(a) the description of the Works and Physical Services to be carried out;<br />

(b) the drawings and location of the Works;<br />

(c) the description of the Goods and related Services to be supplied;<br />

(d) the location of delivery or installation;<br />

(e) the schedule for delivery and completion;<br />

(f) the minimum performance requirements;<br />

(g) the warranty, defects liability and maintenance requirements;<br />

(h) the currency(ies) the tenderers shall quote in the tenders and the applicable<br />

and the applicable date of its exchange rate;<br />

(i) the amount(s) and currency(ies) of Tender security and performance security;<br />

(j) the terms and mode of payment of the Contract price;<br />

(k) the presence or absence of Advance Payment, in line with the government<br />

orders and agreements with development partners;<br />

(l) the minimum insurance coverage; and<br />

(m) any other relevant terms and conditions.<br />

(4) Tender Documents, where appropriate, shall define the tests, standards and methods<br />

that shall be used to determine the compliance of the Goods or equipment to be delivered or<br />

Works to be performed with technical specifications.<br />

(5) Technical specifications shall be prepared in a non-restrictive manner so that a fair<br />

and open competition is possible and shall be consistent with drawings included in the Tender<br />

Documents.<br />

(6) <strong>The</strong> Procuring Entity may, if necessary seek the assistance of external specialists<br />

from outside the Procuring Entity at the time of for preparing the Tender Document.<br />

(7) <strong>The</strong> Documents forming the Contract shall be in the following order of precedence,<br />

namely :-<br />

(a) <strong>The</strong> signed Contract Agreement;<br />

(b) <strong>The</strong> Notification of Award;<br />

(c) <strong>The</strong> Tender and the appendices to the Tender;<br />

(d) Particular Conditions of Contract;<br />

(e) General Conditions of Contract;<br />

(f) Technical specifications;<br />

(g) General specifications;<br />

(h) Drawings;<br />

(i) Price Schedule and schedule of requirements for Goods or Priced Bill of<br />

Quantities for works;<br />

(j) Other Documents including correspondences. r.<br />

(8) <strong>The</strong> Documentation needed for consultancy Services (i.e. Request for Proposal and<br />

Terms of Reference) shall be prepared following provisions in Chapter Six of these <strong>Rules</strong>.<br />

(9) Where Tenders based upon alternative designs, materials, completion schedules,<br />

payment terms and other conditions are permitted, the conditions for their acceptability and the<br />

method for their evaluation shall be stated in the Tender Document.<br />
