Questions— 14 February 2012. <strong>Written</strong> <strong>Answers</strong><br />
<strong>the</strong> <strong>the</strong>n Minister proposed to make a Deportation Order in respect <strong>of</strong> him. He was given <strong>the</strong><br />
options, to be exercised within 15 working days, <strong>of</strong> leaving <strong>the</strong> State voluntarily, <strong>of</strong> consenting<br />
to <strong>the</strong> making <strong>of</strong> a Deportation Order or <strong>of</strong> making representations to <strong>the</strong> Minister setting out<br />
<strong>the</strong> reasons why a Deportation Order should not be made against him. In addition, he was<br />
notified <strong>of</strong> his entitlement to apply for Subsidiary Protection in accordance with <strong>the</strong> provisions<br />
<strong>of</strong> <strong>the</strong> European Communities (Eligibility for Protection) Regulations 2006.<br />
The person concerned submitted an application for Subsidiary Protection. When consideration<br />
<strong>of</strong> this application has been completed, <strong>the</strong> person concerned will be notified in writing<br />
<strong>of</strong> <strong>the</strong> outcome. In <strong>the</strong> event that <strong>the</strong> application for Subsidiary Protection is refused, <strong>the</strong><br />
position in <strong>the</strong> State <strong>of</strong> <strong>the</strong> person concerned will <strong>the</strong>n be decided by reference to <strong>the</strong> provisions<br />
<strong>of</strong> Section 3 (6) <strong>of</strong> <strong>the</strong> Immigration Act 1999 (as amended) and Section 5 <strong>of</strong> <strong>the</strong> Refugee Act<br />
1996 (as amended) on <strong>the</strong> prohibition <strong>of</strong> refoulement. All representations submitted will be<br />
considered before a final decision is made. Once a decision has been made, this decision and<br />
<strong>the</strong> consequences <strong>of</strong> <strong>the</strong> decision will be conveyed in writing to <strong>the</strong> person concerned.<br />
Queries in relation to <strong>the</strong> status <strong>of</strong> individual immigration cases may be made directly to <strong>the</strong><br />
INIS by Email using <strong>the</strong> <strong>Oireachtas</strong> Mail facility which has been specifically established for<br />
this purpose. This service enables up-to-date information on such cases to be obtained without<br />
<strong>the</strong> need to seek information by way <strong>of</strong> <strong>the</strong> <strong>Parliamentary</strong> Questions process. The Deputy may<br />
consider using <strong>the</strong> e-mail service except in cases where <strong>the</strong> response from <strong>the</strong> INIS is, in <strong>the</strong><br />
Deputy’s view, inadequate or too long awaited.<br />
Garda Stations<br />
514. Deputy Aodhán Ó Ríordáin asked <strong>the</strong> Minister for Justice and Equality if he will outline<br />
<strong>the</strong> details <strong>of</strong> <strong>the</strong> closure <strong>of</strong> a Garda station (details supplied) in Dublin 9; his plans for this<br />
site; and if he will make a statement on <strong>the</strong> matter. [7920/12]<br />
Minister for Justice and Equality (Deputy Alan Shatter): In reaching a decision on <strong>the</strong> closure<br />
<strong>of</strong> Garda stations, <strong>the</strong> Commissioner reviewed all aspects <strong>of</strong> <strong>the</strong> Garda Síochána’s policing<br />
model, including <strong>the</strong> deployment <strong>of</strong> personnel, <strong>the</strong> utilisation <strong>of</strong> modern technologies and <strong>the</strong><br />
operation <strong>of</strong> Garda stations, both in terms <strong>of</strong> opening hours and possible closures. In addition,<br />
all Divisional Officers were asked to assess <strong>the</strong> level <strong>of</strong> activity in each Garda Station in <strong>the</strong>ir<br />
area. It must be stressed that <strong>the</strong> key objective <strong>of</strong> <strong>the</strong> station closures is to promote <strong>the</strong> more<br />
efficient and effective deployment <strong>of</strong> resources ra<strong>the</strong>r than secure modest cash savings. In this<br />
context <strong>the</strong> Commissioner has concluded that Garda resources could be better deployed and<br />
more effectively used on <strong>the</strong> front-line if <strong>the</strong>se particular stations no longer had to be staffed<br />
and maintained. There are no plans to review those decisions.<br />
The Garda Commissioner has reiterated <strong>the</strong> commitment <strong>of</strong> An Garda Síochána to providing<br />
a pr<strong>of</strong>essional and effective service to <strong>the</strong> community. Each Divisional Officer with responsibility<br />
for a Division that will be affected by this decision has been tasked with developing a<br />
comprehensive consultation strategy toge<strong>the</strong>r with a tailored implementation plan that will<br />
meet <strong>the</strong> particular needs <strong>of</strong> <strong>the</strong>ir Division. They will consult with <strong>the</strong> various stakeholders<br />
within <strong>the</strong>ir respective Divisions during this process. On receipt <strong>of</strong> a formal closure notice <strong>of</strong><br />
<strong>the</strong> station from An Garda Síochána, <strong>the</strong> Office <strong>of</strong> Public Works will examine o<strong>the</strong>r potential<br />
uses for <strong>the</strong> property.<br />
