the response to a clarification request shall be copied to all Applicants who have<br />

purchased the Pre-Qualification Document, without indicating the source<br />

requesting the clarification.<br />

(9) A Procuring Entity may, in order to clarify issues and answer to questions on any<br />

matter arising in the Pre-Qualification Document, also invite the prospective Applicants to attend a<br />

Pre-Qualification Meeting at a place, date and time duly specified in the Pre-Qualification<br />

Document.<br />

(10) <strong>The</strong> Pre-Qualification Applications shall be received by the Procuring Entity and kept<br />

in safe custody until opening of the same by the Tender Opening Committee (TOC);<br />

(11) Applications received after the deadline for submission of Pre-Qualification<br />

Application shall be returned unopened to the Applicant by the Procuring Entity.<br />

(12) <strong>The</strong> format and text to be used by Procuring Entities for the Invitation for Pre-<br />

Qualification (IFPQ) is shown in Schedule X .<br />

(13) Procuring Entities shall use the standard Pre-Qualification Document issued by the<br />

CPTU when undertaking a <strong>Procurement</strong> using the Pre-Qualification process.<br />

(14) <strong>The</strong> Procuring Entity may permit the use the Pre-Qualification Document posted on<br />

their Website for the submission of Applications.<br />

92. Opening of Pre-Qualification Applications. |— `(1) <strong>The</strong> Tender Opening<br />

Committee (TOC) constituted under Rule 7 shall open the Applications in public after the deadline<br />

for submission date at the time and place specified in the Pre-Qualification Document.<br />

(2) <strong>The</strong> TOC shall record the name, address and any other relevant identity of each<br />

Applicant during opening and, furnish a copy of the record of opening upon such written request to<br />

any Applicant.<br />

(3) <strong>The</strong> Tender Opening Committee shall forward the Applications to the Procuring Entity<br />

which will then be responsible for its safe custody and further action in line with Rule 32.<br />

93. Evaluation of Pre-Qualification Applications. |— (1) <strong>The</strong> TEC shall use the<br />

conditions, criteria, and requirements defined in the Pre-Qualification Document to evaluate the<br />

qualifications of the Applicants.<br />

(2) <strong>The</strong> Head of the Procuring Entity may, to assist the Tender Evaluation Committee,<br />

form a Technical Sub-committee comprising of experienced persons and experts.<br />

(3) <strong>The</strong> TEC shall evaluate the Applications received on a pass or fail basis.<br />

(4) <strong>The</strong>re shall be no upper limit for number of Pre-Qualified Applicants and all<br />

Applicants who passed the Qualification requirements shall be included in the list.<br />

(5) <strong>The</strong> TEC may consider minor deviations in the qualification criteria if they do not<br />

materially affect the capability of an Applicant to perform Works under the Contract.<br />

(6) Qualifications of Subcontractors that have been identified in the Application may be<br />

considered in the evaluation of an Applicant but only in relation to Subcontractors’ specific<br />

assignment.<br />

(7) <strong>The</strong> general experience and financial capacity of Subcontractors shall not be added to<br />
