IRON THE REPAIR OF WROUGHT AND CAST IRONWORK<br />

Historic buildings <strong>and</strong> the law<br />

Under Part IV <strong>of</strong> the Planning <strong>and</strong> Development Act 2000, buildings which form<br />

part <strong>of</strong> the architectural heritage can be protected either by being designated a<br />

protected structure or by being located within an architectural conservation area.<br />

Where a building is a protected structure (or has been proposed for protection)<br />

or is located within an architectural conservation area, the usual exemptions from<br />

requirements for planning permission do not apply. In the case <strong>of</strong> a protected<br />

structure any works, whether internal or external, which would materially affect<br />

its character will require planning permission. Legal protection also extends to<br />

other structures <strong>and</strong> features associated with a protected structure such as<br />

outbuildings, boundary walls, paving, railings <strong>and</strong> the like. In an architectural<br />

conservation area, any works which would affect the character <strong>of</strong> the area also<br />

require planning permission. This may include works to ironwork such as railings<br />

<strong>and</strong> gates. Owners <strong>and</strong> occupiers <strong>of</strong> protected structures have a responsibility to<br />

maintain their buildings <strong>and</strong> not to damage them or allow them to fall into decay<br />

through neglect.<br />

A notice was sent to every owner <strong>and</strong> occupier <strong>of</strong> a protected structure when the<br />

building first became protected but subsequent owners <strong>and</strong> occupiers will not<br />

have been notified. If you are not sure <strong>of</strong> the status <strong>of</strong> your building, check the<br />

Record <strong>of</strong> Protected Structures in the Development Plan for the area. If your<br />

building is a protected structure, or if it is located in an architectural conservation<br />

area, your planning authority will be able to tell you what this means for your<br />

particular property.<br />

As an owner or occupier <strong>of</strong> a protected structure, you are entitled to ask the<br />

planning authority to issue a Declaration which will guide you in identifying<br />

works that would, or would not, require planning permission. Maintenance <strong>and</strong><br />

repair works, if carried out in line with good conservation practice <strong>and</strong> the<br />

guidance contained within this booklet, will generally not require planning<br />

permission. If you are in any doubt about particular proposed works, you should<br />

contact the conservation <strong>of</strong>ficer in your local authority for advice.<br />
