(4) <strong>The</strong> Tender Opening Committee shall ensure that -<br />

(a) Except in case stated in Sub Rule 96(11), Tenders shall be opened immediately<br />

after the deadline for the submission of Tenders but no later than one hour after<br />

expiry of the submission deadline;<br />

(b) Tender Opening Sheet (TOS) is prepared containing the information relating to<br />

Tenders or Proposals announced at the opening in accordance with Sub Rule<br />

(4)(f);<br />

(c) Persons not associated with the Tender are not allowed to attend the opening of<br />

Tenders;<br />

(d) the Tender opening is not delayed on the plea of absence of Tenderers or his<br />

or her representatives , as the presence of Tenderers or their authorised<br />

representatives is optional;<br />

(e) the Tenderers’ representatives shall be duly authorised by the Tenderer;<br />

(f) the following information stated therein is read out from the Tenders after<br />

Tender opening which shall be recorded on a Tender Opening Sheet duly<br />

verified by the members of the Tender Opening Committee -<br />

(i) name and address of the Tenderer;<br />

(ii) withdrawal, substitution or modifications, if any;<br />

(iii) the Tender price;<br />

(iv) discounts, if any; -and<br />

(v) Tender security, if required and information relating to its amount; and<br />

(g) the checklist with steps for Tender opening in Part D of Schedule IV shall be<br />

followed.<br />

(5) Tender modifications or discounts, which are not read out at the Tender opening or<br />

recorded on the TOS, shall not be considered in the evaluation of the concerned Tenders.<br />

(6) No Tender shall be rejected at Tender opening, but late Tenders or Tenders<br />

withdrawn shall be returned directly to the Tenderers unopened.<br />

(7) Upon completion of the Tender opening, all members of the TOC and the Tenderers<br />

or their representatives who attended the Tender opening shall sign the TOS, copies of which shall<br />

be issued to the Head of a Procuring Entity or an officer authorised by him or her and to all<br />

members of the TOC and any authorized Consultants employed in the project and to the<br />

Tenderers.<br />

(8) <strong>The</strong> Member-Secretary of the TOC will ensure that the procedure as per Sub-Rule (4)<br />

is carried out and will sign to certify that the Tender Documents have been sent to the Procuring<br />

Entity immediately after the Tender opening.<br />

(9) Upon completion of the Tender opening all Tenders and all related documents shall<br />

be kept in the safe custody of the Procuring Entity along with a copy of the TOS duly signed by all<br />

concerned.<br />

98. Evaluation of Tenders, Etc. |— (1) <strong>The</strong> Procuring Entity shall ensure that it follows<br />

the requirements of <strong>Rules</strong> 8 and 9 and this Rule with regard to the formation of the Tender<br />

Evaluation Committee (TEC), the appointment of its Chair and members, and of Rule 36 with<br />

regard to the administrative procedures to be followed during the evaluation and approval process<br />

and matters ancillary thereto.<br />

(2) Tenders shall not be evaluated on any basis other than the criteria specified in the<br />
