PROCESSING OF TENDERS<br />

94. Issuance and Sale of Tender Document and Pre-Tender Meeting, Etc. |— (1)<br />

Tender Documents shall be made available to Tenderers as soon as the relevant advertisement is<br />

published under Rule 90.<br />

(2) All prospective Applicants or Tenderers shall be provided the same information and<br />

be assured of equal opportunities to obtain additional information promptly upon request.<br />

(3) Tender Documents shall be posted on the Procuring Entity’s website where possible.<br />

(4) <strong>The</strong> cost of Tender Document will be determined by the Head of the Procuring Entity<br />

or an officer authorised by him or her but the price of a Document shall not exceed the cost of<br />

producing and delivering the Document to Applicants or Tenderers.<br />

(5) A Procuring Entity shall not refuse to make Tender Documents available immediately<br />

to Persons requesting and willing to purchase at the corresponding price if the advertisement<br />

has been published in the newspaper .<br />

(6) <strong>The</strong> Procuring Entity shall record all Persons to whom Tender Documents have been<br />

issued and such records shall have a reference number and include full contact details, such as ID<br />

or personal details, mailing address, telephone and facsimile numbers and electronic mail address,<br />

if applicable.<br />

(7) <strong>The</strong>re shall not be any pre-conditions whatsoever, for sale of Tender Document to<br />

and the sale of such Document shall be permitted up to the day prior to the deadline for the<br />

submission of Tender.<br />

(8) Tender Documents, as well as any modification to Tender Documents under Rule 95,<br />

shall be made available to Tenderers by -<br />

(a) the office of the Procuring Entity;<br />

(b) an authorised agent of the Procuring Entity, if specified in the advertisement;<br />

(c) mail or courier at the request of potential Tenderers against payment by the<br />

Tenderer of the corresponding mailing charges in addition to the prices of the<br />

Documents; and<br />

(d) website of the Procuring Entity mentioned in the advertisement.<br />

that -<br />

(9) Procuring Entities which publish Tender Documents on their website shall ensure<br />

(a)<br />

(b)<br />

the Tender Document is not removed from the website, before the closing date<br />

for the submission of Tenders; and<br />

all modifications and clarifications to the Tender Document ,if made and<br />

issued ,including the reference numbers and dates are also posted on the<br />

website.<br />

(10) A Procuring Entity may, in order to explain the purpose and other requirements of a<br />

particular <strong>Procurement</strong> and respond to questions from potential Tenderers, hold a Pre-Tender<br />

meeting.<br />

(11) All Tenderers who have purchased or wish to purchase the Tender Document shall<br />

be permitted to attend the pre-Tender meeting but the minutes shall be circulated only to those<br />

Tenderers who have purchased the Tender Documents within the period specified in Schedule II.<br />
