COUNCIL MINUTES 28 AUGUST 2012 Option 2 - 97 car bays The main difference in this option is that it removes the pedestrian link and landscape feature to Lake Monger which was a significant feature of the landscaping proposal. In respect of the decision of Council, the following points are made: • 97 bays are provided; • 90 degree parking has been provided along the entire south side (verge) of Dodd Street between Points A and B; • Further parking could be provided on the north side (verge of Dodd Street between Points A and B • No parallel parking has been provided on the north side (verge) of Dodd Street. This option comes close to satisfying Council's decision with the number of parking bays being the only outstanding matter. It is considered that 3 additional car bays could be provided along the north side (verge) of Dodd Street in a parallel configuration. This would mean a reduction on the landscaped verge but could be accommodated. Alternatively, TSH could pay cash-inlieu for three bays at a rate of $3,750 (excluding GST) per bay. This payment could go towards additional parking that may be provided in the area. Subject to the number of bays being increased to 100, this proposal is considered to satisfy Council's decision. Pedestrian Pathway Both options include a 1.2 metre wide pedestrian path on the north side of Dodd. Prior to construction of the new development, there was a 1.2 metre pedestrian path along the verge for more than half of the property's frontage to Dodd Street. Attached are aerial photos showing this path prior to works and a current photograph. This has since been damaged and removed in some parts due to the construction of the development. To the west of the site, there is a 1.2 metre path and a 1.8 metre path to the north-east. It is recommended that should Council endorse option 2 above, then a 1.8 metre path be included in the design and provided for the full extent of the TSH site frontage on the north side (verge) of Dodd Street. The path would allow for visitors and public to gain access from the parking area to either the centre or the surrounding parks and to walk through the landscaped verge. Previously, the Administration recommended that the Town pay TSH the sum of $25,000 for the cost of the footpath construction. There was, however, a footpath along over half the site's frontage and therefore it may be more reasonable that the Town offers half this amount, $12,500, with the TSH being responsible for replacing the path that has been removed during the development of the site. POLICY/STATUTORY IMPLICATIONS: There are no Policy or Statutory Implications related to this report. FINANCIAL IMPLICATIONS: Funds for Dodd Street upgrade have been included in the draft 2012/2013 budget. STRATEGIC DIRECTION: Consideration of this application is consistent with the Town's Strategic Plan 2009-2020 for the priority area 'Planning for our Community'. COUNCIL MINUTES 28 AUGUST 2012 COMMUNITY CONSULTATION: This matter has been assessed under the Community Consultation Policy. The requirements for consultation have been satisfied under the statutory provisions of the Town Planning Scheme. ATTACHMENTS: 1. Email from Telethon Speech and Hearing dated 3 August 2012. 2. Landscape Plans Council Meeting 28 August 2012 Prior to consideration of this item, Mr Ian Birch, Director Development and Sustainability, in accordance with Section 5.65 of the Local Government Act 1995, declared a financial interest in this matter. ADMINISTRATION RECOMMENDATION: Moved by Cr Langer, seconded by Cr King That:- (i) the Telethon Speech and Hearing Centre (TSH) be advised that Council APPROVES the parking and landscape proposal Option 2 attached that allows for 97 car parking bays subject to the following modifications:- (a) (b) three additional car bays be provided on the north side of Dodd Street in parallel configuration; a 1.8 metre continuous footpath be provided along the full width of the TSH frontage on the north side of Dodd Street; (ii) (iii) (iv) (v) (vi) the Town accepts the offer by TSH to undertake the designs and construction process for Dodd Street, subject to the Town's approval of the design and specifications; a 1.8 metre wide footpath is to be included in the works on the northern side of the verge. The Town will pay to the TSH a sum of $12,500 for the cost of the footpath construction; the indigenous themed landscaping proposal is accepted in principle. Detailed design, however, will need to ensure that necessary safety measures are addressed such as: sight lines for vehicles entering and leaving the site, CPTED principles of visibility and avoidance of trip hazards; on-going maintenance of the proposed landscaping areas that extend into the road reserve will be the responsibility of the TSH; the Town will not agree to occupation until this matter has been resolved to its satisfaction; (vii) the Town will pay to the TSH $120,000 to meet the Town’s commitment to funding the road carriageway component of the construction; H:\Ceo\Gov\Council Minutes\12 MINUTES\August 2012\D Item 10 Onwards.docx 211
