <strong>in</strong>volv<strong>in</strong>g a s<strong>in</strong>gle purchase <strong>of</strong> gold, <strong>in</strong>dicat<strong>in</strong>g<br />

at least some confusion by the CEEC as to the nature <strong>of</strong> their relationship. Somika supported the Parti<br />

du Peuple pour la Reconstruction et la Démocratie (PPRD) <strong>in</strong> the build-up to the 2006 elections, which<br />

may have promoted a sympathetic attitude towards them from with<strong>in</strong> the rul<strong>in</strong>g party. 34<br />

Staff shuttle back and forth between Somika and MMR. Kiran Joshi, president <strong>of</strong> MMR’s Board <strong>of</strong><br />

Directors, is listed as one <strong>of</strong> four contact persons at the Somika corporate <strong>of</strong>fice <strong>in</strong> Lubumbashi. 35<br />

<strong>The</strong> various components <strong>of</strong> MMR’s contract have been implemented unevenly. <strong>The</strong> company<br />

prioritised the biggest site, Kisengo, over the others. In early April, a prov<strong>in</strong>cial delegation visited<br />
