COUNCIL MINUTES TUESDAY 28 AUGUST 2012 obvious 'points of differences' between each area which is necessary to better identify each part of Wembley Sports Park, however, it comes together well in an overall aspect. Item 4 is satisfied. It is noted that outside of the State Netball Centre lease, the State is undertaking roads and car parks within the park. The landscaping for these areas will be consistent with our approach as this is a fundamental design requirement. It is noted that the State will need to seek separate approvals for any clearing of native vegetation within Wembley Sports Park. The State will need to seek planning approval for this building. This will require consideration by the North West Metropolitan Development Assessment Panel, of which the Town has two Elected Members sitting on this panel. The Western Australian Planning Commission is required to provide the relevant planning report as the lease area is within the MRS Reserve. The Planning Commission will seek a planning comment report from the Town. It is understood that the State proposes holding a public information event to showcase the State Netball Centre. POLICY/STATUTORY IMPLICATIONS: There are no significant Policy or Statutory Implications related to this report. FINANCIAL IMPLICATIONS: There are no significant Financial Implications related to this report. STRATEGIC DIRECTION: The eventual development of this land for sporting purposes is consistent with the Town's strategic plan of creating communities of choice. COMMUNITY CONSULTATION: The views of the community regarding the proposal of locating the State Netball Centre within Wembley Sports Park are well known and have come to light during previous consultation processes for the Master Plan. The Town supports any initiative by the State to undertake a public information process on the 'look' of the State Netball Centre given that this was largely uncertain during earlier consultation periods. COUNCIL MINUTES TUESDAY 28 AUGUST 2012 ADMINISTRATION RECOMMENDATION: That:- (i) lessor approval of the design of the State Netball Centre, in accordance with the attached Design Development Report dated August 2012 Version 1.2, be granted subject to the following conditions: (a) (b) (c) (d) (e) a permanent fence being constructed in accordance with the Forecourt Landscape Plan (MP-02 Rev H) dated July 2012 shown on Page 28 of the attached State Netball Centre Design Development Report; the operator (VenuesWest) of the State Netball Centre being permitted to open the fence on the forecourt at times that they are operating the State Netball Centre and being responsible for the security and safety of people entering the Matthews Netball Centre premises and any subsequent damage (and repair of) to these premises caused by persons under the operator of the State Netball Centre's supervision; the final design of the fence and gate within the State Netball Centre lease being agreed by the State and Town and any costs above the provision of the standard of the fence proposed by the Town are borne by the State; no temporary obstructions being placed within the forecourt area preventing access from the Matthews Netball Centre premises to the forecourt area without prior approval of the Town; and the final detail design of landscaping within the State Netball Centre lease area and the building façade for the State Netball Centre being consistent with the application submitted by the State and attached to this report; (ii) it be noted that other works undertaken by the State within Wembley Sports Park will require design approval by the Town prior to approval being given to commence work. Committee Meeting 20 August 2012 Prior to consideration of this item, Mr Chris Colyer, Director Infrastructure, in accordance with Section 5.65 of the Local Government Act 1995, declared a proximity interest in this matter. During discussion, Members discussed various opportunities to increase the number of trees in the landscaping design. It was agreed that there was a need to explore the opportunity to increase the number of trees in areas that the State Government is involved in. Amendment Moved by Cr Grinceri, seconded by Cr Carr That a further clause be added to the motion as follows:- (f) the Department of Sport and Recreation to provide a buffer of suitable trees along the western side of the building to provide suitable screening to the Town's satisfaction.
