WHD convinced the appellate court to uphold the dismissal of its client, a
pass-through supplier of asbestos-containing pipe insulation, on summary
judgment. The plaintiff alleged that her deceased husband, a carpenter, was
exposed to asbestos-containing products while performing construction
work at more than 50 job sites in Milwaukee. WHD successfully argued that
the plaintiff’s evidence that the decedent was exposed to any asbestoscontaining
products supplied by its client was speculative, and the trial court
granted summary judgment. The plaintiff appealed. The appellate court
affirmed the grant of summary judgment, agreeing with WHD that the plaintiff
had no credible exposure evidence.
