The follow<strong>in</strong>g requirements are <strong>in</strong>tended <strong>for</strong> suppliers <strong>in</strong> the Medium and<br />

Low Risk categories sourc<strong>in</strong>g timber from Medium and High Risk<br />

countries.<br />

4.4.4 <strong>Legal</strong>ity Requirements Determ<strong>in</strong>ation of Country/Region/FMU -<br />

A list of legal requirements of the timber source countries or regions is<br />

important <strong>for</strong>:<br />

The documentation request of the Prelim<strong>in</strong>ary Risk Assessment of<br />

Suppliers (Section 4.4.2.1)<br />

The improvement programs <strong>for</strong> Medium and Low Risk suppliers<br />

procur<strong>in</strong>g outside the country of harvest (4.5.3)<br />

The Coord<strong>in</strong>ator shall ma<strong>in</strong>ta<strong>in</strong> a database of legal requirements of the<br />

timber source countries or regions. <strong>Legal</strong> requirements may be limited to<br />

those perta<strong>in</strong><strong>in</strong>g to <strong>for</strong>est management and/or those relevant to<br />

stakeholder concerns. A list of species handled, <strong>in</strong>clud<strong>in</strong>g component<br />

species, and their likely countries of orig<strong>in</strong> shall be ma<strong>in</strong>ta<strong>in</strong>ed to limit or<br />

expand the analysis of legal requirements accord<strong>in</strong>g to the Operator‟s<br />

handled species. (see Appendix A4 <strong>for</strong> resources.)<br />

A legal review based on the laws of the country may be per<strong>for</strong>med by<br />

local legal counsel with expertise both <strong>in</strong> <strong>for</strong>estry and export laws. This<br />

legal review comb<strong>in</strong>ed with a thorough review of all the appropriate<br />

documentation can be used to establish the legality of the <strong>in</strong>itial<br />

ownership with the right to sell, harvest, transport, and export.<br />

<strong>Legal</strong> requirements may be unclear because of conflict<strong>in</strong>g<br />

local/national/<strong>in</strong>ternational laws. In these <strong>in</strong>stances the Coord<strong>in</strong>ator shall<br />

note the conflict and document the basis <strong>for</strong> the legal determ<strong>in</strong>ation <strong>in</strong> the<br />

database.<br />

4.4.5 Collection of Documentation - For procurement outside the country of<br />

harvest, the Coord<strong>in</strong>ator shall collect a questionnaire and legality<br />

declaration to determ<strong>in</strong>e the risk rat<strong>in</strong>g of the supplier on an annual basis.<br />

The follow<strong>in</strong>g document verification procedure shall be considered <strong>in</strong><br />

determ<strong>in</strong><strong>in</strong>g the risk of the supplier.<br />

For procurement <strong>in</strong>side the country of harvest, the Coord<strong>in</strong>ator shall<br />

determ<strong>in</strong>e the fulfillment of legality requirements by collect<strong>in</strong>g objective<br />

evidence and complet<strong>in</strong>g the follow<strong>in</strong>g document verification procedure:<br />

4.4.5.1 <strong>Legal</strong> Right to Harvest<br />

The Coord<strong>in</strong>ator shall collect/conduct the follow<strong>in</strong>g:<br />
