COUNCIL MINUTES TUESDAY 28 AUGUST 2012 CR12.137 PROPOSED MODIFICATIONS TO CLANCY'S FISH BAR PURPOSE OF REPORT: To seek approval (as the Landlord) for building modifications at Clancy's Fish Bar, City Beach to incorporate a new cool room and freezer. BACKGROUND: Clancy's Fish Bar lease an area of 1763 m² from the Town at a base rent of $79,553 per annum, plus threshold rent based on turnover over the threshold. The lease expires March 2031. Following completion of the fit out and alteration works for the café at Clancy's Fish Bar (northern section of the premises), which opened for business on 18 December 2011, it was noted that two portable temporary cool rooms remained on site. It was anticipated that the two portable cool rooms would be removed once the building fit out and alterations had been completed. The Town issued a notice to the Directors of Clancy's Fish Bar notifying them to remove the two temporary cool rooms and subsequently met with the Director's to discuss the issue, where it was proposed to construct a permanent cool room and freezer, the subject of this report. DETAILS: Since taking over operations, Clancy's have doubled the turnover and now require an additional cool room and freezer space for their operations. They propose to construct a cool room and freezer to seamlessly integrate into the existing structure, utilising the same building materials. The Town has been provided with drawings on 29 May 2012 (see attached) for approval by Council under the lease and also to seek approval from the Western Australian Planning Commission under the Metropolitan Region Scheme. The modifications are to be constructed within the boundary of the existing lease area and in this regard will have no impact over the existing lease agreement. In addition, Clancy's have expressed a desire to undertake modifications to the car park, footpath and landscaped areas forming the service area of the building to provide improved amenity. However, the Town has suggested deferring any planning until a master plan for the area is completed. This will be undertaken in conjunction with the Surf Club and commercial facilities redevelopment project. The application is supported as it would not detract from the amenity, is contained within the lease area and will assist the operator to maintain a satisfactory level of service. COUNCIL MINUTES TUESDAY 28 AUGUST 2012 POLICY/STATUTORY IMPLICATIONS: Approvals are required from the West Australian Planning Commission, and from the Town Building Regulator and Landlord. Specifically, the lease provides that: "The Tenant will not make or allow any alterations or additions to be made to the Premises or the Improvements including fire sprinklers, air conditioning or plumbing and electrical installations unless the alterations or additions are carried out in accordance with plans and specifications previously approved by the Landlord… The approval and supervision will be at the cost of the Tenant." FINANCIAL IMPLICATIONS: Since taking over the business, Clancy's have significantly increased its turnover and the Town is benefiting from an increase in threshold rent over and above the base rent of approximately $70,000 - $80,000. STRATEGIC DIRECTION: The proposed modifications to Clancy's Fish bar will continue to provide services that bring people together and improve the amenity of the Town's main beaches and reserves. COMMUNITY CONSULTATION: The proposal has been assessed under Policy No. 1.2.11 and no community consultation is required. ATTACHMENTS: 1. Detailed Working Drawings 2.
