(3) 10- Tenderers must give detailed description, make and origin of the manufacturer of various items tendered and goods offered by the Tenderer will be deemed to be covered by a guarantee which may be specified. 11- All rates must be inclusive of Packing, Forwarding, Insurance and Railway Freight etc. F.O.R. destination on door delivery basis. The price quoted shall be net in Indian Rupees strictly for the Unit (each) mentioned in the Bill of Quantity. 12- All items offered have to be delivered according to agreed delivery schedule failing which the General Manager (MMT) reserves the right to accept the supplies beyond the stipulated period. The consignee has the right to impose a penalty upto Rs. 50/- per day for delay not exceeding 5% of the value of unsupplied items. Those items which have been supplied in time but subsequently rejected by the respective consignee, during inspection, will be treated as rejected supplies. The period of delay shall be reckoned from the date of receipt of material as per specification. 13- All items supplied will be subject to an inspection before being accepted by the consignee’s authorised representative of the Corporation. 14- In all matters of dispute relating to this tender the decision of the Managing Director, UPSRTC will be final and binding on tenderer. 15- All disputes and difference, arising out of the contract, shall be referred to the Sole Arbitration of the Managing Director of UPSRTC or his nominee, who shall be an employee of the UPSRTC not below the rank of General Manager whose decision shall be final and binding on both the parties. Thus submission shall be deemed to be a submission to the arbitration within the meaning of Indian Arbitration Act 1996 and statutory modifications thereof. Subject to above all local matters are subject to Lucknow Jurisdiction only. 16- Any other condition as per Bill of Quantity and Terms & Condition form enclosed shall also be treated as condition of tender. 17- Any tender that does not contain all the information required according to the conditions stated above or deviated from the above conditions of his own shall be rejected. 18- Managing Director reserves the right to alter any quantity of any items. 19- Rates must be quoted in attached scheduled “D”, “E” only. 20- Supplies for ELGI Plant material will have to make FOR Sharanpur, Bareilly, Kanpur, Allahabad, Lucknow Moradabad, Aligarh, Etawah and Agra & for INDAG plant FOR Ghaziabad and Gorakhpur. 21- Sample of Tyre Retreading Material from supply shall be sent for Testing at CIRT Pune/IRMRA/ Rubber Board/any other testing laboratory approved by Central Government. Test Report shall be binding for the both parties i.e. Supplier and user. Penalty will be imposed on the supplier for failure of samples in Test Reports as per Penalty Clause of ASRTU, New Delhi specification AS:272:63:FEB:2002 (Revised upto Date). (4) (a) The tenderer should enclose a self test certificate of their product on the above mentioned points (1 to 8) from Central Government approved testing agency (b) Sample of Tread Rubber, BVC & Bonding Gum will be sent for testing within Fifteen days from the date of receipt of material (c) Sampling will be done jointly with RM, SM & in the presence of representative of the company. (d) Sample will also be sent from the final balance quantity irrespective of the quantity left. (e) Sample of Tread Rubber from every 10 M.T. for each tyre shops, shall be sent for testing as per ASRTU specification amd allied Items shell besent fortestingas per requirement. (f) In case Two consecutive sample fail in testing, supplies shall be short closed, irrespective of the fact that samples are sent form different tyre shops of UPSRTC and test reports are form two different testing agencies, The remaining quantity shall be diverted to other eligible sources. 22- The tenderer is also required to with stand unconditional minimum kilometer guarantee which shall not in any case be less than 33,000 km for purchase of T.R.M on Cost Per Kilometer basis (CPKM). CPKM shall be calculated on the Kilometer Guarantee offered by individual supplier which in any case shall not be less than 33,000 km and for first timer (New Comer) CPKM shall be calculated on the basis of minimum km. guarantee as specified by UPSRTC or on the km guaranteed by the firm but guaranteed km cannot be less than the km guarantee desired by UPSRTC in this case 33,000 km. All other terms & conditions regarding guarantee, km assessment and penalty etc. shall be same for every bidder or tenderer. If the life of 80% removed tyres (fir for retreading) during entire order period is found to be less than 80% of guarantee life then the bidder/supplier shall be debarred from participating in future tenders of UPSRTC for T.R.M 23- The purchase of TRM will be decided on the basis of formula given at Serial No 34 of this document. The performance of removed tyres shall be monitored from day one. The sample size will be of 1,000(one thousand) removed tyres (fir for retreading). If the life of these tyres comes to less than 90% of the guaranteed Km. then supplies from the firm shall be stopped and remaining ordered quantity will be diverted to the other qualified firm/s 24- Tenderers should confirm and Guarantee that the rates quoted are lowest for respective quantity and that there are no other lower rates or discounts etc. (Excluding statutory duties) quoted to any other STU’s and/or Govt. Dept./Undertaking. In case of such default the difference shall be recovered from the ordered Firm/Tenderer, after the lower rate quoted in other STU’s in known from the date of quotation. 26- Those firms who insist that their material should only be stored and transported in A.C. environment may not be considered. 27- Offer received for Tread Rubber & Allied Items will be considered in totality. If some tenderer quote either of Items tender will be treated as incomplete and may not be considered. Downloaded from www.upsrtc.com 28- Those tenderers who are U.P. based and are not ASRTU Rate Contract/Trial Rate Contract and have not supplied to any other STU’s are requested to submit documentary proof for registration as SSI unit of director of industries, U.P. for manufacturing of Tyre Retreading material. Those who do not submit documentary evidance may not be considered as approved manufacturer for the purpose of placing the order by UPSRTC. Contd…5
