(3) <strong>The</strong> Approving Authority shall communicate its decision to the Head of the Procuring<br />

Entity and others concerned.<br />

125. Signing of Contract. |— (1) <strong>The</strong> PEC and the successful Consultant shall, in order to<br />

conclude the negotiations, sign the agreed minutes of negotiations and initial the proposed draft<br />

Contract agreement.<br />

(2) A Procuring Entity shall upon receipt of the approval for the signing of the Contract,<br />

and provided that no complaint has been lodged or is still under consideration under <strong>Rules</strong> 57, 59<br />

and 60, invite the successful Consultant to sign the Contract.<br />

(3) <strong>The</strong> type of Contract shall be as specified in the RFP, i.e. Time-based or Lump Sum<br />

Contract.<br />

(4) <strong>The</strong> Consultant receiving an award of Contract shall not be required to submit any<br />

performance security.<br />

(5) <strong>The</strong> Procuring Entity shall assure that a necessary provision have been included in<br />

the RFP to the effect that the Consultant shall be contractually obligated, in the event their<br />

performance of the Services does not meet the standards and requirements set in the Contract, to<br />

re-perform the Services at their own expense or to indemnify the Procuring Entity for losses that it<br />

may suffer.<br />

126. Completion of the Process. |— (1) A Procuring Entity shall, following the signing of<br />

the Contract with the successful Consultant, inform all the other Consultants whose Proposal was<br />

technically responsive that they have been unsuccessful.<br />

(2) <strong>The</strong> Procuring Entity shall publish in its website, where applicable, the name of the<br />

Consultant to which the Contract was awarded as specified in Schedule II.<br />

(3) Information about award of Contracts exceeding the amount specified in Schedule II<br />

shall be posted on the CPTU’s website.<br />
