to make appropriate amendments to the assignment to make it more attractive to the consulting<br />

industry and then re-advertise the Request, but ensuring a wider publicity, provided that Procuring<br />

Entities shall not resort to the practice of re-advertisement as a routine matter, but instead should<br />

always make efforts to invite Requests for Expressions of Interest that will enable them to finalise<br />

adequate short-lists in the first round of advertisement.<br />

(8) If after re-advertising under the proviso to Sub-Rule (7) , the number of re-assessed<br />

and short-listed Applicants is still less than four (4), the short-list should be considered as final and<br />

the Request for Proposal shall be issued to the lower number of short- listed Applicants.<br />

(9) Following the approval of the EOI Assessment Report by the Head of the Procuring<br />

Entity or an officer authorised by him or her or an Approving Authority, all Applicants participating<br />

in the EOI shall be informed whether or not they have been short-listed by the Procuring Entity.<br />

116. Preparation of the Terms of Reference (TOR). |— (1) In preparing the TOR, the<br />

Procuring Entity shall generally provide the following information in order to assist Applicants in the<br />

preparation of their Proposals -<br />

(a) background information on the Procuring Entity and about the broader project<br />

environment within which the assignment will take place;<br />

(b) objectives and scope of the assignment;<br />

(c) the duration of the assignment;<br />

(d) services and surveys necessary to carry out the assignment and the expected<br />

outputs;<br />

(e) details of the number of staff to be trained, the training timetable and the topics,<br />

if already known, shall be specifically outlined where transfer of knowledge, or<br />

training is an objective to enable Applicants to estimate the required level of<br />

resources;<br />

(f) the facilities and support to be provided to the Consultant by the Procuring<br />

Entity or user or beneficiary entity during the assignment; and<br />

(g) Institutional arrangements;<br />

(h) details of existing relevant studies and basic data and their availability and<br />

location of the data;<br />

(2) <strong>The</strong> TOR should not be too detailed or inflexible so that Applicants are able to<br />

propose their own methodology and staffing, and they shall be encouraged to comment on the<br />

TOR in their Proposals.<br />

(3) <strong>The</strong> respective responsibilities of the Procuring Entity or beneficiary entity and the<br />

Consultant shall be clearly defined in the TOR.<br />

(4) <strong>The</strong> scope of the Services described in the TOR shall be consistent with the available<br />

budget.<br />

117. Preparation and Issue of Request for Proposal (RFP) Document.|— (1) A<br />

Procuring Entity shall prepare a Request for Proposal (RFP) Document using the applicable<br />

standard RFP Documents issued by the Government and distribute such Documents to the shortlisted<br />

Applicants.<br />

(2) <strong>The</strong> RFP shall have, as a minimum the following information -<br />

(a) the name and address of the Procuring Entity;<br />
