(2) General Terms & Condition for the Tender Notice for supply of the Items mentioned in the Bill of Quantity, U.P.State Road Transport Corporation. 1- Tenders are invited for supply of items mentioned in the Bill of Quantity as per specifications mentioned therein from the manufacturer. The Tenders shall remain open for acceptance for a period of minimum 12 Month commencing from the date of opening of the Tenders. 2- Tenders must be filled in tender forms obtainable from the undersigned’s office on any working day during office hours on the payment of Rs. 10000.00 {Ten Thousand } (+5% VAT extra) in the shape of Demand Draft in favour of General Manager (MMT) U.P.S.R.T.C Lucknow which is Non-Refundable. The tenders must be properly sealed and superscribed, Tender as per bill of quantity and must be delivered at the undersigned office not later than 13.00 hours on Date mentioned in Bill of Quantity. Tenders received after due date/time will not be entertained, even if the same is due to Postal/courier delay. Tender form may also be downloaded from UPSRTC, Website www.upsrtc.com & prescribed tender Fee Rs. 10000.00 +5% VAT (on Demand Draft payable to GM(MMT) UPSRTC), Lucknow has to be deposited at the time of submission of tender form. 3- Each tender must be accompanied by Tender Form and Bill of Quantity with Terms & Condition. Form should be duly signed and stamped together with a BANK DRAFT in favour of General Manager (MMT), UPSRTC, PARIVAHAN BHAWAN, Lucknow for Rs.5.00 Laks. Tender which are not accompanied by the Earnest Money in the proper Terms will not be considered to be VALID. The Tenderers are required to give the acceptance of payments terms – 100% of the payment due to the suppliers in 45 days. The payment Through RTGS only. Every firm which has been awarded Purchase Order has to deposit Security in shape of Bank Guarantee/Bank Draft of a Nationalized Bank of 10% of the Order Value before commencing of supply. The validity of the Bank Guarantee should be Three Years. In case of Security Deposited in Bank Draft, amount should be withheld for Three Years. 4- Each Tenderer has to submit ‘Technical Bid’ and ‘Financial Bid’, in separate envelope super scribing technical bid or financial bid as the case may be. All the sealed envelope should be kept in a single separate envelop. Financial bid consists of only annexure D & E and bill of Quantity whereas technical bid consists annexure A B & C and all other documents required in tender form. Technical bid shall be opened first subsequent to satisfactory approval, financial bid of those only who qualify in Technical Bid. 5- If subsequent to the submission of the tender, any Tenderer, alter or modifies the contents of his tender which are not acceptable to UPSRTC then, for the purpose of this condition, the Tenderer shall be deemed to have withdrawn his proposal and thereby inviting forfeiture of Earnest Money. If any tenderer withdraws his tender before expiry of the period referred to in para above, UPSRTC may agree to allow such withdrawal, but in such a case Earnest Money deposited by the Tenderers may be forfeited, in case of refusal to such withdrawl and acceptance of the tender, still if the tenderer fails to perform his part of the contract, not only the Earnest Money deposited by the Tenderer shall be liable to be forfeited but shall invite other consequences of Breach of contract If subsequent to the submission of the tender. 6- Correction, if any made by the tenderer must bear date & initial of Tenderer. 7- UPSRTC reserves the right to place order on more than one source. In such case tenderer must enclose their CONSENT to make the supply on eligible lowest rates. (Cost per K.M. in the present case). In case the Purchase Order is placed to more than one source, the quantity shall be distributed as per the Purchase Policy of Corporation and the preference for placing purchase order to more than one would be given to Second, third or subsequent lowest tenderer accordingly after their written consent. Those who give their CONSENT for acceptance of this clause, will get the over riding preference over those manufacturers who do not agree or do not give consent for this clause In case of order to more than one source the total ordered qty. shall be distributed as per purchase Policy:-- Sl. Rate diffrence (CPKM) Bifercation of Qty. to be purchase in %age 1 NIl 50 : 50 2 > 0 to 5% < 60 : 40 3 > 5 % to 10 % < 70 : 30 4 > 10 % to 20 % < 80 : 20 5 > 20 % 90 : 10 Downloaded from www.upsrtc.com In case of 3 source of supply the %age for 1 st Lowest firm will remain the same as calculated as per above policy and the distribution among 2 nd and 3 rd lowest firm shall be made from the balence qty, as per policy given above. 8- The Managing Director reserves the right to reject any or all the tenders without assigning any reasons. 9- It will be open to the General Manager (MMT) to accept any tender in full or in part with respect to valid tender as the Tenderers shall supply such quantities as are accepted by General Manager (MMT) at the quoted rates.
