86. Conditions and Procedures for Use of Limited Tendering Method with<br />

International Competition. |— (1) A Procuring Entity may engage in <strong>Procurement</strong> of Goods,<br />

related Services, Works or physical Services by means of the Limited Tendering Method with<br />

international competition in accordance with this Rule whenever a Procuring Entity considers there<br />

is a need for effective international competition.<br />

(2) <strong>The</strong> procedures as applicable for Limited Tendering Method in the case of national<br />

<strong>Procurement</strong> as specified in Rule 64 shall also be followed for <strong>Procurement</strong> under this method<br />

with international competition.<br />

(3) <strong>The</strong> reasons for use of the method shall be recorded and maintained as per Rule 43.<br />

(4) In the case of international <strong>Procurement</strong> under Limited <strong>Procurement</strong> Method process<br />

and proceedings in flow-charts as specified in Part-C of Schedule III shall be followed.<br />

87. Conditions and Procedures for Use of the Direct <strong>Procurement</strong> Method<br />

Internationally. |— (1) A Procuring Entity may engage in <strong>Procurement</strong> by means of the Direct<br />

<strong>Procurement</strong> Method in accordance with Part 5 of this Chapter whenever a Procuring Entity<br />

considers that there is a need for international <strong>Procurement</strong>.<br />

(2) <strong>The</strong> justification for use of this method shall be recorded and maintained as per Rule<br />

42 and 43.<br />

(3) <strong>The</strong> procedures as applicable for Direct <strong>Procurement</strong> Method in the case of national<br />

<strong>Procurement</strong> as specified in Part 5 of this Chapter shall also be followed for <strong>Procurement</strong> under<br />

this method with international competition<br />

(4) In the case of international <strong>Procurement</strong> under Direct <strong>Procurement</strong> Method process<br />

and proceedings in flow-charts as specified in Part F of Schedule III shall be followed<br />

88. <strong>Procurement</strong> by Embassies and in Special Cases by National Carriers. |— (1) A<br />

High Commissioner or an Ambassador or a Head of Bangladesh Mission overseas, may engage in<br />

<strong>Procurement</strong> by means of the RFQ Method in accordance with Rule 69 for the <strong>Procurement</strong> of<br />

readily available, standard Goods and unforeseen urgent physical Services within the threshold<br />

specified in Schedule II.<br />

(2) National Carriers may, under Section 35 (2) of the Act, undertake <strong>Procurement</strong> of fuel,<br />

spare parts or urgent repairs outside the territory of Bangladesh subject to the threshold specified<br />

in Schedule II.<br />

PART – 7<br />

FRAMEWORK CONTRACTS<br />

89. Framework Contract. |— (1) Procuring Entities may enter into a framework Contract,<br />

under Section 36 of the Act, for the supply of a quantity of similar items at specified prices during a<br />

defined period, in order to avoid repeated Tendering for the same requirement as well as obtain<br />

better prices through economics of scale.<br />

(2) Framework Contracts may be concluded following Open or Limited Tendering with<br />

one or more Suppliers to provide a range of Goods and physical Services over a defined period of<br />

time not exceeding three (3) years.<br />

(3) Framework Contracts shall not be used to procure items or Goods for prices higher<br />

than the market prices.<br />
