In assessing Turkey's competitive strength in the area of
intellectual and industrial property rights, Güldem Berkman
said that when one monitors Turkey's position on international
indexes the picture that emerges is not a positive one, and noted
the following points:

Report Turkey ranked 108th out of 142 countries assessed in the
area of "the protection of intellectual property rights"

ve Sınai Mülkiyet Haklarının korunmasından
geçiyor.
Uluslararası yatırımlar üzerinde fikri mülkiyet haklarının
korunmasının ne ölçüde etkili ve önemli olduğunu
sorduğumuz Fikri ve Sınai Mülkiyet Hakları Çalışma
Grubundan Sorumlu Yönetim Kurulu Üyesi Güldem Berkman
sorumuzu şu şekilde yanıtladı: “Günümüzde bir şirketin değeri
ölçümlenemeyen (intangible) varlıklar ile değerlendirilmektedir.
Bu anlamda, mülkiyet avantajı olarak adlandırılan unsurlar arasında
yeni teknolojiler, farklı bir know-how birikimi, organizasyon
yeteneği yer almaktadır. Aynı şekilde, bir ülkenin imajı/değeri
de fikri mülkiyet haklarının korunmasına atfedilen önemle
doğru orantılıdır. Bir ülkenin yüksek katma değerli sürdürülebilir
ekonomik büyümesinin arkasındaki en önemli koşullarından birini
fikri mülkiyet haklarının korunması oluşturmaktadır.
Grubumuzun görüşleri ışığında hazırlanan “Türkiye’de Fikri
Mülkiyet Haklarının Korunması: Uluslararası Doğrudan Yatırımlara
Etkiler” (Ekim 2011) konulu raporda bu konu karşılaştırmalı
örnek ve bulgularla araştırılmıştır. Söz konusu rapor,
Türkiye’nin rakiplerinin gerisinde kalmış olduğunu ve bu durumun
Türkiye’nin uluslararası yatırımlar için cazibesini olumsuz
olarak etkileyebileceğini göstermekte, buna karşın kararlı politik

hen we asked Güldem Berkman, Responsible
Board Member of the Intellectual and Industrial
Property Rights Working Group, The impact for
the protection of intellectual and industral property rights on
FDI, she answered, "Today a company's value is calculated with
reference to intangible assets. In this sense, new technologies,
different know-how accumulations, and organizational skills
are counted among elements called property advantages. In
the same way, the image/value of a country is also directly
proportionate to the importance placed upon the protection of
intellectual property rights. This is one of the most important
preconditions for a country to have high value-added
sustainable economic growth.
"The report entitled 'Protection of Intellectual Property Rights in
Turkey: Impact on International Direct Investment' (October 2011)
which is based on the views of our group, contains a study of the
subject using comparative examples and findings. The report
shows that Turkey is behind its competitors and that this may have
a negative effect on the attractiveness of Turkey to international
investment, however it says that if decisive political support

destek sağlanması ve hareket edilmesi durumunda ise rakiplerinin
önüne geçerek, yeni istihdam olanaklarını, ihracat artışlarını
ve ekonomik büyüme sağlayacak olan teknoloji transferlerini ve
yeni yatırımları çekmeye devam edeceğini belirtmektedir.”
Fikri ve Sınai Mülkiyet Hakları konusunda Türkiye’nin rekabet gücünü
değerlendiren ve Türkiye’nin bu alandaki konumunu belirlemek
üzere uluslararası endekslerindeki yeri takip edildiğinde
olumlu bir tablo ortaya çıkmadığını söyleyen Güldem Berkman
şu noktalara dikkat çekti:

Türkiye, “Fikri mülkiyet haklarının korunması” alanında 142
ülke arasında ancak 108. sırada kendisine bir yer bulabilmektedir.
2012 yılı Uluslararası Mülkiyet Endeksi (International Property
Right Index) araştırmasına göre fikri ve sınai mülkiyet haklarının
korunması alanında 130 ülke arasında 59. sırada yer almaktadır.
2012 yılı AB İlerleme Raporu’nda, sınai mülkiyet hakları alanında
özellikle uygulamaya ilişkin olarak sorunların devam ettiği
vurgulanmıştır.
According to the 2012 International Property Rights Index study
Turkey ranks 59th out of 130 countries in the protection of
intellectual and industrial property rights.
The 2012 EU Progress Report emphasized that there are
problems in the area of industrial property rights, especially in
enforcement.
In the European Commission's 2011 report on fake and counterfeit
goods Turkey ranked among the top 10 countries of origin. In the
products category, Turkey came first in foodstuffs with a 69%
share, had a 34% share in perfumes and cosmetics, and came
second in clothing with a 5% share.
"If we can make progress in all these data and assessments
presented we can have a positive effect on Turkey's competitive
strength. In this way it is possible for Turkey to reach an
advantageous position compared to other countries for
attracting FDI in technology and high value-added investments,"
said Berkman, who added, "The point of maintaining deterrence
is critical to attract new investments and implementation must
be followed through with maximum effectiveness just as in other
international examples."
Working Group Chairman Mehmet Ateş spoke about the group's
priorities and objectives: "With our Intellectual and Industrial
Property Rights Working Group we are continuing to work to raise
the existing legislation and implementations to international
