ADMINISTRATION RECOMMENDATION:
That:-
(i)
lessor approval of the design of the State Netball Centre, in accordance with the
attached Design Development Report dated August 2012 Version 1.2, be granted
subject to the following conditions:

(e)
a permanent fence being constructed in accordance with the Forecourt
Landscape Plan (MP-02 Rev H) dated July 2012 shown on Page 28 of the
attached State Netball Centre Design Development Report;
the operator (VenuesWest) of the State Netball Centre being permitted to open
the fence on the forecourt at times that they are operating the State Netball
Centre and being responsible for the security and safety of people entering the
Matthews Netball Centre premises and any subsequent damage (and repair of)
to these premises caused by persons under the operator of the State Netball
Centre's supervision;
the final design of the fence and gate within the State Netball Centre lease
being agreed by the State and Town and any costs above the provision of the
standard of the fence proposed by the Town are borne by the State;
no temporary obstructions being placed within the forecourt area preventing
access from the Matthews Netball Centre premises to the forecourt area without
prior approval of the Town; and
the final detail design of landscaping within the State Netball Centre lease area
and the building façade for the State Netball Centre being consistent with the
application submitted by the State and attached to this report;
(ii)
it be noted that other works undertaken by the State within Wembley Sports Park will
require design approval by the Town prior to approval being given to commence work.

Prior to consideration of this item, Mr Chris Colyer, Director Infrastructure, in accordance
with Section 5.65 of the Local Government Act 1995, declared a proximity interest in this
matter.
During discussion, Members discussed various opportunities to increase the number of trees
in the landscaping design. It was agreed that there was a need to explore the opportunity to
increase the number of trees in areas that the State Government is involved in.

Moved by Cr Grinceri, seconded by Cr Carr
That a further clause be added to the motion as follows:-
(f)
the Department of Sport and Recreation to provide a buffer of suitable trees along the
western side of the building to provide suitable screening to the Town's satisfaction.
