21. NOTICES
d. If this Agreement, as provided by Design/Builder, is not duly and properly executed by the
Subcontractor and returned to Design/Builder within thirty (30) calendar days of its date, it may be
declared null and void by the Design/Builder at its option and without further notice.
a. Any notices required or permitted under the Agreement shall be deemed to be fully given if placed in a
pre-paid addressed envelope and sent by certified U.S. mail with return receipt requested or by Federal
Express or other similar national express mail service, or by acknowledged telex or telecopy, or by
delivering the same in person. Notice shall be effective upon three (3) days after said notice is sent or
upon receipt whichever is earliest. All notices to be given to the parties shall be sent to or made at the
addresses as set forth below; but by giving the other party at least ten (10) days prior written notice
thereof, any party hereto shall have the right to change its respective address or the individual to whom
notices are to be sent.

b. Notwithstanding the foregoing, the parties acknowledge and agree that any notice required or
permitted under the Agreement may be sent via electronic mail; provided, however, in such event,
such notice shall be sent to the e-mail address and to the attention of the person(s) as set forth and
identified below, for the respective parties, with written notice as set forth in Paragraph 21.1 above
being sent simultaneously.
