Administrati<strong>on</strong> staff for all cemeteries are based at the Bereavement<br />

Care Service office at Carmountside Cemetery <str<strong>on</strong>g>and</str<strong>on</strong>g> Crematorium.<br />

APPENDIX 1<br />

<strong>City</strong> of <str<strong>on</strong>g>Stoke</str<strong>on</strong>g> <strong>on</strong> <strong>Trent</strong> – Bereavement Care Service<br />

<str<strong>on</strong>g>Rules</str<strong>on</strong>g> <str<strong>on</strong>g>and</str<strong>on</strong>g> <str<strong>on</strong>g>Regulati<strong>on</strong>s</str<strong>on</strong>g> Effective from 1 January 2010<br />

The ‘Local Authorities Cemeteries Order 1977’ <str<strong>on</strong>g>and</str<strong>on</strong>g> ‘Local Government<br />

Act 1974’ must be complied with in all <strong>City</strong> Cemeteries. Other relevant<br />

statutory requirements must also be complied with.<br />

<str<strong>on</strong>g>Rules</str<strong>on</strong>g> <str<strong>on</strong>g>and</str<strong>on</strong>g> <str<strong>on</strong>g>Regulati<strong>on</strong>s</str<strong>on</strong>g> for the Burial Grounds <str<strong>on</strong>g>and</str<strong>on</strong>g> Cemeteries within<br />

the <strong>City</strong> which are situated in Tunstall, Burslem, Smallthorne,<br />

Carmountside, Hanley, <strong>Trent</strong>ham, <str<strong>on</strong>g>Stoke</str<strong>on</strong>g>, Fent<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> L<strong>on</strong>gt<strong>on</strong>.<br />

BURIAL<br />

1. Notice of an intended interment must be given to the Carmountside<br />

side office, during office hours, three clear working days prior to the<br />

day <str<strong>on</strong>g>and</str<strong>on</strong>g> time required. Any instructi<strong>on</strong>s given by teleph<strong>on</strong>e will be<br />

received at the sole risk of the pers<strong>on</strong> giving such orders or<br />

instructi<strong>on</strong>s. The authorised officer will not be resp<strong>on</strong>sible for any<br />

misunderst<str<strong>on</strong>g>and</str<strong>on</strong>g>ing which may arise with regard to any instructi<strong>on</strong>s<br />

given by teleph<strong>on</strong>e unless immediately c<strong>on</strong>firmed in writing. No<br />

forms c<strong>on</strong>nected with the disposal of the dead will be accepted in<br />

facsimile, telexed or electr<strong>on</strong>ic (e mail) form..<br />

2. Grave spaces will be allocated <strong>on</strong> the basis of the next available<br />

plot in the area currently in use for burial purposes. Requests <strong>on</strong> an<br />

individual basis to choose a grave will be c<strong>on</strong>sidered. Choice is<br />

limited <str<strong>on</strong>g>and</str<strong>on</strong>g> will be c<strong>on</strong>sidered within the existing burial area <strong>on</strong>ly.


3. The Notice of Interment <str<strong>on</strong>g>and</str<strong>on</strong>g> all other forms c<strong>on</strong>firming ownership<br />

must be fully completed. These forms are provided by the<br />

council. A Registrars Certificate for Burial or Cremati<strong>on</strong>,<br />

Cor<strong>on</strong>ers order for burial, Stillborn or n<strong>on</strong> viable forms for burial<br />

are to be produced together with other statutory forms, to the<br />

Carmountside office no later than 9.30am <strong>on</strong> the working day<br />

prior to the interment, excluding Saturday. Special c<strong>on</strong>siderati<strong>on</strong><br />

must be given to periods where the office is closed for Bank<br />

Holidays. If a minister is required to c<strong>on</strong>duct a funeral, the<br />

pers<strong>on</strong> requesting this must make the necessary arrangements<br />

<str<strong>on</strong>g>and</str<strong>on</strong>g> notify the Carmountside office accordingly. Where a funeral<br />

has been pre arranged to take place <strong>on</strong> a Saturday, Sunday or<br />

Bank holiday, forms must still be received <strong>on</strong> the working day<br />

prior to the funeral taking place. Failure to provide all forms within<br />

the specified times may result in the cancellati<strong>on</strong> of a funeral.<br />

4. Weekend <str<strong>on</strong>g>and</str<strong>on</strong>g> Bank Holiday same day burials are available in<br />

specified secti<strong>on</strong>s at Tunstall <str<strong>on</strong>g>and</str<strong>on</strong>g> Fent<strong>on</strong> Cemeteries. All graves<br />

for this purpose are for <strong>on</strong>e full interment. This service is not<br />

available <strong>on</strong> Christmas Day, Boxing Day, New Years Day, Good<br />

Friday, Easter Sunday <str<strong>on</strong>g>and</str<strong>on</strong>g> Easter M<strong>on</strong>day. For interments<br />

arranged using the same day weekend <str<strong>on</strong>g>and</str<strong>on</strong>g> Bank Holiday<br />

service, the completed necessary forms must be h<str<strong>on</strong>g>and</str<strong>on</strong>g>ed to the<br />

nominated officer at the cemetery prior to the interment taking<br />

place.<br />

5. The time of arrival for funerals, namely the time when the<br />

processi<strong>on</strong> is to be at the grave side, must be punctually<br />

observed <str<strong>on</strong>g>and</str<strong>on</strong>g> arranged so that no two funerals arrive at the same<br />

time. Service times are available from the Carmountside office.<br />

Such times must be by appointment with the Cemetery Officer.<br />

Bearers must be provided by the Funeral Director, unless<br />

specially requested. In the interests of Health <str<strong>on</strong>g>and</str<strong>on</strong>g> Safety, <str<strong>on</strong>g>and</str<strong>on</strong>g> for


insurance purposes, <strong>on</strong>ly authorised pers<strong>on</strong>s are allowed to lower<br />

coffins into a grave. The <strong>City</strong> <strong>Council</strong> will not be held resp<strong>on</strong>sible<br />

for the delay in any funeral caused by Funeral Director’s delay.<br />

6. No disposal of cremati<strong>on</strong> remains from other crematoria will be<br />

undertaken without the correct Certificate of Cremati<strong>on</strong> being<br />

submitted, together with other appropriate forms. All remains <str<strong>on</strong>g>and</str<strong>on</strong>g><br />

forms must be delivered to Carmountside Cemetery <str<strong>on</strong>g>and</str<strong>on</strong>g><br />

Crematorium office no later than 9.30am <strong>on</strong> the working day prior<br />

to the disposal excluding Saturday<br />

7. Rights of Burial include the right to erect a Memorial, excluding<br />

the Woodl<str<strong>on</strong>g>and</str<strong>on</strong>g> Park area where memorials are not allowed. Each<br />

interment in a grave will be charged the fee applicable at the time<br />

<str<strong>on</strong>g>and</str<strong>on</strong>g> subject to the regulati<strong>on</strong>s now in force, <str<strong>on</strong>g>and</str<strong>on</strong>g> which may be<br />

issued with regards to Interments in Burial Grounds <str<strong>on</strong>g>and</str<strong>on</strong>g>/or<br />

cemeteries by Her Majesty’s Secretary of State or any<br />

Government Department or by the said council or other<br />

competent authority.<br />

8. The Right of Burial is for a 30 year lease period. This lease<br />

period applies to Full Earth burial <str<strong>on</strong>g>and</str<strong>on</strong>g> Full Earth Woodl<str<strong>on</strong>g>and</str<strong>on</strong>g> Park<br />

burials.<br />

9. The Right of Burial for cremati<strong>on</strong> remains graves <str<strong>on</strong>g>and</str<strong>on</strong>g> Woodl<str<strong>on</strong>g>and</str<strong>on</strong>g><br />

Park cremati<strong>on</strong> remains graves is for a 25 year lease period.<br />

10. All leases may be renewed <strong>on</strong> expiry of the current lease, subject<br />

to the fee <str<strong>on</strong>g>and</str<strong>on</strong>g> c<strong>on</strong>diti<strong>on</strong>s applicable at the time. The lease may<br />

be renewed for the maximum period of 25 years for cremati<strong>on</strong><br />

remains graves or 30 years for full graves. Alternatively leases<br />

may be re-purchased for a five year period. Any Right of Burial


not re-leased, where the ground is still available, will be claimed<br />

by the <strong>Council</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> any existing memorial removed, as in the<br />

initial agreement for the Right of Burial. The Right of Burial will<br />

be re-leased to pers<strong>on</strong>s as required. No claims by any previous<br />

registered owner of the Right of Burial shall be made after the<br />

Right of Burial has been reclaimed by the <strong>Council</strong> who reserve<br />

the right to re-use the l<str<strong>on</strong>g>and</str<strong>on</strong>g> as they see appropriate.<br />

11. No grave space in any <strong>City</strong> Cemetery may be reserved.<br />

12. All coffins <str<strong>on</strong>g>and</str<strong>on</strong>g> cremati<strong>on</strong> remains caskets shall be of wood or<br />

material of a biodegradable nature. Shrouds or biodegradable<br />

c<strong>on</strong>tainers/covers as approved by the <strong>City</strong> <strong>Council</strong> will be<br />

allowed. No ir<strong>on</strong> coffins or n<strong>on</strong> biodegradable material will be<br />

allowed. Disposals in the Woodl<str<strong>on</strong>g>and</str<strong>on</strong>g> Park will be permitted <strong>on</strong>ly<br />

in shrouds or biodegradable c<strong>on</strong>tainers/cases as approved by<br />

the Bereavement Care Service Management. Cremati<strong>on</strong><br />

remains are to be disposed of in the supplied c<strong>on</strong>tainer; no<br />

c<strong>on</strong>tainer other than those approved by the <strong>City</strong> <strong>Council</strong> will be<br />

allowed.<br />

13. Once a coffin has entered any <strong>Council</strong> Burial Ground it will not<br />

be opened for any reas<strong>on</strong>.<br />

14. With the excepti<strong>on</strong> of Carmountside, Smallthorne <str<strong>on</strong>g>and</str<strong>on</strong>g> <strong>Trent</strong>ham<br />

Cemeteries garden graves may be allowed at the discreti<strong>on</strong> of<br />

the <strong>Council</strong>. Only seas<strong>on</strong>al bedding plants are permitted within<br />

the soil area provided (6’x2’). Any grave not c<strong>on</strong>forming to the<br />

specificati<strong>on</strong>s, or left unattended will be turfed. As from 1<br />

January 1999, these graves must not be surrounded with<br />

edgings of any descripti<strong>on</strong>. Any such edgings will be removed<br />

<str<strong>on</strong>g>and</str<strong>on</strong>g> disposed of by cemetery staff. No items of any descripti<strong>on</strong><br />

are to be placed/planted within the lawn grave space


immediately in fr<strong>on</strong>t of the memorial foundati<strong>on</strong>. Any such items will<br />

be removed <str<strong>on</strong>g>and</str<strong>on</strong>g> disposed of by the authorised officer.<br />

15. All new grave secti<strong>on</strong>s shall be of lawn style, unless as at paragraph<br />

14 above. All new graves will be excavated to a depth of 6’ <strong>on</strong>ly,<br />

unless otherwise agreed by the authorised officer. Any re-open<br />

graves requested to be dug deeper than 6’ will <strong>on</strong>ly be d<strong>on</strong>e so if<br />

agreed by the authorised officer. All graves will be excavated to<br />

accommodate a coffin of 6’6”x26”x16” unless otherwise agreed by<br />

the authorised officer. No cremati<strong>on</strong> remains caskets or babies’<br />

coffins shall be buried in the grip of any grave. All memorials <str<strong>on</strong>g>and</str<strong>on</strong>g><br />

kerbs shall be completely removed by a licensed memorial mas<strong>on</strong><br />

for full <str<strong>on</strong>g>and</str<strong>on</strong>g> cremati<strong>on</strong> remains interments, unless fixed to a c<strong>on</strong>crete<br />

raft with an approved ground anchoring system. Where a larger<br />

grave space is required to accommodate a large coffin for purposes<br />

other than the necessity of c<strong>on</strong>taining the deceased, an additi<strong>on</strong>al<br />

charge of 50% of the interment fee will be added to the cost of the<br />

interment.<br />

16. Other than in paragraph 14, no tree shrub or plant may be planted<br />

<strong>on</strong> any grave or area of the cemetery without sancti<strong>on</strong> of the<br />

council, nor shall any of the said be allowed to be cut or removed<br />

without compensati<strong>on</strong> being paid for the same, <str<strong>on</strong>g>and</str<strong>on</strong>g> the sancti<strong>on</strong> of<br />

the council being received.<br />

17. All brick, st<strong>on</strong>e or other work, in or about vaults or graves shall be<br />

furnished <str<strong>on</strong>g>and</str<strong>on</strong>g> erected by the <strong>Council</strong> at the cost of the registered<br />

owner.<br />

18. All private graves <str<strong>on</strong>g>and</str<strong>on</strong>g> vaults, with their m<strong>on</strong>uments, memorials <str<strong>on</strong>g>and</str<strong>on</strong>g><br />

grave st<strong>on</strong>es must be kept in good repair by the registered owner.<br />

Notice will be sent to the registered owner of the Right of Burial,<br />

where known, in the case of such repairs being required. Where


a memorial is found to be unsafe we will, by an approved method,<br />

temporarily make the memorial safe <str<strong>on</strong>g>and</str<strong>on</strong>g> in due course permanently<br />

refix or make safe the memorial by an approved method.<br />

19. The Burial Authority may, at the request of a particular denominati<strong>on</strong><br />

or religious body, prohibit the interring or scattering of cremated<br />

human remains in or over a part of the cemetery set apart for their<br />

use. Local Authorities’ Cemeteries Order 1977 Article 5 (6).<br />

20. No body shall be buried or cremati<strong>on</strong> remains interred in any grave<br />

without the c<strong>on</strong>sent in writing of the registered owner of the Right.<br />

Local Authorities’ Cemeteries Order 1977 Article 10 (6).<br />

21. No pers<strong>on</strong> not being an officer or servant of the Burial Authority or<br />

another pers<strong>on</strong> so authorised by or <strong>on</strong> behalf of the Burial Authority<br />

shall enter or remain in a cemetery at any hour when it is closed to<br />

the public.<br />

Local Authorities’ Cemeteries Order 1977 Article 18 (2)<br />

22. No burial shall take place, no cremated human remains shall be<br />

scattered <str<strong>on</strong>g>and</str<strong>on</strong>g> no tombst<strong>on</strong>e or other memorial shall be place in a<br />

cemetery <str<strong>on</strong>g>and</str<strong>on</strong>g> no additi<strong>on</strong>al inscripti<strong>on</strong> shall be made <strong>on</strong> a<br />

tombst<strong>on</strong>e or other memorial without permissi<strong>on</strong> of the officer<br />

appointed for that purpose by the Burial Authority. Part 1 of<br />

Schedule 2 to the Local Authorities’ Cemeteries Order 1977<br />

Para 1.<br />

23. No body shall be buried in a grave in such a manner that any part of<br />

the coffin is less than three feet below the level of any ground<br />

adjoining the grave. Provided that the Burial Authority may, where<br />

they c<strong>on</strong>sider the soil to be of suitable character, permit a coffin<br />

made of perishable materials to be placed not less than two feet<br />

below the level of any ground adjoining the grave.


Part 1 of Schedule 2 to the Local Authorities’ Cemeteries Order<br />

1977 Para 2.<br />

24. No body shall be buried in a grave unless the coffin is effectively<br />

separated from any coffin interred in the grave <strong>on</strong> a previous<br />

occasi<strong>on</strong> by means of a layer of earth not less than six inches thick.<br />

Part 1 of Schedule 2 to the Local Authorities’ Cemeteries Order<br />

1977 Para 3.<br />

25. Every walled grave or vault shall be properly c<strong>on</strong>structed of suitable<br />

materials. Part 1 of Schedule 2 to the Local Authorities’<br />

Cemeteries Order 1977 Para 5.<br />

26. When any grave is reopened for the purpose of making another<br />

burial therein, no pers<strong>on</strong> shall disturb any human remains interred<br />

therein or remove there from any soil which is offensive.<br />

Part 1 of Schedule 2 to the Local Authorities’ Cemeteries Order<br />

1977 Para 4.<br />

27. Within 24 hours of any burial in a walled grave or vault, the coffin<br />

shall be:<br />

• embedded in c<strong>on</strong>crete <str<strong>on</strong>g>and</str<strong>on</strong>g> covered with a layer of c<strong>on</strong>crete<br />

not less than six inches thick, or<br />

• enclosed in a separate cell or compartment of slate, st<strong>on</strong>e<br />

flagging or pre cast c<strong>on</strong>crete slabs of a 1:2:4: mix, in any case<br />

not less than two inches thick, in such a manner as to prevent,<br />

as far as may be practicable, the escape of any noxious gas<br />

from the interior of the cell or compartment.<br />

28. No new walled graves or vaults are available; the above applies to<br />

re-open walled graves or vaults. Part 1 of Schedule 2 to the Local


Authorities’ Cemeteries Order 1977 Para 7.<br />

29. Any pers<strong>on</strong> to whose order a body is buried in a grave in respect of<br />

which an Exclusive Right of Burial has been granted shall, as so<strong>on</strong><br />

as c<strong>on</strong>veniently possible after the subsidence of the earth has been<br />

completed, cause the surface of the grave to be covered with a<br />

memorial, in respect of which a right has been granted by the Burial<br />

Authority or any predecessor of theirs, or with turf as applicable. 30.<br />

No pers<strong>on</strong> shall:-<br />

• wilfully create any disturbance in a cemetery;<br />

• commit any nuisance in a cemetery;<br />

• wilfully interfere with any burial taking place in a cemetery;<br />

• wilfully interfere with any grave or vault, any tombst<strong>on</strong>e or other<br />

memorial, or any flowers or plants <strong>on</strong> any such matter;<br />

• play at any game or sport in a cemetery.<br />

Local Authorities’ Cemeteries Order 1977 Article 18 (1).<br />

31. Any pers<strong>on</strong> who c<strong>on</strong>travenes any part of the above regulati<strong>on</strong>s shall<br />

be liable <strong>on</strong> a summary c<strong>on</strong>victi<strong>on</strong> to a fine not exceeding LEVEL 3<br />

<strong>on</strong> the st<str<strong>on</strong>g>and</str<strong>on</strong>g>ard scale (currently £1,000) <str<strong>on</strong>g>and</str<strong>on</strong>g> in the case of a<br />

c<strong>on</strong>tinuing offence, to a fine not exceeding £10 for each day during<br />

which the offence c<strong>on</strong>tinues after c<strong>on</strong>victi<strong>on</strong> therefore.<br />

Local Authorities’ Cemeteries Order 1977 Article 19.<br />

32. The Register of Burials shall at all reas<strong>on</strong>able times be available for<br />

c<strong>on</strong>sultati<strong>on</strong> by any pers<strong>on</strong> free of charge. A Burial Authority may<br />

charge such fees as they think proper for the making by them of<br />

searches in, <str<strong>on</strong>g>and</str<strong>on</strong>g> the provisi<strong>on</strong> of certified copies of entries in a<br />

Register of Burials or a Record of Disinterments.<br />

Local Authorities’ Cemeteries Order 1977 Article 11 (7).


33. No body shall be removed from any grave or vault from any of the<br />

<strong>City</strong> cemeteries without licence of the Secretary of State or faculty<br />

from the Church of Engl<str<strong>on</strong>g>and</str<strong>on</strong>g> Bishop of the Diocese in which the<br />

cemetery lies. Secti<strong>on</strong> 25 Burial Act 1857.<br />

34. No remains other than Human will be accepted under any<br />

circumstances.<br />

35. All graves must be level with the surrounding ground; no raised plinth<br />

or mound will be allowed.<br />

<str<strong>on</strong>g>Rules</str<strong>on</strong>g> <str<strong>on</strong>g>and</str<strong>on</strong>g> <str<strong>on</strong>g>Regulati<strong>on</strong>s</str<strong>on</strong>g> for Carmountside Crematorium<br />

CREMATION<br />

1. Notice of an intended cremati<strong>on</strong> must be given to the Carmountside<br />

Office during office hours, two clear working days prior to the day<br />

<str<strong>on</strong>g>and</str<strong>on</strong>g> time required. Any instructi<strong>on</strong>s given by teleph<strong>on</strong>e will be<br />

received at the sole risk of the pers<strong>on</strong> giving such orders or<br />

instructi<strong>on</strong>s. The Authorised Officer will not be resp<strong>on</strong>sible for any<br />

misunderst<str<strong>on</strong>g>and</str<strong>on</strong>g>ings which may arise with regard to any instructi<strong>on</strong>s<br />

given by teleph<strong>on</strong>e unless immediately c<strong>on</strong>firmed in writing. No<br />

instructi<strong>on</strong>s or forms of any kind c<strong>on</strong>nected with the disposal of the<br />

dead will be accepted in facsimile, telexed or electr<strong>on</strong>ic (e mail)<br />

form.<br />

2. For the cremati<strong>on</strong> of a pers<strong>on</strong> other than a stillborn child or N<strong>on</strong><br />

Viable Foetus, statutory forms1,4 & 5 or form 6 (form 6 replaces 4 &<br />

5 where there is a cor<strong>on</strong>ers post mortem) must be fully completed.<br />

In the case of a stillborn child, forms 3 & 9 must be fully completed.<br />

Forms 2 <str<strong>on</strong>g>and</str<strong>on</strong>g> 8 must be completed for the cremati<strong>on</strong> of body parts.


All sets of statutory cremati<strong>on</strong> forms must be accompanied by the<br />

Notice of Cremati<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> the Envir<strong>on</strong>mental Policies <str<strong>on</strong>g>and</str<strong>on</strong>g> Disposal<br />

Instructi<strong>on</strong>s form. All of these forms are provided by the <strong>City</strong><br />

<strong>Council</strong>. A Registrars certificate for Burial or Cremati<strong>on</strong>,<br />

Certificate of Stillbirth or N<strong>on</strong> viable forms for cremati<strong>on</strong> are to be<br />

produced, together with other statutory forms, to the Carmountside<br />

Office no later than 9.30am two working days prior to the cremati<strong>on</strong><br />

excluding Saturdays. If a Minister is required to c<strong>on</strong>duct a funeral,<br />

the pers<strong>on</strong> requesting this must make the necessary arrangements<br />

<str<strong>on</strong>g>and</str<strong>on</strong>g> notify the Carmountside office accordingly. Failure to provide<br />

all the forms by the specified times may result in a cancellati<strong>on</strong> of<br />

the funeral.<br />

3. No cremati<strong>on</strong> remains which are not in their complete state will be<br />

accepted at the crematorium.<br />

4. No remains other than Human will be accepted under any<br />

circumstances.<br />

5. No cremati<strong>on</strong> remains will be disposed of until written instructi<strong>on</strong><br />

has been received at the Carmountside Office from the Applicant.<br />

The appropriate form for disposal must be signed by the Applicant<br />

<strong>on</strong>ly. If no instructi<strong>on</strong> is received from the Applicant for the<br />

disposal of the cremati<strong>on</strong> remains in resp<strong>on</strong>se to a reminder letter,<br />

the cremati<strong>on</strong> remains will be strewn in the Garden of<br />

Remembrance after the specified timescale. Cremati<strong>on</strong> remains<br />

are stored free of charge for a <strong>on</strong>e m<strong>on</strong>th period prior to the<br />

reminder letter being sent. If remains are requested to be stored<br />

for l<strong>on</strong>ger than the <strong>on</strong>e m<strong>on</strong>th period, the appropriate fee is<br />

charged.<br />

6. No strewing of cremati<strong>on</strong> remains from other crematoria will be


undertaken without the correct Certificate of Cremati<strong>on</strong> being<br />

submitted, together with other appropriate forms <str<strong>on</strong>g>and</str<strong>on</strong>g> delivered to<br />

the Carmountside office no later than 9.30am <strong>on</strong> the working day<br />

prior to the strewing, excluding Saturday. All cremati<strong>on</strong> remains<br />

must be delivered to the Carmountside office <strong>on</strong> the working day<br />

prior to the strewing.<br />

7. The times for cremati<strong>on</strong> services are from 8.30am to 4.00pm for a<br />

full service <str<strong>on</strong>g>and</str<strong>on</strong>g> 4.15pm for a committal service. Other times are<br />

available <strong>on</strong> request at the appropriate fee. Early morning services<br />

are available at 9.00am <str<strong>on</strong>g>and</str<strong>on</strong>g> 9.30am M<strong>on</strong>day to Saturday at a<br />

reduced fee. These are 20 minute services with provisi<strong>on</strong> for 1<br />

hymn. Other Saturday service times are available. Normal Service<br />

times are 30 minutes for a ‘Full Service’ <str<strong>on</strong>g>and</str<strong>on</strong>g> 15 minutes for a<br />

‘Committal Service’, this includes entry <str<strong>on</strong>g>and</str<strong>on</strong>g> exit time. Additi<strong>on</strong>al<br />

time periods of 15 minutes are available <strong>on</strong> request at the<br />

appropriate fee.<br />

8. The <strong>City</strong> <strong>Council</strong> must comply with the Envir<strong>on</strong>mental Protecti<strong>on</strong>Act<br />

PG5/2 2004. In respect of cremati<strong>on</strong>, the following must be<br />

adhered to:<br />

The coffin/casket must be made of suitable material, which when<br />

placed in a cremator <str<strong>on</strong>g>and</str<strong>on</strong>g> subjected to the cremati<strong>on</strong> process, is<br />

easily combustible <str<strong>on</strong>g>and</str<strong>on</strong>g> which does not emit smoke, give off toxic<br />

gas or leave any retardant smears or drips after final combusti<strong>on</strong>.<br />

No metal furniture or fittings whatever shall be used <strong>on</strong> a coffin/<br />

casket for cremati<strong>on</strong>. Coffin h<str<strong>on</strong>g>and</str<strong>on</strong>g>les should be free from<br />

unnecessary metal comp<strong>on</strong>ents. No metal of any kind shall be<br />

used in the manufacture of such coffin/casket except as necessary<br />

for its safe c<strong>on</strong>structi<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> then <strong>on</strong>ly metal of a high ferrous<br />

c<strong>on</strong>tent. Cross pieces must not be attached to the bottom of the<br />

coffin/casket. If it is desired to strengthen the bottom of the coffin/<br />

casket, wooden strips may be placed lengthways for this purpose.


External c<strong>on</strong>structi<strong>on</strong> coatings to a coffin/casket must allow for<br />

smokeless combusti<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> the use of nitro-cellulose varnish,<br />

polyurethane, melamine <str<strong>on</strong>g>and</str<strong>on</strong>g> any product c<strong>on</strong>taining polyvinyl<br />

chloride (PVC) must not be used. Water based lacquer, free from<br />

additives c<strong>on</strong>taining heavy metals may be used for coating a coffin<br />

or a suitable cloth may be used for covering a coffin/casket. The<br />

excepti<strong>on</strong> to the foregoing is the use of polystyrene which is<br />

restricted to the nameplate <strong>on</strong>ly. This must not exceed 90 grams in<br />

weight. All illegal emissi<strong>on</strong>s will be reported to the<br />

Envir<strong>on</strong>mental Health Officer, who has the authority to take<br />

remedial acti<strong>on</strong> against the Funeral Director.<br />

9. The <strong>City</strong> <strong>Council</strong> has adopted the ‘Envir<strong>on</strong>mental Policy for the<br />

Recycling of Metals Following Cremati<strong>on</strong>’. To comply with this<br />

policy, all metals remaining following cremati<strong>on</strong> will be disposed of<br />

in the most suitable manner to reduce the impact <strong>on</strong> the<br />

envir<strong>on</strong>ment. This includes the sensitive re-cycling of metals<br />

through the industry recognized scheme.<br />

• The applicant for cremati<strong>on</strong> must indicate their preferred<br />

choice for the disposal of any metals resulting from cremati<strong>on</strong><br />

<strong>on</strong> the ‘Envir<strong>on</strong>mental Policies <str<strong>on</strong>g>and</str<strong>on</strong>g> Disposal Instructi<strong>on</strong>s<br />

Form’. This form must be submitted with all the other relevant<br />

documentati<strong>on</strong> under the same procedure <str<strong>on</strong>g>and</str<strong>on</strong>g> timescale as<br />

Regulati<strong>on</strong> 1.<br />

Applicants who choose not to participate in the scheme will have<br />

the metals returned to them. All Funeral Directors must sign<br />

the agreement regarding the above before a cremati<strong>on</strong> will be<br />

accepted. Failure to do so may result in the cremati<strong>on</strong> being<br />

refused.<br />

10. In accordance with the Federati<strong>on</strong> of British Cremati<strong>on</strong> Authorities<br />

Code of Cremati<strong>on</strong> Practice, all coffins are cremated with 24 hours<br />

of receipt.


11. To comply with the Health & Safety at Work Act 1974, coffins/<br />

caskets must not c<strong>on</strong>tain articles of a n<strong>on</strong>-combustible nature that<br />

are likely to be of danger to an operator, or may cause damage to<br />

equipment. Examples of such items are pacemakers, aerosol<br />

c<strong>on</strong>tainers, glass bottles etc. No plaster casts must be left <strong>on</strong> the<br />

body for cremati<strong>on</strong>.<br />

12. Any<strong>on</strong>e who c<strong>on</strong>travenes these regulati<strong>on</strong>s will be reported to the<br />

Envir<strong>on</strong>mental Enforcement Officer <str<strong>on</strong>g>and</str<strong>on</strong>g> the Integrated Health,<br />

Safety <str<strong>on</strong>g>and</str<strong>on</strong>g> Emergency Manager, who will decide whether any<br />

acti<strong>on</strong> is to be taken.<br />

13. All operators employed by the <strong>City</strong> <strong>Council</strong> to cremate must hold<br />

the Cremati<strong>on</strong> Technicians Certificate, <str<strong>on</strong>g>and</str<strong>on</strong>g> adhere to the Code of<br />

Cremati<strong>on</strong> Practice, a copy of which is obtainable from the<br />

Carmountside office.<br />

14. Due to Health & Safety <str<strong>on</strong>g>Regulati<strong>on</strong>s</str<strong>on</strong>g>, members of the public are not<br />

permitted into the crematory. Should the viewing room be<br />

required, <strong>on</strong>e day clear notice is required.<br />

15. Members of the public who wish to view the crematory may do so<br />

at any reas<strong>on</strong>able time, unless operati<strong>on</strong>s at the time would pose a<br />

health <str<strong>on</strong>g>and</str<strong>on</strong>g> safety risk.<br />

16. All coffins <str<strong>on</strong>g>and</str<strong>on</strong>g> cremati<strong>on</strong> remains caskets shall be of wood or<br />

material of a biodegradable nature. No ir<strong>on</strong> coffins or n<strong>on</strong><br />

biodegradable material will be allowed. Un-coffined cremati<strong>on</strong>s will<br />

not be allowed.<br />

17. Once a coffin has entered the crematorium it will not be opened for<br />

any reas<strong>on</strong>.


<strong>City</strong> of <str<strong>on</strong>g>Stoke</str<strong>on</strong>g> <strong>on</strong> <strong>Trent</strong> – Bereavement Care Service<br />

<str<strong>on</strong>g>Rules</str<strong>on</strong>g> <str<strong>on</strong>g>and</str<strong>on</strong>g> <str<strong>on</strong>g>Regulati<strong>on</strong>s</str<strong>on</strong>g> for the Burial Grounds <str<strong>on</strong>g>and</str<strong>on</strong>g> Cemeteries within<br />

the <strong>City</strong> which are situated in Tunstall, Burslem, Smallthorne,<br />

Carmountside, Hanley, <strong>Trent</strong>ham, <str<strong>on</strong>g>Stoke</str<strong>on</strong>g>, Fent<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> L<strong>on</strong>gt<strong>on</strong>.<br />

GENERAL MANAGEMENT<br />

1. All charges <str<strong>on</strong>g>and</str<strong>on</strong>g> fees payable to the <strong>Council</strong> in relati<strong>on</strong> to the table of<br />

fees now in force must be paid <strong>on</strong> or before the working day prior to<br />

the burial, cremati<strong>on</strong> or cremati<strong>on</strong> remains disposal taking place. The<br />

<strong>Council</strong> reserves the right from time to time to make alterati<strong>on</strong>s to the<br />

table of fees <str<strong>on</strong>g>and</str<strong>on</strong>g> the regulati<strong>on</strong>s in force at the time, <str<strong>on</strong>g>and</str<strong>on</strong>g> to reserve<br />

any porti<strong>on</strong> of any Burial Ground, cemetery or crematorium. Funeral<br />

Directors may apply to be included <strong>on</strong> the debtors list at the discreti<strong>on</strong><br />

of the council to enable them to pay fees <strong>on</strong> behalf of their client. A<br />

credit period stipulated by the <strong>City</strong> <strong>Council</strong> is allowed for approved<br />

funeral directors.<br />

2. The <strong>Council</strong> will not be resp<strong>on</strong>sible for making good any damagecaused<br />

by gale, ordinary wear <str<strong>on</strong>g>and</str<strong>on</strong>g> tear or other circumstances over<br />

which they have no c<strong>on</strong>trol, for example acts of v<str<strong>on</strong>g>and</str<strong>on</strong>g>alism by third<br />

parties.<br />

3. A burial authority shall keep a table showing the matters in respect of<br />

which fees or other charges are payable to them, <str<strong>on</strong>g>and</str<strong>on</strong>g> the amount of<br />

each such fee or charge, <str<strong>on</strong>g>and</str<strong>on</strong>g> the table shall be available for inspecti<strong>on</strong><br />

by the public at all reas<strong>on</strong>able times. Article 15 (3) of the Local<br />

Authorities’ Cemeteries Order 1977.<br />

4. Dogs must be kept under c<strong>on</strong>trol at all times. Dog owners must comply<br />

with the ‘Dogs (Fouling of L<str<strong>on</strong>g>and</str<strong>on</strong>g>) Act 1996. There are designated ‘Dog<br />

Free Z<strong>on</strong>es’ within the <strong>City</strong> Cemeteries. The <strong>City</strong> <strong>Council</strong> has the right


to include or change any areas at its discreti<strong>on</strong>. Acti<strong>on</strong> will be taken<br />

for c<strong>on</strong>traventi<strong>on</strong> of this act.<br />

5. Private vehicles may be admitted into Burial Grounds <str<strong>on</strong>g>and</str<strong>on</strong>g><br />

Cemeteries during normal opening times. Access at any other times<br />

is at the discreti<strong>on</strong> of the Bereavement Care Service Management.<br />

6. No unauthorised vehicles are allowed in any area where traffic<br />

management systems are in place. C<strong>on</strong>tractors <str<strong>on</strong>g>and</str<strong>on</strong>g> authorised key<br />

holders must resecure swing barriers <strong>on</strong> entering <str<strong>on</strong>g>and</str<strong>on</strong>g> exiting these<br />

areas. All cars must not exceed 5 mph. There shall be no parking<br />

of vehicles <strong>on</strong> any grass verge or grave, or any area designated as<br />

burial ground, or in fr<strong>on</strong>t of swing barriers. All vehicles must ensure<br />

that funeral cars can pass by them should they need to do so.<br />

7. The opening <str<strong>on</strong>g>and</str<strong>on</strong>g> closing times of Burial Grounds <str<strong>on</strong>g>and</str<strong>on</strong>g> cemeteries<br />

are available from the Carmountside Office <str<strong>on</strong>g>and</str<strong>on</strong>g> are also displayed<br />

in notice boards <str<strong>on</strong>g>and</str<strong>on</strong>g> other signage throughout the cemeteries.<br />

8. Children under 14 years of age will not be admitted except under<br />

the care of a resp<strong>on</strong>sible pers<strong>on</strong>, <str<strong>on</strong>g>and</str<strong>on</strong>g> all visitors will be expected to<br />

keep to the roads <str<strong>on</strong>g>and</str<strong>on</strong>g> walks, to refrain from touching shrubs,<br />

flowers or memorials <str<strong>on</strong>g>and</str<strong>on</strong>g> to observe perfect decorum in all respects.<br />

9. Management has the right to judge any individual matter as it<br />

c<strong>on</strong>siders appropriate. Article 3 of The Local Authorities’<br />

Cemeteries Order 1977 expressly empowers Burial Authorities to<br />

do “all such things as they c<strong>on</strong>sider necessary or desirable for the<br />

proper management, regulati<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> c<strong>on</strong>trol of a cemetery.<br />

10. These regulati<strong>on</strong>s repeal <str<strong>on</strong>g>and</str<strong>on</strong>g> cancel all previous regulati<strong>on</strong>s made<br />

by the <strong>Council</strong> or their predecessors with respect to any Burial<br />

Grounds, Cemeteries <str<strong>on</strong>g>and</str<strong>on</strong>g> crematoria in the said <strong>City</strong>.

Memorials<br />

1. To comply with legal requirements <str<strong>on</strong>g>and</str<strong>on</strong>g> ensure that <strong>City</strong> <strong>Council</strong> Cemeteries<br />

<str<strong>on</strong>g>and</str<strong>on</strong>g> Closed Churchyards are safe places to visit, we are carrying<br />

out a rolling programme of Memorial Safety inspecti<strong>on</strong>s. Where a<br />

memorial is found to be unsafe we will, by an approved method,<br />

temporarily make the memorial safe <str<strong>on</strong>g>and</str<strong>on</strong>g> in due course permanently<br />

refix or make safe the memorial by an approved method. We will inform<br />

owners of all unsafe memorials by letter where we are able to do<br />

so.<br />

2. Provisi<strong>on</strong>s relating to the Memorial Mas<strong>on</strong>s are included in the<br />

Memorial Mas<strong>on</strong>s Licensing Scheme, <str<strong>on</strong>g>and</str<strong>on</strong>g> all Mas<strong>on</strong>s licensed to work<br />

in city cemeteries must comply with the c<strong>on</strong>diti<strong>on</strong>s set out in the<br />

scheme <str<strong>on</strong>g>and</str<strong>on</strong>g> renew the license annually. C<strong>on</strong>diti<strong>on</strong>s set out in the<br />

scheme are periodically reviewed to reflect changing circumstances.<br />

4. All memorials are to be fixed <strong>on</strong> approved foundati<strong>on</strong>s <str<strong>on</strong>g>and</str<strong>on</strong>g> to<br />

Nati<strong>on</strong>al Associati<strong>on</strong> of Memorial Mas<strong>on</strong>’s guidelines as specified in<br />

the licensing agreement. The top surface of all foundati<strong>on</strong>s is to be<br />

below ground level. All memorials are to be of an approved design,<br />

c<strong>on</strong>structed of durable natural st<strong>on</strong>e. However should a n<strong>on</strong> natural<br />

material be presented which might prove suitable, the <strong>Council</strong><br />

would c<strong>on</strong>sider the issue at the time.<br />

5. There are no restricti<strong>on</strong>s <strong>on</strong> the number of vases erected subject to<br />

space being available within the permitted area <str<strong>on</strong>g>and</str<strong>on</strong>g> correct fixing to<br />

the foundati<strong>on</strong>.<br />

6. No memorial will be allowed <strong>on</strong> an unreserved grave. In the case of<br />

a hospital grave the erecti<strong>on</strong> of a memorial is at the discreti<strong>on</strong> of the<br />

hospital trust <str<strong>on</strong>g>and</str<strong>on</strong>g> is subject to the c<strong>on</strong>diti<strong>on</strong>s in stated in 8 below.<br />

7. No memorial other than the granite grave markers supplied by the<br />

<strong>City</strong> <strong>Council</strong>, are permitted <strong>on</strong> the communal graves within the<br />

Butterfly Garden at Carmountside.<br />

8. Drawings of every proposed headst<strong>on</strong>e, tablet or vase together with<br />

dimensi<strong>on</strong>s, intended inscripti<strong>on</strong>, arranged as to style of lettering <str<strong>on</strong>g>and</str<strong>on</strong>g> arrangement<br />

in each line as proposed, must be submitted for the approval<br />

of the <strong>Council</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> must not be fixed into any cemetery without


authorisati<strong>on</strong>. The number of each grave must be engraved <strong>on</strong> the<br />

base of all memorials corresp<strong>on</strong>ding with the Grave Register.<br />

9. Temporary crosses will be provided <strong>on</strong> request, for the appropriate<br />

fee, by the <strong>Council</strong> to be erected <strong>on</strong> the grave space as specified<br />

by the Authorised Officer. No unauthorised crosses will be allowed<br />

<str<strong>on</strong>g>and</str<strong>on</strong>g> will be removed by Bereavement Care Service staff <str<strong>on</strong>g>and</str<strong>on</strong>g><br />

sensitively disposed of.<br />

10. The Right to erect a memorial is included in the Exclusive Right of<br />

Burial <str<strong>on</strong>g>and</str<strong>on</strong>g> is active for the term of the lease.<br />

11. No foundati<strong>on</strong> will be placed, nor will the fixing of any memorial<br />

be allowed up<strong>on</strong> any grave or vault without the submissi<strong>on</strong> of a<br />

completed memorial applicati<strong>on</strong> form including the signature of the<br />

owner of the Exclusive Right of Burial.<br />

12. All Memorial Mas<strong>on</strong>s employed in fixing memorials in any cemetery<br />

must be licensed by the <strong>Council</strong>. Failure to comply with the licensing<br />

agreement will cause such license to be revoked at any time. All<br />

licenses are to be renewed annually.<br />

13. Mas<strong>on</strong>s employed in fixing memorials will be required to remove all<br />

excess soil <str<strong>on</strong>g>and</str<strong>on</strong>g> debris under the instructi<strong>on</strong>s of the Authorised<br />

Officer <str<strong>on</strong>g>and</str<strong>on</strong>g> to clean up the ground carefully <strong>on</strong> completi<strong>on</strong> of their<br />

work. They will be held resp<strong>on</strong>sible for any damage d<strong>on</strong>e by them<br />

or their workmen, either to the Burial Ground or cemetery as the<br />

case may be, or to memorials erected within it, <str<strong>on</strong>g>and</str<strong>on</strong>g> shall indemnify<br />

the <strong>Council</strong> against any claims arising there from.<br />

14. The fixing of memorials or any other work c<strong>on</strong>nected therewith, in<br />

the cemetery will not be permitted <strong>on</strong> Sundays or Bank Holidays.


15. The fixing of memorials in any Burial Ground or cemetery or any<br />

other work is <strong>on</strong>ly permitted between 8:30am <str<strong>on</strong>g>and</str<strong>on</strong>g> 4.30pm <strong>on</strong><br />

weekdays (4.00pm <strong>on</strong> Fridays).<br />

16. All memorials must be completely worked before they are admitted<br />

to the grounds, <str<strong>on</strong>g>and</str<strong>on</strong>g> no labour of any kind bey<strong>on</strong>d that of fixing will<br />

be allowed within any Burial Ground or cemetery except additi<strong>on</strong>al<br />

inscripti<strong>on</strong>s, cleaning <str<strong>on</strong>g>and</str<strong>on</strong>g> gilding.<br />

17. No mas<strong>on</strong> or other pers<strong>on</strong> is allowed to solicit orders within any<br />

Burial Ground or cemetery (except for at <strong>Council</strong> arranged events).<br />

18. The <strong>Council</strong> reserves the right to employ, at the cost of the<br />

registered owner of the Exclusive Right of Burial, qualified pers<strong>on</strong>s<br />

to supervise the erecti<strong>on</strong> of any memorial fixed within any Burial<br />

Ground or cemetery.<br />

19. No memorial may be removed from any Burial Ground or cemetery<br />

without the express permissi<strong>on</strong> in writing of the registered owner of<br />

the Exclusive Right of Burial of the grave from which the memorial is<br />

to be removed – except where it is c<strong>on</strong>sidered to be unsafe or<br />

dangerous, for health <str<strong>on</strong>g>and</str<strong>on</strong>g> safety reas<strong>on</strong>s or where an unreas<strong>on</strong>able<br />

delay to the fixing of any other memorial may occur.<br />

20. The <strong>Council</strong> accepts no resp<strong>on</strong>sibility for any memorial within the<br />

Burial Grounds <str<strong>on</strong>g>and</str<strong>on</strong>g> cemeteries.<br />

21. When any grave <strong>on</strong> which there is a memorial (except memorials fitted<br />

with ground anchors to a c<strong>on</strong>tinuous raft type foundati<strong>on</strong> installed by<br />

the <strong>City</strong> <strong>Council</strong>) is to be opened for the purpose of making an<br />

interment, the Funeral Director or registered owner of the Exclusive<br />

Right of Burial will be resp<strong>on</strong>sible for making arrangements for its


emoval by a licensed mas<strong>on</strong>. All memorials (including foundati<strong>on</strong>s<br />

where applicable) are to be removed from the Burial Ground or<br />

cemetery to the Mas<strong>on</strong>s premises <str<strong>on</strong>g>and</str<strong>on</strong>g> refixed <strong>on</strong> the instructi<strong>on</strong> of<br />

the registered owner of the Exclusive Right of Burial, using<br />

N.A.M.M. approved fixing methods. Memorials must be removed<br />

within 8 hours from the time a booking for interment is made.<br />

Failure to do so may result in the postp<strong>on</strong>ement of the funeral.<br />

22. No breakable or unauthorised items of any descripti<strong>on</strong> (glass,<br />

earthenware, bricks, blocks etc) will be allowed. Any such items<br />

will, in the interests of safety, either be relocated to an acceptable<br />

positi<strong>on</strong>, the owners c<strong>on</strong>tacted <str<strong>on</strong>g>and</str<strong>on</strong>g> requested to remove the items<br />

or will be immediately removed <str<strong>on</strong>g>and</str<strong>on</strong>g> disposed of without notice at<br />

the discreti<strong>on</strong> of Bereavement Care Service staff.<br />

23. Only loose fresh flowers (wrappings are to be removed) are<br />

permitted <strong>on</strong> the communal graves within the Butterfly Garden at<br />

Carmountside. No flowers or pers<strong>on</strong>al items are to be tied to any<br />

leased item.<br />

24. The Memorial Book in the Butterfly Garden is available for inscribed<br />

granite plaques <str<strong>on</strong>g>and</str<strong>on</strong>g> Wendy Houses are provided in which families<br />

may place pers<strong>on</strong>al items.<br />

25. No formal grave markers including headst<strong>on</strong>es, plaques or any<br />

other forms of memorialisati<strong>on</strong> are permitted in the Woodl<str<strong>on</strong>g>and</str<strong>on</strong>g> Park.<br />

Memorial oak trees may be planted by the Bereavement Care<br />

Service at the request of the grave owner.<br />

26. Only loose fresh flowers are permitted in the Woodl<str<strong>on</strong>g>and</str<strong>on</strong>g> Gardens in<br />

all cemeteries <str<strong>on</strong>g>and</str<strong>on</strong>g> the Woodl<str<strong>on</strong>g>and</str<strong>on</strong>g> Park at Carmountside. All<br />

wrapping should be removed <str<strong>on</strong>g>and</str<strong>on</strong>g> no flowers or pers<strong>on</strong>nel items are<br />

to be tied to leased items.


27. A single wreath is allowed in the Woodl<str<strong>on</strong>g>and</str<strong>on</strong>g> Gardens in all<br />

cemeteries <str<strong>on</strong>g>and</str<strong>on</strong>g> the Woodl<str<strong>on</strong>g>and</str<strong>on</strong>g> Park at Carmountside to<br />

commemorate Christmas, Easter, Birthdays or Anniversaries.<br />

28. Lanterns are permitted <strong>on</strong>ly when approved. They must be fixed by<br />

an approved Memorial Mas<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> remain the resp<strong>on</strong>sibility of the<br />

owner of the Exclusive Right of Burial. Lanterns must be<br />

c<strong>on</strong>tained within the footprint of the memorial <str<strong>on</strong>g>and</str<strong>on</strong>g> must be free<br />

from sharp edges <str<strong>on</strong>g>and</str<strong>on</strong>g> glass panels. Lighted c<str<strong>on</strong>g>and</str<strong>on</strong>g>les are<br />

prohibited.<br />

29. Memorial mas<strong>on</strong>s must submit an applicati<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> be in<br />

possessi<strong>on</strong> of an authorised permit before carrying out any work.<br />

30. C<strong>on</strong>tractors employed by grave owners to carry out n<strong>on</strong> memorial<br />

work must be in possessi<strong>on</strong> of a valid license to work in the<br />

cemeteries of <str<strong>on</strong>g>Stoke</str<strong>on</strong>g>-<strong>on</strong>-<strong>Trent</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> a valid permit for work <strong>on</strong> each<br />

grave, issued by <str<strong>on</strong>g>Stoke</str<strong>on</strong>g>-<strong>on</strong>-<strong>Trent</strong> <strong>City</strong> <strong>Council</strong>.
