CBJ conducted raids in22 districton Friday<br />

as part <strong>of</strong> its investigation into the NRHM<br />

scam, which ha claimed five lives tillnow.<br />

It also lodged fourfresh fißs inthe tlO,OOOcrore<br />

scam that rocked the Mayawati government<br />

last year. Among those named in<br />

the FIR are doctors, health department <strong>of</strong>ficials<br />

and medicine suppliers. Withthis the<br />

total number <strong>of</strong> casesregistered inregards<br />

totheNßHMscamisl2.<br />

The raids were carried out in Lucknow,<br />

Basti, Eahraich, Varanasi, Gazipur among<br />

figure in the NEfIM scam. It had already<br />

questioned and raided the residence <strong>of</strong><br />

family welfare minister Babu Singh Kushwaha.<br />

The NRHM scam came into the openafter<br />

chief medical <strong>of</strong>ficer, family welfare, Vinod<br />

Kumar Arya, was killed in broad daylight<br />

on October2olo. This was soonfollowed by<br />

the killing <strong>of</strong> CMO B Singh outside his<br />

home on April2,2011. In its bid to cover up<br />

the scam, the police under pressure from<br />

higher upsframed deputy CMO YS Sachan<br />

forgetting the two doctorskilled and he was<br />

sent to prison. But on June 22,2011, Dr Sachan<br />

was also found dead inside the jail<br />

premises, with the police trying to dismiss<br />

itas a suicide first. Later it emerged that he<br />

too was kified to cover up the scam. These<br />

murders were related to the rampant corruption<br />

in the implementation <strong>of</strong> the<br />

NRIIMscheme in UP.<br />

NEW DEI.HI: The <strong>Central</strong> <strong>Bureau</strong><br />

<strong>of</strong><strong>Investigation</strong> (CDI) onFriday<br />

initiated two preliminary<br />

enquiries (PEs) in two cases <strong>of</strong><br />

alleged irregularities in the<br />

Cononwealth Games(CWG).<br />

The PFIs were lodged toprobe<br />

irregularities in the multi-crore<br />

renovation project on<br />

Connaught Place (CP) and New<br />

Delhi Municipal Council<br />

(NDMC)'s street-lighting projects<br />

as part <strong>of</strong> a beautification<br />

drive ahead <strong>of</strong> the<br />

sporting event.<br />

The CPrenovation projecthad<br />

allegedly escalated nine times,<br />

from the initial estimated sum<br />

<strong>of</strong>t76 crore in 2005 to<br />

671 crore<br />

in 2007, according to a CDI<br />

source. Though the project's<br />

planning began in 2004, its<br />

detailedproject report was only<br />

completed in February 2008,<br />

which delayed itand led to cost<br />

escalation, the source said.<br />

The agency also suspects that<br />

the project's cost escalation<br />

could have been allegedly triggered<br />

by the NDMC decision to<br />

expand its scope and also due<br />

to a cost-revision exercise triggered<br />

by its inclusion under the<br />

In the May 2005 plan, there<br />

was no plan for improving the<br />

subway system inCPbut itwas<br />

included by July 2007 that led<br />

to an escalation by over 60<br />

crore, the source said.<br />

clearance from traffic authorities.<br />

The report said, "NDMC<br />

should have divided the project<br />

into manageable packages, so<br />

as to minimise traffic disruption<br />

across the whole <strong>of</strong> CPS<br />

As part <strong>of</strong> its probe into the<br />

street-lighting projects, the CBI<br />

wouldinvtigate ifthe allegedly<br />

arbitrarS' purchase <strong>of</strong>imported<br />

equipment, though they were<br />

available in the domestic market,<br />

led to the needless expenditure<strong>of</strong>around<br />

t3l crore. The<br />

CRI is yet to find any technical<br />

note regarding reasons for use<br />

<strong>of</strong> imported equipment.<br />

Friday decided to frame charges<br />

against seven persons, including<br />

four MCD <strong>of</strong>ficials and a firm<br />

for their alleged roles in the<br />

CWG street lightning scam, on<br />

Februwy 27.<br />

The CBI has alleged that in<br />

view <strong>of</strong> the 2010 Commonwealth<br />

Games in Delhi, the MCD had<br />

NEW DElill: The <strong>Central</strong> <strong>Bureau</strong><br />

<strong>of</strong><strong>Investigation</strong> (CBI) has lodged<br />

a case against an <strong>of</strong>ficial <strong>of</strong> the<br />

rank <strong>of</strong> Assistant Commissioner<br />

<strong>of</strong> Police (ACP) in Delhi Police<br />

for allegedly amassing assets<br />

worth several crore that were<br />

disproportionate to his known<br />

source<strong>of</strong> income.<br />

The accused, ACP Mahipal<br />

Yadav, is currently posted with<br />

the fourth battalion, Delhi<br />

Armed Police, Wazirabad.<br />

Inducted as a sub-inspector in<br />

Delhi Police in 1977, Yadav has<br />

held several important assignments<br />

in the past.<br />

The agency filed a cased<br />

against Yadav under Section<br />

13(1)(e) <strong>of</strong> the Prevention <strong>of</strong><br />

Corruption Act, 1988, for owning<br />

disproportionate assets<br />

including six prime assets in<br />

central and south Delhi, one <strong>of</strong><br />

which is located in the posh<br />

Greater Kallash. The CBI has<br />

accused Yadav <strong>of</strong> owning five<br />

floors, worth several crore, in<br />

Tughlaqabad and Green Park.<br />

In New Delhi CBI spokesperson<br />

Dharini Mishra said, "The<br />

allegations are <strong>of</strong> gross irregularities<br />

and manipulation in<br />

award <strong>of</strong>contracts by CMOs to<br />

various private parties."<br />

The scam has claimed two<br />

CMOs and a deputy CMO, who<br />

were murdered, and others, who<br />

allegedly committed suicide.<br />

The Supreme Court today<br />

dismissed the petition filed by former Union telecom<br />

secretary Mr Siddarth Behura seeking interim<br />

bail in the 2G scam case even as Team Anna<br />

member Mr Prashant Ehushan filed another<br />

petition seeking a court-monitored CM trobe<br />

into the Union home minister Mr P<br />

Chidambaram's alleged rote in fixing the 26<br />

spectrum prices along with then teletom minister<br />

Mr A Raja. Mr Chidambaram was the finance minister<br />

when the alleged multi-million-rupee scam<br />

took place.<br />

Mr Behura had approached, the Supreme<br />

Court against<br />

the order <strong>of</strong> Delhi 'High Court<br />

which had rejected his petition for bail, Mr Raja<br />

and Mr Behura are in Tihar Jail for their alleged<br />

involvement in (he 2G scam case.<br />

The petition, filed by the Centre for Public<br />

Interest Litigation (CPIL), has contended that the<br />

facts that have now come on record merit a thorough<br />

investigation into the role <strong>of</strong> the finance<br />

ministry and Mr Chidambaram in the 2G scam.<br />

The petition has alleged that Mr Chidambaram<br />

overruled the <strong>of</strong>ficers <strong>of</strong> the finance ministrywho<br />

had favoured auction/market-based pricing'<strong>of</strong><br />

the spectrum, and by doing so he allowed the 2G<br />

scam to precipitate.<br />

The CPIL has held that as the finance minister,<br />

Mr Chidambaram was in a position to stop the<br />

scam which led to massive loss to public finances<br />

and corresponding gains to private parties. Thus,<br />

he clearly abused his position to benefit private<br />

parties and is liable to be tried under the<br />

Prevention <strong>of</strong> Corruption Act.<br />

its jurisdiction for the<br />

Commonwealth Games-2010.<br />

The Comptroller and Auditor<br />

General had in its report<br />

pointed out that the origiral<br />

cost estimate for the projqct<br />

to renovate and restore Con<br />

naught Place was Rs.76 crore<br />

Gomanbhaj Patel. The<br />

agency conducted searches<br />

at his premises in Delhi<br />

and Dadra and Nagar<br />

Haveli on Friday.<br />

The case has been<br />

registered against the<br />

first-time Lok Sabha MP<br />

fromDadra and Nagar<br />

Haveli based on allegations<br />

that he amassed<br />

disproportionate assets<br />

worth about Rs.2.18 crore<br />

between 2001 and 2009<br />

when he was the member<br />

<strong>of</strong> Silvassa Group Gram<br />

Panchayat, Interim<br />

Council <strong>of</strong> Silvassa<br />

Municipal Area and the<br />

Silvassa Municipal Council<br />

on different occasions.<br />

The CBI has claimed to<br />

have seized documents<br />

pertaining to movable and<br />

immovable assets during<br />

the search and they were<br />

being examined.

<strong>of</strong> the Delhi Police<br />

has been booked by the <strong>Central</strong><br />

<strong>Bureau</strong> <strong>of</strong> <strong>Investigation</strong><br />

for allegedly possessing assets<br />

disproportionate to his<br />

knon sources <strong>of</strong> income.<br />

Mahipal Singh, who was<br />

previously posted as the in-'<br />

charge <strong>of</strong> Abmedkar Nagar<br />

sub-division, has been booked<br />

under the Prevention <strong>of</strong><br />

Corruption Act.<br />

According to the CM, he<br />

was allegedly found in possession<br />

<strong>of</strong>five properties--one in<br />

Green Park and four in Tughlaqabad--in<br />

the name <strong>of</strong> either<br />

him or his relatives. He<br />

also<br />

purportedly owns a flat<br />

in neighbouring Faridabad.<br />

The agency suspects that he<br />

also owns several benami<br />

properties at other places in<br />

the Capital.<br />

After registration<br />

<strong>of</strong> the<br />

case, the CBI sleuths conducted<br />

searches at five places,<br />

including the South Delhi<br />

residence <strong>of</strong> the accused ACP.+<br />

They are scrutinising property<br />

papers and the financial<br />

transactions allegedly made<br />

through his bank accounts.

Irregularities in award <strong>of</strong>contracts by accused CMOs<br />

NEW DELHI: The <strong>Central</strong> <strong>Bureau</strong><br />

<strong>of</strong> <strong>Investigation</strong> has detected<br />

alleged irregularities<br />

in the award <strong>of</strong> contracts by<br />

the Chief Medical Officers <strong>of</strong><br />

district hospitals in the<br />

course <strong>of</strong> execution and implementation<br />

<strong>of</strong> the National<br />

Rural Health Mission funds<br />

in Uttar Pradesh. While four<br />

fresh cases have been registered,<br />

searches are being carried<br />

out at over 30 places<br />

across the State.<br />

The cases have been registered<br />

under the relevant provisions<br />

<strong>of</strong> the Indian Penal<br />

Code and the Prevention <strong>of</strong><br />

Corruption Act. According to<br />

a CBI spokesperson, gross irregularities<br />

and manipulations<br />

have allegedly been<br />

detected in the award <strong>of</strong> contracts<br />

by the accused CMOs<br />

to groups <strong>of</strong> private parties<br />

active in several districts.<br />

The first case covers irregularities<br />

in the contracts<br />

awarded by the then CMOs<br />

posted in ICushinagar, Gorakhpur,<br />

Deoria and<br />

Maharajganj<br />

to a group <strong>of</strong> private<br />

firms, mainly based in Lucknow,<br />

at inflated rates causing<br />

substantial losses to the exchequer.<br />

The companies have<br />

been identified as Sewa Enterprises,<br />

Sun Surgical, undustan<br />

Trading, Surji<br />

Sugicals, Charisma Health<br />

Care, Medicine Mahal, Garg<br />

Pharma and Gupta Brother.<br />

"Searchesare being carried<br />

out at $0 places in Lucknow,<br />

Varanasi, Meerut, Bahraich<br />

and Ballia," said the <strong>of</strong>ficial.<br />

The CBI had in November<br />

last registered a preliminary<br />

enquiry in pursuance <strong>of</strong> a<br />

court order for a probe into<br />

the implementation <strong>of</strong> the<br />

NRHM funds allocated to the<br />

State Government. The enquiry<br />

revealed that the Mission<br />

Directorate (NRI-IM) <strong>of</strong><br />

the U.P. Government had received<br />

money running into<br />

several thousand crores between<br />

2005-06 and 2010-11<br />

towards expenditure under<br />

various heads <strong>of</strong> schemes like<br />

Mission Flexipool, Immunization,<br />

Reproductive Child<br />

Health and<br />

National Blindness<br />

Control Programme,<br />

apart from funds forcivil construction<br />

and up-gradation <strong>of</strong><br />

hospitals.<br />

The funds channelled to<br />

the respective district health<br />

societies were "utilised" by<br />

the CMO5/CMO (Family<br />

Welfare) concerned. "The enquiry<br />

carried out so far has<br />

indicated that drugs and<br />

equipments, even <strong>of</strong> substandard<br />

quality, were supplied<br />

by the accused firms at<br />

inflated rates," said the <strong>of</strong>ficial<br />

added. The private companies<br />

purportedly bagged<br />

the contracts through their<br />

links with public servants.

NEW DELHI: Alleging that Union<br />

Home Minister P. Chidambaram,<br />

as Finance Minister, had<br />

an equal role as the former<br />

Telecom Minister A. Raja in<br />

fixing the 2G spectrum licence<br />

prices, the Centre for<br />

Public Interest Litigation<br />

(CPIL) on Friday moved the<br />

Supreme Court demanding a<br />

CBI probe into the former's<br />

role in the scam:<br />

petition alleged that it<br />

was now clenrly established<br />

with facts and documents<br />

that the then Finance Minister<br />

overruled the <strong>of</strong>ficers <strong>of</strong><br />

his own Ministry who<br />

favoured<br />

auction/ marketbased<br />

pricing <strong>of</strong> spectrum,<br />

and instead allowed the 2G<br />

scam to take place and the<br />

companies to make windfall<br />

pr<strong>of</strong>its.<br />

The CPIL alleged that Mr.<br />

Chidambarani, in no time, revised<br />

his position from giving'<br />

away 4.4 MHz <strong>of</strong> spectrum at<br />

2001 prices, to giving away<br />

6.2 MHz <strong>of</strong> spectrum at 2001<br />

prices thus forcing an additional<br />

loss on the exchequer.<br />

He knew fully well even post<br />

issue <strong>of</strong>Letters <strong>of</strong> Intent that<br />

it was legally possible to auction<br />

start-up spectrum<br />

and<br />

provisions <strong>of</strong> the licence<br />

agreement being cited by the<br />

DoT were not applicable<br />

since the Lol holders were<br />

not licensees at this stage.<br />

Further, it said, the then<br />

Finance Minister allowed<br />

companies such as Swan and<br />

Unitech to sell <strong>of</strong>f their<br />

stakes, without charging any<br />

government's share <strong>of</strong> itspremium<br />

on account <strong>of</strong> spectrum<br />

valuation and without enforcing<br />

his own agreement<br />

with Mr. Jtaja dated January<br />

30,2008.<br />

The petitioner said new<br />

documents and evidence<br />

showed that within three<br />

weeks <strong>of</strong> the issuance <strong>of</strong> the<br />

LoIs, Mr. Raja and Mr. Chidambaram<br />

met and concluded<br />

that 14 operators were too<br />

many for the Indian market<br />

and that several <strong>of</strong> the new<br />

entrants had come in for<br />

'speculative reasons.' Further,<br />

they knew fully well that<br />

these companies would enter<br />

Minister/Ministry in the<br />

Unanswered'questions<br />

"There are<br />

several unanswered<br />

questions that are for<br />

the CR1 to investigate. The reluctance<br />

<strong>of</strong> the CR1 in investigating<br />

thç role <strong>of</strong> Mr.<br />

Chidambaram or even questioning<br />

the then Finance<br />

Minister is not surprising because<br />

as Home Minister, Mr.<br />

Chidambaram is a very powerful<br />

figure in the <strong>Central</strong><br />

Government under which the<br />

CR1<br />

functions, and most <strong>of</strong><br />

the <strong>of</strong>ficers <strong>of</strong> the CBI are <strong>of</strong><br />

IPS cadre whose controlling<br />

authority (in charge<br />

<strong>of</strong> appointments,<br />

postings, transfers,<br />

appraisal reports,<br />

promotions) is the Home<br />

Ministry itself," the CPIL<br />

said.<br />

It sought a direction to the<br />

CR1 to conduct a thorough investigation<br />

/further investigation<br />

into the role <strong>of</strong> the<br />

Finance Ministry under the<br />

then Finance Minister in the<br />

2G scam, under the close supervision<br />

<strong>of</strong> the Supreme<br />

Court, assisted by the <strong>Central</strong><br />

Vigilance Commissioner and<br />

the senior Vigilance<br />

In an order issued on Friday,<br />

prima facie, a case was made<br />

out against the four <strong>of</strong>ficials<br />

with a private firm, Sweska<br />

Powertech EngineersPrivate<br />

Ltd, and its two co-promoters,<br />

The court discharged<br />

WEEKS after an Assistant<br />

Commissioner<strong>of</strong> Delhi Police<br />

was transferredand an<br />

inquiry orderedagainst him<br />

in connection with a land<br />

scam that took place in an<br />

area under his jurisdiction,<br />

the CBI on Thursday conducted<br />

searches at his residence<br />

and <strong>of</strong>fice.<br />

The searches reportedly<br />

led to the recovery <strong>of</strong>documents<br />

pertaining to properties<br />

and bank accounts,<br />

sourcessaid.<br />

Following the searches,<br />

theCBI registered a case under<br />

Section 13 (1) (E) <strong>of</strong> the<br />

Prevention <strong>of</strong> Corruption<br />

Act against ACP Mahipal<br />

Singh.<br />
