COUNCIL MINUTES TUESDAY 28 AUGUST 2012 Draft Policy 6.5: Precinct P5: West Leederville was advertised earlier this year (during January and February) in accordance with clause 48 (3) of the Scheme and at the close of advertising nine written submissions were received. Generally, submissions received outlined the following themes for consideration: • impact of nil setbacks in terms of streetscape and safety; • building heights - suggested maximum building heights include three and four storeys; • green areas for workers and roof top gardens; • energy and water efficiency of buildings; • improved waste management, including recycling; • residential densities; • parking demands; and • impact on surrounding residential amenity - increased traffic, overshadowing, overlooking. In accordance with clause 48 (4), the Council is required to:- (a) (b) review the draft Planning Policy having regard to any written submissions; and determine, by resolution, to adopt the draft Planning Policy, with or without amendment, or not to proceed with it. During the drafting of the previous amendments to the West Leederville Precinct Policy regard was given to the written submissions received. It was therefore considered that the amendments proposed and considered by Council in March and June did not require the Policy to be readvertised prior to Council's adoption of the proposed changes. However, given preceding versions of the Policy and the current revisions have now resulted in a document that is quite different to that originally advertised and to that which Council previously adopted it is considered prudent to readvertise. This will ensure transparency in regard to the process of adopting policy as required under Town Planning Scheme No. 1 and strength of the Policy in regard to its legal soundness. Re-advertising Requirements Having prepared a draft Policy clause 48 (3) of the Town Planning Scheme requires that Council: (a) (b) (c) advertise a summary of the draft Planning Policy once a week for two consecutive weeks in a newspaper circulating in the Scheme Area, giving details of where the draft Planning Policy may be inspected, and in what form and during what period (being not less than 21 days) submissions may be made, unless the draft Policy is to be advertised under clause 24 or 25 of the Scheme, in which case no further advertisement is required; where practicable, to notify those persons who, in the opinion of the Council, might be directly affected by the draft Planning Policy; and to forward a copy of the draft Planning Policy to the Western Australian Planning Commission for its consideration and advice in cases where the Council considers that the Policy may be inconsistent with other provisions of the Scheme or with state and regional planning policies. COUNCIL MINUTES TUESDAY 28 AUGUST 2012 In advertising the proposed draft West Leederville Precinct Policy, the following advertising method is recommended:- a) advertisements be placed in the local newspapers under the Town of Cambridge noticeboard; b) a notice and copy of the draft policy be placed on the Town's website; c) a letter sent to ratepayer groups; d) a letter sent to the Western Australian Planning Commission; and e) persons on the West Leederville Planning and Urban Design Mailing List and the residents who initially made submissions on the Policy be informed of the proposed amended draft Policy. If Council endorses the draft Policy for advertising at its August meeting advertising could be undertaken in September with a view to reporting to Council in October for final adoption. Revocation of the current Policy is not recommended at this point. The current Policy (adopted by Council in June 2012) should stand until the readvertising process is completed. COMMITTEE AND ADMINISTRATION RECOMMENDATION: Moved by Cr MacRae, seconded by Cr Bradley That:- (i) Town Planning Scheme No. 1, draft Policy 6.5 - Precinct P5: West Leederville, as amended and attached to this agenda, be adopted for the purpose of advertising as specified in accordance with clause 48 of the Town Planning Scheme and be advertised as follows:- (a) (b) (c) an advertisement be placed in the local newspapers under the Town of Cambridge noticeboard; a notice and a copy of the draft Policy be included on the Town’s website; and a notice be sent to the Western Australian Planning Commission, local ratepayer groups, persons on the West Leederville Planning and Urban Design Study mailing list, as well as those residents who initially made submissions on Draft Policy 6.5 - Precinct P5:West Leederville. During discussion, Cr MacRae proposed an amendment to the motion to add a further clause in relation to the bonus plot ratio provisions for the Cambridge High Street and Southport Street Nodes, relating to the provision of ROW's and public spaces.
