The timely submission of a claim under Article 51 of these Regulations may result in the suspension of the procurement process by the Director General as foreseen under Article 31 of these Regulations, provided that the claim is not frivolous and contains a declaration the contents of which, if proven, demonstrate that the claimant will suffer irreparable injury in the absence of a suspension, it is probable that the complaint will succeed and the granting of the suspension would not cause disproportionate harm to the Agency. 2. Interim measures may be proposed to the Director General by the Head of the Procurement Department, the Agency’s Industrial Ombudsman or the Agency’s Procurement Review Board.

ESA/REG/001, rev.2 Page 75 ARTICLE 57 - COMPENSATION Where as a result of the review procedure foreseen under Part VI of these Regulations a final and binding decision grants compensation to a claimant for the loss or injury suffered due to a procedural breach of these Regulations by the Agency, such compensation shall in all cases be limited to the cost for tender preparation and the costs incurred for protest within the limit of 100 000 Euro. In no event shall the Agency be held liable for payments in excess of 100 000 Euro for compensation granted under these Regulations.

the suspension of the procurement process by the Director General as foreseen under<br />

Article 31 of these Regulations, provided that the claim is not frivolous and contains a<br />

declaration the contents of which, if proven, demonstrate that the claimant will suffer<br />

irreparable injury in the absence of a suspension, it is probable that the complaint will<br />

succeed and the granting of the suspension would not cause disproportionate harm to<br />

the Agency.<br />

2. Interim measures may be proposed to the Director General by the Head of the<br />
