Tracks<br />

Current <strong>Rule</strong>:<br />

1. The non-subscriber or other than <strong>rail</strong>road<br />

subscriber is responsible, including cost of repair,<br />

for loss or damage to cars in its possession.<br />

a. Handling line is responsible for ensuring cars<br />

received from a non-subscriber or other than a<br />

<strong>rail</strong>road subscriber meet the Mechanical<br />

Requirements for Acceptance of the Field Manual<br />

of the <strong>AAR</strong> <strong>Interchange</strong> <strong>Rule</strong>s, <strong>Rule</strong> 88.<br />

b. Handling line will ensure car mark owner receives<br />

a no charge car repair data record.


<strong>Rule</strong> <strong>99</strong> - Intent Of The <strong>Rule</strong><br />

• Handling Line does not get relief from the<br />

responsibility to the Car Owner<br />

• Non-subscriber or other than <strong>rail</strong>road subscriber<br />

can be held responsible for damage<br />

• Disputes can be presented to the <strong>AAR</strong> Arbitration<br />

Committee<br />

• <strong>AAR</strong> <strong>Rule</strong> Clarification to support responsibility if<br />

litigation is pursued
