Section 1 of the Act sets out the principles in accordance with which police<br />

services are to be provided in Ontario, which include the need to ensure<br />

the safety and security of all persons, and the importance of safeguarding<br />

the fundamental rights guaranteed by the Ontario Human Rights Code. 17<br />

The powers and responsibilities of the Toronto <strong>Police</strong> Services Board are<br />

set out in Part III of the Act.<br />

The independent oversight roles of the SIU (Part VII of the Act and O. Reg.<br />

267/10), the <strong>In</strong>dependent <strong>Police</strong> Review Director (Parts II.1 and V of the<br />

Act) and the Ontario Civilian <strong>Police</strong> Commission (Part II of the Act) are set<br />

out.<br />

The obligation of the Chief of <strong>Police</strong> to cause an investigation to be<br />

conducted into any incident with respect to which the SIU has been<br />

notified is set out in section 11 of O. Reg. 267/10.<br />

Section 41 of the Act sets out the principal duties of the Chief of <strong>Police</strong>, and<br />

section 42 sets out the principal duties of a police officer.<br />

The requirements relating to Adequacy and Effectiveness of <strong>Police</strong><br />

Services are set out in O. Reg. 3/99. Section 13(1)(g) requires the Chief of<br />

<strong>Police</strong> to establish procedures in respect of police response to persons who<br />

are emotionally disturbed or have a mental illness or a developmental<br />

disability. Section 29 requires the Toronto <strong>Police</strong> Services Board to<br />

establish policies in respect of the same issue.<br />

Requirements relating to equipment and use of force are set out in<br />

Regulation 926. 18<br />

The minimum hiring criteria for police officers are set out in section 43 of<br />

the Act, and the requirement of a one-year probationary period for new<br />

officers is in section 44. The minimum requirements for the training of<br />

new recruits at the Ontario <strong>Police</strong> College are set out in O. Reg. 36/02.<br />

(i) There is a Code of Conduct for police officers set out in O. Reg. 268/10.<br />

Breach of the Code of Conduct constitutes misconduct that can be<br />

prosecuted under the disciplinary process set out in Part V of the Act. The<br />

Code of Conduct identifies what constitutes discreditable conduct,<br />

insubordination, neglect of duty, deceit, breach of confidence, corrupt<br />

practice, unlawful or unnecessary exercise of authority, damage to clothing<br />

or equipment, and consuming drugs or alcohol in a manner prejudicial to<br />

duty.<br />
