S,R,O No 21-Law/<strong>2008</strong> |— In-exercise of powers conferred under section 70 of the <strong>Public</strong><br />
<strong>Procurement</strong> Act, 2006 (Act 24 of 2006), <strong>The</strong> Government is pleased to make the following <strong>Rules</strong>,<br />
namely -<br />
CHAPTER ONE<br />
PRELIMINARY<br />
1. Short title and commencement |— (1) <strong>The</strong>se <strong>Rules</strong> may be called the <strong>Public</strong><br />
<strong>Procurement</strong> <strong>Rules</strong>, <strong>2008</strong>.<br />
(2) <strong>The</strong>y shall be effective on the date of coming into force of the <strong>Public</strong> <strong>Procurement</strong><br />
Act, 2006<br />
2. Definitions |— In these <strong>Rules</strong>, unless there is anything repugnant to the subject or<br />
context—<br />
(1) "Act" means <strong>The</strong> <strong>Public</strong> <strong>Procurement</strong> Act, 2006 (Act 24 of 2006);<br />
(2) "Administrative Authority" means the concerned Procuring Entity, Head of<br />
the Procuring Entity and Secretary of the Ministry or Division respectively;<br />
(3) "Advertisement" means an advertisement published under Section 40 in<br />
newspapers, websites or any other mass media for the purposes of wide<br />
publicity;<br />
(4) "Applicant" means a Person who seeks to become enlisted under the Limited<br />
Tendering Method under Section 32 (a) of the Act or to be pre-qualified in<br />
response to an Invitation for Pre-Qualification under Part-2 of Chapter Six of<br />
the Act, or to be short-listed in response to a request for Expression of Interest<br />
under Section 54 of the Act ;<br />
(5) "Approval Procedures" means the approval procedures of a Tender or a<br />
Proposal as detailed in Rule 36;<br />
(6) "Approving Authority" means the authority which, in accordance with the<br />
Delegation of Financial Powers, approves the award of contract for the<br />
<strong>Procurement</strong> of Goods, Works or Services;<br />
(7) "Code of Ethics" means the set of conditions and provisions which a Person<br />
shall abide while participating in public <strong>Procurement</strong>;<br />
(8) "Completion Date" is the date of completion of the Works as certified by the<br />
Project Manager;<br />
